GENERAL PROJECT DESCRIPTION The Applicant has previously received Flood Plain Development Permit approvals for construction of improvements on their property adjacent to the Roaring Fork River. The Approvals included a single family home , a variety of accessory buildings , and infrastructure to serve the improvements . The Applicant's approved site plan included a "Caretakers Cabin -pending approval of Land Use Change Permits". Under the current approvals the cabin could not include a full kitchen and full bathroom facilities . The Applicant has proposed pursuing at this time approvals for an ADU that would allow the cabin to be improved with a full kitchen and complete bathroom facilities . The cabin has a footprint of 400 sq.ft. and is estimated to have up to 800 sq .ft. of floor area on two levels . The proposal is anticipated to fully comply with the current Flood Plain Permit and an other applicable provisions of the Land Use and Development Code . The overall property is 2 .56 acres in size and the unit will be limited to a maximum of 1,500 sq .ft . based on Section 7- 701 of the Land Use and Development Code . The unit will be served by a shared well and septic system . II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS • Garfield County Comprehensive Plan 2030 as amended • Garfield County Unified Land Use Resolution of 2008 as amended o Article Ill, Zoning • Rural Zone District -Lot/Building Requirements (Table 3-201) and Use Table (Table 3-403) o Article IV, Application and Review Procedures • Administrative Review (Section 4-103) • Common Review Procedures (Section 4-101) • Table 4-102 Common Review Procedures and Required Notice • Table 4-201 Application Submittal Requirements • Description of Submittal Requirements (Section 4-203) • Section 4-118 Waiver from Standards • Section 4-202 Waiver from Submittal Requirements o Article VII, Standards -Division 1 General Standards, Division 2 General Resource Protection Standards, Division 3 Site Planning -as applicable • Standards Applicable to an Accessory Dwelling Unit (Section 7-701) • Compliance with all conditions of approval contained in the Chante Pejunta Land Use Change Permit -Flood Plain Development issued on 11/8/11 and recorded at Reception No. 810684. Ill. COMPREHENSIVE PLAN 2030 In Chapter 2, Future Land Use, the Garfield County Comprehensive Plan 2030 indicates that ADU's shall be included in the Comprehensive Plan density recommendations. The property is designated Residential Low, RL (10 Acres/DU). Analysis of the density calculation and general conformance of the Application to the Comprehensive Plan will be part of the development review process. IV. REVIEW PROCESS In summary, the Application will follow the Administrative Review Process contained in Sections 4-101 and 4-103 and Table 4-102: 1. Pre-application Conference 2. Submittal of Application (3 copies plus a copy on CD) 3. Determination of Completeness 4. If Technically Complete the Applicant will be notified and the request scheduled for a Decision by the Director. If it is not Technically Complete the Applicant will be advised of the deficiencies. 5. Additional copies of the Application are provided for referral agencies. 6. Applicant completes public notice mailing by certified mail to adjacent property owners within 200' and mineral rights owners on the property. The mailing is required to be a minimum of 15 days prior to the Director's Decision 2 7. Staff prepares a report including public and referral comments 8. Director's Decision 9. Ten day call-up period after which the action becomes final provided there are no requests for a call-up by the Board of County Commissioners or requests for reconsideration. 10. Once all conditions of approval are met the Director can issue the Land Use Change Permit. V. ADDITIONAL DETAILS ON PROCESSING AND SUBMITTAL REQUIREMENTS In addition to the submittal requirements documented in Table 4-102 and Section 4-203 the following clarifications are provided. • A list of property owners within 200 ft. will have to be provided and said owners will receive public notice of the date set for the Director's Decision. Information on mineral rights ownership on the site will also be required and owners of mineral rights will also receive public notice. • A copy of a deed confirming the Applicant's ownership of the property also needs to be provided along with any authorizations to represent and statements of authority (typically required for LLC's and Corporations). • The Application will need to demonstrate a legal and physical supply of water (water supply plan) adequate to serve the additional unit. Well pump tests and water quality testing will be required. • An updated County Road and Bridge access permit may be required. • A waste water treatment plan with information regarding on-site waste water treatment (formerly known as an ISDS) will be required. • The Application will need to address any natural hazards or soils constraints on the site. Demonstration of compliance with the Flood Plain Development Permit for the site will be required. • The Site Plan needs to show improvements on the site including proposed locations for access driveways, parking areas, proposed infrastructure, existing structures, and the proposed ADU. • The Applicant may request waivers from submittal requirements in accordance with Section 4-202. Submittal waivers for a Development Agreement, Improvements Agreement, and elements of the Impact Report may be appropriate. Landscaping submittal requirements may be addressed as part of the Site Plan with an indication where existing vegetation is found on the site. Traffic information should be provided but a waiver may be requested from the completion of a full traffic study. VI. APPLICATION REVIEW a. CHANTE PEJUTA ACCESSORY DWELLING UNIT (ADU) Project Description The owner of this single family residential property is seeking approval for an accessory dwelling unit. The space for the dwelling unit will be provided in the recently permitted Storage Building. Sleeping and living space will be in the upper level loft room and bathing and kitchen spaces will be on the main level of the building. This accessory dwelling unit will be used by the owner as either space for house guests or a care taker of the property. CHANTE PEJUTA ACCESSORY DWELLING UNIT (ADU) Regulatory Provisions Being Addressed Garfield County Unified Land Use Resolution of 2008 1. Article III, Zoning Rural Zone District (Table 3‐201 & Table 3‐403) Response: Table 3‐201 ‐ The lot area of 2.56 acres is greater than the minimum 2.0 acres. Lot coverage is 4%, so well below the 15% limit. All setbacks have been met during the permitting process for the Storage Building which will house the proposed ADU. Table 3‐403 – The ADU use we are seeking is allowed per administrative review. 2. Article IV, Application & Review Procedures Response: This application adheres to all the review procedures of Article IV. A pre‐ application summary is attached and all items required per Table 4‐201 are included. We are seeking no Waiver from Standards but do request a Waiver from Submittal Requirements in regard to the Traffic Study. See Exhibit 5 Traffic Study. 3. Article VII, Standards A. Division 1‐ General Standards Section 7‐101 Zone District Use Regulations Response: The land use change being requested complies with Article III. See above. Section 7‐102 Comprehensive Plan & Intergovernmental Agreements Response: The land use change is in conformance with the Garfield County Comprehensive Plan. Section 7‐103 Compatibility Response: The nature, scale & intensity of the ADU use is compatible with adjacent properties. Section 7‐104 Source of Water Response: The applicant has an adequate, reliable, long term and legal water supply for the ADU. See Exhibit 6 Water Supply. Section 7‐105 Central Water Supply and Wastewater Systems Response: Central water distribution is not applicable. The already permitted individual wastewater system for the primary residence was sized for an ADU. See Exhibit 7. Section 7‐106 Public Utilities Response: Adequate public utilities are available to serve the ADU. Section 7‐107 Access and Roadways Response: The proposed ADU will use the same driveway as the primary residence to access County Road 100. The driveway meets the standards set in Table 7‐107. Section 7‐108 Use of Land Subject to Natural Hazards Response: The only natural hazard on this site is flooding since this property is in the 100‐yr flood plain. All structures have been designed to meet the standards set in the approved flood plain development permit issued on 11/8/11. Section 7‐109 Fire Protection Response: The building that will house the ADU has been permitted and constructed to meet the fire protection standards of the local fire district B. Division 2‐ General Resource Protection Standards Section 7‐201 Agricultural Lands Response: There are no agricultural lands adjacent to this property. Section 7‐202 Wildlife Habitat Areas Response: The 35’ setback along the Roaring Fork River will preserve a substantial amount of native vegetation and provide a corridor for wildlife across the site. Section 7‐203 Protection of Waterbodies Response: The building that will house the ADU is outside the minimum 35’ setback from the mean high water line of the Roaring Fork River as are all the structures on the property. Section 7‐204 Drainage and Erosion Response: The ground around the building that will house the ADU has been graded for positive drainage away from the building. All surface drainage shall be kept on site and not directed toward the river. Section 7‐205 Environmental Quality Response: The creation of an ADU on this property will have no impact on the air or water quality of the site. Section 7‐206 Wildfire Hazards Response: This property does not have any areas that are designated as severe wildfire hazard areas and none of the structures are built on slopes greater than 30%. The roof material of the building that will house the ADU is metal, which is non‐combustible. Section 7‐207 Natural and Geologic Hazards Response: None of the geologic hazards identified in this section exist on this property. Section 7‐208 Reclamation Response: The major construction activity on this site has been completed and all disturbed areas have been reclaimed. New landscaping of the site is in its final stages. C. Division 3‐ Site Planning and Development Standards Section 7‐301 Compatible Design Response: The proposed ADU being housed in the existing storage building on this property is compatible with the adjacent uses in this rural residential area. In addition, the site is buffered from the road and adjacent properties with vegetation and berming and the exterior materials of the storage building compliment those of the primary residence and are in keeping with those of the adjacent homes. Section 7‐302 Off Street Parking and Loading Standards Response: Two parking spaces have been provided for the ADU on a gravel drive that connects to the main drive of the primary residence. Division 7‐ Additional Standards for Residential Uses `Section 7‐701 Accessory Dwelling Unit Response: The existing Storage Building, that will house the proposed ADU, has 704 SF on the main level and 271 SF on the upper level for a total area of 975 SF, which is below the 1500 SF limit for properties less than 4 acres. The ADU will be used for residential purposes only and its construction shall comply with all building codes. The lot area exceeds the minimum 2 acres and the ADU shall have a separate entrance from the primary residence. Sections 7‐702, 703,705,706,707 Response: Not applicable to this use. Section 7‐704 Lighting Standards Response: See attached supplemental information on Lighting Standards. Chante Pejuta Land Use Change Permit – Floodplain Development, issued on 11/8/11, recorded at Reception # 810684. Response: The proposed ADU shall comply with all the conditions of the floodplain development permit. It will be housed in the existing Storage Building which was permitted and constructed to meet all recommendations of the Land Use Change Permit. Garfield County Comprehensive Plan 2030 as amended 1. Chapter 2, Future Land Use Response: This property, Chante Pejuta, is one of 4 lots that were subdivided in 1987 with the creation of the 10 acre Ries Exemption. Each of the lots is 2 acres or larger with Chante Pejuta having 2.56 acres. This small subdivision is bounded by the Roaring Fork River and County Road 100. The adjacent lands are primarily open space or agricultural, with some industrial area along the south side of County Road 100. According to the Garfield County Future Land Use Map, the Ries Exemption falls within the 3 mile area of influence of Carbondale and is designated Residential Low with 10+ acres per dwelling unit. Therefore, the Ries Exemption currently does not comply with the County’s Future Land Use density, since it is now 2.5 acres per dwelling unit. With the addition of the proposed ADU, that density will increase slightly to 2 acres per dwelling unit for the Ries Exemption. Although the existing and proposed uses do not comply with the density recommendation, they do comply with the description of the Residential Low designation which is “Agricultural and related uses as well as home occupation uses that can be adequately buffered from adjacent incompatible uses.” The proposed ADU is a home occupation and the property has a great deal of landscaping and berming that buffer it from the adjacent residences and County Road 100. In addition, the proposed ADU meets all the standards and details of the County’s Zoning Code. It will also be housed in an existing structure, the Storage Building, which was designed like a typical agricultural building or barn. The rural character of the structure is in keeping with one of the goals of the comprehensive plan and that is to maintain rural character outside the Urban Growth Areas. CHANTE PEJUTA ACCESSORY DWELLING UNIT (ADU) Statement on Lighting Standards The proposed ADU will be housed in the existing Storage Building at Chante Pejuta. The exterior lighting is in place and does meet the lighting standards of County Code Section 7‐304. 7‐304 A Downcast Lighting – All the exterior lighting fixtures on the Storage Building have been installed so that the light is directed toward the interior of the site. 7‐304 B Shielded Lighting – The light source on the exterior fixtures of the Storage Building is hidden behind a translucent panel and all fixtures are arranged so that concentrated rays of light will not fall directly onto adjacent properties. 7‐304 C Hazardous Lighting – The Storage Building is far from the road and obscured by vegetation, so none of the exterior lights will create a traffic hazard and none of them are colored. 7‐304 D Flashing Lights – None of the exterior lights are flashing or blinking. 7‐304 E Height Limitations – All the exterior lights on the Storage Building are well below the 40 foot height limit. The existing accessory structure, the Storage Building, will be remodeled to add bathing facilities and a full kitchen to accommodate house guests and perhaps in the future, a care taker. 1. Adjacent Land Use – The new use being proposed from dwelling‐single unit to dwelling– 2 Unit will remain compatible with the adjacent properties. In this residential area, which is zoned rural, all the homes are on large lots and most contain accessory structures. The addition of at most two persons in the proposed ADU should have minimal impact on the adjacent properties. 2. Site Features – The dominant feature of this site is the Roaring Fork River. The building which will house the ADU meets the 35’‐0” river setback. The site is also within the 100‐ year flood plain of the Roaring Fork River and approvals for Flood Plain Development have been obtained for all improvements on the site. Berms along CR 100 that existed prior to the development of the site have been raised slightly and enhanced with additional trees and shrubs to provide good screening of the development from the roadway. 3. Soil Characteristics ‐ The flood plain soils on this relatively flat site posed no problem with construction of the residence and accessory structures, except that due to high groundwater, all structures have been designed as slab‐on‐grade at elevations established basements to minimize water damage. 4. Geology and Hazard – The only natural hazard present at this site is the 100‐year flood. All structures have been raised above the level of the 100‐year flood and they have no basements. Since the approved Flood plain Development Permit for the site was for a residential use, an ADU would be a compatible use. 5. Groundwater and Aquifer Recharge Areas – This site being in the floodplain, does have high groundwater and all structures have been designed without basements to minimize the potential water problems. The structures have also been elevated above the flood elevations identified in the Flood Plain Development Permit. The individual sewage disposal system for the property was sized for the residence plus an ADU and was designed to meet flood plain conditions with hold‐downs for the septic tank and a raised leach field. 6. Environmental Impacts – Since no new construction is being proposed for the ADU, the impact on the environment shall be minimal. 7. Nuisance – An ADU for this site will not generate any additional vapor, dust, smoke, noise, glare or vibrations beyond what is already present from the existing residence. 8. Hours of Operation – The proposed use is residential dwelling‐2 unit, so the hours of operation is not applicable. CHANTE PEJUTA ACCESSORY DWELLING UNIT (ADU) EXHIBIT 5 ‐ Traffic Study We request a waiver from providing a traffic study prepared by a professional engineer. The new use, an ADU, will not generate enough trips per day to have a significant impact on County Road 100, the road that is used to access this property. According to the County’s 2002 Transportation Study, County Road 100 had an average daily traffic count of 4813. Assuming on average 6 trips per day for the ADU, the traffic count on County Road 100 would be increased by only 0.12% by this new use. CHANTE PEJUTA ACCESSORY DWELLING UNIT (ADU) EXHIBIT 6 – WATER SUPPLY The existing well permit for this property is approved for a single family dwelling and 5,800 sf of irrigation. The owner’s original contract with the Basalt Water Conservancy District (BWCD Contract No. 3.3.5.77) covers the existing well permit. The owner has also obtained a second contract with the BWCD (Contract No. 605) for two storage ponds. The second contract, No. 605, has been recently amended to remove one of the ponds and add another residence. With the original contract and the amended contract, the owner has applied for a new well permit to change and increase the use of the existing well for a second dwelling. The water from the existing well has been recently tested. Aside from hardness, none of the contaminants that were detected were above the referenced standards. In addition, the storage building that will house the ADU, also houses a slow sand filtration system that will further improve the quality of the water. PURPOSE AND LOCATION OF USE: Applicant will use the waters herein granted for beneficial purposes limited to the augmentation of existing and future wells and other water sources, within or through facilities or upon lands owned, operated or served by Applicant, which lands are more fully described on Exhibit "A" attached hereto; provided that the location and purpose of Applicant's use of said water shall be legally recognized and permitted by the applicable governmental authority having jurisdiction over the property served. Appli- cant's contemplated usage for the water allotted hereunder is for the following use or uses: DOMESTIC Applicant acknowledges that usage of the District's water rights as herein contemplated shall be in lieu of or supplemental to Applicant obtaining or adjudicating, on its own, the right to use certain waters. To the extent that service cannot be achieved by use of the District's allotted water rights, or in the event said service is inadequate, Applicant may, utilize such other water rights, by way of supplementing the District's water rights, or otherwise, as is necessary to assure water service sufficiently reliable for Applicant's intended purpose or purposes. All lands, facilities and areas served by water rights allotted hereunder shall be situated within the boundaries of the District . The District reserves the exclusive right to review and approve any conditions which may be attached to judicial approval of Applicant's use of the District's water rights allotted hereunder. Applicant agrees to defray any out-of-pocket expenses incurred by the District in connection with the allot- ment of water rights hereunder, including, but not limited to, reimbursement of legal and engineering costs incurred in con- nection with any water rights adjudication necessary to allow Applicant's use of such allotted water rights; provided, however, in the event any such adjudication involves more of the District's water rights than are allotted pursuant to this Contract, Applicant shall bear only a pro-rata portion of such expenses. Water service provided by the District shall be limited to the amount of water available in priority at the original point of diversion of the District's applicable water right and neither the District, nor those entitled to utilize the District's decrees, may call on any greater amount at new or alternate points of diversion. The District, or anyone using the District's decrees, may call on any addi- tional sources of supply that may be available at an alternate point of diversion, but not at the original point of diversion, only as against water rights which are junior to the date of application for the alternate point of diversion. In the event the Applicant intends to develop an augmentation plan and institute legal proceedings · for the approval of such augmentation plan to allow the Applicant to utilize the water allotted to Applicant hereunder, the Applicant shall give the District written notice of such intent. In the event the Applicant develops and adjudicates an augmentation plan to utilize the water allotted hereunder, Applicant shall not be obligated to bear or defray any legal or engineering expense of the District incurred by the District for the purpose of develop- ing and adjudicating a plan of augmentation for the District. In any event, the District shall have the right to approve the Applicant's augmentation plan and the Applicant shall provide the District copies of such plan and of all pleadings and other papers filed with the Water Court in the adjudication thereof. 4. PAYMENT: Applicant shall pay annually for the water service described herein at a price to be fixed annually by the Boa-rd of Directors of the District for such service. The initial annual payment shall be made, in full, within 15 days after the date of a notice from the District that the initial payment is due. Said notice will advise the Applicant, among other things, of the water delivery year to which the payment shall apply and the price which is applicable to that year. Annual payments for each year thereafter shall be made by the Applicant on or before each March 1. If an annual payment is not made by the due date, written notice thereof will be sent by the District to the Applicant at Applicant's address set forth below. If payment is not made within ten (10) days after said written notice, the District may, at its option, elect to terminate all of the Applicants right, title, or interest under this Contract, in which event the water right allotted hereunder may be trans- ferred, leased or otherwise disposed of by the District at the discretion of its Board of Directors. In the event water deliveries hereunder are made by or pursuant to agreement with some other person, corporation, quasi-municipal entity, or governmental entity, and in the event the Applicant fails to make payments as required hereunder, the District may, at its sole option and request, authorize said person or entity to curtail the Applicant's water service pur- suant to this Contract, and in such event neither the District nor such persons or entity shall be liable for such curtailment. 5. APPROPRIATION OF FUNDS: The Applicant agrees that so long as this Contract is valid and in force, Applicant will budget and appropriate from such sources of revenues as may be legally available to the Applicant the funds necessary to make 2 1 • the annual payments in advance of water delivery pursuant to this Contract. BENEFIT OF CONTRACT: The water right allotted hereunder shall be beneficially used for the purposes and in the manner specified herein and this Contract is for the exclusive benefit of the Applicant and shall not inure to the benefit of any successor, assign, or lessee of said Applicant without the prior written approval of the Board of Directors of the District. In the event the water right allotted hereunder is to be used for the benefit of land which is now or will hereafter be subdivided or otherwise held or owned in separate ownership interest by two ( 2) or more uses of the water right allotted hereunder, the Applicant may assign the Applicant's rights hereunder only to a homeowners association, water district, water and sanitation district or other special district properly organized and existing under and by virtue of the laws of the state of Colorado and then only if such association or special district establishes to the satisfaction of the Basalt Water Conservancy District that it has the ability and authority to assure its performance of the Applicant's obligations under this Contract. In no event shall the owner of a portion, but less than all, of the Applicant's property to be served under this Contract, have any rights hereunder, except as such rights may exist through a homeowners association or special district as above provided. Any assignment of the Applicant's rights under this Contract -shall be subject to and must comply with such requirements as the District may hereafter adopt regarding assignment of Contract rights and the assumption of Contract obligations by assignees and successors, provided that such requirements shall uniformly apply to all allottees receiving District service. The restrictions on assignment as herein contained shall not preclude the District from holding the Applicant, or any successor to the Applicant, responsible for the performance of all or any part of the Applicant's covenants and agreements herein contained. 7. OTHER RULES: Applicant's rights under this Con- tract shall be subject to the Water Service Plan as adopted by the District and amended from time to time;--provided that such Water Service Plan shall apply uniformly throughout the District among water users receiving the same service from the District. Applicant shall also be bound by the provisions of the Water Conservancy Act of the State of Colorado, the Rules and Regu- lations of the Board of Directors of the District, the plumbing advisory, water conservation, and staged curtailment regulations, if any, applicable within the County in which the water allotted hereunder is to be used, together with all amendments of and supplements to any of the foregoing. 8. CURTAILMENT OF USE: The water service provided hereunder is expressly subject to the provisions of that certain Stipulation in Case No. 80 CW 253 on file in the District Court in Water Di vision No. 5 of the State of Colorado, which Stipu- lation provides, in part, for the poss i ble curtailment of out-of-house municipal and domes tic water demands upon the occurrence of certain events and upon the District giving notice of such curtailment, all as more fully set forth i n said sti pu- lation . 9. PRIOR RESOLUTION: The water service provided hereunder is expressly subject to that certain Resolution passed by the Board of Directors of the District on September 25, 1979, and all amendments thereto, as the same exists upon the date of this application and allotment contract. 12. The existing well is currently covered under Contract 77e and is in the 01 CW305 Ruling 1 of 2 Decree for 1 single family dwelling and irrigation use (4,535 square feet). Contract 77e cannot be amended as this is an increase in water usage. Therefore, a new/amended contract is sought by the Applicant to add 2nc1 single family dwelling. (W1a) .:I&~,::",....... 1.000 2.000 Scale: 1"=2,000' 3,000 AMENDMENT TO WATER ALLOTMENT CONTRACT BASALT WATER CONS ERV ANCY DISTRICT Contract No. 605 WHEREAS, the Basalt Water Conservancy District (hereinafter the "District") granted Water Allotment Contract No. 605 dated August 14, 2012, (the "Contract") to Chante Pejuta, LLC (the "Applicant") for 0.5 cubic feet of water per second from the District's direct flow rights to serve certain property located in Garfield County, Colorado, which lands are described as Exhibit A attached hereto; and WHEREAS, the Applicant has requested that the Contract be amended to decrease the volume of storage or other augmentation water allotted thereunder from 0.5 to 0.4 acre feet. WHEREFORE, the Contract shall be and hereby is amended to provide that the Applicant shall be entitled to receive and apply to beneficial use 0.4 acre feet per year of storage or other augmentation water owned or controlled by the District. Applicant shall restrict actual diversions and consumptive use under this Contract to these amounts . The Contract amount is based on the water requirements table attached hereto as Exhibits B-1 and B-2, which shall replace any and all water use or allocation schedules previously associated with this contract. Any further increase or change in the water requirements to be served by the District will require an amendment to the subject contract. The Amendment is made subject to the following conditions: 1. At Applicant's request, this water allotment contract supply and Applicant's structure(s) benefited hereunder have been included in the District's umbrella plan for augmentation decreed in Case No. 02CW77 ("Umbrella Plan"). Applicant has paid $1,200.00 as its pro rata share of the costs and expenses incurred by the District to obtain the Umbrella Plan contemporaneously with acceptance of this Order, unless otherwise agreed in writing by the parties, which amount is based on and limited to the type(s) and amount of water use made by Applicant as detailed in Exhibit B-1 to the Water Allotment Contract. However, by acceptance of this Contract, Applicant acknowledges that it shall be responsible for any adjudication of the water right associated with the Applicant's ponds. The Contract allots storage/augmentation water of the District to augment evaporative losses from the surface area of the pond, but the Applicant acknowledges that the District will not be responsible for adjudicating a water right or priority date for the pond in any future water rights plan of augmentation filed by the District. In its sole discretion, the District may include the augmentation of the e v aporative losses from the pond in a future augmentation plan filing (as above described), but only after the Applicant provides the 201 4-5-1 3 A mendm e nt to C o ntra c t N o. 605 1 District with a decree of court which adjudicates the water right and priority associated with the pond. In the event that the District includes the augmentation of the evaporative losses in a future augmentation plan filing, the Applicant shall pay the District's costs associated with the plan (as above described). 2. Any and all conditions imposed upon the release and diversion of water allotted hereunder in any water rights plan of augmentation or other water rights decree of the Water Court for Water Division No. 5 shall be incorporated herein as a condition of approval of this contract. Granting of this allotment contract does not constitute the District's representation that the Applicant will receive a well permit or water rights decree for the land to be benefited hereby. 3. PAYMENT: Applicant shall pay annually for the water service described herein at a price to be fixed annually by the Board of Directors of the District for such service. Payment of the annual fee shall be made, in full, within fifteen (15) days after the date of a notice from the District that the payment is due. Said notice will advise the Applicant, among other things, of the water delivery year to which the payment shall apply and the price which is applicable to that year. If a payment is not made by the due date, a late fee of $50 (or other amount as the Board may set from time to time) will be assessed and final written notice of the delinquent account and late fee assessment will be sent by the District to the Applicant at Applicant's address set forth in the Assignment attached . If payment is not made within thirty (30) days after said final written notice, the District may, at its option, elect to terminate all of the Applicant's right, title, or interest under this Contract, in which event the water right allotted hereunder may be transferred, leased or otherwise disposed of by the District at the discretion of its Board of Directors. 4. WELL PERMIT: If Applicant intends to divert through a well, then Applicant must provide to District a copy of Applicant's valid well permit before the District is obligated to deliver any water hereunder, and it is the Applicant's continuous duty to maintain a valid well permit. Applicant shall also comply with all restrictions and limitations set forth in the well permit obtained from the Colorado Division of Water Resources . Applicant must comply with the well-spacing requirements set forth in C.R.S . §37-90-137, as amended, if applicable. Compliance with said statutory well-spacing criteria shall be an express condition of the extension of service hereunder, and the District shall in no way be liable for an Applicant's failure to comply. Applicant agrees to mark the well in a conspicuous place with the permit number. 5. MEASURING DEVICE OR METER: Applicant agrees to provide, at its own expense, a totalizing flow meter with remote readout to continuously and accurately measure at all times all water diverted pursuant to the terms of Applicant's water right and the terms of this Contract. On or before November 15 of each year, Applicant will provide 2014-5 -13 Ame ndm e nt to C o ntra ct No. 60 5 2 accurate readings from such device or meter (recorded on a monthly basis for the period November 1 through October 30 of each year) to District, the Division Engineer and Water Commissioner. Applicant acknowledges that failure to comply with this paragraph could result in legal action to terminate Applicant's diversion of water by the State of Colorado Division of Water Resources. By signing this Contract, Applicant hereby specifically allows District, through its authorized agent, to enter upon Applicant's property during ordinary business hours for the purposes of determining Applicant's actual use of water. 6. COMPLIANCE WITH SECTION 404 OF THE CLEAN WATER ACT. Applicant shall comply with Section 404 of the Clean Water Act and consult with the Army Corps of Engineers to complete any Section 404 compliance that may be required as a result of the construction of any facilities necessary to use contract water. 7 . CONTRACT TERMINATION : A. Termination by District: 1. The District may terminate this Contract for any violation or breach of the terms of this Contract by Applicant, or Applicant's breach of any other contract with the District. 2. The District may terminate this Contract if, in its discretion, any judicial or administrative proceedings initiated by Applicant threaten the District's authority to contract for delivery or use of the District's water rights, or threaten the District's permits, water rights, or other interests of the District. B. Termination by Applicant: 1. Applicant may terminate this Contract in its entirety for any reason by notifying the District in writing of the termination on or before April 1.
