A Site Application for the expansion of this facility was recently approved by Garfield County, subject to the submittal of a Floodplain Special Use Permit. By way of history, this facility was originally built by the Rifle South Metropolitan District. In the mid-1980's, the City assumed the ownership of the facility. In 1997, the City of Rifle built a new lagoon facility to replace the previous Rifle South Metropolitan District facility. This expansion to 250,000 gpd was completed in 1998. Subsequent in 2001, the City of Rifle prepared a Site Application to further expand the facility to 331 ,000 gpd. Garfield County staff recognized that a Floodplain Special Use Permit was required for the facility, as it fell within the flood fringe as outlined in the adopted FEMA Floodplain Study. The facility constructed in 1997 was built to conform to the Floodplain Special Use Permit criteria. The 100-year floodplain was identified and is attached on the drawings. When the City built the new facility in 1997, they constructed three aerated lagoons, expanded a settling cell, built a chlorine contact structure and built overflow structures in between the lagoons . All these facilities were built in compliance with the Floodplain Special Use requirements. The tops of the berms were built one foot above the 100-year floodplain elevation of 5270. The tops of the berms were built to an elevation of 5271. The tops of the concrete of the overflow structures were constructed to an elevation of 5271.2. The top of the concrete of the chlorine contact structure is 5271.1. In the event of a shallow flood condition (i.e .,less than one foot), the ponds, overflow structure and chlorine contact structure are protected. The slopes of the lagoons themselves were built at 2: 1 slope and will not be damaged by the shallow flooding that would occur in a 100-year event. All the berms were compacted to 95% of modified Proctor densities. Because these ponds were built to contain water, they will not be damaged during a flood event. c c 6 May 10, 2001 Ms. Kit Lyons, Planner Page 2 I am attaching a copy of the drawings which reflect the following: 1. The cover sheet shows a vicinity map as required in your Section 9.03.01. 2. Sheet Cl shows a site plan showing the pond expansion. The three aerated lagoons are shown with a 10-foot wide berm at elevation 5271. This sheet also shows a blow-up of the 100-year Floodplain FEMA mapping. This sheet also shows the property boundary and legal description of the lot. 3 . Sheet C2 shows cross sections of the berms, again. which depict the top of berm elevation and the side slopes. 4 . Sheet C3 shows the overflow structures and the top of concrete elevation of 5271.2. 5 . Sheet C4 shows the chlorine contact structure, again, with a top of concrete elevation of 5271.1 . The subject of this recent Site Application is to expand the plant from 250,000 to 331,000 gpd. Very little work is necessary in order to accomplish this. The top of berms were originally placed one foot above the 100-year floodplain elevation, which allowed for five feet of freeboard. This project will utilize that freeboard to add additional volume and detention time for the lagoons . There will be no change to the earthwork or berming of the lagoons. An influent lift station will be installed that will raise the hydraulic grade line of the water in the ponds from an elevation of 5266 to 5269, leaving two feet of freeboard remaining in the ponds. The lift station that will be installed will have a below-ground wetwell. That wetwell structure will have a top of concrete elevation one foot above the 100-year floodplain elevation and will be installed with a watertight cover or seei i. Mechanical equipment (i.e., pumps and motor control center panels will be placed either at an above-ground location with a finish floor one foot above the 100-year floodplain elevation or will be recessed in a mechanical pre· engineered structure that will have a roof one foot above the 1 00-year floodplain elevation, again, with a watertight access hatch. Aerators will be installed in the lagoons which will have no impact on the 100-year floodplain elevati on . An interior baffle wall of the overflow structures will be raised but, aga i n, will have no impact on the floodplain elevation. Again, the exterior of these overflow structures are already above the 100-year floodplain elevation. 6. The wastewater treatment facility holds a valid NPDES Discharge Permit. The facility holds a valid Site Application for the 1997 expansion and has proceeded with the mission of a Site Application for this recent expansion. The 1997 facility required an update to the City's valid 201 Plan. As part of that update , consultation was required with the Army Corps of Engineers, U.S. Fish and Wildlife Service, State Geologist, Historical Society, Soil Conservation Service , State Division of Wildlife, State Engineer's Office, Air Pollution Control Division and National Park Service. A copy of the 201 Facility Plan update and the replies from these various agencies are attached. (2) To determine whether proposed building site will be reasonably safe from flooding, and that the structure will be in compliance with the applicable provisions for uses and standards for construction set forth in this Resolution. The 1997 expansion consisted of constructing lagoons , overflow structure and a chlorine contact structure. All these facilities were built with the tops one foot above the 100-year floodplain elevation . These facilities will be protected during flooding . (3) To determine if the proposed development is located in the floodway. If located in the floodway, assure that encroachment provisions of Section 6.09.01(1)(A) are met. The development is located in the flood fringe as shown on Sheet C 1 , which has a map depicting the 100-year floodplain map as determined by FEMA . The project is not in the flood way. 1 ( 6 SCHMUESER I GORDON I MEYER ( (4) To assure that adjacent communities, the Colorado Water Conservation Board and Federal Emergency Management Agency have been notified of the proposed watercourse alteration or relocation. This project does not propose altering a watercourse or relocation. (5) To assure that the carry capacity of the altered/relocated watercourse is maintained. (A.85-211 ). This project does not alter the carrying capacity of the watercourse. The FEMA mapping guidelines require that any area within the flood fringe is shown as being filled when determining the hydraulic grade lines of the various flood elevations. 6.09 SPECIAL USE AND STANDARDS FOR CONSTRUCTION 6 .09.02 lOM tee 9l!017a14 ~·01 Floodway (1) Prohibited Uses and Activities. The following uses and activities are prohibited in the Floodway: (A) Encroachments, including fill, new construction. substantial improvements and other development, unless a technical evaluation demonstrates that encroachments shall not result in any increase in any food levels during the occurrence of the base flood discharge . If the technical evaluation satisfies the requirement, all new construction and substantial improvements shall be required to meet the performance standards set forth in Section 6.09.02(3). This project will not cause or result in danger of substantial debris being carried downstream by floodwater. (B) The storage or processing of materials that in times of flooding are buoyant, flammable, explosive or otherwise potentially injurious to human, animal or plant life. This project will not result in the storage or processing of materials that, in times of flooding, would be injurious to humans. 2 ( 6 SCHMUESER GORDON MEYER ( 6.09.02 LOM lec\960l7ol4 S·I0.01 {C) The disposal of garbage or other solid waste materials. This project will not result in the disposal of garbage or other solid waste materials. (0) The placement of any structures, either fixed or mobile, for purposes of human occupation, either permanent or temporary. This project will not cause an obstruction which would adversely affect the efficiency or restrict the flow capacity of a designated floodplain . Flood Fringe/Flood Prone Areas (3) Performance Standards. The following performance standards must be met for development in the Flood Fringe or Flood Prone Areas: {A) The lowest floor, including basement, of any new or substantially improved building design for residential occupancy shall not be less than one ( 1) foot above the maximum water elevation of the 100-year Flood. The features constructed as part of the 1 997 improvement and thi s improvement have resulted in elevations one foot above the 1 OO ·year floodplain. (8) All new construction or substantial improvements shall be reasonably safe from flooding. This update contains a brief review of that same 201 Plan plus an expanded Environmental Assessment. 'This addition is being done at this time due to the fact that when the original 201 Plan was prepared there was only limited environmental infonnation required. In order to comply with new regulations the Financial Assistance Program of the Water Quality Control Division of the Colorado Department of Public Health and Environment asked that the City of Rifle prepare an update that contained more extensive information. This is being done in conjunction with an application for a low interest loan from the CDOPHE. This money is required in order to expand the existing South Rifle Wastewater Treatment Facility, which is being done in order to comply with the facilityts discharge permit. [ i 1 r { r r l [ f [ [ [ [ L l l [ [ L SECTION I: CURRENT 201 F'ACILITY PLAN REVIEW r r r r r [ I L l [_ [' [/ l l [ L l I [ SECTION I: CURRENT 201 FACILITY PLAN REVIEW The firm of Schmueser Gordon Meyer, Inc. has reviewed the City of Rifle's 201 Facility Plan as prepared by ARIX dated June 1979. This plan was developed prior to the construction of the existing wastewater treatment facility located on the north of the Colorado River. The plan reviewed a detailed set of alternatives related to the North and' South plants and provided an assessment matrix to produce a final recommendation. The study concludes: "Expanding the City and District's1 plants is the most cost-effective solution for the future needs. This alternative rates high in environmental and non-economic aspects due to the fact that this approach makes maximum use of existing facilities, does not pump sewage across the Colorado River, has land requirements which are easily met, does not produce sludge or have sludge handling problems, has low operating and maintenance costs and is very reliable. Other environmental impacts associated with the recommended plan are not considered excessive". After reviewing the assumptions made at the time this document was prepared, intervi~wing local officials and staff, ad looking for any other options now available, we believe the assumptions and conclusions reached in the original document are still valid and should be followed. 1 At the time this document was prepared, a Metropolitan District owned and operated the South Treatment Facility. 1-1 r l [ [ [ l r [ [ r l [ r l ( L [ l Li SECTION II: ENVIRONMENTAL ASSESSMENT UPDATE r l [ [ r [ l [ r l l l L II ENVIRONMENTAL ASSESSMENT UPDATE The present plant is situated on the south bank of the Colorado River, approximately 1. 7 miles west of the Rifle exit on I-70. It is located on flat open land owned by the City of Rifle. It gently slopes upward from the river with no geological impediments to construction. As it is an already existing facility there are no physical limitations to make the site unsuitable. The climate is typical of the north western section of the state of Colorado. No hurricanes, typhoons or tomados. There is an occasional severe winter storm but that does not affect the feasibility of the planned expansion nor are there any considerations of air quality problems. There is no anticipation of excessive growth in the area. It has seen a somewhat accelerated growth more from a migration of up valley·workers than any other factors but that is now leveling out. The area will see a steady growth rate. This growth rate will not be accelerated nor induced to accelerate due to the expansion of the facility. The facility is being expanded as a result of it operating at an 80% capacity and anticipation of a steady growth on the south side of town. The facilities will be serving an already developed community. There is some potential for growth but that growth will not be spurred by the construction of this facility. No existing homes or businesses will be displaced with this proposed expansion. There is adequate space at the existing site not to encroach on other development. The steady growth of the area will have some impact on other public services but the City has a current growth plan that takes this into consideration and as no growth will be spurred as a result of this facility the City is able to follow their Master Plan and accommodate any strains on utilities and services. They also have a current Streets improvement plan that will accommodate any variations in traffic. The expansion of the existing plant does not favor one citizen over another. All groups are affected equally and there is no preferential treatment as a result of this expansion. Conversely no one group is adversely affected by this expansion. Land values are changing due to factors other than the expansion of this plant. Transportation facilities are not an issue with the expansion of this plant. It is one person operated. Therefore, there is no need to have public transportation service the area. Its existence does not regulate the need for any additional service nor the potential loss of any facility. Mass transportation is addressed by the City's Master Plan The expansion of the plant does not affect land use controls. As this is an already existing plant there is no open space, recreation, industrial land use or existing housing affected by the expansion. Land use controls are set in the Town's Master Plan regardless of the expansion of the plant. This project does exist within the 100-year floodplain. The expansion will take this into account during the design phase in order to protect both the facility and the Colorado River. All finished floors will be one foot above the flood line and all construction will comply with the Garfield 2-1 [ r l [ r [ r l l r l [ l L [ l L L County Special Use Permit. The facility does not serve any other development within the floodplain. This is not designated as a wetland area nor is it located on a wild and scenic river. There are no impacts to nationally significant river sources. This is verified in the attached letter from the National Park Service, National Rivers Program. There are also no National Register for Historic Places properties within the boundary of the proposed expansion. There will be no archeological nor cultural impacts at the site. As stated in the attached letter from the Colorado Historical Society if any are found during construction the City of Rifle is obligated to stop construction and report it's findings as such. There do exist four endangered species of fish occupying the Colorado River in the Rifle area. They are the Colorado Cutthroat Trout, Humpback Chub, Bony Tail Chub and the Colorado Squawfish. However the Fish and Wildlife Service believes that the decline of these species is directly related to water depletions. As there will be no additional water depletions due to this project these endangered species will remain unaffected. In regards to other wildlife/wetland issues, in particular any bald eagles or falcons, this is an already existing site. Therefore, there will be no additional or new impacts on the habitats of the wildlife in the area. Nor does this site contain any sensitive habitat designed by any governmental agency. No recreation or open space will be modified by this project. Again as an already existing site with all planned construction to be well within its borders there will be no impact on any of these sites. There is no feasibility of combining this project with parks, waterway or any other recreational uses. The modifications are very simple. Ponds are being built so very little in the way of opening up hiking or biking trails exists. The water in the area is not conducive to any waterway activities and it would be unwise to put a park for public use at a wastewater treatment facility. Again because this is an existing site and the only expansion of the plant will be done well within its border no agricultural land is being effected. Air quality is not an issue as well. Per a letter from the Colorado State Department of Public Health and Environment the area in which the plant exists is in compliance with all regulatory standards. Please see the attachment for a copy of the referenced letter. Construction will produce a minimum of dust and the road going to the plant does not support any traffic other than the support personnel for the plant itself. The design of the plant is such that there is no release of any particulates or any of the other five pollutants listed, into the immediate environment. There are also no asbestos materials used in the new construction nor were there any used in the original construction that would be disturbed now. The discharge from the plant is carried by a ditch that then feeds directly to the Colorado River. Therefore, there are no stream quality considerations. The appropriate discharge parameters are governed by the Colorado Department of Public Health & Environment. The plant currently works within those parameters. Through the Site Application process the City of Rifle is working with the CDOPHE to assure we continue to comply with mandated discharge parameters. All drainage issues from development within the City of Rifle area are dealt with 2-2 ( r l f l [ [ [ [ ( l l l l L L on a development by development process. The City Engineer works with those issues to assure no problems are incurred with any development. There are no water rights at issue here as well as not having any impact on transferring water from one basin to another. There are no flow or bank modifications being done to the Colorado, which is the only body of water that is in relation to this project. We are working with and plan to continue to work closely with the State Department of Health to assure that we comply with all governmental regulations with regard to wasteload calculations as well as any impacts on groundwater quality. No Anti.degradation Review is required. To our knowledge no potable drinking water supply is affected in any way by this project. As this plant discharges directly to the Colorado there is no discharge to the groundwater supply, which is assured through new ponds that are lined. The City routinely produces public infonnation notifications about water conservation throughout the area. The immediate service area community is too small to have any cost effective measures put in place. These avenues are constantly being evaluated by city staff so that in the event the community becomes cohesive enough so that those measures can be instituted. There are no adverse effects to the public health as a result of this project. There are no noise levels whatsoever. It is a lagoon system. The City of Rifle employs accepted practices of pest control to control any mosquito problem in abeyance. There are absolutely no increased risks of disease from this expansion. This facility produces minimal sludge as it is a lagoon facility. Approximately once every 20 years the ponds are dredged and cleaned out. At that time any debris is taken to a locally approved landfill. This plant neither produces nor uses large amounts of energy. It is a natural system. Therefore, it doesn't create any usable energy. There is no method to reduce any energy consumption further or to recover any used energy. The project is an expansion of the existing plant. The methods employed at the facility are long used time tested methods that are not of unproven techniques and there is no public controversy over. In fact the public is in support of expanded facilities in order to see economic growth in the area. No water rights are impacted nor are additional rights required. This project is not multipurpose. There are no jurisdictional disputes from this project. The project is part of the City of Rifle's waste management operation. Due to the existence of this plant there is no proliferation of septic systems as there would be if the plant was not located at its present location. There is now a method of controlling individual systems as growth is within the boundaries of the service area and all new building is required to tie into this system. No inter-jurisdictional agreements need to be signed. There is no level of public controversy. The expansion is and has been part of regular local government proceed!r.gs that allow for the participation of the public. In addition there will be the required public notification when construction begins. Comment from the U.S. Fish and Wildlife is a requirement of the 201 Facility Plan Environmental Assessment check list. By way of history, the City of Rifle prepared a 201 Facility Plan update in June of 1979. As a result of that 201 Plan, the City of Riffe currently has two wastewater treatment facilities. The main facility is located just west of the City of Rifie on the north side of the Colorado River. In addition. the City also owns and operates the Rifle South Wastewater Treatment Facility, which is located on the south side of the Colorado River and serves all the developed area south of the interstate and river. The south wastewater treatment facility is a three=ceH aerated lagoon .with disinfection via chlo.rination. At the present time, flows coming into the facility are reaching the permitted capacity through the· Colorado Department of Health. As a result of the increased flows, the City of Rifle would like to expand this facility. After a Facilities Analysis was prepared, the City has chosen to pursue an expansion with a new, three-cell aerated lagoon located immediately adjacent to the present facility. Wtth this method of expansion, the current facility can continue to treat flows while the new facility is being built. Again. comment from the U.S. Fish and Wildlife is a requirement for the environmental assessment contained within the 201 Plan. l would be happy to answer any questions you may have, or direct you to the site in the field. After reviewing the information and map you sent in your letter dated July I I, 1996, the following comments may help you in the facility planning process. There are National Ambient Air Quality Standards (NAAQS) for six pollutants -carbon monoxide, particulate matter, ozone, sulfur dioxide, lead, and nitrogen dioxide. The geographical area surrounding the town ·of Rifle is in attainment of all of these standards. The State of Colorado, however, has permit and regulatory requirements that apply to these and other pollutants. For example, the Division's Stationary Source Program may require air pollution permits or notices if ground disturbances exceed 25 acres or last longer than six months. if construction or demolition dust is produced, if odors are produced which require odor control equipment, or if unpaved roads create traffic levels that exceed cenain thresholds as defined by Colorado Air Pollution Regulation No. I. Additionally, permits or notices may be required if asbestos demolition or removal -is involved; this requirement falls under a separate set of regulations for asbestos. To comply with section 7(c) of the Endangered Species Act of 1973, as amended, Federal agencies or their designees are required to obtain from the Service infonnation concerning any species or critical habitat, listed or proposed to be listed, which may be present in the area of a proposed const~uction project. We believe that any action made possible by the project that causes a depletion of water from the Upper Colorado River Basin should prompt a "may affect" finding for the listed fishes and necessitate consultation under the Endangered Species Act. You should contact us to obtain infonnation on calculating the quantity of historic and new depletions associated with the project. Be advised that the Fish and Wildlife Service can enter into formal section 7 consultation only with another Federal agency or its designee.
