Smith Don DeFord Mildred Alsdorf Chuck Deschenes , Commissioner Chairman ( absent ) , Commissioner Chairman Pro Tem , Commissioner , County Attorney , Clerk of the Board , County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 92-109 A RESOLUTION CONCERNED WITH THE APPROVAL OF A FLOODPLAIN SPECIAL USE PERMIT APPLICATION FOR JOHN ELDER. WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from John Elder for a Floodplain Special Use Permit to allow for the placement of fill & compensatory measures within the regulated floodplain on the following described tracts of land: Located in Sections 25 and 36, T7S, R88W, Ranch at Roaring Fork, Phase IV, Filing III (in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public hearing on the 14th day of December 1992, upon the question of whether the above-described Floodplain Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. BOOK 850 fAGE5i5 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 4. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Permit be and hereby is authorized permitting to allow for the placement of fill & compensatory measures within the regulated floodplain, upon the following specific conditions: All proposals of the applicant shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners. 2. All required building permits will be obtained. Elevation certificates will be required to ensure that all structures will be located at least one (1) foot above the floodplain line indicated on the bluelines submitted with the application. 3. Driveways and roads will conform to Garfield County Road Standards. 4. Lot 11 ("Elder Lot") will appear on the Final Plat. A plat note will be included, as follows: "Lot 11 is considered unbuildable, subject to Army Corps of Engineers 404 permit and conformance with Garfield County Floodplain Regulations, as amended". 5. A Subdivision Improvements Agreement and appropriate security will be required prior to approval of the Final Plat. 6. Fisherman easements and utility easements will appear on the Final Plat.
