The Community Building proposed is a one story building of 1,200 sq. ft. The building will house a ~ulti-purposeToom, ..workout area, two restrooms and mechanical equipment ar~as. A Recreational Community Center land use indicates an average trip rate of 22.88 vehicles per weekday per 1,000 sq. ft., or approximately 37.45 vehicles for 1,200 sg. ft. per day. Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use. Mid Valley Metropolitan District has provided a letter stating they have adequate available services to provide water and sanitation service for this proposed use. (2). Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or slia l be constructed in conjunction with the proposed use. The proposed project will not be attracting any offsite users. Traffic will be generated from within Cerise Ranch which has adequate street improvements to accommodate traffic volumes generated from this Community Center. (3). Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character. The proposed Community Center is located near the entrance of Cerise Ranch in adjacent to other common use areas such as a Volleyball Court and Picnic Shelter. The area has been designated at Common Area and is not is close proximity to any homesites. It is our understanding that the developer of the Cerise Ranch Subdivision w ill be applying to Garfield County for a Special Use Permit in order to develop a community center and swimming pool within the subdivision. Although we have not had the opportunity to review the Special Use Permit Application, it is the District's understanding that the proposed additional uses will consist of the following: ( 1) a swimming pool with 14,050 gallons of water capacity; and (2) a community building with two bathrooms (but no showers) and a small, non-industrial kitchen. For those proposed uses listed above, the District: has the capacity in its sewer treatment plant; has available potable water supplies; has sufficient capacity in its decreed plan for augmentation in Consolidated Case Nos. 85CW591 and 90CW074 (Second and Third Decrees), copies of which are a ttached ; and can and will serve the new uses with District water and sewer services, subject to the following conditions: 1. The Applicant shall pay a ll additional water and sewer tap fees for the new uses and facilities prior to receiving a building permit from Garfield County. If no building permit is required for the new uses, Applicant shall pay all additional tap fees prior to implementing each new use. 2. (9) The District currently has a contract for 235 acre-feet with the Basalt Water Conservancy District. B. The Applicati~n also requested the right to use certain historic irrigation water rights for augmentation purposes. Such historic irrigation rights were quantified in the application and amended applications foto historic consumptive use credits claimed by the Applicant. At this time, the Applicant is requesting entry of a decree using augmentation water obtained from Ruedi Reservoir as its only augmentation source. The Applicant has requested entry of a Decree granting an augmentation plan using Ruedi Reservoir water reserving the right to obtain a supplemental decree using the historic irrigation water rights as an alterriate source of augmentation water at a later time, in Case No. 90CW074. 6. Statement of plan for augmentation, covering all applicable matters under C.R.S. 37-92-103(9), -302(1)(2) and -305(8). A. Water use by the District. The Mid Valley Metropolitan District (hereinafter the "District") is a metropolitan district organized pursuant to Title 32 of the Colorado Revised Statutes, generally located in Sections 33, 34 and 35, Township 7 South, Range -87·West and in Sections 2, 3, 4, IO and 11, Township 8 South, Range 87 West of the 6th P.M., .in Eagle County, Colorado. At this time, the District. comprises approximately 2,000 acres of land. Additional land may be included within the District's boundaries pursuant to ~tatute and may be served by the District under this plan for augmentation. An EQR is an equivalent residential unit assumed to use 350 gallons per day for in-house use and 290 gallons per day for 2,500 square feet of lawn and garden irrigation during a 183-day irrigation season (April -October). Such additional lawn space as well as additional irrigated open space is accounted for as open space irrigation in Table 1 by the District including such additional irrigation in its number of acres of irrigated open space. Commercial uses within the D istrict are accounted for in Table 1 using EQRs. Irrigation associated with such commercial uses is assumed to be 100 square feet for each EQR of commercial development. The District anticipates that at full build-out of existing land within the District or presently served by the District there will be 1213 .7 residential EQR's, 327 commercial EQR's and 15 acres of open space irrigation . The water requirements (diversion and consumption) for the District at full build- out of these EQRs and 15 acres open space irrigation are as follows : . . . The water supply for the District will be diverted from the three wells described above. 'This water will be pumped into central systems for distribution to its customers. The District currently has a central sewage treatment facility which uses an aerated lagoons system . This system results in a five percent consumptive use for all water used for in-house purposes. B. Operation of Plan of Augmentat ion. The .District will report to the Division Engineer of the number of EQRs actually served by the District's municipal water supply system at the end of each year (October 31) and on July 15 of each year until full buildout occurs. The District will also advise the Division Engineer of C:\FILES\MVMD. 7DB . Such reporting to the Division Engineer shall be on forms and will provide such information as may be requested by the Division Engineer . The amount of diversions associated with type of use (in-house, commercial or irrigation) have been used to calculate depletion factors on a monthly basis . The delays resulting from the pumping of the wells and irrigation return flows to the stream are calculated to obtain adjusted well depletion and return flow factors. Waste water return flows from the treatment plant will be measured and recorded on a monthly basis until full buildout occurs. These factors, delayed well depletions and delayed irrigation returns and the waste water return flows are ·used to calculate stream depletions on a monthly basis. Such depletion factors are more fully set forth on Exhibit "A". · · Actual diversions for the previous year plµs a five percent increase (until full buildout occu~s) will be used in conjunction with the depl~tions and return flow factors to calc·ulate net stream depletion on a monthly basis for the current year. Augmentation requirements for the year will be calculated at the end of the previous year (October 31) and submitted to the Division Engineer. Should the District experience yearly growth greater than the five percent anticipated, adjustments to the projected diversion amounts will be made. The Applicant shall review the amount of water withdrawn from the wells, the number of EQR's, irrigated acreage and return flows from the waste water treatment plant on a biannual basis every other year commencing on October 31, 1995, continuing on October 31, 1997, October 31, 1999, and ending on October 31, 2001 or until full buildout whichever occurs first . If water usage exceeds the amounts contained _herein for the number of EQR's and acres irrigated, or if the total irriga~ed acreage .exceeds the amount predicted and used as a basis for this plan, or the .annual monthly diversion distribution varies significantly (more than 10%) from the projected full buildout diversion distribution, the Applicant shall recalculate th~ depletions and return flow factors used in the accounting submitted to the Division Engineer pursuant to this decree. The Applicant's engineers have determined that there is lli2 hydraulic connection · between Blue Creek and the Mid Valley Metropolitan District Well Nos . 1 and 2 in the non-irrigation season, and therefore there is no effect in the non-irrigation season. Reserving the right in the future, based on further engineering analysis, to file an appropriate water court proceeding claiming there is a reduced or no connection between the Mid Valley Metropolitan District Well Nos. 1 and 2 and Blue Creek during the irrigation season, the District has agreed to replace water pumped on an average daily basis to Blue Creek by diverting water through the Robinson Ditch into Blue Creek at a point within the District. However, the Applicant reserves the right to claim historic consumptive use credits associated with curtailed irrigation under its Robinson Ditch rights . which credits will be determined in a fater phase . of this case. By consenting to entry of this decree, Objectors have not agreed that the Applicant may continue to divert its Robinson Ditch water to Blue Creek and also have credit for the historical consumptive use of those Robinson Ditch water rights.· Whether such diversions may continue if Applicant claims credit for the historical consumptive use of the Robinson Ditch is an issue to be determined in the later phase of this case. The Applicant may file an appropriate water court proceeding claiming that there is no connection between the Mid Valley Metropolitan District Well Nos. 1 and 2 and 13lue Creek during the irrigation season. Such application shall be duly filed and published in accordance with Colorado law . The provisions of this decree shall not be binding upon the Applicant in asserting such claim. There is no connectio'n between the Mid Valley Metropolitan District Well Nos. 1 and 2 and Blue Creek in the non-irrigation season. The applications for underground water rights and for approval of plan for augmentation were properly filed with this Court. · 2. The applicatiqns as filed are complete and contain all information required as provided by law. · 3. Timely and adequate notice of the filing of these application were given as required by law, and this Court has jurisdiction over this matter and all persons , whether they are parties hereto or not. 4. The Statements of Opposition filed by the Objectors were timely filed. . . 5. A Motion for Partial Summary Judgment was filed by the Applicant. The Court hereby grants such Motion by entering this Decree. The Court hereby enters this Decree considering only Ruedi Reservoir as a source of augmentation water. In a subsequent proceeding in this case the Court shall consider adding as a source of augmentation water, the irrigation water rights as more fully set forth in the application and amended application filed in this case. This Decree shall not prejudice the Applicant or affect the viability, usability or qualification of such irrigation rights, however, appropriate tenns and conditions may be imposed on Applicant befor~ such rights are included as an augmentation source. 6. The Objectors Jean Blue, Oscar Cerise, Michael Palmer and Floyd Crawford withdrew their opposition from the entire case . Stipulations were entered into with all other Objectors in which said Objectors consent to the entry of this Findings of Fact, Cqnclusions of Law, and Judgment and Decree. The Statements of Opposition of the remaining Objectors shall be continuing as they pertain to the remaining unresolved issues in this case . Case No. 90CW074 (Consolidated with Case No. 85CW591) shall be bifurcated. The Court has not considered _the Applicant 's irrigation water rights as they are set forth in the application, as a source of augmentation water· in entering this Findings of Fact, Conclusions of Law, Judgment and Decree. The Court shall consider such sources in a subsequent hearing, or pursuant to subsequent stipulations. The Court may also consider the effect during the irrigation season of pumping the Mid Valley Metropolitan District Well Nos. 1 and 2 on Blue Creek in subsequent consideration of this case pursuant to an appropriate water court proceeding , filed with the Court and published according to law. . 8 . The proposed plan for augmentation meets the statutory criteria for a plan for augmentation set forth in C.R.S. §37-92-103(9), -302(1), and -305(8), as one contemplated by law and, if operated in accordance with the terms and conditions of this Ruling, the use of water diverted form the MVMD Well Nos. 1, 2 & 3 will not injuriously affect the owner of or persons entitled to use water under a vested water right or decreed conditional water right. The State Engineer shall review and, to the extent necessary, issue amended or replacement well permits for the MVMD Wells Nos. 1, 2 & 3 in accordance with this decree and C.R.S. §37-90-137(2). 11 . The Applicant shall install such measuring devices as may be required by the Division Engineer to facilitate the operation of this plan for augmentation and to assure compliance herewith . 12 . The approval of this plan for augmentation shall be subject to reconsideration by the Water Judge on the question of injury to the vested water rights of others for a period of five (5) calendar. years succeeding the year in which this decision is rendered. In determining the period of reconsideration, the Court has considered that the Applicant has been operating pursuant. to a substitute supply plan approved by the Sta te Engineer and several years of actual use as proposed herein has occurred. 13 .
