TO CONSTRUCT A COMMUNITY BUILDING ON LOT 1, CERISE RANCH SUBDMSION, PHASE 1 TO GARFIELD COUNTY, ON CERISE RANCH ROAD WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received applicatiqn from Cerise Ranch L.L.C. for a Conditional Use Permit. The Conditional Use Permit would allow the applicant to have a Community Building on their property at the 3 .. 804 acre site located on the lot identified as Lot 1 Cerise Ranch Subdivision, Phase 1 to· Garfield County on Cerise Ranch Road and Highway 82. WHEREAS, the Conditional Use Permit request for a "Community Building" specifically will allow a Community Building of 1,200 sq . ft. with a multipurpose room, workout area, two restrooms, mechanical equipment area and an outdoor swimming pool. WHEREAS, the subject property is located in the Agricultural/Residential/Rural Density (AIR/RD) zone district which contemplates a "Community Building" as a Conditional Use within that district; and WHEREAS, the Board held a public hearing on the 19th day of July, 2004, upon the question of whether the above-described Conditional Use Permit should be granted or denied, at 1 Cerise Ranch L.L.C., Cooditi o oal Use Permit .·~ 11 1 ,.~: I llllll lllll lllllll Ill 111111111111111111111111111111111 59854 09 /16 /2004 09:52R B1623 P62 M RLSDORF ~ of 3 R 0.00 D 0 .00 GARFIELD COUNTY CO ) which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Permit ; and WHEREAS, the Board · on the basis of substantial competent evidence produced at the . aforementioned hearing, has made the following determination of fact: 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all . pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That the application is in compliance with the Garfield County Zoning Resolution of 1978 , as amended. · 4. For the above stated and other reasons, the proposed use and permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Co lorado, that the Conditional Use Permit be and hereby is approved to allow for an Community Building at the site identified in . the app lication, upon the following specific conditions: 1. The Owner shall be required to gain any and a ll applicable land use permits for any additional construction on Lot 1. 2 . The Applicant shall landscape and screen the proposed use as shown in the proposal layout plan in the application and as shown in Figure 1. of the final staff report. 3. Wetlands determinations for the Cerise Ranch Subdivision, Phase 1 Final Plat shall be observed and no building shall occur in these areas. 4.
