APPLICATION SUBMITTAL REQUIREMENTS As a minimum, specifically respond to all the following items below and attach any add itiona l information to be submitted with this application : 1. Submit plans and specifications for the proposed use includ ing the hou rs of operation , the number and type of veh icles accessing the site on a daily, weekly and/or monthly basis, and the size of any existing and/o r proposed structures that will be used in conjunction with the proposed use. Please submit the specific information in narrative form and be specific. 2 . If you will be using water or will be treating wastewater in conjunction with the proposed use , please detail the amount of water that would be used and the type of wastewater treatmen t. If you will be utilizing well wa ter, please attach a copy of the appropriate we ll permit and any other legal water supply information, including a water allotment contract or an approved water augmentation plan to demonstrate that you have legal and adequate water for the proposed use. 3. Submit a site plan /map drawn to scale that portrays the boundaries of the subject property, all existing and proposed structures on the property, and the County or State roadways w ith in one (1) mile of your property. If you are proposing a new or expanded access onto a County or State roadway, submit a driveway or highway access permi t. 4. Submit a vicinity map showing slope I topography of your property, for whic h a U.S .G.S. 1 :2 4,000 scale quadrangle map will suffice. 5. Submit a copy of the appropriate portion of a Garfield County Assesso r's Map showing all subject property and public and private land owners adjacen t to your property (wh ich should be delineated). In addition, submit a list of all property owners, private and pu blic landowners and their addresses adjacent to or within 200 ft. of the site. This information can be obtained from the Assessor's Office. We will also need the names (if applicable) of all mineral right owners of the subject property. (That information ca n be found in your t itle policy under Exceptions to T itle). 6 . Submit a copy of the deed and a legal description of the subj ect property. 7. If yo u are acting as an agent for the property owner , you must attach an acknowledgement from the property owner that you may act in his/her behalf. 8. Submit an impact statement that specifically responds to each of t he following criteria from Section 5.03 of the Zoning Regulations : (1) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commiss ioners shall either be in place or shall be constructed in conjunction with the proposed use. (2) Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use. (3) Design of the proposed use is organized to minimize impact on and f ro m adjacent uses of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively uti lized areas, access po ints, lighting and signs in such a manner as to protect establi shed neighborhood character. 9. Depending on the type of Conditional Use Permit requested, you may need to respond to additional conditional use review standards in the Garfield County Zoning Resolution Section 5.03. Refer to the Sec tion 5.03 of the Zoning Resolution which can be located on the Garfield County web site at http://www.qarfield-cou nty.com/building and planning/index.htm or call this office. 10. A $400.00 Base Fee: Applicant shall sign the "Ag reement for Payment" form and provide the fee with the application. 11 . Submit 2 copies of this completed application form and all the required subm ittal materials to the Building and Planning Department. Staff wi ll request additional copies once th e conditional use permit application has been deemed technically complete. II. PROCEDURAL REQUIREMENTS (The following steps outline how the Special Use Permit Application review process works in Garfield County.) 1. Submit this completed application form (pages 1-4), base fee, and a ll submittal requirements to the Garfield County Planning Department. It will be received and g iven to a Staff Planner w ho will review the application for technical completeness. 2. Once the application is deemed technically complete, the Staff Planne r w il l send you a letter indicating the application is complete. In addition , Staff will also send you a "Public Notice Form(s)" indicating the time and date of your hearing before the Board of County Commissioners. Prior to the public hearing , Staff will provide you with a Staff Memorandum regarding your requested Conditional Use Permit. (If Staff determines your application to be deficient, a letter will be sent to you indicating that additional information is needed to deem your application complete.) 3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the requested Conditional Use Permit for the public hearing. If proper notice has not occurred, the public hearing will not occur. Notice requirements are as follows : a. Notice by publication, including the name of the applicant, description of the subject lot, a description of the proposed Conditional Use and nature of the hearing , and the date, time and place for the hearing shall be given once in a newspaper of genera l ci rculation in that portion of the County in which the subject property is located at least thirty (30) but not more than sixty (60) days prior to the date of such hearing , and proof of publication shall be presented at hearing by the applicant. b. Notice by mail , containing information as described in the paragraph above , shall be mailed to all owners of record as show n in the County Assessor's Office of lots within two hundred feet (200') of the subject lot and to all owners of mineral interest in the subject property at least thirty (30) but not more than sixty (60) days prior to such hearing time by certified return receipt mail, and receipts shall be presented at the hearing by the applicant. c . The site shall be posted such that the notice is clearly and conspicuously vis ible f rom a public right-of-way, with notice signs provided by the Planning Department. The posting must take place at least thirty (30) but not more than sixty (60) days prior to the hearing date and Is the sole responsib il ity of the applicant to post the notice, and ensure that it remains posted until and during th e date of the hearing. 4. The Applicant is required to appear before the Board of County Commissioners at the time and date of the public hearing at which time the Board will cons ider the Condit ional Use request. In addition, the Applicant shall provide proof at the hearing that prope r notice was provided. 5. Once the Board makes a decision regarding the Conditional Use request, Staff will provide the App licant with a signed resolution memorializing the action taken by the Board . Follo wing the Board's approval, this office will issue the Conditional Use Permit to the app li cant. If the Board's approval Includes specific conditions of approval to be met, th is office will not issue the Official Conditional Use Permit certificate until the applicant has satisfied all conditions of approval. The Conditional Use Permit approval is not finalized until th is office has issued the Official Conditional Use Permit certificate signed by the Chairman of the Board of County Commissioners . GENERAL PROJECT DESCRIPTION Marathon Oil Company (Marathon), as agent for Berry Petroleum Company (Berry), requests a Garfield County Conditional Use Permit (CUP) for warehouse facilities/storage area (Lay Down Yard) to support its natural gas development activities. The proposed facility is located approx imately 17 miles NW of the Tow n of Parachute at an elevation of approximately 8 ,200 feet (Figure 1 ). The fac ility w ill be accessed v ia Garfield County Road 215 north of the Town of Parachute and then via a seri es of private roads. The relatively remote nature of Marathon 's operations necessitates the constru ction of this facility so that equipment and materials may be stored in a central location . The construction of a lay down yard at this location will min imi ze the need for materials to be transported to the area during times of inclement weat her th ereby increasing the safety of Marathon 's operations. Details of this request along with the information required by Garfield County 's CUP application and Sections 3 .10.01, 5.03, and 9.02 of the Garfield County Zoning Resolution of 1978, as amended, are provided below. Figure 2 provides a compliance matrix identifying the sections of this application that address each of Garfield County's requirements . 2. PROJECT LOCATION AND PROPERTY OWNERSHIP The proposed Lay Down Yard is located on approximately 50 acre s of land lyi ng in the SE/4 of the SE/4 of Section 32 , Township 5 South , Range 96 West , 61h Principal Meridian , Garfield County, Colorado (Figure 1 ). The 50-acre pa rcel is owned by Berry, and is located within a larger 880-acre property owned by Berry. This property is located within the Plateau zone of the Resource/Lands zone district and is not in a platted subdivision. The majority of the adjacent properties are currently undergoing oil and gas development. The nearest municipality is the Town of Parachute, approx imate ly 17 miles southeast, and there are no residences within at least a one -mile rad ius of the site . The location of the proposed Lay Down Yard is on property th at is owned by Berry ; a legal d escription of the property is provided in Appendix A. Copies of deeds demonstrating ownersh ip of this property are also contained in Append ix A. Appendix B contains a letter from Berry designating Marathon as its agent in regard to this application . Copies of the applicable maps from the Garfield County Assessor's Offic e ar e contained in Appendi x C, and a map summarizing the adjacent prop erty ownership is provided in Figure 3. Appendix D provides lists of surface or mineral own e rs t hat Ma ra th o n O il Compa ny 1 Lay Down Yar d C UP Oc tober 2 1 , 2 007 require notification of this application. A signed Agreement to Pay Form is included in Appendix E. 3. DETAILED PROJECT DESCRIPTION This section provides details of the proposed design, operation, and ultimate reclamation of the Lay Down yard . This section addresses all of the requirements specified by the Garfield County Zoning Resolut ion of 1978, as amended, as indicated on Figure 2 . 3.1 Site Design The design for the proposed Lay Dowri Yard is provided in Figure 4. As indicated on this figure, this facility will consist of a disturbed area of approximately 12.36 acres which will primarily be a graded surface that will be utilized for storage of materials and equipment. Note that the proposed facility is associated with natural resources , therefore, the ten (10)-acre size limitation specified in Section 5.03.08(5)(E) of the Garfield County Zoning Resolution of 1978, as amended, is not applicable to this fac ility. The site will be graded so that all precipitation that falls on the location will drain to a retention pond in the southeast corner of the location. Diversion ditches to control surface water will also be located along the perimeter of the pad as shown on Figure 4. Additional detail regarding control of Stormwater runoff is provided later in this section. The perimeter of the location will also be fenced to prohibit access to the facility by livestock and wildlife. The fence will consist on chain 6" chain link fence with 3 strands of barbed wire on top with 24' gates required for access. The facility will be accessed via Garfield County Road 215 and then via the existing Garden Gulch Road and other private roads , including a short access road into the facility off of an existing private road (Figure 4). No new or improved accesses onto a County or State roadway will be required or are being proposed. A 50-foot by 80-foot maintenance building will also be erected at the lay down area and will be a pre-engineered quonset-hut style building set on a concrete foundation. Upon approval of this CUP, a building permit will be submitted for the maintenance building will be submitted to Garfield County and will provide the necessary details regarding the structure and its installation. As shown on Figure 4 , the building w ill be located in excess of 100 feet from the exterior boundary of the property. Construction at the site will begin upon approval of this appl ication and is expected to take approximately 2-3 weeks to complete. Ma rath o n Oil Company 2 Lay Down Ya rd C U P October 2 1 , 20 0 7 3.2 Hours of Use and Traffic Considerations The Lay Down Yard will be accessible to Marathon personnel and contractors 24 hours- a-day, 365-days-a-year. The facility will generally be unmanned; however, daily inspections will be conducted by local operation personnel. An analysis of the traffic anticipated to be generated by this project is provided in Appendix I. As indicated in that analysis, the vehicles that will be hauling materials and equipment to this facility during its operation would normally be hauling the same materials and equipment to individual well locations. Therefore , the frequency of vehicle trips to the site after construction is complete is expected to be similar to the current operational frequency . However, because these materials and equipment can be stock piled at the Lay Down Yard during periods of good weather, the presence of this facility will minimize the need for trucks to deliver during inclement weather, significantly increasing the safety of Marathon's operations . The Lay Down Yard is located approximately 10 miles up Garden Gulch Road, an existing private road off of Garfield County Road 215. The road provides safe and adequate access and egress onto and off of Garfield County Road 215 . The construction of the lay down yard would have minimal direct impact to County Road 215, and street improvements would not be necessary. All construction and operations personnel will park on site and will not block or hinder normal traffic on County Road 215. All activities on this site will be conducted out of the right-of-way of County Road 215, and all loading and unloading of vehicles will be conducted out of the public right-of-way . Marathon is finalizing a comprehensive emergency response plan for all of its operations. When this plan has been finalized, it will be submitted to the Garfield County Emergency Operations Coordinator for review. 3.3 Utilities and Sanitation Electrical power and lighting will be supplied by two portable 6-kilowatt (kw) light plants and one 20-kw generator that will be located in the maintenance building. Portable toilets will be used at the site, and documentation regarding arrangements made for the hauling and disposal of sewage from these toilets is provided in Appendix F. No water supply wells are located on this site, nor are any water supply wells planned in the future. Potable water, in the form of bottled water, will be transported from off-site and made available to personnel. No other utilities will be installed in association with the Lay Down Yard. 3.4 Impact Mitigation The primary impacts potentially associated with this facility are -· Marathon Oil Company 3 La y Dow n Yard CUP October 2 1 , 2007 • Traffic and associated impacts • Stormwater runoff • Noxious weeds • Wildlife impacts As discussed in the previous section, the construction of this facil ity w ill result in minor, temporary increases in traffic on County Road 215 and the private roads accessing the facility. Once the facility is in operation, however, the volume of traffic anticipated w ill be very similar to that that would result from Marathon's operations if the facility was not constructed. Regardless of whether there is an increase in traff ic volume , Marathon will implement the following measures to minimize impacts to transportation and roads: • Control dust along unsurfaced access roads and minimize tracking of soil onto paved roads, as required by the CDPHE Construction Stormwater Pe rmit. • Comply with county and state weight restrictions and limitations. • Limit construction and operation traffic speeds to a low and reasonable level. • Keep dusty, exposed areas damp with water or a magnesium-chloride solution or other dust suppressant. • Stabilize traffic areas with gravel. • Revegetate or stabilize non-traffic areas as soon _as practicable . A Stormwater Management Plan (SWMP), detailing the use of s ite-specific Best Management Practices (BMPs), has been prepared for this site and a copy of construction permit application submitted to the Colorado Department of Public Health and Environment (CDPHE) is provided in Appendix G. Implementation of the SWMP will ensure that activities conducted at the site comply with stormwater management regulations as required by Garfield County, the State of Colorado , and the United States Environmental Protection Agency. Implementation of these plans also ensures that construction and operation of this facility will not impact surface runoff, stream flow, or groundwater. In addition , no flammable or explosive solids or gases will be stored on site. Furthermore, the SWMP outlines housekeeping procedures t o prevent materials and wastes for being deposited on the property in such a manner that they may be transferred off the property by any reasonably foreseeable natural cause or force. Some of these measures are: • Storing materials and containerized fluids in a neat and orderly manner; • Placing any wastes requiring temporary storage in sealed containers, then collecting and disposing containers at suitable off- site facilities ; and • Containing sanitary wastes in portable toilets, which will be pumped on a regular basis . As indic ated in th e agreement provided in Appendix F , waste will be transported and disposed of at an approved facility. Marath o n Oi l Com pany 4 Lay Down Yard C U P O ctober 21, 2007 Marathon contracted with Paller & Girard, Inc. to prepare a Noxious Weed Management Plan for this facility and other nearby operations. This plan is included in Appendix H. In addition to the measures that are outlined in this plan, Marathon will implement other measures to prevent infestation of noxious weeds. These measures include seeding cut and fill slopes around the facility to re-establish native vegetation. Section 3 .5 below provides additional detail regarding Marathon's efforts to revegetate the location and control weeds. The potential impacts to wildlife from this facility are discussed in the Wildlife Assessment and Mitigation provided as Appendix J. That assessment discusses several mitigation measures that could be employed . Most of those mitigation measures are associated with revegetation of disturbed soils and prevention of the introduction and spread of noxious weeds. Section 3.5 below d iscusses Marathon's plans for revegetating the location and controlling weeds. It is also anticipated that there may be impacts to wildlife associated with the traffic into and out of the facility . As indicated previously, the volume of traffic associated with this facility is anticipated to be similar to that that would occur if the facility was not constructed; therefore, the construction of this facility will not increase the impact to wildlife from traffic. To the contrary, the fact that materials and equipment can be stock- piled at the Lay Down Yard will minimize the need for truck traffic at night or during other times when wildlife are active and should reduce the potential for vehicle-wildlife collisions. The remote location of this facility and the type of operations that will occur should eliminate many of the other impacts required to be addressed in this applicat io n. No smoke, vibration, heat, radiation or fumes will be produced as a result of the operation of this facility . The topography surrounding the site acts as a visual barrier in most directions, and the site will not be visible from any public roads . Lighting will only be required during unscheduled nighttime maintenance and all lights on the property will be pointed downward and screened to prevent direct reflection on any adjacent property. ·Appendix K provides an analysis of the noise that will be generated during the operation of this facility. As indicated in that analysis, the facility will be operated in compliance with the noise standards set forth in the Colorado Revised Statutes. Adjacenf property will not be affected and a pubic nuisance or hazard will not be created. 3.5 Site Reclamation The facility will be operated for the life of the gas wells in the a re a which is estimated to be 30 years or more . At the end of the econom_ic life of wells in the area, the site will be reclaimed by removing all surface facilities , grading to restore original contours, replacing topsoil, and revegetating the reclaimed area as outlined below. Marathon Oil Company 5 Lay Down Yard CUP October 21, 2007 o During site construction , topsoil will be stockpiled to facilitate reclamation. To the extent possible, topsoil will be placed along the fill slope of the location and revegetated to maintain the viability of the topsoil. The cut and fill slopes of the location will be revegetated with the following seed mix - MixtureNariety Mountain Brome , Bromar Russian Wild Rye, Boziosky Orchardgrass, Paiute Intermediate Wheatgrass , Oahe Regreen 404 Crested Wheatgrass, Hycrest Pubescent Wheatgrass, Luna Pure% 17.35 17.12 16 .84 16.45 14.70 7.25 7 .14 • All foundations associated with the maintenance building will be removed and disposed of appropriately. • The site will be carefully surveyed for any sign of oil , diesel fuel, or gasoline stains and any impacted soil will be excavated and treated and/or disposed of in accordance with applicable regulations. • The site will be returned as closely as possible to the original grade. • The site will be re-vegetated with a selection of grass and shrub species that are consistent with the pre-construction community composition and soil types . Native species will be utilized to the extent possible but sterile grasses may also be used to expedite growth of vegetation to limit erosion and weed invasion until nativ~ species are established . At a minimum, the seed mix specified above will be used; however, the specific seed mix to be utilized will be developed prior to reclamation of the site using the data from Marathon and other operators in the vicinity regarding mixes that are proving to be successful. Marathon will also consult with the Colorado Division of Wildlife (DOW) to determine if there are specific plant species that could be used that will enhance wildlife habitat. The seed mix that will be used for reclamation will be provided to Garfield County prior to any reseeding taking place. To maximize the potential for successful revegetation of the site, seeding will take place in the fall or prior to May 15, if spring planting must occur. If initial attempts to revegetate the site prove unsuccessful, Marathon will reseed the location until the location has been revegetated. • All seed mixes and mulch used during reseeding will be certified as weed free. • Marathon will require that all construction equipment arrive at each location clean to prevent the importation of noxious weeds. Consistent with Marathon's weed management plan provided in Appendix H, active measures will be taken as necessary to control the spread of noxious weeds . All such measures will be in accordance with Garfield County's Weed Management Plan. If deemed necessary by the County Commissioners, Marathon will provide financial assurance for the purpose of ensuring the proper reclamation and closure of the facility. The Base Fee is an estimate of the average number of hours of staff time devoted to an application, multiplied by an hourly-rate for the personnel involved. Methods of Treatment: Chemical: Due to the nature of average weed infostations, chemical treatments wilJ be the most effective and cost efficient. Herbicides will be applied by truck mounted power sprayers, ATVs and/or backpack sprayers as appropriate-for each individual situation. Specific herbicides and application rates for commonly occurring noxious weeds are included in the attached document (Appendix A). Herbicide treatments of noxious weeds, if necessary, are expected to begin in the month of June at this elevation and continue thru August. Mechanical: Annual and Biennial noxious weeds may be controlled by chopping the root below ground level with a shovel or hoe. This method can be used by Marathon field personnel when individual plants or small infestations are encountered . Evaluation of Treatments and Follow-up Treatments All treatments will be evaluated for efficacy in the fall and re-treatment will be perfonned if necessary. WestWater Engineering Page 3 of 6 pages Au g ust 10, 2007 Discussion The site is an open, shrubby, meadow in a narrow valley formed by House Log Gulch, a tributary to Red Gulch above the West Fork of Parachute Creek. Aspen, Populus tremuloides, wood lands cover ridge tops and pockets in dry arroyos. The aspen woodlands on steep er s lopes above and adjacent to the site provide high qua lity habitat for mule deer (see Phot o 1), elk, black bear, Cooper's hawks, Swainson's hawks, and cavity nesters like the do wny woodpecker and northern flicker . Photo 2 is a Red-tail ed Hawk, observed during the onsite examination. The Wyoming big sagebrush (Artemesia tridentata wyomingensis) -need legrass (Stipa spp .) plant community (see Photo 3), dominated by Wyoming big sagebrush, is within the overall range of the great er sage grouse. Structure of shr ubs and adjacency to wet meadows and streams provide excellent brood r earing habitat. Wet meadow and stream s produce succul ent herbaceous pl ants and insects, important to nesting greater sage grouse and survival of their young. Grazing intensity by lives tock and wi ldlife is low and well within the capacity of the vegetation community to produce sufficient forage. Heavy browsing of older, senescent serviceberry (Amelanchier alnifolia) by mule deer was evident around the site (see Photo 4). Photo 2. Senescent service berry Within the overall range of greater sage grouse, the area around the site meets criteria for brood rearing habitat, a particularly important habitat component of sage grouse overall range. In dcy years, insufficient brood rearing forage leads to low recruitment of young-of-the-year going into the winter. The quality of the sage grouse habitat is tempered somewhat by large numbers of standing, dead aspen, w hich create excellent hunting perches for hawks and, to a lesser extent, golden eag le s. Gently sloping sagebrush meadows surrounded on three sides with aspen woodlands provide hi gh quality transitional and summer range for mule deer, elk and black bear. Foraging by all three species was evident. Workers onsile have recently observed a black bear. Wildlife Mitigation and Management Recommendations Migratory Birds and Wildlife. Potential oil ski ms on the proposed produced water storage ponds and h igh salt content could res ult in mortality of birds or mammals that attempt to use the ponds or accidentally fall into the ponds. This is likely to be a concern with the U .S. Fish and Wildlife Service and the Colorado Division of Wildlife. Appropriate fencing and nettin g of the ponds to exclude wildlife would help to reduce potential impacts. Improve Greater Sage Grouse Habitat. Sage grouse brood rearin g habitat could be improved by excluding livestock, particularly cattle, from creek bottoms and wet meadows a long creeks . Evidence of cattle loafing could be seen in wetlands in House Log Gu lch at the time of inspection. Degradation of the wetland s reduces capacity of wetlands to produce insects and herbaceou s forage critical to sage grouse in their annua l cycle. Additionally, regulated noxious weeds including houndstongue (Cynoglossum officinale) and mu sk thi stle, Carduus nutans, were observed in House Log Gulch and adjacent meadows. These invasive species degrade sag e grouse and other wil dlife habitat by rep lacing native vegetation. Catt le loafing disturbs soils and increases opportunities for invasive species to gain hold. WestWater Engineering Page 5 of 6 pages August 10 , 2007 Minimize footprint of disturbance. Reduce t o the minimum level possible all soil disturbing act ivities. Park co nstruction vehicles on previous ly disturbed lands during construction to further reduce temporary disturbance. Re-seeding. Temporary and permanent disturbances are recommended to be re-seeded with native grasses. These measures should be described in an Integrated Vegetation and Noxious Weed Management Plan for this site. Best management practices such as the imprinting of un- vegetated slopes to reduce rill erosion should be implemented. Fence Removal. Wildlife un-friendly fences are located adjacent to th e site. If possible, old fence is recommended to be removed to enhance safe wi ldl ife movement. Black Bear Measures. It is not only unsafe, but illegal to feed bears . Keep all tra sh and food waste in bear-proof containers. Put dog food and bowls and cooking appliances and utensil s in bear-proof storage at night. Black bears will rarely attack; however, if they are surprised, fee l danger, wish to protect territory or if they have cubs they may attack. The best way to avoid danger is to avoid bears. When walking or traveling through bear territory make a lot of noise. If you see a black bear, make sure he sees you. Hold your arms high above your head us ing a coat or outer garment to make yourse lf appear larger. Continue to make noise and slowly back away. If you run the bear will likely chase you. If the bear comes for you, climb a tree or drop to a fetal position. Cover you head and neck with your hands. Once the bear realizes you are not a threat he may leave . Sound readings were colle cted on Aug~st 2"d, 2007, at four location s on the edge of proposed Lay Down yard site and at two locations near the proposed Water Storage Facility (s ee attached figures). Sound meas urements were collected using a calibrated TES 1350A sound level meter se t to collect general noise measurements (db(A)). In accordance with Rule 802 of the Colorado Oil and Gas Co nservation Commission (COGCC ) Rules and Regulations, entitled "Noise Abatement," sound meas urements were collected each minute for 15 minutes and then averaged . These averages are provided on the attached figures. Sound meas urements ranged from between 34.4 and 38.9 db(A) at the proposed L ay Down Yard site , and between 33.0 and 33.3 at the proposed Water Storage Facil ity. The only so und-generating equipment that will b e associated with these fac ilities are a generato r and portable li ght-plants at the Lay Down Yard. Although the specific generator that will be in sta lled at this locati on is not currently known, it is anticipated to be similar to the one shown in Attachment A. As indicated on the specifications sheet for this generato r, th e sound produced by the generator is 62 db (A) measured at a di stance of 23 fee t from the generato r. This generator will b e installed within a quonset-hut typ e building a nd will be lo cated in excess of 200 feet from the property boundary. Similarly, the specific li ght plants that will be procured for this location are not known but are anticipate d to be similar to tho se shown in Attachment B. The specification s sheet for these plants indicates that they generate 69 db (A) on average during operation. Again, these plants will be located within the interior of th e fac ility away from the property boundaries. The c hange in so und press ure, as meas ured in deci be ls (db), with distance from the noise source can be calculated using the following e quati on: SPL = 10 *log(l2/ll) Where SPL is the change in sound pressure level between two relative intensities (12 and 11 ). Dear Mr. Jarman and Mr. Richardson I received your response to Marathon's submittal for a Conditional Use Permit (CUP) for a Lay Down Yard facility to support its natural gas development activities . That letter indicated that there is no use defined as a 'lay down yard' in the Plateau sub zone and requests several studies for traffic, wildlife and noise impacts. While Marathon agrees that a 'lay down yard' is not defined and was ou r error in term versus storage area I yard we disagree with the requirement to provide engineered studies for traffic, wildlife and noise impacts. Storage is a use within in the definitions under the Industrial Operations Section 5.03 .07 in which the requirements are noted, and of which Marathon has supplied within the CUP application. These are impact statements to include adjacent land, wildlife, traffic, mitigation, reclamation of the site, security plan, dis.tance from o.ther land owners and a detail project description with site plan. There is no stated code requirement for engineered studies . Additionally we would like to note that our submittal mirrored other submittals to the County that have been approved in the recent past. These include : 1 . Hyrup Amine Facility SUP approved in June 2006 2. Hyrup Evaporation Pond SUP approved in April 2006 3. Chevron North Clear Creek Construction Materials Mine CUP approved in March 2006. ( We have made the necessary change in term to the filing to make it technically complete, but respectfully request that Garfield County be mindful of consistency when reviewing permit applications and when interpreting the code. If engineered studies are required then possibly a text change should be initiated by the County to clearly state that in the code.
