APPLICATION SUBMITTAL REQUIREMENTS As a m inimum , specifically respond to all the f~lowing items below and attach any additional infonnation to be submitted with this application: 1. Submit plans and specifications for the proposed use including the hours of operation , the numbe r and type of vehicles accessing the site on a daily, weekly and/or monthly basis, and the size of any existing and/or proposed structures that will be used in conjunction with the proposed use. Please submit the specific information in narrative form and be specific. -------....•. ·--···-' -·-------·- 2 . If you will be using water or will be treating wastewater in conjunction with the proposed use , please detail the amount of water that would be used and the type of wastewater treatment. If you will be utilizing well water, please attach a copy of the appropriate well permit and any other legal water supply information, including a water allotment contract or an approved water augmentation plan to demonstrate that you have legal and adequate wator for the proposed use. 3 . Submit a site plan /map drawn to scale that portrays the boundaries of the subject property, all existing and proposed structures on the property, and the County or State roadways within one (1) mile of your property. If yuu are proposing a new or expanded access onto a County or State roadway, submit a driveway or highway access permit. _.4. Submit a vicinity map showing slope I topography of your property, for which a U.S.G .S. 1 :24,000 scale quadrangle map will suffice . ..,.S . Submit a copy of the appropriate po!1ion of a Garfield County Assessor's Map showing all mineral rights owners of the subject property and public and private landowners adjacent to your property. In additional, submit a list of all property owners and their addresses adjacent to or within 200 ft . of the site. This information can be obtained from the Assessor's Office. - 6 . · Submlt a copy of the deed and a legal description of the subject property. 7. If you are acting as an agent for the property owner, you must attach an acknowledgement from the property owner that you may act in his/her behalf. 8 . Submit an impact statement that specifically responds to each of the following criteria from Section 5.03 of the Zoning Regulations: (1) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use. (2) Street Improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use . . (3) Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character. 9. Depending on the type of Conditional Use Permit requested, you may need to respond to additional conditional use review standards in the Garfield County Zoning Resolution Section 5.03. Refer to the Section 5.03 of the Zohing Resolution which can be located on the Garfield ) County web site at pttp:/fv.Jww .garfield -county .cg_rn/building_ and planning/jndex.htm or call this office . 10. A $400.00 Base Fee: Applicant shall sign t he "Agreement for Payment" form and provide the fee with the application . 11. Submit 2 copies of this completed application form and all the required submittal materials to the Building and Planning Department . Staff will request additional copies once the conditional use permit application has been deemed technically complete. IL PROC~DURAL REQUIREMENT& (The following steps outline how the Conditional Use Permit application review process works in Garfield County.) 1. Submit this completed application form (pages 1-4), base fee , and all submittal requirements to the Garfield County Planning Department. It will be received and given to a Staff Planner who will review the application for technical completeness . 2 . Once the application is deemed technically complete, the Staff Planner will send you a lette r indicating the application is complete . In addition, Staff will also send you a "Public Notice Form(s)" indicating the time and date of your hearing before the Board of County Commissioners. Prior to the public hearing, Staff will provide you with a Staff Memorandum regarding your requested Conditional Use Permtt. (If Staff determines your application to be deficient, a letter will be sent to you indica ti ng that addit iona l information is needed to deem your application complete.) 3. It is solely the Applicant's responsibility to ensure proper noticing occu rs regarding the requested Conditional Use Pennit for the public hearing. If proper notice has not occurred, the public hearing will not occu r. Notice requirements are as follows: a. Notice by publication, including the name of the applicant, description of the subject lot, a description of the proposed Conditional Use and nature of the hearing, and the date, time and place for the hearing shall be given once in a ne ws paper of general circulation in that portion of the County in which the subject property is located at least thirty (30) but not more than sixty (60) days prior to the date of such hearing, and proof of publication shall be presented at hearing by t he applicant. b. Notice by mail, containing information as described under paragraph (1) above, shall be mailed to all owners of record as shown in the County Assessor's Office of lots within two hundred feet (200') of the subje ct lot and to all owners of mineral interest in the subject property at least thirty (30) but not more than sixty (60) days prior to such hearing time by certified return receipt mail, and rece ipts shall be presented at the hearing by the applicant. c. The site sh a ll be posted such that the notice is clearly and conspicuously visible from a public right-of-way, with notice signs provided by the Planning Department. The posting must take place at least th irty (30) but not more than sixty (60) days prior to the hearing date and is the sole responsibility of the applicant to post the notice, and ensure that it remains posted until and during the date of th e hearing . 4 . The Applicant is required to appear before the Board of County Commissioners at the time and date of the public hearing at which time the Board will consider the Conditional Use request. In addition, the Applicant shall provide proof at the hearing that proper notice was provided. 5. Once the Board makes a decision regarding the Conditional Use request, Staff will provide the Applicant with a signed resolution memorializing the action taken by the Board . Following the Board's approval, this office will issue the Conditional Use Permit to the applicant. If the Board's approval includes specific conditions of approval to be met, this office will not issue the Official Conditional Use Permit certificate until the applicant has satisfied all conditions of $pproval. The Conditional Use Permit approval is not finalized until this office has issued the Official Conditional Use Perrnit certificate signed by the Chairman of the Board of County Commissioners. PROPOSED PLAN FOR SHOP The proposed plan is to move my sole proprietorship business (The Woodworks) to my own personal property of 35.95 acres. I have owned and operated this business since 1976 (27 years), the last 23 Y2 years being located in the town of Silt. Hours of operation will be 1 O am - 6 pm, Monday thru Friday. There will be UPS deliveries approximately 6-8 times per year. All other material will be brought in by my own transportation . There may be 2 - 4 vehicles per week accessing the site, or there could be O vehicles per week. There will be no large trucks accessing the site. The Woodworks is my one-man shop where I manufacture cabinets and wood furniture from raw lumber and plywood products . I have had no complaints from any of my neighbors in the town of Silt in my 23 years here. My current shop has a main street access and is adjacent to the Senior Housing Unit across the alley. The Proposed structure is a 30' x 80' post and beam building with 30' x 60' enclosed and a 20' carport exposed on two sides. I will be using well water from our personal well (see enclosed perm it). The septic system is new due to the age of the previous septic system , and has been inspected by the Garfield County Inspector. The approximate usage based on my current usage in Si lt would be approximately 750 gallons per month. The new septic system on our property was designed to accommodate the proposed usage and is adequate to handle the small volume. It is essentially the same usage as it would be if I were at my home all day. A water heater, a shop sink, and a Y2 bath with a urinal for water conservation will be the complete shop water system . Site Description: The subject property is located a 'h mile south on Mamm Creek . The property contains approximately 3 5 acres . The shared driveway defines the eastern boundary of the property. The property is fairly flat and sparsely vegetated . The southwest portion of the property drops off sharply to County Road 315 . The property is improvement with a single- family residence, a garage on a foundation , a small wood shed, and a number of ranch I agricultural machinery and parts scattered ne ar the improvements . Aside from the improvements, a good portion of the property is irrigated pastures . There is a pond on the northern most corner of the property . An irrigation ditch traverses the property in a northwest I southeast direction . C. Description : The Applicant has owned and operated "The Woodworks" since 1975 , and has been located in the Town of Silt the last 23 'h years . The Woodworks is a one-man business, where the Applicant manufactures cabinets and wood furniture from raw lumber and plywood products . Billmeyer CUP BOCC : 6116 103 Page2 The Applicant is proposing to erect a 30 ' X 80 ' (2,400 sq . ft .) post and beam building . Approximately 1,800 sq . ft. (30' X 60') will be enclosed for the home occupation, and 600 sq . ft . will be used for a carport, exposed on two sides. The location of the structure can be seen in the photograph to the right. The yellow ribbon represents the approximate location of the 1,800 sq . ft . portion of the structure, and the red tape, adjacent to the existing garage, represents the 600 sq . ft. carport area. The Woodworks will operate within the confined of the new building .__I he Applicant has provided with the application plans for the proposed building . The Applicant asserted that no sawdust or by-products will emanate from the structure, nor will there be any excessive noise . The Applicant has noted that the hours of operation will be from I 0 am to 6 pm , Monday thru Friday. There will be approximately 6 to 8 UPS deliveries per year. Raw materials are brought to the site by the Applicant. The Applicant is anticipating 2 to 4 vehicle trips per week associated with the home occupation, however, some weeks there may not be any . There will be no large truck accessing the site. D. Zoning: The subject property is zoned AIR/RD . Pursuant to section 2 .02 .29 of the Zoning Resolution, "Home Occupation" is defined as "any use for gain or support carried on a s an accessoty use within a dw elling or building accessory there to, wherein such use would not cr eate the appearance of impact of a c ommercial activity." Although the type of home occupation proposed falls under the definition of"Fabrication", which is not a use allowed in the AIR/RD zone district, it is staff opinion that since the request is for a Home Occupation and meets the definition of a home occupation, the standards outlined in Section 5.03 .07, Industrial Operations, of the Garfield County Zoning Resolution should not apply . E . Relationship to the Comprehensive Plan: The subject property is desig nated on the "Proposed Land Use Districts, Study Area 2 & 3" map in the Garfield County Comprehensive Plan of 2000 , as "Outlying Residential." Outlying Residential is consistent with the underlying zoning, which in the case of A I R I RD is a minimum lot area of 2 acres . In addition , the property is located within the Rifle Annexation Boundary. This application was not referred to the City of Rifle or the Town of Silt for comments. F . Adjacent Land Uses : 1. North: Vacant Land 2 . West: Vacant Land, CR 315 . 3 . East: Vacant Land, irrigated pastures. 4 . South : Vacant Land, agricultural improvements . G. Road/ Access : The primary access to the subject area is an existing driv eway off of County Road 315 . H. Applicabi lity : Pursuant to Section 9 .02.03 of the Zoning Resolution , an application for a Conditional Use Permit shall be approved or denied by the Board of County Commissioners after holding a public hearing thereon in conformance w ith all provisions of the Zoning Resolution. Conditional Uses are subject to the standards set forth in Section 5.03 of the Zoning Resolution. This section states that utilities adequate to provide water and sanitation service, street improvements, and design of the proposed use to minimize impact through various means shall be provided. Impacts are expected to be minimal due to the small nature of the proposed home occupation. These issues are discussed in detail in the body of this report. II. REVIEW AGENCY AND OTHER COMMENTS: This application was not referred out to any review agencies for comments. ID. REVIEW CRITERIA FOR CONDITIONAL USE PERMITS (SECTION 5:03) Pursuant to Section 5 .03 , as listed under the Zone District Regulations , conditional uses shall conform to all requirements listed there under and elsewhere in the Zoning Resolution , as well as the following standards: 1. Utiliti es adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use. Response: The ex isting well that serves the subject property is located on the property immediately to the northeast. There is a n easement for this well . The Applicant is proposing to use the existing well for a water heater, a shop sink and a Yi bath with a urinal which will be Billmeyer CUP BOCC: 6/16/03 Page 4 installed in the new structure. A well permit has been provided with the application, however, the permit has the name of the previous property owner. The name of the well permit should be changed to reflect the currently property owner, the Applicant. A new septic system has been installed on the property. The Applicant has provided a permit issued by the County in March of this year. The Applicant asserted that the new septic system has been designed to accommodate the proposed usage associated with the home occupation. 2. Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use. Response: Access to the property is an existing shared driveway off of CR 315. Some improvement, per the Garfield Road and Bridge Department, are required where the driveway intersects with CR 315. 3. Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphe1y of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character. Response: Due to the location of the property, the existing improvements, as well as the proposed structures, are I will not be visible from adjacent neighbors or the county right-of-way. No signage is anticipated. No fencing or landscaping is not proposed. There will be one motion light to illuminate the walkway between the house and the structure. The color of the building will blend in with the existing home and garage, which are both a tan color. There will be few extra windows within this structure. It is staff's opinion that the home occupation and associated structure shall not impact adjacent land uses. IV. ADDITIONAL COMMENTS 1. A letter of support (Exhibit B) from a mineral owner was submitted . V. SUGGESTED FINDINGS 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting . That for the above stated and other reasons, the proposed conditional use permit is in the best interest of the health , safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. RECOMMENDATION Staff recommends APPROVAL, with the following conditions: 1.
