Garfield County Zoning Board of Adjustment

As yo u know, this firm represents Bernard and Ma rtha Lon g . In that r egard, w e
would like to thank you for your consideration of my cli e nt's position with regard t o the
above-captio n ed zo ning compliance matter. I am in receipt of your February 7, 2005 l etter
(postmarked February 8, 2005 and receive d February 9, 2005) making administrati ve
interpretation that the presence of a kitchene tt e in the basem ent of the primary r esiden ce
located a t 8153 312 Co unty Road, New Castle, Colorado created a per se zoning violation
under the Garfield Co unty Zoning Regulations in th a t either (i) a two-fa mily dwelling unit
is created (S ec tion 2.02.21) or (ii) a n "ap artm e nt" is creat ed (a s refe ren ce d in your initial
notice letter of November 29, 2004).
As co nveyed by my correspondence to your offic e dated February 2, 2005, w e
beli eve tha t th e current m atter is subj ect to factua l iss u es a nd differing reasonable

interpre tations. To that end, I res pectfully submit the disputed inter pretation of the current
u se of the s ubj ec t property to the Garfield County Zoning Board of Adjustments (th e
"Board") pursuant to Garfield County Zoning Regulation 9 .04 .
In the event the administrative d e termination of the Compliance Officer is upheld
by th e Board following a h ea ring, w e resp ec tfully r equest a reasonably s ufficient st ay of
any furth er action pending my clients' preparation, applicati on and processing of a zoning
variance reques t pursuant to Garfield County Zoning Regulation 9.05, given the unique
circumstances surrounding this matter.
As a m atter of clarifica tion, at a m eeting, prior to my involvement, be tween my
clients and official s of the Garfield County Building and Planning Departme nt, a d e finition
of "Dwelling Unit" as "Any building or portion thereof which contains living faciliti es,
sleeping, eating, cooking and sanitation for not more than one (1) family." The definition
appears to d erive from a Garfield County Zoning Regulation (or so me other regulatory
docume nt) li st of d efinition s as Section 2:20.17. In an alyzing thi s zoning co mpliance i ss u e,
I h av e relied upon the language in the most recent, available form of the Garfield County
Zoning Regulation Section 2.02.19 which defines "Dwelling Unit" as "One (1) or more
room s in a dwelling occupied by one (1) family living independe ntly of any other family ."
Additionally, I have relied upon the d efinitions of: "Dwelling'' (S ec tion 2.02.18); "Dwelling,
Single Family'' (S ec tion 2.02.20); "Dwelling, Two Family'' (S ec tion 2.02.21); a nd "Family"
(S ec tion 2.02.24).
To m y mind, ther e exis t subtle distinctions, influenced by factual circumsta n ces,
b e tween the d efinition s b ein g relied upon by (a) the Garfield County Building and
Planning De p artm ent; and (b) my cli ents. Pl ease advis e m e, in ad vance of any sc h edul ed
h earing before the Board, pursuant to the within appeal of administrative offi cer's
decisions, as to which of the se ts of d efiniti ons is applicable to the current dispute.
I would like t o again reiterate or appreciation for your office 's professional and
cooperative efforts to resolve thi s issue . Please incorporate our prior corres pondence in the
App eal file. Do n o t h esitate to contact me with any questions or requests for additional
informa tion or d oc umentation .
