The above referral was received by the Town of Parachute regarding development in the Parachute
area, this development may not increase the overall volume of traffic on County Road 215 or
through the Town of Parachute but the Town Board still has concerns about the traffic as drilling
increases so does the traffic.
Does the County have any plans to improve County Road 215 as the drilling increases?

Dear Katy:
A review has been performed of the documents for the Conditional Use Permit application submittal
of the Petroleum Development Corporation Lay down Yard. The package was found to be thorough
and well organized. The following comments, questions, or concerns were generated:
I. The criteria to determine successful site reclamation is proposed to be an inspection by the
Director. This should by more specifically the Garfield County Vegetation Manager.
2. No review was performed for the infrastructure concerning the employee housing.
3. Site construction exceeds one acre of site disturbance. Permitting may be required from the
State of Colorado for Stormwater Discharges Associated with Construction Activity.

Revegetation
Revegetation Plan-The applicant has submitted a revegetation plan that includes a plant materials list.
Revegetation Security-It is the recommendation of this department that the applicant post a revegetation
security for the laydown yard, since this project may be long-term, the recommended rate per acre for
revegetation will higher than the short-term rate.
Staff recommends a revegetation security of $11,000 (2. 75 acres x $4,000)
The security shall be held by Garfield County until vegetation has been successfully reestablished
according to the Reclamation Standards in the Garfield County Weed Management Plan. It is the
responsibility of the applicant to contact the County, upon successful revegetation establishment, to request
an inspection for bond release consideration.
All bales used in erosion control must be certified as weed free straw or mulch

2. The equipment storage area is not placed any closer than 300 ft. from
any existing residential dwelling.
3. All equipment storage will be enclosed in an area with screening at
least eight (8) feet in height and obscured from view at the same
elevation or lower. Screening may include berming, landscaping, sight
obscuring fencing or a combination of any of these methods.
4. Any repair and maintenance activity requiring the use of equipment
that will generate noise, odors or glare beyond the property boundaries
will be conducted within a building or outdoors during the hours of 8
a.m. to 6 p.m., Mon.-Fri.
5. Loading and unloading of vehicles shall be conducted on private
property and may not be conducted on any public right-of-way.
(E) Any storage area for uses not associated with natural resources, shall not
exceed ten (10) acres in size.
(F) Any lighting of storage area shall be pointed downward and inward to the
property center and shaded to prevent direct reflection on adjacent property.
(6) Water pollution: in a case in which potential hazards exist, it shall be necessary to
install safeguards designed to comply with the Regulations of the Environmental Protection
Agency before operation of the facilities may begin. All percolation tests or ground water
resource tests as may be required by local or State Health Oflicers must be met before
operation of the facilities may begin.
VII. RECOMMENDED MOTION
"I will make a motion to approve a Conditional Use Pe1mit for Storage for the Petroleum
Development Corporation Laydown Yard with the conditions provided by Staff."

11. That the Applicant shall comply with the following requitements of the County Road and
Bridge Department:
a. All vehicles hauling equipment and materials for the construction of the project and
for storage will comply with Garfield County's oversize/ overweight permit system.
b. A letter from Petroleum Development Corporation stating what companies can
obtain oversize/ overweight permit operating under their bond posted with Garfield
County will be sent to Garfield County Road & Bridge Department before any
permits will be issued to said companies.
12. All project activities shall be requited to comply with the following performance
standards:
(1) Volume of sound generated shall comply with the standards set forth in the Colorado
Revised Statutes at the thne any new application is made.
(2) Vibration generated: every use shall be so operated that the ground vibration
inherently and recurrently generated is not perceptible, without instruments, at any point of
any boundary line of the property on which the use is located.
(3) Emissions of smoke and particulate matter: evety use shall be operated so as to
comply with all Federal, State and County air quality Jaws, regulations and standards.
(4) Emission of heat, glare, radiation and fumes: every use shall be so operated that it
does not emit heat, glare, radiation or fumes which substantially interfere with the existing
use of adjoining property or which constitutes a public nuisance or hazard. Flaring of
gases, aircraft warning signals, reflective painting of storage tanks, or other such operations
which may be required by law as safety or air pollution control measures shall be exempted
from this provision.
(5) Storage area, salvage yard, sanitaty landfill and mineral waste disposal areas:
(A) Storage of Dammable or explosive solids or gases shall be in accordance with
accepted standards and laws and shall comply with the national, state and local tire
codes and written recommendations / comments from the appropriate local
protection district regarding compliance with the appropriate codes;
(B) At the discretion of the County Commissioners, all outdoor storage facilities
may be required to be enclosed by fence, landscaping or wall adequate to conceal
such facilities from adjacent property;
(C) No materials or wastes shall be deposited upon a property in such form or
manner that they may be transferred off the property by any reasonably foreseeable
natural causes or forces;
(D) Storage of Heavy Equipment will only be allowed subject to (A) and (C)
above and the following standards:
1. The minimum lot size is five (5) acres and is not a platted subdivision.

that demonstrates that the proposed use will not exceed the state's noise guidelines.
3. Volume of sound generated shall comply with the standards set forth in the Colorado
Revised Statutes.
4. Vibration generated by the storage site shall be so operated that the ground vibration
inherently and recurrently generated is not perceptible, without instruments, at any point of
any boundary line of the property on which the use is located.
5. Emissions of smoke and particulate matter by the storage site shall be so operated so as to
comply with all Federal, State and County air quality laws, regulations and standards.
6. Emission of heat, glare, radiation and fumes: The storage site shall be so operated that it
does not emit heat, glare, radiation or fumes which substantially interfere with the existing
use of adjoining property or which constitutes a public nuisance or hazard.
7. The Applicant shall provide an approved commercial portable chemical toilet on site. The
portable chemical toilet shall be maintained and in sanitary conditions at all times. The
Applicant must provide a contract with a service company establishing maintenance of the
portable chemical toilet prior to issuance of the Conditional Use Pennit.
8. That the Applicant shall provide a wildlife analysis of the project prior to issuance of the
CUP that demonstrates that the proposed use will not impact wildlife in the area.
9. The Applicant must install an 8-foot chain-linked fence around the perimeter of the site
which also requires a building pe1mit.
10. That the Applicant shall comply with the following requirements of the County Vegetation
Management Department:
a. The Applicant shall submit a reclamation bond of $11,000 to Garfield County for
the reclamation of the disturbance prior to the issuance of the Conditional Use
Permit. The security shall be held by Garfield County until vegetation has been
successfully reestablished according to the Reclamation Standards in the Garfield
County Weed Management Plan. It is the responsibility of the applicant to contact
the County, upon successful revegetation establishment, to request an inspection for
bond release consideration.
b. Please submit an inventOl')' of county listed noxious weeds on a weed map prior to
issuance of the CUP.

Response
These aforementioned performance standards shall be considered conditions of approval should the
Board move to approve the Conditional Use Permit.
V. RECOMMENDED FINDINGS
1. The meeting before the Board of County Commissioners was extensive and complete, that
all pertinent facts, matters and issues were submitted and that all interested parties were
heard at that meeting.
2. Staff finds that the project results in limited impacts to surrounding properties due to its
highly remote location within the subject property, on the Plateau with no residential uses
within miles of the location, and is surrounded by gas drilling activities;
3. That by proceeding with this proposal there will be an overall decrease m traffic on
unimproved roadways and county roads which will promote safety and wellbeing;
4. That the proposed facility meets the requirements set forth in Section 5.03, 5.03.07 and
5.03.08 with the exception of the requirement of a wildlife report and sound analysis that
shall be required prior to issuance of the CUP;
VI. STAFF RECOMMENDATION
Due to 1) the extreme remote location of the storage area centrally located on a 5,000-acre property,
2) limited nature of potential impacts, and 3) the reduction of traffic on the County Road System,
Staff recommends the Board approve the request for a Conditional Use Permit for Storage for the
Petroleum Development Corporation Laydown Yard with the following conditions:
1. That all representations of the Applicant, either within the application or stated at the
hearing before the Board of County Commissioners, shall be considered conditions of
approval unless explicitly altered by the Board.
2. That the Applicant shall provide a noise analysis of the project prior to issuance of the CUP
Revised Statutes at the time any new application is made.

(2) Vibration generated: eveiy use shall be so operated that the ground vibration inherently
and recurrently generated is not perceptible, without instruments, at any point of any
boundary line of the property on which the use is located;
(3) Emissions of smoke and particulate matter: eveiy use shall be operated so as to comply
with all Federal, State and County air quality laws, regulations and standards;
(4) Emission of heat, glare, radiation and fumes: eveiy use shall be so operated that it does
not emit heat, glare, radiation or fumes which substantially interfere with the existing
use of adjoining property or which constitutes a public nuisance or hazard. Flaring of

The site wlll be seeded before May 15 If seeding takes place during the spring and b<;Jfore August 30 (and the
deep freeze) If seeding takes place In the fall. The site will be drill seeded with a rangeland drill to one-Mff or
one-quarter Inch on slopes 3:1 or fiaUer. Slopes steeper than 3;1 or areas inaccessible by drill seeding
equipment wlll be broadcast seeded followed by harrowing or hand raking to lightly cover the seed with soil.
All areas will be mulched within 24 hours after seeding. Mulch will be certified weect-.iroo straw or grass hay.
Grass hay will be applied at 1 % tons per acre; straw mulch will be applied at 2 tons per acre. Mulch material
will be crimrsd into the soil surface with a commercial mulch crimper, a straight disk, or bulldozer tracks r.
olherwise too steep to other crimp !he mulch in place.
The seed mixture will contain a diverse range of species specific to the site and approximating the surrounding
undisturbed area_ The seed mlxlure wm also support the post-disturbance land usft--livestock grazing.
(B) The County Commissioners may require security before a permit for special or
conditional use is issued, if required. The applicant shall furnish evidence of a
bank commitment of credit, bond, certified check or o"ther security deemed
acceptable by the County Commissioners in the amount calculated by the County
Commissioners to secure the execution of the site rehabilitation plan in
worlananlike manner and in accordance with the specifications and construction
schedule established or approved by the County Commissioners. Such
commitments, bonds or check shall be payable to and held by the County
Commissioners;
Response
The County Vegetation Manager reviewed the proposal and that the recommended rate per acre for
revegetation will be higher than the short-term rate since this project may be long-term. It is
suggested that we require a bond of $4000 per acre, thus, the revegetation security required is a bond
total of $11,000.
(C) Impacts set forth in the impact statement and compliance with the standards
contained in Section 5.03.08 ofthis Resolution. (A. 93-061)
Section 5.03.08 Industrial Performance Standards
Industrial Performance Standards: All industrial operations in the County shall comply with
applicable County, State, and Federal regulations regulating water, air and noise pollution
and shall not be conducted in a manner constituting a public nuisance or hazard.
Operations shall be conducted in such a manner as to minimize heat, dust, smoke,
vibration, glare and odor and all other undesirable environmental effects beyond the
boundaries of the property in which such uses are located, in accord with the following
standards;
(1) Volume of sound generated shall comply with the standards set forth in the Colorado

decrease traffic on the County Road System and the Town of Parachute because the bulk of the
material will be hauled on private roads on the plateau located in Puckett property. Traffic would
increase the travel to this specific site only. One semi-trailer, 6-9 pick-up trucks or larger will be
accessing the site during a week period. The laydown yard will be covered with 6 inches of gravel to
minimize dust.
A driveway access is already established for access to the requested area and meets the driveway
access design standards for Garfield County Road & Bridge Department. Access to the property is
located off of County Road 215. PDC states that the laydown yard will decrease traffic on County
Road 215 and decrease potential wildlife crossings at County Road 215.
The County Road and Bridge Department provided the following comments regarding the project's
impact to the county road system: 1) all vehicles hauling equipment and materials for the
construction of the project and for storage will comply with Garfield County's oversize/ overweight
permit system. 2) a letter from Petroleum Development Corporation stating what companies can
obtain oversize/ overweight permit operating under their bond posted with Garfield County will be
sent to Garfield County Road & Bridge Department before any permits will be issued to said
comparues.
{E) That sufficient distances shall separate such use from abutting property which
might otherwise be damaged by operations of the proposed use(s);
Response
The proposed site is located 2. 75 miles from County Road 215 and no residence is visible from the
site. It is centrally located in the 5,000 acre property. Additionally, the physical / geographic location
of the site area is remote such that views from the south will not be impacted by the use.
(2) Pennits may be granted for those uses with provisions that provide adequate mitigation
for the following:
(A) A plan for site rehabilitation must be approved by the County Commissioners
before a pennit for conditional or special use will be issued;
Response
The representative proposes a reclamation plan that will restore the site to the original contours.
There is very little vale to the topsoil of this complex. The shallow geology on the Roan Plateau is
characterized by thin soil layers overlying shallow shale bedrock. The application states that the
most reasonable method to reclaiming the site will be to rip the site to 18 inches and recontour as
nearly possible to the original grade. The underlying topsoil in the storage area will be removed and
used as topsoil at previous cut areas. The site will also be recontoured to control dust, weeds, and
minimize erosion. The top 4 inches of soil will be tilled to prepare the site for reseeding after the site
is recontoured. The soil will be tilled using a disk, a chisel plow or harrow. Rock fragments will also
be removed that exceed 30 to 45 percent of the soil surface.

As mentioned above, the task performed at the laydown yard will not require permanent domestic
water. Staff recommends installation of an approved commercial portable chemical toilet for the
storage site. The portable chemical toilet shall be maintained and in sanitary conditions at all times.
The Applicant must provide a contract with a service company establishing maintenance of the
portable chemical toilet.
(B) Impacts on adjacent land from the generation of vapor, dust, smoke, noise, glare
or vibration, or other emanations;
Response
The laydown yard activities will consist of the use of semi-trailers and trucks delivery and retrieving
drilling supplies and materials. The applicant states noise and vibration will be less than current
drilling operations occurring on the plateau and; due to the remote location and physical geography
of the site, there will be no detectable vibration or noise generated from the use at the boundaries of
the property. Staff recommends that the Applicant shall provide a noise analysis of the project prior
to issuance of the CUP that demonstrates that the proposed use will not exceed the state's noise
guidelines. Any potential glare, heat, radiation, or fumes generated from the use would not create a
nuisance or hazard. Emissions may be created by trucks entering the site, but all trucks are in
compliance with state and federal laws. The laydown yard will be covered with 6 inches of gravel to
minimize dust.
(C) Impacts on wildlife and domestic animals through the creation of hazardous
attractions, alteration of existing native vegetation, blockade of migration routes,
use pattems or other disruptions;
Response
The application states that the chain-linked fence and guarded site entrance will prevent wildlife and
domestic animals from entering the site. PDC states that the fence and guarded entrance will
prevent from access onto the site and thus will have minimal impacts on wildlife and domestic
animals. Colorado Division of Wildlife states that an 8-foot fence is the minimum height
requirements to prevent wildlife from entering the site. Staff cannot determine if the laydown yard
activities will or will not impact wildlife for the 2. 75 acres site, therefore, Staff recommends that the
Applicant shall provide a wildlife analysis of the project prior to issuance of the CUP that
demonstrates that the proposed use will not impact wildlife in the area.
(D)Allirmatively show the impacts of truck and automobile traffic to and froin such
uses and their impacts to areas in the County;
Response
The application states that the trips generated from the use of the laydown yard will minimally
impact the County Road System because the bulk of the material will be hauled on private roads on
the Puckett Land property. The application states that the trips generated from the laydown yard will

The access to Puckett property is from County Road 215. The application states that the trips
generated from the laydown yard will decrease traffic on the County Road System and the Town of
Parachute because the bulk of the material will be hauled on private roads on the plateau located in
Puckett property. Traffic would increase the travel to this specific site only, but decrease the amount
of trips needed to obtain supplies off of private property. One semi-trailer, 6-9 pick-up trucks or
larger will be accessing the site during a week period. The laydown yard will be covered with 6
inches of gravel to minimize dust.
(3) Design of the proposed use is organized to minimize impact on and from
adjacent uses of land through installation of screen fences or landscape materials on
the periphery of the lot and by location of intensively utilized areas, access points,
lighting and signs in such a manner as to protect established neighborhood
character;
Response
Puckett Land Company owns the surrounding 5,000 acres. The site is located in a remote area on
the plateau. The Applicant states a chain-linked fence will be installed around the perimeter of the
laydown yard and adjacent temporary employee housing. However, the PDC temporary employee
housing has not been approved. An 8-foot chain-linked fence must be installed for the perimeter of
the storage site. Colorado Division of Wildlife states that an 8-foot fence is the minimum height
requirements to prevent wildlife from entering the site. The site will have a guard stationed at the
entrance and the fencing will prevent wildlife and unauthorized personnel from entering the site.
The site will not be lighted at night. Staff finds that the location of the laydown yard is such that it
will have virtually no impact on any surrounding properties.
Standards in Section 5.03.07 for Industrial Operations
Industrial Operations: Industrial Operations, including extraction, processing, fabrication,
industrial support facilities, mineral waste disposal, storage, sam'tary landfill, salvage yard,
access routes and utility Jines, shall be permitted, provided:
(1) The applicant for a permit for industrial operations shall prepare and submit to the
Planning Director ten (10) copies of an impact statement on the proposed use describing
its location, scope, design and construction schedule, including an explanation of its
operational characteristics. One (1) copy of the impact statement shall be fiJed with the
County Commissioners by the Planning Director. The impact statement shall address
the following:
(A) Existing lawful use of water through depletion or pollution of surface mn-off,
stream Dow or groun,d water;

The 5,000 acre property is located within the Resource Lands zone district and can be characterized
as containing all the sub-zone districts in that zone included plateau, talus slopes, escarpment, and
gentle slopes and lower valley floor. The subject laydown yard is located in the plateau which allows
storage as a conditional use. The following picture below illustrates these zones for the Board's
reference.
Pursuant to Section 5.03, as listed under the Zone District Regulations, conditional uses shall
conform to all requirements listed thereunder and elsewhere in the Zoning Resolution, as well as the
following standards:
(1) Utilities adequate to provide water and sanitation service based on accepted.
engineering standards and approved by the Board of County Commissioners shall
either be in place or shall be constructed in conjunction with the proposed use.
Response
The laydown yard does not require permanent domestic water. Employees will not be based at the
laydown yard. Duties preformed will primarily be delivery, pick-ups or inventorying supplies and
employee time spent at the laydown yard will be short. The Applicant states personnel can access
water and restroom facilities at the adjacent temporary employee housing unit. PDC included the
number of employees accessing the laydown yard in the design of the temporary employee housing
unit. The PDC temporary employee housing has not been approved, therefore, must supply
restroom facilities independent of the temporary employee housing. Staff recommends installation
of an approved commercial portable chemical toilet for the storage site. The portable chemical toilet
shall be maintained and in sanitary conditions at all times. The Applicant must provide a contract
with a service company establishing maintenance of the portable chemical toilet.
(2) Street improvements adequate to accommodate traffic volume generated by
the proposed use and to provide safe, convenient access to the use shall either be in
place or shall be constructed in conjunction with the proposed use;

will be transported to drilling operations in the area. These drilling supplies and materials are
required for natural gas extraction. The laydown yard will allow for employees to obtain necessary
supplies without having to access public roads and thus reducing the traffic on County Road 215.
The location of the laydown yard will minimize travel time and distance which will provide safer
travel especially during winter months. Hours of operation are proposed to be 24 hours a day, 7 days
a week. This site will not have employees based at the laydown yard full-time. One semi-trailer, 6-9
pick-up trucks or larger will be accessing the site during a week period. The laydown yard will be
covered with 6 inches of gravel to minimize dust. The photo below displays the layout for the
storage area and surrounding facilities.
II. GENERAL SITE DESCRIPTION
The site proposed for storage is located in the geologic formation defined as the plateau. It is a 2.75
acre area covered primarily by sage that is located about 2.75 miles from of CR 215. The site is
located west of the existing private access road. Puckett 36-31 well pad, including an existing gas
processing enclosure and the existing well enclosure, are located east of the proposed site. The
proposed temporary employee housing is to be located to the south of the storage site. The photo
below shows the easterly view from the site, including the access road and Puckett 36-31 well pad.
