At a regular meeting of the Board of County Commissioners for Garfield County,
Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood
Springs on, Monday , the 1 4th day of January A.D. 20 02 , there were present:

when the following proceedings, among others were had and clone, to -wit:
RESOLUTION NO. 2002 - 06
A RESOLUTION CONCERNED WITH THE APPROVAL OF A CONDITIONAL USE
PERMIT APPLICATION TO ALLOW A HOME OCCUPATION FOR LOS AMIGOS RANCH
PARTNERSHIP LOCATED AT PINION DRIVE.
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has
received an application from Los Amigos Ranch Partnership, for a conditional use permit to
allow for approval of a home occupation within a single-family PUD zone district; and
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, held a
public hearing on the 17th day of December, 2001, upon the question of whether the above
described home occupation should be granted or denied, at which hearing the public and
interested persons were given the opportunity to express their opinions concerning the approval
of said conditional use permit; and
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, on the
basis of substantial competent evidence produced at the aforementioned hearing, has made the
following determination of fact as listed below:

1. That proper public notice was provided as required for the hearing before the
Board of County Commissioners;
2. That the hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that meeting;
3. That for the above stated and other reasons, the proposed conditional use permit is
in the best interest of the health, safety, morals, convenience, order, prosperity and
welfare of the citizens of Garfield County.
4. That the application is in conformance with the Garfield County Zoning
Resolution of 1978, as amended;
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that the home occupation Conditional Use Permit is hereby approved subject
to compliance with all of the following specific conditions:
A. All items indicated in the staff report, recommended by the Board of County
Commissioners, and included by the Board of County Commissioners at the public
hearing as itemized below:
1. That all representations of the applicant, either within the application or stated at
the hearing before the Board of County Commissioners, shall be considered
conditions of approval including but not limited to: use of the office will be from
8:00 am to 5:00 pm on weekdays and occasional hours on weekends, the number
of vehicles accessing the site will vary from two (2) to six (6) vehicles per day, the
business will have a limit of two (2) employees, the size of the business office will
remain approximately 600 square feet, and there shall be no appearance of
commercial activity on the site.
2. That the applicant shall meet all requirements of the Garfield County Zoning
Resolution of 1978, as amended, and shall meet all building code requirements;
3. That it is the applicant's responsibility to comply with any applicable covenants or
Homeowners' Association rules;
4. All parking needs resulting from the home occupation shall remain on Lot 5, Los
Amigos Ranch Subdivision, 0136 Pinion Drive.

5. Any expansion of this use shall require an amendment of the Conditional Use
Permit.
6. If the applicant fails to meet these conditions by 12/17/02, and subsequently the
special use permit is never issued, the approval shall be automatically revoked, unless
an extension is granted by the Board of County Commissioners.
