At a regular meeting of the Board of County Commissioners for Garfield County,
Colorado, held in the Commissioners' Meeting Room, Garfield County Plaza Building, in
Glenwood Springs on Monday, the 13th day of June, 2005, A. D. there were present: ·

when the following proceedings, among others were had and done, to-wit:
RESOLUTION NO. 2005-50
A RESOLUTION CONCERNED WITH THE APPROVAL OF A CONDmONAL USE
PERMIT FOR A HOME OCCUPATION FOR LOT 8 OF THE UP CA TILE CREEK
SUBDIVISION LOCA JED AT 73 ROCKY ROAD, GARFIELD COUNTY, COLORADO

WHEREAS, the Board of County Commissioners of Garfield County, Colorado (the Board),
received an application for a Conditional Use Permit (CUP) for a Home Occupation to operate a
professional pottery studio on Lot 8 of the Up Cattle Creek Subdivision owned by Jill and Alleghany
Meadows, located at 73 Rocky Road, Garfield County, Colorado and is also located within the
AIR/RD zone district; and
WHEREAS, the Board held a public hearing on the 13th day of June, 2005, upon the question
of whether the above described CUP should be granted or denied, at which hearing the public and
interested persons were given the opportunity to express their opinions concerning the approval of
said CUP; and
WHEREAS, the Board, on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determination of fact as listed below:
1. That adequate public notice was provided as required for the hearing before the
Board of County Commissioners and proof thereof submitted in the record;

2. That the hearing before the Board of County Conunissioners was extensive and
complete, that sufficient pertinent facts, matters and issues were submitted and that
all interested parties were heard at that meeting;
3. That for the above stated and other reasons, the proposed Conditional Use Permit is
in the best interest of the health, safety, morals, convenience, order, prosperity and
welfare of the citizens of Garfield County.
4. That the application is in conformance with Sections 2.02.29, 5.03, and 9.02 of the
Garfield County Zoning Resolution of 1978, as amended;
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that the Conditional Use Permit is hereby approved subject to compliance with all
of the following specific conditions:
I. That all representations made by the Applicant in the application, and at the public
hearing before the Board of County Commissioners, shall be conditions of approval,
unless specifically altered by the Board of County Conunissioners.
2. The Applicant shall be allowed to open the studio to the general public for the I) annual
Carbondale Community School fundraiser "Art Studio Tour" which occurs one weekend
every October; and 2) an Open Studio Weekend in the late spring, around Mother's Day,
each year.
3. The Applicant shall be prohibited from erecting any signage or lighting associated with
the Home Occupation.
4. No retail or wholesale sales of any kind associated with the activities of the Home
Occupation shall be allowed to take place at the property which requires any visitor
traffic. However, retail sales shall be allowed to occur during the 1) annual Carbondale
Community School fundraiser "Art Studio Tour" which occurs one weekend every
October; and 2) an Open Studio Weekend in the late spring, around Mother's Day, each ·
year.
5. In the event any representations made in the application for which this permit is granted
change and are no longer consistent with the representations in this application, the
Applicant shall be required to submit a new permit application to the County addressing
the changes.
