APPLICATION SUBMITTAL REQUIREMENTS As a minimum, specifically respond to all the following items below and attach any additional information to be submitted with this application: 1. Submit plans and specifications for the proposed use including the hours of operation, the number and type of vehicles accessing the site on a daily, weekly and/or monthly basis, and the size of any existing and/or proposed structures that will be used in conjunction with the proposed use. Please submit the specific information in narrative form and be specific. 2. If you will be using water or will be treating wastewater in conjunction with the proposed use, please detail the amount of water that would be used and the type of wastewater treatment. If you will be utilizing well water, please attach a copy of the appropriate well permit and any other legal water supply information, including a water allotment contract or an approved water augmentation plan to demonstrate that you have legal and adequate water for the proposed use. 3. Submit a site plan /map drawn to scale that portrays the boundaries of the subject property, all existing and proposed structures on the property, and the County or State roadways within one (1) mile of your property. If you are proposing a new or expanded access onto a County or State roadway, submit a driveway or highway access permit. 4. Submit a vicinity map showing slope I topography of your property, for which a U.S.G.S. 1 :24,000 scale quadrangle map will suffice. 5. Submit a copy of the appropriate portion of a Garfield County Assessor's Map showing the subject property and all public and private landowners adjacent to your property (which should be delineated). In addition, submit a list of all property owners, private and public, and their addresses adjacent to or within 200 ft. of the site. This information can be obtained from the County Assessor's Office. You will also need the names (if applicable) of all mineral interest owners of the subject property, identified in the County Clerk and Recorder's records in accordance with §24-65.5-101, et seq. (That information may be found in your title policy under Exceptions to Title). 6. Submit a copy of the deed and a legal description of the subject property. 7. If you are acting as an agent for the property owner, you must attach an acknowledgement from the property owner that you may act in his/her behalf. 8. Submit an impact statement that specifically responds to each of the following criteria from Section 5.03 of the Zoning Regulations: (1) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use. (2) Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use. (3) Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character. 9. Depending on the type of Conditional Use Permit requested, you may need to respond to additional conditional use review standards in the Garfield County Zoning Resolution Section 5.03. Refer to the Section 5.03 of the Zoning Resolution which can be located on the Garfield County web site at http://www.garfield-county.com/buildinq and planning/index.him or call this office. 10. A $400.00 Base Fee: Applicant shall sign the "Agreement for Payment" form and provide the fee with the application. 11. Submit 2 copies of this completed application form and all the required submittal materials to the Building and Planning Department. Staff will request additional copies once the conditional use permit application has been deemed technically complete. II. PROCEDURAL REQUIREMENTS (The following steps outline how the Conditional Use Permit application review process works in Garfield County.) 1. Submit this completed application form (pages 1-4), base fee, and all submittal requirements to the Garfield County Planning Department. 11 will be received and given to a Staff Planner who will review the application for technical completeness. 2. Once the application is deemed technically complete, the Staff Planner will send you a letter indicating the application is complete. In addition, Staff will also send you a "Public Notice Form(s)" indicating the time and date of your hearing before the Board of County Commissioners. Prior to the public hearing, Staff will provide you with a Staff Memorandum regarding your requested Conditional Use Permit. (If Staff determines your application to be deficient, a letter will be sent to you indicating that additional information is needed to deem your application complete.) 3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the requested Conditional Use Permit for the public hearing. If proper notice has not occurred, the public hearing will not occur. Notice requirements are as follows: a. Notice by publication, including the name of the applicant, description of the subject lot, a description of the proposed Conditional Use and nature of the hearing, and the date, time and place for the hearing shall be given once in a newspaper of general circulation in that portion of the County in which the subject property is located at least thirty (30) but not more than sixty (60) days prior to the date of such hearing, and proof of publication shall be presented at hearing by the applicant. b. Notice by mail, containing information as described in the paragraph above, shall be mailed to all owners of record as shown in the County Assessor's Office of lots within two hundred feet (200') of the subject lot and to all owners of mineral interest in the subject property at least thirty (30) but not more than sixty (60) days prior to such hearing time by certified return receipt mail, and receipts shall be presented at the hearing by the applicant. c. The site shall be posted such that the notice is clearly and conspicuously visible from a public right-of-way, with notice signs provided by the Planning Department. The posting must take place at least thirty (30) but not more than sixty (60) days prior to the hearing date and is the sole responsibility of the applicant to post the notice, and ensure that it remains posted until and during the date of the hearing. 4. The Applicant is required to appear before the Board of County Commissioners at the time and date of the public hearing at which time the Board will consider the Conditional Use request. In addition, the Applicant shall provide proof at the hearing that proper notice was provided. 5. Once the Board makes a decision regarding the Conditional Use request, Staff will provide the Applicant with a signed resolution memorializing the action taken by the Board. Following the Board's approval, this office will issue the Conditional Use Permit to the applicant. If the Board's approval includes specific conditions of approval to be met, this office will not issue the Official Conditional Use Permit certificate until the applicant has satisfied all conditions of approval. The Conditional Use Permit approval is not finalized until this office has issued the Official Conditional Use Permit certificate signed by the Chairman of the Board of County Commissioners. We had an opportunity to meet with David Pesnichak-Garfield County Senior Planner on November 21, 2007 in a pre-application meeting to determine the information needed. 1. Project Description: The proposal includes the addition of the historic Glover Cabin to the site. Glover Cabin was constructed in the 1890' s near Parachute Creek approximately 4 miles North of the Town of Parachute. Glover Cabin is located due South of the Williams Production RMT Co.-Parachute Creek Gas Plant. Williams Production RMT Co. has donated Glover Cabin, including the cost of upgrades and relocation, to the Grand Valley Historical Society. Pictures of Glover Cabin are attached. Additionally, an aerial view of the site is attached. Garfield County approved a Conditional Use Permit for the property on October 11, 2004 in resolution number 2006-57. Please find this resolution attached. This conditional use permit allowed for the use of the renovated Battlement Mesa Schoolhouse as a community building. 1. Via this Conditional Use Permit, we are requesting that Garfield County allow for the relocation of the Glover Cabin to this 4 acre site. The location that has been chosen will not detract from the Battlement Mesa Schoolhouse. Page 1of3 The existing Battlement Mesa Schoolhouse and the proposed Glover Cabin are well- placed within this property to reduce impacts on adjacent properties. The Grand Valley Historical Society plans to use the refurbished Glover Cabin as an exhibit for living conditions in the 1890 to 1900' s to their visitors and guests. Refurbishment of the Glover Cabin will include a new concrete foundation, structural improvements to the roof section to preserve the building from snow and wind load damage, weathered shingle roofing, chinking of the exterior logs and installation of windows and a door. Site improvements will include a new concrete or gravel path from the Battlement Mesa Schoolhouse to the Glover Cabin. Architectural and engineered drawings will be submitted to the Garfield County Building Department for issuance of a building permit. 2. We are requesting that condition # 4 of Resolution 2006-57 be amended in the following fashion: 4. Use of the building would occur between 8:00 AM and 10:00 PM and would provide meeting space to accommodate a maximum of ±Q 65 persons at any one time. The reason for this request is a legitimate need to allow for groups of over 20 people to utilize the Battlement Mesa Schoohouse for meetings and activities. Please find attached a letter dated 3/28/08 from David Blair-Fire Chief-Grand Valley Fire Protection District reevaluating the occupant loads for the building. This letter and determination is the source of the 65 persons. Parking: Currently there are 36-9' wide x 20' long parking spaces on-site, 1 handicapped space and 1 van accessible space. Section 5.01.02 (4) of the Garfield County Zoning Resolution "Minimum Off-Street Parking", notes "Auditorium and public assembly-one (1) space per one hundred (100) square feet of floor area used for seating or assembly". 988 sq. feet divided by 100= 9.88 parking spaces needed. 36 parking spaces in existence exceeds the 10 spaces necessitated by the code. Water Supply: Well permit number 264602 is attached in submittal 3. 65 persons per day x 10 gallons per day usage= 650 gallons per day. 650 gallons x 167 days use= 108,550. In no way do we anticipate the full use of 65 persons of the facility of 167 days of use which equals almost 24 full weeks of usage a year. Condition 6 of the well pennit notes a maximum yearly use of 1/3 acre foot (108,600 gallons). Condition 9 requires a totalizing flow meter to be installed. The Grand Valley Historical Society must comply with the well permit issued by the Colo. Division of Water Resources. In conclusion, the water supply is adequate to supply the use of the facility. Page 2 of 3 Septic System: The engineered drawing and calculations for the system stamped 8/10/05 are attached in submittal 3. The percolation rate was noted as 15" per minute. Septic System calculation utilizing CDPHE and Garfield County Code. A. 65 persons x IO gallons per day usage= 650 gallons per day. B. 650 gallons per day x 1.5 safety factor= 975 gallons per day. C. 975 gallons per day x square root of the percolation rate 3.88 (15 minutes per inch)= 3,783 D. 3,783 divided by 5= 756.60 square feet of seepage bed needed. The seepage bed as per the 8/10/05 design is 840 square feet. In conclusion, the existing septic system is acceptable to handle a load of 65 persons daily. 2. Existing zoning: The property is zoned Agricultural/Rural/Residential Density. The Garfield County Zoning Resolution Section 3.02.02 notes "Agricultural/Rural/Residential Density. "Uses, conditional: Aircraft landing strip, church, community buildings, day nursery and school; group home for the elderly." We see that the proposal meets the Garfield County AIR/RD conditional use permit designations. Additionally, there is an existing conditional use permit on the property that further affirms this fact. 3. Surrounding zoning: Agricultural/Rural/Residential Density immediately adjacent in all directions and the Battlement Mesa PUD. 4. Wastewater System-The wastewater system, septic tank and leach field, is in place and was permitted via the Garfield County Building Department. Please find attached the 8/10/05 septic design drawing stamped by Leslie Wood P.E. and a letter dated 4116/07 from Leslie Wood P.E. in regards to inspection of the installation. Neither system will be impacted as the Glover Cabin will not have water or wastewater facilities located within it. As noted in the introduction letter, the increase in occupants to the Battlement Mesa Schoolhouse will have an impact on the water and sewer systems. Visual Impact-The addition of the Glover Cabin has been located in order to minimize impact on adjacent parcels as it is located near the low point of the property at the Northeast property corner. The Cabin is 15'-3" wide x 25' -6" long and has a 15' -6" high ridgeline. This dimension is well below the 25' allowable height within the AIR/RD zone district. B. Glare-A shake shingle roof will be installed on the cabin. The only reflection from the cabin would be from windows when the sun reflects at the correct angle. There is very little glazing on the exterior of the building. An electrical feeder will be installed to the cabin for the potential future addition of lighting. If exterior light fixtures are installed in the future, the fixtures will be shaded and will be downcast in order to prevent light pollution and glare to adjacent properties. C. Traffic-We are not anticipating additional vehicle traffic on-site because of the Glover Cabin installation. There will be a concrete sidewalk or a gravel path installed from the Battlement Mesa Schoolhouse to the Glover Cabin for pedestrian use only. It was removed by digging it and it was bagged and removed from the property. -Russian Thistle -aka Tumbleweed (not a designated noxious weed) is prevalent on our property and we will begin that removal and eradication in 2009. -The President of the Society and members of the Board of Directors will be educated as to weed identification of the Garfield County's 21 Noxious Weeds and other weeds and we all will be alert to any of these weeds. The weeds that are found will be removed with recommended methods of removal or control as soon as possible and noted on a property map. -The Society would like to host a community/society meeting to educate people in our area on noxious weeds and it would be great to highlight historic/indigenous plantings of our area, too. -Only approved grasses, flowers, trees and bushes will be planted on our property. We envision and plan to do minimal and simple plantings to keep the historical significance of our property, mainly around the School House and to keep the area along driveway, walkways and parking area mowed.
