I REQUEST
CNR Shooting Sports L.P. is seeking approval of a Special Use Permit to allow a private
"Shooting Range Facility". The proposed facility is planed to operate in conjunction with
the Orchard Lake Lodge Reserve approved by the Board of County Commissioners (the
Board) on March 12th, 2007 and is to be available to local special interest groups on a
reservation basis. The lodge is in the process of completing conditions of approval
specified by the Board.
II PROJECT DESCRIPTION
The proposed shooting facility will be comprised of an open-air pavilion housing eight (8)
shooting stations, one (1) operator stand, storage area, seating area, kitchenette (no
meals will be prepared on-site) and a restroom. The hours of operation will from 9:00 AM
to 10:30 PM as needed.
The Applicant has commissioned Sport Shooting Consultants, LTD to assist with
construction and operational safety of the proposed facility.

IV ZONING
Shooting Range Facility is contemplated as a special use in the Resource Land -Lower
Valley Floor Zone District, and is defined as follows:
42.02.493 Shoot Range Facility
A public or private facility designed to provide training in the use of firearms, firearm
practice and firearm competition, for use by persons other that the owner, resident lessee,
their immediate family members any time' or less than five (5) friends on an irregular
basis.
Staff Finding
The Applicant's proposal is consistent with this definition.
V § 5.03 Review Standards
A Utilities adequate to provide water and sanitation service based on accepted
engineering standards and approved by the Board of County Commissioners
shall either be in place or shall be constructed in conjunction with the
proposed use;
Staff Finding
Water will be provided to the proposed facility from an off-site well. Water rights have
been augmented by the Water Court's Findings of Fact, Ruling or Referee and Judgment
& Decree issued December 23`d, 2005 (Case No. 01CW373). Water quality tests for
bacteria and nitrate will be conducted after pump installation. The Applicant has
represented that quarterly water testing will be conducted and bottled water will be
provided on-site.
Wastewater generated on-site will be treated by an Individual Sewage Disposal System
(ISDS). The proposed ISDS will be reviewed by Garfield County Building and Planning
prior to construction.
B Street Improvements adequate to accommodate traffic volume generated by
the proposed use and to provide safe, convenient access to the use shall
either be in place or shall be constructed in conjunction with the proposed
use;

Staff Finding
The proposed facility will serve as an amenity for the approved Orchard Lake Lodge.
Street improvements were not required as a result of the increased traffic generated by
the use. Street improvements will not be required as a result of the proposed use as
represented.
C Design of the proposed use is organized to minimize impact on and from
adjacent uses of land through installation of screen fences or landscape
materials on the periphery of the lot and by location of intensively utilized
areas, access points, lighting and signs in such a manner as to protect
established neighborhood character;
Staff Finding
The subject property is not situated in an extremely remote area of Garfield. County.
Adjacent uses include a hunting lodge, ranch operations, public lands and oil and gas
activity. The proposed use will not adversely impact adjacent uses and is consistent with
the established neighborhood character. The Applicant has represented that all lighting
associated with the use will be directed downward and inward to allow night time activities
on the subject property.
VI § 5.03.027 Review Standards
Specific Special Use Permit Standards specific to a "Shooting Range" (Section
5.03.27)
1) All outdoor shooting ranges shall be designed by a NRA Range Technical Team,
in accordance with the standards established by the in the NRA document
entitled "The Range Manual'; unless modified by the Board of County
Commissioners after a public hearing in which it was demonstrated that adequate
safety measures have been taken by the applicant.
Staff Finding
The NRA is not a certification or a code enforcement agency and does not certify
ranges. The Applicant has commissioned a consultant to assist with the design and
opererational standards. Staff suggests that as a condition of approval the Board
require the applicant to comply with all applicable suggestions identified in "The Range
Manual".
2) All shooting ranges will have sanitary facilities on site.
Staff Finding
The Applicant has represented that an approved ISDS will be installed on-site.
3) Any lighting used for a shooting range shall be oriented inward and downward.

This standard has been made a condition of approval.

4) No alcoholic beverages will be allowed on the shooting range site.
Staff Finding
This standard has been made a condition of approval. In addition, this language shall be
posted on permanent signs at the range.
VII SUGGESTED FINDINGS
1.) That proper public notice was provided as required for the hearing before the
Board of County Commissioners;
2.) That the hearing before the Board of County Commissioners was extensive and
complete and that all interested parties were heard at that meeting;
3.) The Application is in conformance with §5.03 and §2.02.493 of the Garfield
County Zoning Resolution of 1978, as amended;
4.) That for the above stated and other reason, the proposed Special Use Permit is
in the best interest of the health, safety and welfare of the citizens of Garfield
County;
VIII STAFF RECOMMENDATION
Staff recommends approval of the proposed Special Use Permit allowing a "Shooting
Range" on a property owned by CNR Shooting Sports, LP. with the following conditions:
1) That all representation made by the Applicant in the application and as
testimony in the public hearing before the Board of County Commissioners
shall be conditions of approval, unless specifically altered by the Board of
County Commissioners;
4) The Applicant shall obtain a Driveway Access permit from Garfield County
Road and Bridge and meet all conditions identified by the Road and Bridge
Department prior to the issuance of the Special Use Permit;
5) All lighting associated with the proposed use shall be directed downward
and inward;
6) The Applicant shall comply with Garfield County Zoning Resolution of 1978,
as amended and all applicable Building Code Requirements;
7) All food waste shall be contained within a bear -proof garbage receptacle
and disposed of accordingly, so as not to become an attraction to wildlife;

8) The Applicant shall demonstrate compliance with the State Requirements
regarding Bacteria and Nitrates for well water, prior to the issuance of the
Special Use Permit;
9) The Applicant shall submit a map and inventory the subject property for
County Listed Noxious Weeds to Garfield County Vegetation Department
prior to the issuance of the Special Use Permit;
10)The Applicant shall provide a weed management plan approved by Garfield
County Vegetation Management prior to the issuance of the Special Use
Permit;
11)No alcoholic beverages shall be allowed on the shooting range site at any
time. The requirement shall be posted on permanent signs at the shooting
range facility. If someone appears to be intoxicated, they shall be removed
immediately from the range.
12)The facility shall comply with all applicable recommendations regarding
outdoor ranges as provided in the NRA "Range Source Book".

General Comments: Garfield County Road & Bridge Department has no objections to
this application with the following comments.
I have made an onsite visit to the location of the application and have issued a driveway
access permit for this location onto Cr. 209. The driveway access permit has conditions
specific to the driveway access location including a stop sign at the entrance to Cr. 209.
The stop sign and installation shall be as required in the MUTCD (Manual on Uniform
Traffic Control Devices.
Garfield County Road &Bridge Department requests that no installations including gates
or signage be installed on Cr. 209 or within the ROW of Cr. 209. Any gates or other
installations that may be within Garfield County ROW that violate County resolutions
or block entrance to other lands shall be removed before final approval.
As Cr. 209 has a low traffic volume the increase in traffic flow should not present a
problem and with the future improvement plans for Cr. 204 the increase in traffic flow
should not present a problem on Cr. 204.

Thanks for the opportunity to comment on the special use permit.
My comments are as follows:
1. Noxious Weeds
A. Inventory and mapping -The applicant needs to map and inventory the property for the
County Listed Noxious Weeds. The Brush Creek valley has historically had severe
weed problems. County listed species found in the area include, but are not limited to:
Russian knapweed, hoary cress (whitetop), musk thistle, Canada thistle, plumeless thistle,
common burdock, houndstongue, and tamarisk.
All proposed project areas shall be inventoried prior to ground -disturbing activities. If
noxious weeds are found, they shall be treated prior to ground -disturbing activities to
limit weed seed production and dispersal.
B. Weed Management -The applicant shall provide a weed management plan for the
inventoried noxious weeds.

A review has been performed of the documents for the Special Use Permit Application of the CNR
Shooting Sports, LP. The package was found to be well organized. The following comments,
questions, or concerns were generated:
1. The sewer and water systems are shown schematically but without construction level details.
These systems should be designed by an engineer and the design submitted, at a minimum, for
building permit.
2. An access permit may be necessary for the proposed driveway. Similarly, the driveway is shown.

design should be submitted at the time of building permit.

Thank you for the opportunity to comment on the Special Use Permit requested by CNR Shooting Sports, LP to
develop and operate a shooting range facility on Kessler Canyon Ranch, The subject property encompasses
approximately 49 of acres private land northeast of Brush Creek along the valley floor, and is currently utilized
primarily for outdoor recreation, including hunting.
The subject property is dominated by sagebrush -steppe, pinyon juniper, and mountain shrub vegetation. This habitat
is valuable to many species of wildlife, including elk, mule deer, mountain lion, black bear, wild turkey, raptors, and
small mammals. The subject property falls within winter range, winter concentration area and severe winter range for
elk; summer range and winter range for mule deer; and winter range for wild turkey.
The proposed shooting range facility would utilize a small portion of the overall ranges listed above; however,
increased activity in the area during construction may cause animals to alter their behavior and movement patterns.
The Division of Wildlife recommends that construction activities be minimized during the time period of December Is`
through April 30th in order to minimize stress on wintering animals.
The Division of Wildlife acknowledges that the area selected for the shooting range facility is located a significant
distance from the riparian area along Brush Creek, which will reduce impacts to wildlife. The topographic area
surrounding the proposed shooting range provides excellent natural barriers, which will increase safety at the facility.
The Division of Wildlife appreciates the opportunity to comment on projects in Garfield County. If you have further
