HomeMy WebLinkAbout4.0 Resolution 2007-924111rd. rl :I'Xi#11,«u,,ININ+l,i0a111! 11111 Receptiontl: 734309 10/01/2007 04:57.31 PM Jean Alberico 1 of 4 Rec Fee:$0,00 Doc Fee:0.00 GRRFIELD COUNTY CO STATE OF COLORADO ) )ss County of Garfield ) At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Plaza Building, in Glenwood Springs on Monday, the 2"d day of July, 2007, there were present: John Martin Larry McCown Tresi Houpt Don DeFord Jean Alberico Ed Green Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2 0 0 7- 9 2 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT ALLOWING SHOOTING RANGE FACILITY ON A PROPERTY LOCATED ON COUNTY ROAD 209 OWNED BY CNR SHOOTING SPORTS, LP. PARCEL NO. 216524400029 WHEREAS, the Board of County Commissioners of Garfield County, Colorado, received a Special Use Permit (SUP) request to allow a "SHOOTING RANGE FACILITY" submitted by Balcomb & Green, P.C.; and WHEREAS, the subject property contains approximately 49 acres, situated in Section 3, Township 6 South, Range 99 West of the 6th Principal Meridian and is practically located off of County Road 209, in the Resource Lands: Gentle Slopes and Lower Valley Floor Zone District: WHEREAS, the Board of County Commissioners opened a public hearing on the 2nd day of July, 2007 upon the question of whether the above-described SUP should be granted or denied, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said SUP; and 0011A11:11110,1VICIVICITNiwi«iti,iii 11111 Reception#: 734309 10/01/2007 04:57:31 PM Jean Rlberico 2 of 4 Rec Fee:$0.00 Doc Fee:0.00 GARFIELD COUNTY CO WHEREAS, the Board of County Commissioners closed the public hearing on the 2nd day of July, 2007 to make a final decision; and WHEREAS, the Board of County Commissioners on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of facts: 1. That proper publication, public notice, and posting was provided as required by law for the hearings before the Board of County Commissioners. 2. That the public hearing before Board of County Commissioners was extensive and complete; all pertinent facts, matters and issues were submitted; and that all interested parties were heard at those hearings. 3. The proposed special use permit conforms to Sections 3.10.04, 5.03, and of the Garfield County Zoning Resolution of 1978, as amended. 4. The proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that based on determination of facts set forth above, the SUP request to allow a "Shooting Range Facility" is approved with the following conditions: 1) That all representation made by the Applicant in the application and as testimony in the public hearing before the Board of County Commissioners shall be conditions of approval, unless specifically altered by the Board of County Commissioners; 4) The Applicant shall obtain a Driveway Access permit from Garfield County Road and Bridge and meet all conditions identified by the Road and Bridge Department prior to the issuance of the Special Use Permit; 5) All lighting associated with the proposed use shall be directed downward and inward; 6) The Applicant shall comply with Garfield County Zoning Resolution of 1978, as amended and all applicable Building Code Requirements; 7) All food waste shall be contained within a bear -proof garbage receptacle and disposed of accordingly, so as not to become an attraction to wildlife; IN 11111 Reception 734309 10/01/2007 04:57:31 PM Jean fllberico 3 of 4 Rec Fee:$0.00 Doc Fee:0.00 GRRFIELD COUNTY CO 8) The Applicant shall demonstrate compliance with the State Requirements regarding Bacteria and Nitrates for well water, prior to the issuance of the Special Use Permit; 9) The Applicant shall submit a map and inventory the subject property for County Listed Noxious Weeds to Garfield County Vegetation Department prior to the issuance of the Special Use Permit; 10) The Applicant shall provide a weed management plan approved by Garfield County Vegetation Management prior to the issuance of the Special Use Permit; 11) No alcoholic beverages shall be allowed on the shooting range site at any time. The requirement shall be posted on permanent signs at the shooting range facility. If someone appears to be intoxicated, they shall be removed immediately from the range. 12) The facility shall comply with all applicable recommendations regarding outdoor ranges as provided in the NRA "Range Source Book".
