Application Requirements: These items must be submitted with the application
I.) Plans and specifications for the proposed use including the hours of operation, the amount of
vehicles accessing the site on a daily, weekly and/or monthly basis, and the size of any existing or
proposed structures that will be utilized in conjunction with the proposed use. Please submit this
information in narrative form and be specific.
2.) If you will be using water or will be treating wastewater in conjunction with the proposed use,
please detail the amount of water that would be used and the type of wastewater treatment. If you
will be utilizing well water, please attach a copy of the appropriate well permit and any other
legal water supply information, including a water allotment contract or an approved water
augmentation plan.
3.) A map drawn to scale portraying your property, all structures on the property, and the County or
State roadways within one (I) mile of your property. If you are proposing a new or expanded
access onto a County or State roadway, submit a driveway or highway access permit.
4.) A vicinity map, showing slope of your property, for which a U.S.G.S. I :24,000 scale quadrangle
map will suffice.
5.) A copy of the appropriate portion of a Garfield County Assessor's Map showing all public and
private landowners adjacent to your property. Include a list of all property owners and their
addresses.
6.) Attach a copy of the deed and a legal description of the property. If you are acting as an agent for
the property owner, you must attach an acknowledgement from the property owner that you may
act in his/her behalf.
7 .) You must submit an impact statement consistent with the requirements of Sections 5 .03,
paragraphs 1 thru 3, detailing the impact of the proposed, conditional use.
The consideration of this proposed Conditional Use will require at least one (I) public meeting, for which
public notice may not be required. However, in the discretion of the Board of County Commissioners,
the consideration of this proposed Conditional Use may require at least one (I) public hearing, for which
public notice must be provided. The Planning Department will mail you information concerning the
public meeting hearing(s), approximately 30 days prior to the scheduled hearing. You will then be
required to notify, by certified return receipt mail, all adjacent landowners and publish the notice provided
by the Planning Department, in a newspaper of general circulation. Both these notices must be
mailed/published at least 15 days prior to the public hearing. The applicant shall bear the cost of mailing
and publication and proof of mailing and publication must be submitted at the time of public hearing.

APPLICATION FOR CONDITIONAL USE PERMIT
GENERAL INFORMATION
Marlin (Colorado), Ltd., the owner of the Prehm Ranch ("Applicant'') seeks a
conditional use pennit for a non-residential river cabin.
The Prehm Ranch is currently comprised of 191 acres located along the Roaring Fork
River approximately Y, mile south of the Glenwood Springs Municipal Airport. The Ranch is served
by Garfield County Road 163 from the north. On November 27, 2000, the Applicant received
approval from the Board of County Commissioners for a subdivision exemption creating 3 lots of
approximately 4 acres each. The Applicant proposes to divide the balance of the property into 5 35-
acre tracts. The total build-out for the Prehm Ranch will be 8 residential units with accessory
structures. The river cabin will be located on what has been identified as Lot 6, a 35-acre parcel
encompassing the river frontage through the Ranch.
On April 16, 200 I, the Applicant received approval ofa Special Use Pem1it from the
Board of County Commissioners for, among other things, the site of the proposed river cabin.
Because the river cabin is located within the flood plain of the Roaring Fork River, Applicant
submitted all necessary technical and engineering infonnation to satisfactorily demonstrate the
appropriateness of the cabin site.
Although the Applicant believed that the construction of the river cabin as a non-
residential structure constitutes an accessory building and use pcnnittcd by right in the underlying
AIR/RD Zone District, the Planning Office and County Attorney dctennined that the river cabin
constitutes a "community building" subject to conditional use review. The river cabin will be
available for use by all property owners within the Prehm Ranch."rhercfore, Applicant is submitting
this request for conditional use approval for a "community building" which will be for common
recreational puqJOses. The building will be non-residential.
The plans and specifications for the river cabin arc appended to this Application as
Attachment I. The interior space of the cabin is approximately 736 square feet. The cabin also
includes a covered deck and a sun deck. The footprint of the building will be approximately 1,568
square feet, including the decks. The tloorplan depicts the proroscd improvements, including a
common room with wet bar and a locker room with restroom.
The cabin will served by an exempt well permitted through the Colorado Division
of Water Resources, Well Permit No. 231210. Although the well permit authorizes up to 15 gallons
per minute, the Applicant anticipates water usage of not more than 100 gallons per day.
A septic system will be developed for the treatment of waste water. A condition of
the Special Use Penni! is that the Applicant submit a properly designed and engineered individual
waste water treatment system to the County for approval prior to issuance of a building permit for
the river cabin.
LONING RESOLUTION§ 5.01
Under Zoning Resolution §5.03, conditional uses arc pennitted uses based upon
compliance with the requirements of Zoning Resolution §5.03.10. There are no special regulations
or review criteria applicable to community buildings.
The river cabin will only be available for use by the owners of the 8 lots on the Prehm
Ranch and their guests. The river cabin will not generate any traffic over and above that associated
with the residential use of the Ranch. As a condition of the subdivision exemption approval, the
Applicant agreed to extend new utility lines into the Ranch and to construct improvements to County
Road 163 serving the Ranch from the north. These improvements have been reviewed by the County
Planning and Engineering Departments and, as of the date of this Application, have been permitted
and are substantially completed.
The access to the river cabin will be on an interior, private Ranch road, restricted to
use by property owners and their guests. Roads and utility extensions will be maintained by the
Prehm Ranch Owners Association, a Colorado not-for-profit corporation, established by the
Applicant to manage and maintain the common areas and interests of the Ranch. The Owners
Association will also be responsible for maintenance and care of the river cabin and can assess the
owners for costs associated therewith.
The proposed use of the river cabin as a community building will limit overall
development of accessory structures along the Roaring Fork River corridor through the Ranch. The
Covenants of the Owners Association establish building envelopes within which structures may be
located, as depicted on the map of the property appended hereto as Attachment 3. Structures are
prohibited outside of the building envelopes. The intent of creating the river cabin is to minimize
development on the river, thereby maintaining the natural condition of the riparian zone to the
greatest extent possible.
The Applicant respectfully requests approval of this Application for Conditional Use
Permit for a "community building." The Applicant represents that the cabin will not be used for
residential purposes and consents to the imposition of a condition prohibiting residential uses in
conjunction with approval of the Conditional Use Permit.
