Monarch #101 Aspen, Colorado 81611 Dear Mr. Heng: I am responding to your request, submitted by Earth Resource Investigations, for a Department of the Army permit to construct a boat ramp on the Prehm Ranch property. The project site is located on the west bank and floodplain terrace of the Roaring Fork River just downstream of its confluence with Fourmile Creek within the SE 1/4 NE 1/4 of Section 34, Township 6 South, Range 89 West, Garfield County, Colorado. The Chief of Engineers has issued nationwide general permit number 14 and 36 which authorizes the discharge of dredgedorfill material in waters of the United States for minor road crossings and boat ramps, respectively. We have determined that Your project will not affect threatened or endangered species protected by the Endangered Species Act. Your project can be constructed under this authority provided the work meets the conditions listed on the enclosed information sheets. You have indicated that a wetland will be crossed with the access road and compensatory wetland mitigation will be created along the shorelines of the entrance ponds being built. As identified in Nationwide Permit General Condition number 26, discharges associated with this ramp access road shall not result in permanent, above -grade fills within the 100 -year floodplain. You must send finished photographs of the constructed boat ramp and access road and a signed letter of certification to the Corps of Engineers within 30 days after completion of the work (see general condition number 14). A copy of the certification statement is included for your use. This verification is valid until February 11, 2002. If you have not completed your project by that time, you should contact the Corps of Engineers to obtain information on any changes which may have occurred to the nationwide permits. We understand that lot owners at the ranch will utilize the river cabin for social and recreational activities. The water supply will be provided by a well to be drilled near the cabin access road. The well will be permitted as a "fee" well covered under a water contract through the West Divide Water Conservancy District. Attached is copy of the water contract for your review. The water contract covers domestic and -irrigation -uses at the -cabin. in-house demands were conservatively overestimated to be equivalent to a single-family residence (350 gallons per day). The contract also covers water demands for the irrigation of up to 1,000 square feet of landscaping. A well permit application was made to the Colorado Division of Water Resources on June 8'h, 2001 (copy attached). The Permit application is pending. Please call if you have any questions. Page D-6; Cabin Floor Plan: 1.1. The floor plan submitted shows a kitchen sink, lavatory, and a water closet. The ISDS design calculations should be modified accordingly to match this floor plan. 2. Page 19; table I of State of Colorado ISDS guidelines: 2.1. 1 recommend using the flow quantities from this table to design the system. The kitchen sink, lavatory and water closet numbers should closely resemble the average daily usage of this cabin. 2.2. If these quantities are used the average gallons/person/day estimate will come out to 564 gallons/person/day instead of the 375 gallons/person/day estimate submitted. 3. Sheet 1; individual sewage disposal system for proposed river cabin lot 6, The Preserve at Prehm Ranch, Garfield County 3.1. See attached drawing for comments. The proposed work involves 400 linear feet of rock riprap with three rock jetties and shrub plantings on the west bank of the Roaring Fork River just downstream of the large river island and upstream of the new boat ramp (Corps permit #200175145) within the SE 1/4 NE 1/4 of Section 34, Township 6 South, Range 89 West, Garfield County, Colorado. The Corps of Engineers, Sacramento District, has issued Regional General permit Number GP37 to authorize certain limited discharges of dredged or fill material associated with streambank and streambed stabilization projects. We have determined that your project will not affect threatened or endangered species protected by the Endangered Species Act. Based on our review of the information submitted, the project is authorized by this regional permit subject to the enclosed permit conditions. We also ask that you submit "before" and "after" photographs of this section of riverbank within 30 days after completion of this project. This authorization is valid until August 1, 2004. We have assigned number 200175058 to your project. Please refer to this number in any correspondence with this office. If your plan to work extends beyond August 1, 2004, you must contact this office -2 - to receive an extension.
