10. A $400.00 Base Fee: Applicant shall sign the "Agreement for Payment" form and provide the
fee with the application.
11. Submit 2 copies of this completed application form and all the required submittal materials to
the Building and Planning Department. Staff will request additional copies once the Special
Use Permit application has been deemed technically complete.
II. PROCEDURAL REQUIREMENTS
(The following steps outline how the Special Use Permit Application review process works in
Garfield County.)
1. Submit this completed application form, base fee, and all supplemental information to the
Garfield County Planning Department. It will be received and given to a Staff Planner who
will review the application for technical completeness.
2. Once the application is deemed technically complete, the Staff Planner will send you a
letter indicating the application is complete. In addition, Staff will also send you a "Public
Notice Form(s)" indicating the time and date of your hearing before the Board of County
Commissioners. Prior to the public hearing, Staff will provide you with a Staff Memorandum
regarding your requested Special Use. (If Staff determines you application to be deficient,
a letter will be sent to you indicating that additional information is needed to deem your
application complete.)
3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the
requested Special Use and the public hearing. If proper notice has not occurred, the
public hearing will not occur. Notice requirements are as follows:
a. Notice by publication, including the name of the applicant, description of the subject
lot, a description of the proposed special use and nature of the hearing, and the
date, time and place for the hearing shall be given once in a newspaper of general
circulation in that portion of the County in which the subject property is located at
least thirty (30) but not more than sixty (60) days prior to the date of such hearing,
and proof of publication shall be presented at hearing by the applicant.
b. Notice by mail, containing information as described in the paragraph above, shall
be mailed to all owners of record as shown in the County Assessor's Office of Tots
within two hundred feet (200') of the subject lot and to all owners of mineral interest
in the subject property at least thirty (30) but not more than sixty (60) days prior to
such hearing time by certified return receipt mail, and receipts shall be presented at
the hearing by the applicant.
c. The site shall be posted such that the notice is clearly and conspicuously visible
from a public right-of-way, with notice signs provided by the Planning Department.
The posting must take place at least thirty (30) but not more than sixty (60) days
prior to the hearing date and is the sole responsibility of the applicant to post the
notice, and ensure that it remains posted until and during the date of the hearing.
4. The Applicant is required to appear before the Board of County Commissioners at the time
and date of the public hearing at which time the Board will consider the request. In addition,
the Applicant shall provide proof, at the hearing, that proper notice was provided.
5. Once the Board makes a decision regarding the Special Use request, Staff will provide the
Applicant with a signed resolution memorializing the action taken by the Board. Following
the Board's approval, this office will issue the Special Use Permit to the applicant. If the
Board's approval includes specific conditions of approval to be met, this office will not issue
the Official Special Use Permit certificate until the applicant has satisfied all conditions of
approval. The Special Use Permit approval is not finalized until this office has issued the
Official Special Use Permit certificate signed by the Chairman of the Board of County
Commissioners.

GARFIELD COUNTY BUILDING AND PLANNING DEPARTMENT
AGREEMENT FOR PAYMENT FORM
(Shall be submitted with application)
GARFIELD COUNTY (hereinafter COUNTY) and
(hereinafter APPLICANT) agree as follows:
Chevron U.S.A. Inc.
1. APPLICANT has submitted to COUNTY an application for Special Use Permit for
A Communication Facility at Tom Creek Gulch (hereinafter, THE PROJECT).
2. APPLICANT understands and agrees that Garfield County Resolution No. 98-09, as amended,
establishes a fee schedule for each type of subdivision or land use review applications, and the guidelines for
the administration of the fee structure.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved in processing the
application. APPLICANT agrees to make payment of the Base Fee, established for the PROJECT, and to
thereafter permit additional costs to be billed to APPLICANT. APPLICANT agrees to make additional
payments upon notification by the COUNTY when they are necessary as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the consideration of an
application or additional COUNTY staff time or expense not covered by the Base Fee. If actual recorded costs
exceed the initial Base Fee, APPLICANT shall pay additional billings to COUNTY to reimburse the COUNTY
for the processing of the PROJECT mentioned above. APPLICANT acknowledges that all billing shall be paid
prior to the final consideration by the COUNTY of any land use permit, zoning amendment, or subdivision
plan.

I. APPLICATION SUBMITTAL REQUIREMENTS
As a minimum, specifically respond to all the following items below and attach any
additional information to be submitted with this application:
1. Please submit, in narrative form, the nature and character of the Special Use
requested. Submit plans and supporting information (i.e. letters from responsible
agencies). Include specifications for the proposed use including, but not limited to,
the hours of operation, the number and type of vehicles accessing the site on a daily,
weekly and/or monthly basis, and the size and location of any existing and/or
proposed structures that will be used in conjunction with the proposed use, and
provisions for electric power service and any other proposed utility improvements.

Proposed Use
Site description
Chevron U.S.A. Inc. plans on constructing a communications tower on its property in Garfield County.
The tower will provide both voice and data communications for the company's tight gas operations in the
Skinner Ridge Field to the company's office in Grand Junction, Colorado. The tower will also provide
communication support for drilling operations. The tower will be located as follows:
1. SWNW/4 of Section 36, T5S, R98W of the 6th Prime Meridian
The facility will be integrated into the communication system that Chevron is establishing for its Skinner
Ridge field. It will allow for field personnel in the vicinity of Tom Creek Gulch to communicate with the
local company office in Grand Junction, and will allow remote monitoring of operations by both the local
company office and the main office in Houston, Texas. The tower will be sited for line of sight to point
down valley to an existing tower location near the end of County Road 211.
Chevron will be operating in a fairly remote area with very few residents and where the terrain features
are very extreme. The elevation between the valley floor and the top of the mesa averages around 1500'
in height. With these features the area has little to no infrastructure for communication available and any
that are available are limited in expansion for added service. The proposed facility will add to the
communication coverage Chevron needs as it develops its property along Clear Creek Canyon. The
proposed facility will assist Chevron in ensuring safe and efficient operations.
Site Design
The tower will be 30 feet tall and will have radio transmission and receiver equipment with self contained
power sources. The tower base will consist of a 10' X 10' pad constructed from either compacted gravel
or concrete with the tower base set in the ground within an approximately 2' X 5' concrete filled hole
within the pad. The tower base may be larger due to ground conditions. However, the surface
disturbance will not be larger than the 10' X 10' pad. The pad will also have a battery box located on it
as well. The tower is entirely self supporting and will not require guy wires for anchoring or stabilization.
The tower will be utilized for the life of the Chevron's Skinner Ridge Field which is expected to last at
least thirty years.
A representative drawing is attached.
The facility will be designed and operated pursuant to the rules and regulations of the Colorado Oil & Gas
Conservation Commission and the International Fire Code as such regulations pertain to the operations of
the facility.

The tower and related equipment will not create heat, radiation or fumes. The finish of the tower is
matted and should not create any glare.
The total disturbance for this location will consist of approximately of 260 square feet. The tower
location will be 10' X 10' for 100 sq ft and a turn around of 8' X 20' for 160 sq ft. An existing two track
road will provide access to the location. Consequently, no new roads will be built. Since access is from a
private road, no driveway or county road access permits will be needed. The disturbed area will be
managed in accordance with the attached Soil Management and Revegetation Plan. When the tower is no
longer useful the location will be reclaimed in accordance with the attached Reclamation Plan.
Hours of Operation
The tower will be used continuously 24 hours per day, seven days a week in all types of weather. No
utilities will be utilized for the operation of the towers. This tower is powered by deep cycle batteries that
will be recharged by solar panels rigged to the tower. The facility will be operated in accordance with
Garfield County and Federal Communication Commission regulations.
Vehicles, Machinery, and Structures
Vehicles accessing the location will be light to medium duty trucks and the traffic will be limited to
periodic maintenance and any repairs that might occur between any scheduled maintenance.
The only construction, other than assembling the tower, will be the construction of the pad. No buildings
or other structures will be needed for the tower.
Electric Power Service and any other proposed utility service
No utilities will be utilized for the operation of the tower. Power for the tower is provided by deep cycle
batteries that will be recharged by solar panels rigged to the tower. No water or sanitation service will be
used for the operation of this facility. The facility will comply with the National Electrical Code as the
code pertains to the design, construction, and operation of the tower.
2. If you will be using water or will be treating wastewater in conjunction with the
proposed use, please detail the amount of water that would be used and the type of
wastewater treatment. If you will be utilizing well water, please attach a copy of the
appropriate well permit and any other legal water supply information, including a
water allotment contract or an approved water augmentation plan to demonstrate that
you have legal and adequate water for the proposed use.
Water Use
No water will be used for the operation of this facility.
Water well
Currently, there are no water wells located at the tower location, nor are there any wells planned in the
future.

Wastewater
The proposed activities on this site will not generate any wastewater.
Sanitation
None needed.
Water Pollution
There will not be any substances used on this site that pose a threat to the surrounding water quality.
No fuel or hazardous materials will be stored on the site.
Stormwater Management
The total disturbance will be Less than one acre to construct the towers. Construction will be limited to
the amount necessary to build the 10'X 10' pad and the 8' X 20' turnaround. No stormwater management
plan should be needed.
See attached map showing disturbance.
3. Submit a site plan /map drawn to scale that portrays the boundaries of the subject
property, all existing and proposed structures on the property, and the County or
State roadways within one (1) mile of your property. If you are proposing a new or
expanded access onto a County or State roadway, submit a driveway or highway
access permit.
No improvements to county or state roadways are planned.
A vicinity map including the roads that will be used in association with the proposed use is attached.
4. Submit a vicinity map showing slope / topography of your property, for which a
U.S.G.S. 1:24,000 scale quadrangle map will suffice.
Attached is a plat for the location of this facility.
5. Submit a copy of the appropriate portion of a Garfield County Assessor's Map
showing all subject property and public and private landowners adjacent to your
property (which should be delineated). In addition, submit a list of all property
owners, private and public landowners and their addresses adjacent to or within 200
ft. of the site. This information can be obtained from the Assessor's Office. We will
also need the names (if applicable) of all mineral right owners of the subject property.
(That information can be found in your title policy under Exceptions to Title).
The Garfield County Assessor's Map that depict the area the proposed use encompasses is attached.

The tower sets on a tract where Chevron owns the surface and the Bureau of Land Management owns the
minerals. The tract is Tract 104 on the attached plat and comprises approximately 40 acres. The tower is
located for line -of -sight down valley to another tower located near the end of County Road 211("Hiner
Gate") located in Section 10, T6S, R98W. The location is necessary to give the best vantage point to the
Hiner Gate tower in order to support Chevron's drilling, completion and production operations at the
entrance to Tom Creek Gulch.
6. Submit a copy of the deed and a legal description of the subject property.
The deed and legal description to this property are attached.
7. If you are acting as an agent for the property owner, you must attach an
acknowledgement from the property owner that you may act in his/her behalf.
8. Submit a statement that specifically responds to each of the following criteria from
Section 5.03 of the Zoning Regulations:
(1) Utilities adequate to provide water and sanitation service based on accepted
engineering standards and approved by the Board of County Commissioners
shall either be in place or shall be constructed in conjunction with the
proposed use.
No utilities will be needed to provide either or water or sanitation services for the proposed use.
(2) Street improvements adequate to accommodate traffic volume generated by
the proposed use and to provide safe, convenient access to the use shall
either be in place or shall be constructed in conjunction with the proposed
use.
No street improvements will be needed. All access will be on company property. No new access from
county roads will be needed.
(3)
Design of the proposed use is organized to minimize impact on and from
adjacent uses of land through installation of screen fences or landscape
materials on the periphery of the lot and by location of intensively utilized
areas, access points, lighting and signs in such a manner as to protect
established neighborhood character.
The tower will be in remote a fairly location and will not impact any adjacent land uses. The location in
Section 36 T5S, R98W is approximately two miles from the end of County Road 211. While the minerals
in the tract where the tower is located belong to the BLM, the tower will not interfere with any rights of
the BLM and will not affect any of the other adjoining property owners. There will be no lighting or
signs except for any warning signs.

9. Depending on the type of Special Use Permit requested, you may need to respond
to additional conditional use review standards in the Garfield County Zoning
Resolution Section 5.00[Supplementary Regulations]. This may include uses such
industrial uses [section 5.03.07 & 5.03.08], Accessory Dwelling Units [section 5.03.21]
Utility Zine/Utility Substations, etc. Specific sections of the Zoning Resolution which
can be located on the Garfield County web site at http://www.qarfield-
countv.com/buildinq and planninqi/index.htm or information can be obtained from
this office.
5.03.13 Broadcasting Studio and/or Communication Facility: Such broadcasting studios
and/or communication facility shall be approved by the Federal Communication
Commission and the Federal Aviation Administration, where appropriate. (A84-78;97-60)
The proposed use will comply with the Federal Communications Commission regulations. Due to the
height and the location of the tower Federal Aviation Administration regulations will not apply to this
tower.
See attached determination from the Federal Communications Commission.
1. All facilities shall comply with the radio frequency emission requirements of the
Federal Communication Commission and any facility in compliance cannot be denied.
The transmission and receiving equipment and antennas for the proposed use will comply with Federal
Communication Commission regulations for the class of equipment and frequency emissions.
2. The co -location of telecommunications facilities on one site is encouraged and the
denial of a landowner/lessor of the co -location of a site shall be based on technical
reasons, not on competitive interests. It is the County's policy to minimize the number of
communication facilities by the encouragement of co -locating such facilities.
Whenever possible, Chevron will co -locate communications facilities at existing sites. However, for the
proposed use there are no other suitable facilities that would provide the service that Chevron needs for its
operations. Any future request for co -location at this site will be considered on technical merits.
3. A freestanding telecommunications facility, including antennas, shall not exceed
the maximum structure height in the applicable zone district unless an exception is
approved by the Board based on the applicant demonstrating the following: (A97-60)
For the applicable zone district there is no specified maximum height for the proposed use.
(a) Use of existing land forms, vegetation and structures to aid in
screening the facility from view of blending in with the
surrounding built natural environment
The facilities are located in remote areas and should not impact any adjacent land uses and generally be
out of the view of the public.
(b) Design, materials and colors of antennas and their support
structures, shall be compatible with the surrounding environment,
and monopole support structures shall taper from the base to the
tip.

The tower structures are open lattice type construction and have a low visible impact. Other than the
towers there will be no other structures. The tower will be dull galvanized steel and will not cause any
glare and due the open lattice structure will be practically invisible.
(c) It is consistent with existing communication facilities on
the same site.
There are currently no communication facilities at the proposed site.

provide the fee with the application.

Appendix #2
Soil Managemen and Revegation Plan
Soil Management and Revegetation Plan
Due to the relatively small disturbance at the tower location, Chevron U.S.A. Inc. will
institute the following procedures to manage the soil and institute revegetation at the
location in SWNW/4 Section 36, T5S, R98W.
Prepare Site
I . In a spot close to the base flat blade a turn around for vehicle 8'x 20'.
2. At the tower site, layout 10' x 10' pad site.
3. Clear pad site of all vegetation down to bare soil.
4. Bag the cleared vegetation and dispose of the material in a licensed
land fill.
Construct Tower Base
1. In the center of the cleared area, auger or dig by hand a 2' x 5' hole.
2. Rake and scatter evenly the earth removed from the hole around the 10' x
10' pad site.
3. Compact the soil within the 10' x 10' pad site.
4. Set tower base into hole.
5. Mix and pour cement into hole to complete tower base.

1. In the areas cleared for access utilize erosion control measures as specified
in Chevron's Storm Water Management Plan.
2. Replant the access areas with a county approved seed mix.
3. Monitor locations and treat for noxious weeds.
4. If necessary reseed areas around tower locations with county approved
seed mix.

Reclamation Plan
Reclamation Plan
Chevron U.S.A. Inc. will utilize the following procedures to reclaim the site in the
SWNW/4 Section 36, T5S, R98W.
Tower Removal and Surface Reclamation
1. Remove all radio equipment, batteries and battery equipment from tower.
2. Dismantle the tower.
3. Break up pad and remove.
4. Excavate a portion of the dirt from beside the tower foundation and tip the
foundation on its side and bury at 2' to 3' below ground level.
5. Remove tower, equipment and pad material from location, and reuse,
salvage or dispose in a licensed landfill.
6. In the disturbed area redistribute and recontour top soil .
7. Broadcast the disturbed area with a county approved seed mix.
8. Cover disturbed area with either weed free mulch or a seed blanket.
9. Monitor disturbed areas for noxious weeds and treat as needed until the
disturbed areas are revegetated.
10. Notify the County Vegetation when revegetation has occurred and
schedule aninspection.
