Douglas Cerise A tract of land located in portions of Section 18 and 19, T7S, R87W and Sections 13 and 24, T7S, R88W; more practically described as a tract of land located approximately 3 1/2 miles north of the State Highway 82 and C.R. 103 intersection off of C.R. 103. A one (1) acre area within a portion of a 303 acre ranch. None None C.R. 103 EXISTING ZONING: A/R/RD A/R/RD ADJACENT ZONING: I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The tract of land is located in District C, Area of Minor Environmental Constraints of the Garfield County Comprehensive Plan. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural portion of the County that has large lot residential development and agricultural operations. The proposed storage and processing site has some sagebrush on a relatively flat unimproved area above the irrigation ditch line. B. Project Description: It is proposed to store logs hauled down from Red Table Mountain on a portion of a ranch approximately one (1) acre in size. The logs will be hand peeled on site with drawknives and axes only, no machine processing. It is anticipated that 5 to 10 log trucks will deliver logs in the fall, with the same number leaving later in the year. No utilities are proposed for the site, since none are required. C. History: The log storage was started on the site illegally and the proposed application is a response to the notice sent by the County to correct the zoning violation. III. MAJOR ISSUES AND CONCERNS A. Zoning -The A/R/RD zone district allows natural resource processing and storage by special use. A special use must be compatible with adjacent and nearby land uses. Directly adjacent to the proposed storage area is the Hawkridge subdivision with the remaining portion of the site being open agricultural land. The Board may require -:J- . ~ ; fencing, or a wall, to screen the storage area from adjacent property. Due to the higher elevation of the adjacent residential development to the north, it is impossible to visually screen the site. B. Staff Comments -In addition to the log trucks, there is heavy equipment on site for moving logs around the area. According to neighbors, there are chain saws used on site in addition to the non-motorized equipment. While the applicant feels that the use is unobtrusive, the use will be highly visible to neighbors with potential dust and smoke affecting adjoining properties due to the removal of vegetation. IV. SUGGESTED FINDINGS 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That the proposed Special Use is not compatible with the adjacent land uses. 4. For the Special safety, welfare above stated and other reasons, the proposed Use is not in the best interest of the health, morals, convenience, order, prosperity and of the citizens of Garfield County. V. RECOMMENDATION - Denial of the proposed Special Use permit due to incompatibility with the adjacent residential development . .
