At a regular meeting of the Board of County Commissioners for Garfield County,
Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood
Springs on, Monday, the 17th day of June A.D. 2002, there were present:

when the following proceedings, among others were had and done, to-wit:
RESOLUTIONNo. 2002-99
A RESOLUTION APPROVING A FLOODPLAIN SPECIAL USE PERMIT TO
CONSTRUCT A SINGLE-FAMILY DWELLING FOR BERNARD PONCELET
LOCATED PARCEL 1 OF THE DAY SUBDIVISION.
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, received an
application from Bernard Poncelet, owner, for Floodplain Special Use Permit; and
WHEREAS, the subject property contains approximately 6.5 acres and is located within a
delineated l 00-year floodplain area and requires A Floodplain Special Use Permit; and
WHEREAS, the owner has demonstrated compliance with all required review criteria and I
or standards for the Floodplain Special Use Permit; and
WHEREAS, the Board of County Commissioners, continued the public hearing to June 17,
2002;and
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, held a
public hearing on the 17th day of June, 2002, upon the question of whether the above described
Floodplain Special Use Permit should be granted or denied, at which hearing the public and
interested persons were given the opportunity to express their opinions concerning the approval the
aforementioned requests; and ·

WHEREAS, the Board of County Commissioners of Garfield County, Colorado, on the basis
of substantial competent evidence produced at the aforementioned hearing, has made the
following determination of fact as listed below:
1. That proper public notice was provided as required for the hearing before the Board
of County Commissioners;
2. That the hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that meeting;
3. That for the above stated and other reasons, the request for Floodplain Special Use
Permit is in the best interest of the health, safety, morals, convenience, order,
prosperity and welfare of the citizens of Garfield County.
4. That the application is in conformance with the Garfield County Zoning Resolution
of 1978, as amended;
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that the Floodplain Special Use Permit request is hereby approved subject to
compliance with all of the following specific conditions:
A. All items indicated in the staff report, recommended by the Board of County Commissioners, and
included by the Board of County Commissioners at the public hearing as itemized below:
1. All representations of the applicant made in the application and during the public hearing
shall be considered conditions of approval, unless approved otherwise by the Board of
County Commissioners.
2. The applicant shall meet all requirements of the Garfield County Zoning Resolution of 1978,
as amended, and shall meet all building code requirements.
3. Prior to the issuance of a certificate of occupancy, the Applicant shall provide the Garfield
County Building and Planning Department with an official survey indicating the proposed
home location was surveyed and the finished floor elevation must be constructed at 6182.1
feet in order to be one foot above the floodplain elevation. The applicant has represented that
the finished floor for the primary residence will be 6183.5 feet, which will meet the
floodplain regulations. This survey is to be completed by a licensed surveyor who shall sign
and stamp the survey submitted to this Department.
