PROCEDURAL REQUIREMENTS (The following steps outline how the variance application review process works in Garfield County.) 1. Submit this completed application form (pages 1-3), base fee, and all submittal requirements to the Garfield County Planning Department. It will be received and given to a Staff Planner who will review the application for technical compliance. 2. Once the application is deemed is technically complete, the Staff Planner will send you a letter indicating the application is complete and will request additional copies for the board to review. Jn addition, Staff will also send you a "Public Notice Form(s)" indicating the time and date of your hearing before the Board of Adjustment. Prior to the public hearing, Staff will provide you with a Staff Memorandum regarding your requested variance. 3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the requested variance and the public hearing. If proper notice has not occurred, the public hearing will not occur. Notice requirements are as follows: a. Notice by publication, including the name of the applicant, description of the subject lot, a description of the proposed variance and nature of the hearing, and the date, time and place for the hearing shall be given once in a newspaper of general circulation in that portion of the County in which the subject property is located at least thirty (30) but not more than sixty (60) days prior to the date of such hearing, and proof of publication shall be presented at hearing by the applicant. b. Notice by mail, containing information as described under paragraph (1) above, shall be mailed to all owners of record as shown in the County Assessor's Office of lots within two hundred feet (200') of the subject lot and to all owners of mineral interest in the subject property at least thirty (30) but not more than sixty (60) days prior to such hearing time by certified return receipt mail, and receipts shall be presented at the hearing by the applicant. c. The site shall be posted such that the notice is clearly and conspicuously visible from a public right-of-way, with notice signs provided by the Planning Department. The posting must take place at least thirty (30) but not more than sixty (60) days prior to the hearing date and is the sole responsibility of the applicant to post the notice, and ensure that it remains posted until and during the date of the hearing. 4. The Applicant is required to appear before the Board of Adjustment at the time and date of the public hearing at which time the Board will consider the variance request. In addition, the Applicant shall provide proof at the hearing that proper notice was provided. 5. This property consists of an existing Kingdom Hall (place of worship) with 'off street' parking that was constructed approximately 30 years ago. Zoning regulations and guidelines that are in force today did not exist at that time. A Variance Application for this property was initially submitted in August 2005, but it was determined by the Zoning department that a Conditional Use Permit would be required prior to our requesting a variance. As of March 2007, we were granted a Conditional Use Permit from the Zoning Department. The owners of this property are now requesting a variance from the Garfield County Zoning Department to demolish the existing building and parking lot and construct a new Kingdom Hall with new 'off street' parking facilities. Although the existing building has an attached one bedroom apartment; the owners have decided to eliminate the apartment in the new construction. The existing property is located on Lions Ridge Road, 250 feet east of Catherine Store Road, and 750 feet north of Highway 82, in Carbondale, .Colorado. This property is zoned AIR/RD and contains 41,382 square feet or 0.95 acres of land. The existing lot coverage including building, parking, and walkways consists of 23,740 SF or 57.4% of the total property. Included in this square footage is a 30' right-of-way dedicated for a portion of Lions Ridge Road that runs through the south side of the property. The utilities for this property consists of overhead electrical service from 'Holy Cross Energy', underground gas service from 'Kinder Morgan Energy', and water service provided by a potable well system belonging to the 'Lions Ridge Estates Homeowner's Association, of which the church is a member. The building is provided with a private septic tank & drainfield located under the gravel parking area located on the west side of the building that was installed at the time of the original construction, and rebuilt & enlarged in 1989, when a one bedroom apartment was constructed. Information related to these utilities was recorded with the Zoning Department when the owners applied for the Conditional Use Permit. Kingdom Hall Variance Application Page2 The proposed improvements to the property consists of a new one story wood frame Kingdom Hall (place of worship), new and enlarged 'off-street' parking lot, a detached storage & maintenance shed, connecting sidewalks, and a new septic tank & drainfield. The proposed building, parking lot, and amenities as described above, and indicated on the attached drawings, consists of a total of 26,240 SF or 63.4% of the lot. This constiMes an increase in lot coverage of 6.0%. The minimum lot size in the present Zoning regulations is 2 acres (Section3.02.04) with a maximum lot coverage of 15% (Section 3.02.05). We are requesting that a variance fur this increase be approved, as the overall impact on the site remains essentially unchanged. In addition, a new open air 'porte cochere' (drive-tbru) extends into the front setback by 7 .O', which we would like to include in our variance request. (Section 3.01.06.1.a) The site itself has an unusual shape, bordered by steep grades to the north (greater than 30 %), and Lions Ridge Road running through the south portion of the property. The usable area for development is therefore highly restrictive, making for a peculiar and exceptional hardship. The proposed plan allows for more adequate off-street parking. improved access to the parking areas, and more efficient use of the site. Although the lot coverage is higher than allowed by the present zoning regulations, the site is surrounded by designated 'open space' making the perceived lot coverage much lower. The owners have met with the Lions Ridge Homeowner's Association, which represents the owners living on all sides of this property, and they have found no objection to the proposed improvements. They are, in fact, unanimously in favor of the proposed construction, as it will solve a number of existing traffic problems, and greatly improve the overall appearance of the site, which serves as the entrance to the subdivision. The association has offered to submit a letter to the Variance Board, documenting their favorable response to our plans.
