BACKGROUND
The Building and Planning Department received a Conditional Use Permit (CUP)
application for a "Warehouse Facilities I Storage Area" on an approximately 10,300-acre
property owned by Oxy USA WTP LP. The site is located approximately 13.5 miles
northeast of the Town of DeBeque.
More specifically, the Applicant requests approval from the Board for a warehouse and
storage area (2.5 acres) approximately two (2) miles past the end of County Road 213.
Site disturbance is to be limited to 2.5 acres with site development consisting of material
and equipment storage and a 100 x 60-foot warehouse building (Quonset-hut style). Total
construction time is expected to be two to three weeks. As no permanent personnel are to
be stationed at this facility, no utilities C)re to be provided onsite aside from a portable
toilet, portable power generator for occasional lighting and bottled water for personnel
utilizing the site.
The proposed facility is not anticipated to be viewable from any public right-of-way or,
following a review of nearby address points, from any existing residences in the area.
The Applicant has represented this application in the following manner:
OXY USA WTP LP (OXY) requests a Garfield County Conditional Use Permit {CUP) for
warehouse facilities/storage area {Warehouse Site) to support Its natural gas
development and operations activities. The presence of the warehouse/storage area
will allow OXY to stockpile supplies during good weather which will reduce traffic during
bad weather, ultimately increasing the safety of their operation. The praposed facility is
located approximately 13.5 miles NE of the Town of De Beque at an elevation of
approximately 8,600 feet (Figure 1). The facility will be accessed via Garfield County
Road 213 north of the Town of De Beque and then via OXY's private roads. The
relatively remote nature of OXY's operations necessitates the construction of this facility
so that equipment and materials may be stored in a central location. The construction
of the Warehouse Site at this locatlon will minimize the need for materials lo be
transported to the area during times of inclement weather thereby increasing the safety
of OXY's operations.
Details of this request along with the infonnation required by Garfield County's CUP
application and Sections 3.10.01, 5.03, and 9.02 of the Garfield County Zoning
Resolution of 1978, as amended, are provided below. Figure 2 provides a compliance
matrix identifying the sections of this application that address each of Garfield County's
requirements.

In addition, the Applicant has made the following representations:
3.2 Hours of Use and Traffic Considerations
The Warehouse Site will be accessible to OXY personnel and contractors 24 hours-a-
day, 365-days-a-year, weather permitting. The facility will generally be unmanned;
however, daily inspections, weather permitting, will be conducted by local operations
personnel.
An analysis of the traffic anticipated to be generated by this project is provided in
Appendix L As indicated in that analysis, the vehicles that will be hauling materials and
equipment to this facility during its operation would normally be hauling the same
materials and equipment to Individual well locations. Therefore. the frequency of
vehicle trips to the site after construction is complete is expected to be similar to the
current opera!ional frequency. However, because these materials and equipment can
be stock piled at the Warehouse Site during periods of good weather, the presence of
this facility will minimize the need for trucks to deliver durlng inclement weather,
significantly increasing the safety of OXY's operations.
The Warehouse Site is located approximately 11 miles up Conn Creek Road (Garfield
County Road 213), and OXY's existing private roads. The road provkfes safe and
adequate access and egress onto and off of Garfield County Road 213. The
construction of the Warehouse Site would have minimal direct impact to County Road
213, and street improvements would not be necessary.
All construction and operations personnel will park on slte and will not block or hinder
normal traffic on County Road 213. All activities on this site will be conducted out of the
right-of-way of County Road 213, and all loading and unloading of vehicles will be
conducted otrt of the public rig ht-of-way.
The Warehouse will be equipped with emergency provisions for anyone stranded by
inclement weather and a first-aid station. A comprehensive emergency response plan
for all of OXY's operations Is Included as Appendix E.

II § 5.03 Review Standards
(1) Utilities adequate to provide water and sanitation service based on
accepted engineering standards and approved by the Board of County
Commissioners shall either be in place or shall be constructed in
conjunction with the proposed use;
Staff Finding
The proposed Warehouse and Storage Facility does not include any restroom or other
sanitary facilities and the Applicant has not represented any water rights or ability to
install an ISDS on the site. The Applicant has represented that portable toilets and bottled
water will be provided onsite for those individuals working at the warehouse facility. As
there are not to be any permanent staff occupying the warehouse and storage facility
however, staff finds that the proposed sanitation facilities are adequate for this level of
occupancy.
(2) Street Improvements adequate to accommodate traffic volume
generated by the proposed use and to provide safe, convenient access
to the use shall either be in place or shall be constructed in
conjunction with the proposed use;
Staff Finding
Staff referred this application to Garfield County Road and Bridge Department (Road and
Bridge). Road and Bridge provided the following comments:
Garfield County Road & Bridge Department has no objections to
this application with the following comments. This application is
exempt from the driveway access permit requirement as the access
is from a private owned road above the end of the County road
system. All vehicles hauling equipment and materials for this
application shall abide by Garfield County's oversize/overweight
permits system. All vehicles requiring an oversize/overweight
permit shall have on file with Garfield County Road & Bridge
Department a letter from OXY USA stating such vehicles can
obtain oversize/overweight permits under their road bond on file
with Garfield County Road & Bridge Department.
The traffic analysis prepared by Tim Dobransky of Cordilleran Compliance Services
represents the following:

Initially, until the Warehouse Site is sleeked, it is anticipated the total number of vehicles that will access
the facility during a typical day would range from 9 to 14 vehicles. After the yard is stocked, subsequent
vehicles could average 2 trips per day made by a light-duty vehicles, and 2-3 for tractor trailers. The
following table identifies the anticipated trip generation for the project. It is important to note that OXY
will be conducting numerous activities within the proposed area, and the traffic activity will occur with or
without the site development and site operations of the Warehouse site.

Based on the current energy related traffic load on County Road 213, OXY's traffic activity should have a
minimal increase on traffic activity including Light and Heavy vehicles. All vehicles hauling equipment
and material for project construction will abide by Garfield County regulations.
Based on the aforementioned findings, Staff finds that as long as the Applicant obtains
and abides by all conditions from the Garfield County Road and Bridge Department that
the street improvements are adequate to accommodate the traffic volume generated by
the proposed use.
(3) Design of the proposed use is organized to minimize impact on and
from adjacent uses of land through installation of screen fences or
landscape materials on the periphery of the lot and by location of
intensively utilized areas, access points, lighting and signs in such a
manner as to protect established neighborhood character;
Staff Finding
Adjacent and nearby uses include intense gas extraction activities. The site will not be
visible from any public roads and is not expected to impact any neighboring residences.
The Applicant has made the following representations:
The remote location of this facility and the type of operations that will occur should
eliminate many of the other impacts required to be addressed in this application. No
smoke, vibration, heat, radiation or fumes will be produced as a result of the operation
of this facility. The topography surrounding the site acts as a visual barrier in most
directions, and the site will not be visible from any public roads. Lighting will only be
required during unscheduled nighttime maintenance and all lights on the property will be
pointed downward and screened to prevent direct reflection on any adjacent property.
Section 5.03.07 Industrial Operation
The applicant for a permit for industrial operations shall prepare and submit to the

Planning Director ten (10) copies of an impact statement on the proposed use
describing its location, scope, design and construction schedule, including an
explanation of its operational characteristics. One (1) copy of the impact statement
shall be filed with the County Commissioners by the Planning Director. The impact
statement shall address the following:
(1) Existing lawful use of water through depletion or pollution of surface
run-off, stream flow or ground water;
Staff Finding
The proposed Warehouse and Storage Facility does not include any restroom or other
sanitary facilities and the Applicant has not represented any water rights or ability to
install an ISDS on the site. The Applicant has represented that portable toilets and bottled
water will be provided onsite for those individuals working at the warehouse facility. As
there are not to be any permanent staff occupying the warehouse and storage facility
however, staff finds that the proposed sanitation facilities are adequate for this level of
use.
The Applicant has applied to CDPHE for a Construction Stormwater Permit. This
application will need to be approved prior to commencement of construction.
Staff recommends that a condition of approval be added to the Special Use Permit
requiring the Applicant to install a containment system for the fuel storage and all other
liquid chemical storage on the site. This containment system(s) should be adequate to
contain 110% of the total capacity of the stored liquids.
(2) Impacts on adjacent land from the generation of vapor, dust, smoke,
noise, glare or vibration, or other emanations;
Staff Finding
The expected emanations from this facility are expected to be limited to noise and dust.
Staff recommends periodic treatment of the gravel driveway and parking area to reduce
dust emissions.
A sound analysis prepared by Cordilleran Compliance Services which demonstrates
general compliance with the State Statute regarding noise.
(3) Impacts on wildlife and domestic animals through the creation of
hazardous attractions, alteration of existing native vegetation,
blockade of migration routes, use patterns or other disruptions;
Staff Finding
This application was referred to both the Garfield County Vegetation Management
Department and the Colorado Division of Wildlife.

The Garfield County Vegetation Department had the following comments (See Exhibit H):
The applicant states that a 2008 Noxious Weed Inventory will be performed, this
information is not included.
In 4 different locations throughout the application, different reclamation seed
mixes are referred to. Appendix H contains 6 BLM seed mixes bringing the total
mixes mentioned in the application to nine.
Integrated Vegetation and Weed Management
• The Noxious Weed Management Plan indicates that a weed inventory will be done in 2008. This
information is not included. The weed management plan is contingent upon a current inventory.
• Staff requests that the applicant provide a current inventory and a weed management plan based
on the current inventory.
Reclamation
• The applicant has quantified the surface area to be disturbed as 2.5 acres on private land. Staff
recommends a security of $10,000 based on the long-term rate of $4000/acre x 2.5 acres.
• The security shall be held by Garfield County until vegetation has been successfully reestablished
according to the Reclamation Standards in the Garfield County Weed Management Plan. It is the
responsibility of the applicant to contact the County, upon successful revegetation establishment,
to request an inspection for security release consideration
• The applicant shall provide the Vegetation Management Department with copies of the original
tags from each seed bag. We do ask that the applicant specify which seed mixture they plan on
using.
The Colorado Division of Wildlife stated in Exhibit J that "Based both on the location and
type of action being proposed the Division believes impacts to the wildlife resource to be
negligible."
(4) Affirmatively show the impacts of truck and automobile traffic to and
from such uses and their impacts to areas in the County;

Staff referred this application to Garfield County Road and Bridge Department (Road and

(5) That sufficient distances shall separate such use from abutting
property which might otherwise be damaged by operations of the
proposed use(s);

The Applicant has made the following representations:

Permits may be granted for those uses with provisions that provide adequate
mitigation for the following:
1) A plan for site rehabilitation must be approved by the County
Commissioners before a permit for conditional or special use will be
issued;
2) The County Commissioners may require security before a permit for
special or conditional use is issued, if required. The applicant shall
furnish evidence of a bank commitment of credit, bond, certified check
or other security deemed acceptable by the County Commissioners in
the amount calculated by the County Commissioners to secure the
execution of the site rehabilitation plan in workmanlike manner and in
accordance with the specifications and construction schedule
established or approved by the County Commissioners. Such
commitments, bonds or check shall be payable to and held by the
County Commissioners;
3) Impacts set forth in the impact statement and compliance with the
standards contained in Section 5.03.08 of this Resolution.
Staff Finding
As this will be a disturbance of 2.5 acres of currently undisturbed ground, Staff
recommends a reclamation security be held in the amount of $10,000 based on the long-
term rate of $4000/acre x 2.5 acres (See Exhibit H).
III §5.03.08 Industrial Performance Standards
(1) Volume of sound generated shall comply with the standards set forth
in the Colorado Revised Statutes at the time any new application is
made;

Cordilleran Compliance Services prepared a sound analysis. The sound analysis
demonstrates anticipated compliance with the State Noise Statue.
(2) Emission of smoke and particulate matter: Every use shall be
operated so as to comply with all Federal, Sate and County air quality
laws, regulations;

The entrance to the facility is expected to be graveled as is the parking area. All vehicles
accessing the site will be licensed and in compliance with State and Federal
requirements. Staff has included a recommended condition of approval requiring period
treatment of the facility to reduce the amount of dust emanation.
(3) Emission of heat, glare, radiation and fumes: every use shall be so
operated that it does not emit heat, glare, radiation or fumes which
substantially interfere with the existing use of adjoining property or
which constitutes a public nuisance or hazard. Flaring of gases,
aircraft warning signals, reflective painting of storage tanks, or other
such operations which may be required by law as safety or air
pollution control measures shall be exempted from this provision;

Aside from emissions generated by the electric generator and vehicles and trucks
accessing the site, the Applicant does not represent uses that will generate heat, glare,
radiation or fumes.
(4) Storage area, salvage yard, sanitary landfill and mineral waste
disposal areas:
a) Storage of flammable or explosive solids or gases shall be in accordance
with accepted standards and laws and shall comply with the national, state
and local fire codes and written recommendations/comments from the
appropriate local protection district regarding compliance with the
appropriate codes;

All storage of flammable or explosive solids or gases shall comply with all applicable laws
at the national, state and local levels. In addition, Staff recommends a condition of
approval requiring a containment system(s) for 110% of the total capacity for all liquid
chemicals stored on the site.
b) At the discretion of the County Commissioners, all outdoor storage facilities
may be required to be enclosed by fence, landscaping or wall adequate to
conceal such facilities from adjacent property;

As the site is not visible from any public vantage point, Staff does not recommend the
construction of a screen fence, wall or other landscaping. However, in order to prevent
wildlife from accessing potentially dangerous chemical and fuel storage areas, Staff does
recommend that all fuel storage be either indoors or within a fully fenced area.
c) No materials or wastes shall be deposited upon a property in such form or
manner that they may be transferred off the property by any reasonably
foreseeable natural causes or forces;

d) Storage of Heavy Equipment wilf only be allowed subject to (A) and (C)
above and the following standards:

(I) The minimum lot size is five (5) acres and is not a platted subdivision.

The Subject parcel is over 10,000 acres.
(2) The equipment storage area is not placed any closer than 300 ft. from any
existing residential dwelling.
Staff Finding
Following a review of aerial photography and GIS data, it appears that the warehouse and
storage area is at least % mile from the nearest residential property.
(3) All equipment storage will be enclosed in an area with screening at least
eight (8) feet in height and obscured from view at the same elevation or
lower. Screening may include berming, landscaping, sight obscuring fencing
or a combination of any of these methods.
Staff Finding
As the site is not visible from any public vantage point, Staff does not recommend the
construction of a screen fence, wall or other landscaping. However, in order to prevent
wildlife from accessing potentially dangerous chemical and fuel storage areas, Staff does
recommend that all fuel storage be either indoors or within a fully fenced area.
(4) Any repair and maintenance activity requiring the use of equipment that will
generate noise, odors or glare beyond the property boundaries will be
conducted within a building or outdoors during the hours of 8 a.m. to 6 p.m.,
Mon.-Fri.
Staff Finding
Staff has included this requirement as a condition of approval.
(5) Loading and unloading of vehicles shall be conducted on private property
and may not be conducted on any public right-of-way.

e) Any storage area for uses not associated with natural resources shall not
exceed ten (10) acres in size.

The proposed use is in compliance with this standard.
f) Any lighting of storage area shall be pointed downward and inward to the
property center and shaded to prevent direct reflection on adjacent property.

Staff has included this requirement as a condition of approval.
(5) Water pollution: in a case in which potential hazards exist, it shall be
· necessary to install safeguards designed to comply with the
Regulations of the Environmental Protection Agency before operation
of the facilities may begin. All percolation tests or ground water
resource tests as may be required by local or State Health Officers
must be met before operation of the facilities may begin.
Staff Finding
All Regulations of the Environmental Protection Agency and all other applicable Federal,
State and Local regulations shall be complied with at all times.
IV SUGGESTED FINDINGS
1.) That proper public notice was provided as required for the hearing before the
Board of County Commissioners;
2.) That the hearing before the Board of County Commissioners was extensive and
complete and that all interested parties were heard at that meeting;
3.) The Application is in conformance with Garfield County Zoning Resolution of
1978, as amended;
4.) That for the above stated and other reason, the proposed Conditional Use Permit
is in the best interest of the health, safety and welfare of the citizens of Garfield
County;
V STAFF RECOMMENDATION
Staff recommends approval of the proposed Conditional Use Permit allowing a
"Warehouse I Storage Facility" with the following conditions of approval:
1. That all representations made by the Applicant in the application and as

testimony in the public hearing before the Board of County Commissioners shall
be conditions of approval, unless specifically altered by the Board of County
Commissioners;
2. The Applicant shall comply with all standards as set forth in §5.03.08 "Industrial
Performance Standards" of the Garfield County Zoning Resolution of 1978 as
amended and included here as follows:
a. Volume of sound generated shall comply with the standards set forth in the
Colorado Revised Statutes.
b. Every use shall be so operated that the ground vibration inherently and
recurrently generated is not perceptible, without instruments, at any point of
any boundary line of the property on which the use is located.
c. Emissions of smoke and particulate matter: every use shall be operated so
as to comply with all Federal, State and County air quality laws, regulations
and standards.
d. Every use shall be so operated that it does not emit heat, glare, radiation or
fumes which substantially interfere with the existing use of adjoining
property or which constitutes a public nuisance or hazard. Flaring of gases,
aircraft warning signals, reflective painting of storage tanks, or other such
operations which may be required by law as safety or air pollution control
measures shall be exempted from this provision.
e. Storage of flammable or explosive solids or gases shall be in accordance
with accepted standards and laws and shall comply with the national, state
and local fire codes and written recommendations/comments from the
appropriate local protection district regarding compliance with the
appropriate codes.
f. No materials or wastes shall be deposited upon a property in such form or
manner that they may be transferred off the property by any reasonably
foreseeable natural causes or forces.
g. All chemical and fuel storage will be enclosed in a fenced area at least eight
(8) feet in height.
h. Any repair and maintenance activity requiring the use of equipment that will
generate noise, odors or glare beyond the property boundaries will be
conducted within a building or outdoors during the hours of 8 a.m. to 6 p.m.,
Mon.-Fri.
i. Loading and unloading of vehicles shall be conducted on private property
and may not be conducted on any public right-of-way.

j. Any storage area for uses not associated with natural resources shall not
exceed ten (10) acres in size.
k. Any lighting of storage area shall be pointed downward and inward to the
property center and shaded to prevent direct reflection on adjacent property.
3. The total area to be used for the Warehouse I Storage Area shall not exceed
2.5 acres and shall occur within the area identified by the Applicant in the
Conditional Use Permit.
4. The Applicant shall abide by all regulations enforced by the Garfield County
Road and Bridge Department.
5. In order to control dust, the Applicant shall periodically treat the driveway and
storage area with an approved dust suppressant.
6. The Applicant shall construct an eight (8) foot tall fence containing all areas
which store chemicals or fuels.
7. All vehicles associated with this Conditional Use Permit must be licensed and
in compliance with State and Federal requirements.
8. The Applicant shall construct and install a spill containment system at 110%
of the total storage capacity for all liquid chemicals and fuels onsite.
9. The Applicant shall submit a weed inventory of the site and a weed
management plan based on the inventory. This documentation shall be reviewed
and approved by the Garfield County Vegetation Management Department prior
to the issuance of the Conditional Use Permit.
10. The Applicant shall provide a reclamation security in the amount of $10,000 to
be held by Garfield County. The applicant has quantified the surface area to be
disturbed as 2.5 acres on private land. The security of $10,000 is based on the
long-term rate of $4000/acre x 2.5 acres.
The security shall be held by Garfield County until vegetation has been
successfully reestablished according to the Reclamation Standards in the
Garfield County Weed Management Plan. It is the responsibility of the applicant
to contact the County, upon successful revegetation establishment, to request an
inspection for security release consideration
The applicant shall provide the Vegetation Management Department with copies
of the original tags from each seed bag. We do ask that the applicant specify
which seed mixture they plan on using.

Thanks for the opportunity to comment on this project. In general , the application contains weed and
revegetation information , however not all of it is pertinent to the specific application or key data is missing ,
The applicant states that a 2008 Noxious Weed Inventory will be performed, this information is not
included .
In 4 different locations throughout the application , different reclamation seed mixes ar e referred to.
Appendix H contains 6 BLM seed mi xes bringing the total mixes mentioned in the application to nine .
Integrated Vegetation and Weed Management
• The Noxious Weed Management Plan indicates that a weed inventory will be done in 2008 . This
information is not included. The weed management plan is contingent upon a current inventory .

1. No mention is made of containment systems for fuel storage or other liquid chemical storage on site . It is difficult
to tell from the submittal how close this site and these materials will be to surface waters and springs . In light of
past water quality issues in this area , I believe it is prudent to require appropriate containment systems for any
chemicals and fuels on site to prevent water contamination in the event of a spill or other release .
2 . Proper management of the site surface at all times to is necessary to minimize dust impacts.
No other concerns at this time. Thanks for the opportunity to review this application .
