I. DESCRIPTION OF THE PROPOSAL
A Special Use Permit (SUP) application was submitted by Orion Energy Partners, LP (Orion)
requesting a "Temporary Employee Housing" facility on property owned by the State of
Colorado, Division of Wildlife, known as Garfield Creek State Wildlife Area (surface owner).
The wildlife area is located south of the Town of New Castle and the well pad located
approximately 4 miles southeast of the intersection of CR 335 and 312 with direct access to
CR 312 (Garfield Creek Road). The subsurface rights are leased to Orion by Gene and
Mary Hilton (the subsurface owners) and the proposed employee housing is proposed to be
located on a COGCC APD, Hilton #23-1.
More specifically, the Applicant requests approval for a Temporary Employee Housing
facility to house personnel for the purpose of natural gas drilling operations, proposing a
minimum of 4 and a maximum of 8 personnel living at the site. The timeframe for this
request is less than 6 months as the operator has accommodated the Division of Wildlife
request to vacate the housing aspect of the operation during hunting season.

Housing Structures
All of the installed facilities are required to meet all applicable building and fire code
requirements. The facility will have sufficient potable water storage in tanks on the rig.
Sewage and Wastewater are proposed to be handled by a vault -and -haul system at each
facility.
Water: The Applicant is proposing to haul potable water to each facility using water
hauling contractors. The Applicant has provided information regarding the use of a CDPHE-
certified potable water hauler who obtains the water from an approved source. All water
must be treated prior to delivery to each facility.
Expected usage is 75 gallons, per day, per person and storage is proposed at 3,000 gallons
which would provide 5 to 10 days capacity. Delivery is expected to occur every 5 days.
Sewage: Sewage and Wastewater are proposed to be handled by a vault -and -haul system
with minimum tank capacity of 2,000 gallons with pickup occurring every 2 to 3 days.
In addition, the roads which serve the proposed facilities are demonstrated to be in good
repair and based on Staff observation, the roads are adequate for year-round access to the
facilities by wastewater and sewage hauling vehicles.
Refuse: The site is to be served by at least one thirty -gallon, bear -proof refuse receptacle
and be emptied by a refuse hauler at least once per week. Refuse is proposed to be
disposed of at the Garfield County landfill.
Proximity to Permanent Available Housing: The Applicant has stated that they are housing
some workers off-site and that the maximum of 4 essential personnel well be housed on-
site. The proposed temporary housing quarters will reduce daily vehicle trips on CR 312
and CR 335. It is Staff's opinion that onsite housing will promote safety on the drilling rigs
as well as reduce the overall amount of traffic on Garfield County and State of Colorado
roadways.
Renewal: Since the proposed facilities are to be served with vault -and -haul sewage disposal
systems, the facilities are not permitted to be on location for more than a cumulative of
one year each, therefore this Special Use Permit is not eligible for renewal.
Reclamation and Revegetation: All housing structures and associated equipment will be
completely located within the COGCC approved well pad described as Hilton #23-1.
Reclamation will be handled by the Colorado Oil and Gas Conservation Commission and
secured through the appropriate bond.

REVIEW CRITERIA FOR SPECIAL USE PERMITS (SECTION 5:03)
Pursuant to Section 5.03, as listed under the Zone District Regulations, special uses shall
conform to all requirements listed there under and elsewhere in the Zoning Resolution, as
well as the following standards:
1. Utilities adequate to provide water and sanitation service based on
accepted engineering standards and approved by the Board of County
Commissioners shall either be in place or shall be constructed in conjunction
with the proposed use.
Response
Staff feels that with the provisions made for water hauling and sewage disposal as
described above and in combination with the staff recommended conditions, this standard
is satisfied.
2. Street improvements adequate to accommodate traffic volume generated
by the proposed use and to provide safe, convenient access to the use shall
either be in place or shall be constructed in conjunction with the proposed use.
Response
Overall, the approval of this Special Use Permit for Temporary Employee Housing will
reduce traffic on the access roads to the site. In addition, County Road and Bridge has
recommended that the applicant speak with the School District regarding school bus timing
and routes. The applicant has stated in correspondence that they will avoid large truck
traffic during scheduled school bus times as provided by RE -2 School District.
3. Design of the proposed use is organized to minimize impact on and from
adjacent uses of land through installation of screen fences or landscape
materials on the peripheryof the lotand by location of intensively utilized areas,
access points, lighting and signs in such a manner as to protect established
neighborhood character.
Response
The character of the areas is largely rural in nature with the site located on a windy,
narrow road. The Garfield Creek State Wildlife Area (GCSWA) is interspersed with a few 'in
holdings', typically parcels that are agricultural/residential in nature. Mineral ownership of
the GCSWA includes both public and private entities, with this APD being related to
minerals rights held by Gene and Mary Hilton and leased to Orion Energy. The facilities
are to be located entirely on an approved COGCC well pad and will ultimately reduce the

amount of traffic to and from the site, it is Staff's opinion that these Temporary Employee
Housing facilities will not adversely affect any nearby neighbors as proposed.
II. BACKGROUND / SITE DESCRIPTION
The GCSWA was purchased by the State of Colorado in 1981 utilizing hunting and fishing
dollars. The property encompasses over 13, 000 acres of habitat for a variety of wildlife
species and is maintained by the CDOW.
An article in the Rocky Mountain News, dated June 16, 2008 and written by Ed Dentry
sates that GCSWA "is rare among the state's 230 SWAs in that it embraces a complete
ecosystem for elk: summer, winter and transitional ranges."
The Mule Deer Foundation website indicated that the extreme variety provided by this
parcel, which ranges from 5, 900 feet in elevation to 10,000 feet, provides year-round
habitat for both deer and elk.

As previously stated, the subject well pad is operated by Orion Energy who leases the
minerals from Gene and Mary Hilton. Surface ownership is the State of Colorado, Division
of Wildlife with the property commonly known as Garfield Creek State Wildlife Area. Orion
Energy has been working closely with the Division of Wildlife to alleviate or mitigate
impacts related to this use. There will be seasonal restriction as well as protective
measures for both wildlife and the environment. Recent articles also have reported that
the use of pipelines to transport water produced by the well to reduce truck traffic, as well
as water sampling around the well pad to protect water quality.
III. AUTHORITY & APPLICABILITY

Pursuant to Section 9.03.04 of the Zoning Resolution, an application for a Special Use
Permit shall be approved or denied by the Board of County Commissioners after holding a
public hearing thereon in conformance with all provisions of the Zoning Resolution.
IV. REVIEW AGENCY AND OTHER COMMENTS
Section 9.03.05 !Periodic Review ofSUP1
Pursuant to section 9.03.05 of the Zoning Resolution:
Any Special Use Permits maybe made subject to a periodic review not less than every six
(6) months ft required by the County Commissioners The purpose of such review shall be
to determine compliance or noncompliance with anyperformance requirementsassociated
with the granting of the Special Use Permit. The County Commissioners shall indicate that
such a review is required and shall establish the time periods at the time of issuance ofa
Special Use Permit Such review shall be conducted in such manner and by such persons
as the County Commissioners deem appropriate to make the review effective and
meaningfu/. Upon the completion of each review, the Commissioners may determine that
the permit operations are in compliance and continue the permit, or determine the
operations are not in compliance and either suspend the permit or require the permittee to
bring the operation into compliance bya certain specified date. Such periodic review shall
be limited to those performance requirements and conditions imposed at the time of the
original issuance of the Special Use Permit.
V. RECOMMENDED FINDINGS
1. Proper posting and public notice was provided as required for the meeting before the
Board of County Commissioners.
2. The meeting before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters and issues were submitted and that all interested
parties were heard at that meeting.
3. For the above stated and other reasons, the proposed special use permit has been
determined to be in the best interest of the health, safety, morals, convenience, order,
prosperity and welfare of the citizens of Garfield County.
4. The application has met the requirements of Special Use (Sections 5.03 and 5.02.21)
the Garfield County Zoning Resolution of 1978, as amended.

VI. STAFF RECOMMENDATION
Due to 1) the limited nature of potential impacts to surrounding properties, 2) by
proceeding with this proposal there will be an overall decrease in traffic on unimproved
roadways and county roads which will promote safety and wellbeing, 3) the fact that the
Temporary Employee Housing facility will be situated on an approved well pad with active
gas operations, and 4) that the Temporary Employee Housing facilities meet the
requirements set forth in Section 5.02.21, Staff recommends the Board approve the
request for a Special Use Permit for Temporary Employee Housing on Garfield Creek State
Wildife Area in the Agricultural / Residential / Rural Density (A/R/RD) zone district with the
following conditions:
1. That all representations of the Applicant, either within the application or stated at
the hearing before the Board of County Commissioners, shall be considered
conditions of approval unless explicitly altered by the Board.
2. That the operation of the facility be done in accordance with all applicable federal,
state, and local regulations governing the operation of this type of facility.
3. Emissions of smoke and particulate matter: every use shall be operated so as to
comply with all Federal, State and County air quality laws, regulations and
standards.
4. Emission of heat, glare, radiation and fumes: every use shall be so operated that it
does not emit heat, glare, radiation or fumes which substantially interfere with
the existing use of adjoining property or which constitutes a public nuisance or
hazard. Flaring of gases, aircraft warning signals, reflective painting of storage
tanks, or other such operations which may be required by law as safety or air
pollution control measures shall be exempted from this provision.
5. Water pollution: in a case in which potential hazards exist, it shall be necessary to
install safeguards designed to comply with the Regulations of the Environmental
Protection Agency before operation of the facilities may begin. All percolation
tests or ground water resource tests as may be required by local or State
Health Officers must be met before operation of the facilities may begin.
6. All Special Use Permits for Temporary Employee Housing are subject to all
applicable building code, state and federal permit requirements, fire protection
district requirements and fire code requirements.
7. Water and wastewater systems proposed to service Temporary Employee Housing
must comply with all applicable state and local laws and regulations.

8. Applicants must keep appropriate records, to be provided to the County upon
request to demonstrate that water supplied to a site is from an approved source
and that wastewater is disposed at an approved facility. The operator must
conduct monthly tests (or quarterly if an on-site disinfection system is installed)
and maintain records of stored potable water samples specific for coli form. Any
tests indicating coli form contamination must be disclosed to the Garfield County
Board of Health or designee.
9. In no case shall unsafe water be used for drinking nor shall raw sewage or
contaminated water be discharged on the ground surface.
10. The maximum allowable time length of the Special Use Permit for Temporary
Employee Housing is one (1) year; however, no single Temporary Employee
Housing facility allowed under this Special Use Permit shall be onsite for more than
a cumulative of one year. For good cause shown, the permit may be renewed
annually in a public meeting with notice by agenda only. Annual renewal review
shall be based on the standards herein as well as all conditions of the permit. A
permit may be revoked anytime through a public hearing called up by staff or the
Board of County Commissioners.
11. Inhabitants of the temporary housing shall be applicant's employees, contractors
and/or subcontractors, working on the related construction or mineral extraction
operation, and not dependents of employees, guests or other family members.
12. Temporary employee housing sites shall be maintained in a clean, safe and
sanitary condition, free of weeds and refuse. Any hazardous or noxious materials
that must be stored on site for operational or security reasons must be managed in
accordance with all applicable federal, state and local laws and regulations.
13. Fire Protection General Requirements: Provisions shall be made for giving alarm in
case of fire. It shall be the responsibility of the duly authorized attendant or
caretaker to inform all employees about means for summoning fire apparatus,
sheriff's office and resident employees. All fires are subject to §307 of the 2003
International Fire Code (IFC) including but not limited to permits, attendance, open
fires, coal grills, fire bans and bon fires. One (1) or more approved extinguishers of
a type suitable for flammable liquid or electrical fires (Class A, Class B and Class C),
carbon dioxide or dry chemical, shall be located in an open station so that it will not
be necessary to travel more than one hundred (100) feet to reach the nearest
extinguisher.
14. Outdoor food storage is prohibited unless facilities that prevent the attraction of

animals to the temporary employee housing site are provided.
15. The applicant shall provide a detailed map and GPS coordinates to the Garfield
County Sheriff's Office and the relevant Fire Protection District which is sufficient
for emergency response purposes, including location of the temporary employee
housing site; private and public roadways accessing the site, marked as open,
gated and/or locked; and detailed directions to the site from a major public right-
of-way. The map is subject to approval by the Garfield County Sheriff's Office and
relevant Fire Protection District.
16. The applicant shall notify the County when site development begin. The applicant
shall verify in writing, by site plan and through photo documentation that the site,
water system, and sewage disposal system were designed, installed and inspected
in accordance with the said special use permit and comply with all applicable
regulations, permits, and conditions. All written documentation and site plans
verifying compliance must be stamped by a certified Colorado Engineer. The
County also reserves the right to inspect a site, without notice, to assess
compliance with the Special Use Permit for Temporary Employee Housing. A
determination of noncompliance with any Special Use Permit for Temporary
Employee Housing, or condition approval thereof, is grounds for revocation or
suspension of said permit, in accordance with Section §9.01.06.
17. No animals shall be allowed at temporary employee housing sites.
18. The maximum number of occupants permitted under this Special Use Permit for
Temporary Employee Housing is eight.
19. Sewage systems shall to be installed and maintained in accordance with the
Garfield County ISDS regulations with all pipes and connections water tight and lids
kept securely in place at all times except during normal cleaning operations.
20. Wildlife -proof refuse containers must be provided for trash. At least one thirty (30)
gallon (4 cubic feet) container shall be provided for each unit or the equivalent in a
central trash collection facility. Said container(s) must be durable, washable, non-
absorbent metal or plastic with tight -fitting lids. Refuse shall be disposed of not less
than once weekly.
21. Each facility shall have a minimum total capacity of 3,000 gallons of potable water
storage and be refilled a minimum of every five days.
22. Each facility shall have a minimum total capacity of 2,000 gallons of sewage
/wastewater storage capacity and shall be emptied a minimum of every three days.

General Comments: Garfield County Road & Bridge Department has no objection to this
application with the following comments.
The use of onsite housing will reduce the daily trips on Cr. 312 increasing safety for all
users of Cr. 312 and Cr. 335 and reduce the impact to the County road system.
The driveway access permit issued for the well pad will also serve as the access for the
temporary housing. No other permits will be needed from Garfield County Road &
Bridge Department.
Cr.312 is a narrow winding road and we ask that Orion Energy make sure all employees
abide by posted speed limits or those imposed by Orion Energy if they are less than the
posted speed limit.
Cr. 312 is a school bus route and Orion Energy should contact the RE 2 school district
transportation department for school bus route times and avoid large truck traffic during
these time schedules. Employees should be informed of this time schedule also.
All vehicles hauling oversize/overweight loads on Cr. 312 and Cr. 335 shall have an
oversize/overweight permit issued by Garfield County Road & Bridge Department. All
vehicles requiring an oversize/overweight permit shall have on file a letter with Garfield
County Road & Bridge Department stating said vehicles can obtain an
oversize/overweight permit under Orion Energy's bond on file with Garfield County
Road & Bridge Department.

Cordilleran Compliance Services, Inc. (Cordilleran) was contracted by Orion Energy
Partners, LLC (Orion) to provide Environmental Engineering and Consulting Services
associated with drilling an exploratory natural gas well in the Garfield Creek State
Wildlife Area (GCSWA) in Garfield County, Colorado, Orion Energy Partners, LP
(Orion), on behalf of the Colorado Division of Wildlife (CODW) has submitted a Special
Use Permit (SUP) application to install temporary employee housing to support drilling
operations on one well pad in Garfield County.
The following responses are provided to address Road and Bridge agency comments
forwarded to Cordilleran from your office.
Garfield County Road & Bridge Department has no objection to this application
with the following comments:

operations will travel at speeds no greater than 25 mph. Orion has installed signage to
reflect the 25 mph speed limit for these heavy vehicles.
Cr. 312 is a school bus route and Orion Energy should contact the RE 2 school
district transportation department for school bus route times and avoid large truck
traffic during these time schedules. Employees should be informed of this time
schedule also.
Orion has secured copies of the RE 2 school transportation bus schedule for the
Garfield Creek/CR 330 bus route. Orion employees and contractors have been
instructed to avoid large truck traffic during the times identified on the bus schedule.
All vehicles hauling oversize/overweight loads on Cr. 312 and Cr. 335 shall have
an oversize/overweight permit issued by Garfield County Road & Bridge
Department. All vehicles requiring an oversize/overweight permit shall have on
file a letter with Garfield County Road & Bridge Department stating said vehicles
can obtain an oversize/overweight permit under Orion Energy's bond on file with
Garfield County Road & Bridge Department.

determine whether the affidavits refer to the contractors that submitted them or that they will obtain water from
registered haulers. I recommend that applicant submit CDPHE water hauler registration documentation for any
potable water hauling subcontractor they intend to utilize.

1.0 INTRODUCTION
1.1 Project Description
Orion Energy Partners is proposing to drill an exploratory test well to evaluate its oil and gas
leasehold. The well pad site is located in the SE1/4, SW1/4, Section 23, Township 6 South,
Range 91 West, and lies immediately to the west of County Road 312. Approximately 2.70
acres will be disturbed at the pad site of which 2.03 acres will be reclaimed. A gas pipeline will
be constructed from the well pad site to a gathering facility located west of Garfield Creek State
Wildlife Area (SWA). The pipeline follows County Road 312 north to an existing power line
right-of-way (ROW) where it turns west, following an existing pipeline corridor to the gathering
facility. The pipeline will disturb an area 30 feet in width for approximately 2.2 miles for a total
disturbed area of 10.08 acres.
As part of the process to obtain a Colorado Division of Wildlife (CDOW) Special Use Permit,
Cordilleran Compliance Service, Inc., on behalf of Orion Energy Partners, asked WestWater
Engineering, Inc (WWE) to conduct a weed survey and write the integrated vegetation and
noxious weed management plan (IVNWMP). In the preparation of this plan, WWE biologists
considered several factors including soil types, existing land management, absence or presence
of listed noxious weeds, and potential natural vegetation community.
2.0 LANDSCAPE SETTING
2.1 Vegetation Communities
The predominant vegetation community in the valley floor consists of mixed mountain
shrublands inhabited by Gambel's oak (Quercus gambeli), mountain mahogany (Cercocarpus
montanus), Sagebrush (Artemesia tridentata), serviceberry (Amelanchier alnifolia) and
snowberry (Symphoricarpus rotundifolius) interspersed with hay meadows. Irrigated hay
meadows exist in the valley floor and on the benches to the west of Garfield Creek. Oakbrush
transitions into a mosaic of pinon-juniper (PJ), big sagebrush and mountain mahogany on
moderate to steep hillsides above the valley floor to the west. PJ woodlands dominate the drier
southwest facing slopes to the east of Garfield Creek known as the "badlands."
The confluence of Baldy Creek and Garfield Creek is located at the southern end of the project
area, east of the proposed well pad. The riparian areas adjacent to the creeks contain narrowleaf
cottonwood (Populus angustifolia), mountain boxelder (Acer negundo), Gambel's oak,
chokecherry (Prunus virginiana), sumac (Rhus trilobota), Hawthorne (Crataegus rivularis) and
wild rose (Rosa woodsii). Elevations range from 5,900 to 6,800 feet above sea level in the
project area. In general, terrain is flat to gently sloping in the valley bottom with hillsides
moderate to very steep on both sides of the Garfield Creek drainage.
2.2 Soil Types
There are ten different soil types found in the project area but two, Vale silt loam and
Torriorthents-Camborthids-Rock outcrop complex, comprise the largest area of the proposed
pipeline alignment. Vale silt loam is found at the proposed well -pad site and is typical of
meadows and slopes of 3-6 percent. Vale silt loam soils usually have characteristic native
vegetation comprised of Western wheatgrass (Pascopyrum smithii), prairie sandreed

(Calamovilfa longifolia), needle and thread grass (Hesperostipa comata), green needlegrass
(Stipa viridula), blue gramma (Chondrosum gracile), rabbitbrush (Chrysothamnus nauseosus),
and serviceberry (Amelanchier alnifolia). This soil type can also support a wide variety of plant
species such as oakbrush and cultivated grasses used in agricultural hay production. Villa
Grove-Zoltay loam soil is also found on the slopes near the meadow areas of the north end of the
alignment. These soils generally occupy slopes of 15-30 percent and characteristic native
vegetation includes serviceberry, Gambel's oak, snowberry, western wheatgrass, mountain
brome (Bromus marginatus) and elk sedge (Carex garberi). Other soils found adjacent to the
Villa Grove-Zoltay loams include Ascalon find sandy loam, Ascalon -Pena complex and
Cimarron loam. These soils are found on gentler slopes of 2 to 12 percent, have similar
vegetation composition to the Villa Grove-Zoltay soils, but support an addition shrub species,
mountain mahogany.
Soils found at the power line pipeline construction site are of the Torriorthents-Camborthids-
Rockoutcrop complex, which is typically found on steep slopes often greater than 30 percent.
Depending on aspect, general vegetation communities found on these soils include PJ woodland
and mountain shrublands.
3.0 NOXIOUS WEEDS
Noxious weeds are plants that are not native to an area. Most have come from Europe or Asia,
either accidentally or as ornamentals that have escaped. Once established in a new environment
they tend to spread quickly since insects, diseases and animals that normally control them are
absent. Noxious weeds are spread by man, animals, water, and wind. Prime locations for the
establishment of noxious weeds include roadsides, sites cleared for construction, areas that are
overused by animals or humans, wetlands, and riparian corridors. Subsequent to soil
disturbances, vegetation communities can be susceptible to infestations of invasive or exotic
weed species. Vegetation removal and soil disturbance during construction can create optimal
conditions for the establishment of invasive, non-native species. Construction equipment
traveling from weed -infested areas into weed -free areas could disperse noxious or invasive weed
seeds and propagates, resulting in the establishment of these weeds in previously weed -free
areas.
Prevention and control of noxious and invasive weeds is a high priority for the State of Colorado.
Colorado's Noxious Weed Act (State of Colorado 2005) sets forth the rules pertaining to
prevention and control and classifies noxious weeds into three lists: A, B, and C. Each list has
specific control requirements, with the most stringent requirements for those species found on
List A. List A includes noxious weeds targeted for eradication and for which management plans
have been developed for their control. Control of these species is required by law. If these
species are found within a project area, prescribed management techniques stipulated by
Colorado's Noxious Weed Act must be implemented. These techniques must be applied for the
duration of the seed longevity for the particular species. List B species are recommended for
control through the development and implementation of state noxious weed management plans.
List C species are generally considered too widespread to effectively control. Control of List C
species is not required, but may be done by jurisdictions that chose to manage these species.
In addition to the State-wide noxious list, counties may elect to target specific noxious weeds in
their locale. The noxious weed list for Garfield County is found in Table 1.

3.1 Survey Methods
Mapped soil types, as published by the Natural Resources Conservation Service (NRCS), U.S.
Department of Agriculture (USDA), were reviewed to determine the soil types and vegetation
characteristics of the plant site and surrounding property (NRCS 2008).
A preliminary field inspection of the proposed Hilton 23-1 well pad and the power line section of
the proposed pipeline were conducted by WWE biologists on January 16, 2008. A follow-up
survey was conducted April 29 and 30, 2008. WWE biologists surveyed an area 150 feet from
all sides of the well pad and 150 feet from the center line on both sides of the proposed pipeline.
WWE biologists surveyed the area to identify vegetation communities and to search for, identify,
and map noxious weed species. A snow cover of 12-20 inches prevented accurate detection and
identification of existing weeds. Only those plants persisting above the snow were observed and
recorded during the January survey. During the April survey the area was free of snow, allowing
visual observation and identification of growing weeds and plants.
Vegetation types were determined through field identification of plants, aerial photography, and
on -the -ground assessments of plant abundance visible during the survey. Identification of plant
species was aided by using pertinent published field guides (Whitson et al. 2001, CWMA 2007,
Kershaw et al. 1998). Weeds visible above the snows were identified from dried residual growth
during the winter survey. The April 2008 survey identified plants by visual observation of new
plant growth. Photographs were taken of the general project location, vegetation and terrain, and
other specific biological findings. Locations of weeds and other features included in this report
were recorded with the aid of a handheld global positioning system instrument (GPS) using
NAD83/WGS84 map datum, with all coordinate locations based on the Universal Transverse
Mercator (UTM) coordinate system in Zone 13S.
3.2 Observations
This report includes weeds found during the January 16, 2008, and April 2008, surveys by WWE
biologists. Few weeds were observed during the January survey due to the 12-20 inch snow
cover. However, during the April survey plants were readily observed allowing more accurate
determination of the location and extent of noxious weeds in the project area. There is a
preponderance of weeds observed in the riparian areas and in the power line ROW, but scattered
weeds, primarily musk thistle in the meadow and pad area, were evident during the survey
(Figure 1). Noxious weeds observed included houndstongue, common burdock, musk thistle,
bull thistle, common mullein, chicory and Russian knapweed (Table 2). The most prevalent
weeds observed were houndstongue and musk thistle (Photos 1 and 2). A complete listing of
weeds observed and locations is found in appendix A.

Cordilleran Compliance Services, Inc. (Cordilleran) was contracted by Orion Energy
Partners, LLC (Orion) to provide Environmental Engineering and Consulting Services
associated with drilling an exploratory natural gas well in the Garfield Creek State
Wildlife Area (GCSWA) in Garfield County, Colorado. Orion Energy Partners, LP
(Orion), on behalf of the Colorado Division of Wildlife (CODW) has submitted a Special
Use Permit (SUP) application to install temporary employee housing to support drilling
operations on one well pad in Garfield County.
The following responses are provided to address engineering agency comments
forwarded to Cordilleran from your office.
1, Details for the connection of the potable water and wastewater tanks to the
trailers should be provided for review.
After the housing trailers are installed on the drilling site, Orion will have potable
water, waste water and electricity connected. Subsequent to the connection, Orion
will have all the appropriate connections inspected and certified by a professional,
licensed engineer in accordance with county requirements.
2. The site plan shows two tanks presumably one for potable water and one for
wastewater. The application refers to an additional storage of 2,500 gallon for
fire protection. The Applicant will need to provide details for the fire protection

Orion will have a "pull -off' trailer installed onsite which will have a minimum capacity
of 2500 gallons of water and will be dedicated to fire protection. Attached is a

Dear Interested Resident,
I have recently been informed that there are concerns and questions from local residents
regarding Orion Energy Partners, LP (Orion) Temporary Employee Housing Special Use Permit
(SUP) Application which was submitted to the Garfield County Building & Planning
Department. This SUP application is scheduled to be considered for approval by the Garfield
County Board of Commissioners on August 11, 2008 at 1:15 pm in Glenwood Springs,
Colorado.
In order to alleviate the potential concerns of individuals with respect to this permit
application, I would like to provide some details regarding the specifics of the Temporary
Employee Housing SUP.
This temporary housing permit SUP is currently required by Garfield County Zoning
regulations for the temporary housing used by safety and oversight personnel during natural gas
drilling operations.
In order to conduct safe drilling operations, Orion must provide temporary living quarters
(housing) for essential personnel during the 24 hour drilling operations. This housing is not
intended to accommodate large numbers of personnel and it is not what is often referred to as a
"man -camp". The site configuration consists of no more than 3 trailers designed to accommodate
Orion's safety and oversight personnel (four to eight individuals) during 24 hour drilling
operations. This equipment typically accompanies any natural gas drill rig operation.
Orion's current drilling plan calls for no more than four individuals to be housed on site
during the drilling process. As it was written for submittal to the Garfield County Building &
Planning department, the temporary housing SUP application can accommodate up to eight
individuals on site. This would allow additional personnel to reside on site to address mechanical
problems or safety issues, if necessary. The housing units will be confined to the well pad
identified in Orion's approved Colorado Oil and Gas Conservation Commission (COGCC)
application for permit to drill (APD). This housing cannot be located anywhere else on Colorado
Division of Wildlife's (CDOW) Garfield Creek State Wildlife Area. The temporary housing
facilities will only be on the drill site for the duration of drilling operations, this is currently
estimated to be 2 to 3 weeks.

The Hilton #23-1 is vertical Williams Fork/Rollins/Cozette/Corcoran test with a proposed
total depth of 8,400' MD/8,400 TVD. The following procedures and specifics should be
followed as close as possible to optimize drilling activity and cost.
No cores or DST's are planned for this well. Patterson #500 will be utilized to drill the
well on a day -rate basis from spud to TD.

2) Orion Energy Partners personnel or representative should be on location
throughout the entire drilling operation including the following: drilling,
logging operations, and casing and cementing operations.
3) A maximum of 4 personnel to reside on location. All other contractors,
mud loggers, rig crew, etc is to house OFF location.
4) A two man mud logging crew is scheduled for the well — they will have a
work trailer, but housed off site.
5) The Hilton 423-1 is a State well, therefore the approved State drilling permit
shall be followed and on location at all times.
6) The State office (Dave Andrews) shall be contacted on the following items:
a. 24 hour notice for spud and/or commencement of operations (if surface
previously pre-set).
b. Setting of surface casing (notify State if surface gas and loss circulation is
encountered that requires cement squeeze).
c. Twenty-four (24) hours prior to BOP testing, & the running of surface and
production casing.
d. All significant lost circulation over 100 bbls and which requires shut down
of operations for an hour or longer to pump LCM and rebuild pit volume.
Information requested is: depth, mud volume lost, did kick ensue, mud
weights before and after loss and procedures used to regain circulation.
e. All significant kicks defined as: managed by shutting in well to circulate
out the kick or managed by going on choke and requiring an increase in
MW exceeding .3 ppg. Information requested is: depth and time of kick,
surface casing depth, size and cementing data, initial and final mud
weights, SIDPP, SICP, and any other pressure management information
available.
f. Depth, rate and mud weight of any water flows.
g. Plugging and abandonment.
7) All tools and pipe ran in the hole are to be callipered. OD, ID, and length are
to be recorded and kept available on the rig floor.
8) No smoking on or near pits and rig floor.

9) Survey every 100' on surface hole. Survey as necessary during production
hole interval to maintain minimal deviation from designed well trajectory.
10) On initial nipple up, test the pipe rams and blind rams to 3,000 psi, annular to
1,500 psi. Every 30 days thereafter, seal is broken or repairs are made, test
rams to 3,000 psi. BOP drills are to be conducted by each crew within 24
hours of surface casing drill -out and weekly thereafter.
11) Maintain drill string design to provide 100,000# over pull, assuming used
premium class drill pipe.
12) The following information must be noted on the appropriate daily morning
report:
a. Name of Orion's representative on location.
b. Spud or operations commencement with date and time.
c. Date and time TD reached.
d. Type of logs ran and interval logged.
e. Date, time and who was contacted for any notifications made to COGCC.
E If plugging operations are conducted, report by whom permission to plug
was granted, date, time and witness, if any.
13) An inventory of rental equipment will be maintained by the Rig Supervisor
and turned in at the end of the well.
14) When ordering casing for surface and production holes, verify the amount
released of each weight and grade. Specify the order in which it is to be
placed on the racks.

1,500 psi. Ensure rig is centered over hole — bottom must be centered over top.

Drill a 7 7/8" hole to a depth of 8,200' MD. Maintain contact with Denver office

Economics of the Kokapelli project dictate getting to TD as quick and cheap as possible.

shaker cleans up, fluid should be mudded up for trip if necessary, the bit tripped out and a

PRODUCTION CASING RUNNING PROCEDURE
Visually inspect, clean threads, drift and strap on location. Use API Modified pipe dope
on connections. Run casing as follows:
1) Float shoe on bottom.
2) 1 joint of 4 '/", 11.6#, N-80, LT&C casing centralized with stop ring on
middle of joint.
3) Differential fill float collar.
4) 4'/z", 11.6#, N-80, LT&C casing to TD. Bow spring centralizers shall be
placed on collars of bottom 3 joints, then one centralizer as experience has
dictated is necessary.
5) Thread lock all connections up through float collar. Ensure pins and boxes are
thoroughly cleaned before applying thread lock.
6) If conditions allow, reciprocate casing when on bottom and throughout the
cement job until just prior to bumping plug.

PRODUCTION CASING CEMENTING PROGRAM
TBD - Volumes and blends/weights to be determined from open hole logging and
drilling/losses information. Contact Denver following open hole logging for cement
design. (Denver will also be in contact with Schlumberger District) In general, top
of tail cement should be designed 1,000' above top of gas.
CEMENTING PROCEDURE:
1) Run casing and accessories as per order/outline above. Circulate and condition
hole a minimum of two bottoms -up or as required to clean up cuttings/circulate
out gas.
2) Test lines to 3,000 psi.
3) Pump as follows:
a. 20 bbls chemical wash.
b. Mix and pump cement at 6-8 bpm.
c. Drop plug and displace with 2% KCl substitute water at 8-10 bpm.
Decrease rate to 2.0 bpm when 10 bbls short of displacement. Further
decrease rate to .5 bpm on the last 2 bbls.
d. Bump plug at 1,000 psi over final circulating pressure. Release pressure
and check for flow back.
4) Monitor well as needed, set slips with casing in full tension, & cut off casing.
**Note:
a) BHST is estimated to be 200 degrees F.
b) Have cement tested with actual water to be used prior to
pumping job. Maintain copy of results on location.
c) Catch both wet and dry cement samples of slurry. Store samples
for testing should a problem with cement job occur.
d) If hole conditions allow, reciprocate casing when to TD and
throughout the cement job until just prior to bumping the plug.
NOTE: PER APPROVED PERMIT
(1) Upon completion of the primary cementing operation, the annular fluid level
around the production casing shall be monitored for a minimum of 4 hours
after cementing and prior to setting slips. (this requirement may also be met
by setting the casing slips immediately after cementing and maintaining the
ability to monitor the annular fluid level and keep the hole full. Operators
shall maintain the ability to monitor the annular fluid level and keep the hole
full. The amount of mud that is used to keep the hole full shall be recorded.
If mud volumes in excess of 20 bbls are necessary to keep the hole full, the

loss of fluid shall be reported to the COGCC immediately.

Notice, Form 4, requesting approval to complete the well.
(2) The bradenhead pressure shall be measured at intervals of 6, 12, 24, 48, and
72 hours after the production casing is cemented. If bradenhead pressures
greater than 150 psi are observed, such pressures shall immediately be
reported to the COGCC and a remediation procedure shall be prepared for
COGCC approval.
(3)
Following the cementing operation, a combination temperature/cement bond
log shall be run within 12-48 hours to locate the actual cement top. If the
cement top does not meet the requirements of this Notice of Operations (500'
above top of gas), the COGCC shall be immediately notified and a
remediation procedure shall be prepared for COGCC approval. Running
the CBL may be delayed if a temperature survey is conducted within 12-48
hours of cementing and if the operator monitors the bradenhead pressure on
a daily basis after the initial 72 hour period on all wells on the pad until the
CBL is run. If the option of delaying the running of the CBL is chosen, the
results of the temperature survey and the bradenhead monitoring shall be
reported via e-mail to the COGCC Northwest Area Engineer within 7 days
of cementing. If bradenhead pressures greater than 150 psi are observed
during the extended monitoring period it shall be immediately reported to
the COGCC and a remediation procedure shall be prepared for COGCC
approval. The operator shall maintain the ability to immediately and safely
commence remedial cementing operations if needed.
Following the temperature survey, ensure Denver office has copy so that CBL
deferment request can be sent timely.
WELLHEAD AND BOP'S
Land casing in slips with entire casing string in tension. ND BOP's, cut off casing, tack
weld cap on casing stub, and release rig.

WELL CONTROL PROCEDURE
In the event that a kick is seen while drilling, the following procedure should be
followed:
1) Pick up kelly and raise the tool joint above the floor.
2) Shut down mud pump.
3) Close annular preventer.
4) Close the choke.
5) Open the HCR.
6) Record standpipe pressure (SIDPP) & casing pressure after it has stabilized.
7) Contact Drilling Superintendent.
8) Calculate Initial Circulating Pressure + Slow Circulating Pressure + SIDPP.
9) Calculate required kill mud weight.
10) Complete kill sheet.
