The Special Use Permit is issued subject to the conditions set forth in the above-mentioned resolution, and shall be valid only during compliance with such conditions and other applicable provisions of the Garfield County Zoning Resolution, Subdivision Regulations, Building Code, and other regulations of the Board of County Commissioners of Garfield County, Colorado. OF SECTION 10 T6S, R98W PARCEL NO# 2137-321-00-008 Recitals A. Garfield County is a legal and political subdivision of the State of Colorado for which the Board of County Commissioners (Board) is authorized to act B. On the 2"d day ofJanuary, 1979, the Board adopted Resolution 79-01 concerning a Zoning Resolution for the County of Garfield, State of Colorado. C. Pursuant to Section 9.03.04 of the Zoning Resolution of 1978, an application for a Special Use Permit shall be approved or denied by the Board of County Commissioners after holding a public hearing thereon in conformance with all the provisions of the Zoning Resolution. D. E. The Board of County Commissioners closed the public hearing on August 41 \ 2008, and acted on the basis of substantial competent evidence produced at the aforementioned hearing. Resolution NOW, TIIEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Pennit is approved based on the following findings: I. The forgoing Recitals are incorporated by this reference as part of this Resolution. 2. Proper public notice via publication pursuant to Section 9.03.04 of the Zoning Resolution of 1978, as amended, was provided as required by law for the hearing before the Board of County Commissioners. 3. An application for a special use permit was made consistent with the requirements of Section 5.03 of the Garfield County Zoning Resolution of 1978, as amended. 4. The public hearing before the Board of County Commissioners was extensive and complete; all pertinent facts, matters and issues were submitted; and all interested parties were heard at that hearing. 5. The proposed special use pennit is in compliance with the recommendations set forth in the Comprehensive Plan for the unincorporated areas of the County. 6. The proposed special use pennit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 7. The Special Use Permit for the Extension of the Hiner Gate Communications Tower from 30' to 50' and the placement ofa communications-related shed measuring 10' x 12' proposed by Chevron USA, Incorporated, shall require that the following conditions be satisfied: A. That all representations of the Applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval unless explicitly altered by the Board. B. That the Applicant shall comply with the fire protection provmons included in the rules and regulations of the Colorado Oil and Gas Conservation Commission (COGCC) and the International Fire Code as the Code pertains to the operation of th.is facility. D. Volume of sound generated shall comply with the standards set forth in the Colorado Revised Statutes. E. Vibration generated: the Tower shall be so operated that the ground vibration inherently and recurrently generated is not perceptible, without instruments, at any point of any boundary line of the property on which the use is located. F. Emission of heat, glare, radiation and fumes: the Tower shall be so operated that it does not emit heat, glare, radiation or fumes which substantially interfere with the existing use of adjoining property or which constitutes a public nuisance or hazard. Flaring of gases, aircraft warning signals, reflective painting of storage tanks, or other such operations which may be required by law as safety or air pollution control measures shall be exempted from th.is provision. G. Any storage area for uses not associated with natural resources shall not exceed ten (I 0) acres in size. H. Any lighting of storage area shall be pointed downward and inward to the property center and shaded to prevent direct reflection on adjacent property. I.
