Please consider this packet our application for a Special Use Permit for the SemCrude
L.P. Condensate Transfer Facility located on County Road 246 (Anvil Points Road)
Township 6 South, Range 94 West, Section 20, 6th P.M.
1. Project Description: SemCrude L.P. transfers condensate from William Production
RMT Co. natural gas well sites to facilities outside of Garfield County. Natural Gas
condensate is a complex combination of hydrocarbons separated and/or condensed from
natural gas and containing carbon numbers in the range of CS.
During Summer operations, SemCrude L.P. utilizes tankers to haul condensate from well
pad sites to facilities outside of Garfield County. The remote locations and varying road
conditions of these natural gas wells necessitate the use of two and one-half ton
truck/multi-axle tank trucks (bobtails) during the Winter and Spring months. Please see
pictures of the tankers and bobtails attached in Tab 2a-Site Pictures.
SemCrude L.P. is proposing to construct a Condensate Transfer Facility on the East side
of Anvil Points road approximately 0.7 of a mile North of the Anvil Points Road, U.S.
Highway 6 & 24 intersection.
The purpose of the facility will be to allow a centralized location to unload condensate
from the bobtails and then to load condensate onto tankers for transport to locations
outside of Garfield County.
Currently, these 80,000 pound tankers are driven to each of the many natural gas well
sites in Garfield County to service these areas. The new facility will allow 50,000 pound
bobtails to access natural gas well sites and haul to the facility.

We see that the proposed facility meets the Garfield County Resource Lands-Gentle
Slopes and Lower Valley Floor special use permit designations as a material handling
industrial support facility.
3. Surrounding zoning: Resource Lands and the existing uses are Industrial and
Agricultural.
4. Garfield County Comprehensive Plan of 2000: The Garfield County
Comprehensive Plan of 2000 notes this project in Study Area 3. Natural Resource
extraction is detailed in Section 9 of the "Goals, Objectives, Policies and Programs"
located on page 17.
"Garfield County recognizes that under Colorado Law, the surface and mineral right
interests have certain legal rights and privileges, including the right to extract and
develop these interests. Furthermore, private property owners also have certain legal
rights and privileges, including the right to have the mineral estate developed in a
reasonable manner and to have adverse land use impacts mitigated."
Policies Section 9.1 notes:
"Garfield County, to the extent legally possible, will require adequate mitigation to
address the impacts of mineral extraction on adjacent landowners. These measures may
include the following:
A. Landscaping and screening;
B. Modification of phasing or area to be mined;
C. Roadway improvements and signage;
D. Safe and efficient access routes;
E. Drainage improvements to protect surface and groundwater"
We see that the proposed proposed facility meets the Garfield County comprehensive
plan goals, objectives, policies and programs. We have addressed each of the policies
stated in 9. I.
Additionally, the surrounding uses to this property include the Garfield County landfill,
natural gas drilling operations and the oil shale processing facility located at the New
Paraho.
5. Referral Agencies:
We have had a pre-application meeting with Mr. Fred Jarman, Director of the Garfield
County Building and Planning Department on December 7, 2006. ·
We have met with many of the referral agencies to review the proposed plant expansion
and to review agency concerns and issues.

Dear Phil,
Thank you for submitting the additional information this office requested regarding the
Special Use Permit application you submitted to this office on February 20, 2007 for
Storage and Material Handling of Natural Resources in the Resource Lands (GSLVF) Zone
District for the Semcrude L. P. Condensate Transfer Facility. The purpose of this letter is to
inform you that the Application has been deemed technically complete.
Staff has scheduled this request to be heard by the Board of County Commissioners in a
public hearing on their regularly scheduled meeting date of June 4, 2007 at 1:15 PM. I
have included the public notice form which you are required to mail and publish according
to the language below. In addition, I have included a completed poster sign within this
mailing. You will post this sign at the property according to the language below regarding
posting notice.
Please submit 12 copies of all the information you provided to Staff in your application so
that we may provide them to referral agencies I Departments and County Commissioners
for their review. (You may submit reduced copies of all large plans.) Staff will need to have
these copies by May 10, 2007. Please review the public notice requirements below:
(1) Notice by publication, including the name of the applicant, description of the subject
lot, a description of the proposed use and nature of the hearing, and the date, time
and place for the hearing shall be given once in a newspaper of general circulation
in that portion of the County in which the subject property is located at least thirty
(30) but not more than sixty (60) days prior to the date of such hearing, and proof of
publication shall be presented at hearing by the applicant.

PUBLIC NOTICE
TAKE NOTICE that the Estate of William F. Clough (Property Owner) which has leased
property to SemCrude L.P. has applied to the Board of County Commissioners, Garfield
County, State of Colorado, for a Special Use Permit to allow for a natural gas condensate
transfer facility to be constructed in connection with the following described property
situated in the County of Garfield, State of Colorado; to-wit:

PRACTICAL DESCRIPTION
Pursuant to sections 3.10.04, 5.03, 5.03.07, and 5.03.03 of the Garfield County Zoning
Resolution of 1978 as amended, The proposed SUP consists of the construction I
installation of 12 tanks designed to contain condensate produced from natural gas
production as a transfer station for condensate produced in the well fields to be taken
market by Semcrude L. P. The proposed facility will be located on a 5-acre site leased to
Semcrude L. P. within the larger Estate of William F. Clough located approximately 0. 7
mile north of the intersection of U.S. Highway 6 & 24 on the East side of Garfield
County Road #246 "aka Anvil Points Road" near the City of Rifle.
All persons affected by the proposed special use permit are invited to appear and state
their views, protests or support. If you can not appear personally at such hearing, then
you are urged to state your views by letter, as the Board of County Commissioners will
give consideration to the comments of surrounding property owners, and others affected,
in deciding whether to grant or deny the request for the special use permit. The
application may be reviewed at the office of the Planning Department located at I 03 3th
Street, 4th Floor, Garfield County Plaza Building, Glenwood Springs, Colorado between
the hours of 3:30 a.m. and 5:00 p.m., Monday through Friday.
A public hearing on this application has been scheduled for the 4th day of June

Dear Phil,
This office is in receipt of the Special Use Permit application you submitted to this office on
February 20, 2007 for Storage and Material Handling of Natural Resources in the Resource
Lands (GSLVF) Zone District for the Semcrude L. P. Condensate Transfer Facility. I am
writing this letter to inform you the application has been deemed technically incomplete and
the Garfield County Building and Planning Department needs additional information in
order to process and review the application. Your timeliness in providing this information
will expedite our ability to place your application on the public hearing agenda. Please
provide information that more specifically addresses each of the following items.
1. Section 5.03(3) requires an application to contain a specific response that satisfies the following
standard:
5.03(3) Design of the proposed use is organized to minimize impact on and from
adjacent uses of land through installation of screen fences or landscape materials on
the periphery of the Jot and by location of intensively utilized areas, access points,
lighting and signs in such a manner as to protect established neighborhood
character.
2. Section 5.03.08(1) requires an application to demonstrate how the proposed operation can
satisfy the standards setforth in the Colorado Revised Statutes at the time any new application is
made. Tab 11.1.B.4 in the application states that "SemCrude L. P. will comply with state law in
regards to noise." This statement does not address what the standard requires which is proof of
how the operation can meet state statute. Please address this issue.

Thanks for the information regarding the SemCrude L.P. application.
As per your phone message, planning department staff will recommend to the Board of County Commissioners at
their May 7, 2007 meeting that the application be heard only by the commissioners and not referred to the
planning commission.
We understand that the commissioners have the ability to recommend that the issue be referred to the planning
commission.
In anticipation of the June 4, 2007 hearing before the board of county commissioners, please find attached a draft
public notice for your review and approval. I was unsure of the time on June 4 that this would be heard. Please
advise. Additionally, please note that I have identified in the public notice the 5.23 acre lease parcel legal
description so that this adequately notes where this lease parcel is located. The entire W.F. Clough parcel is
3,217.22 acres in size. Please advise if this meets the intent of the Gar1ield County code.
As per Gar1ield County code, I will do the following:
1. Publish the Public Notice in the Glenwood Springs Post-Independent at least 30 days but not more than 60
days prior to the June 4, 2007 hearing.
2. Mail the Public Notice, via certified return receipt mail, to all owners of record within 200 feet of the W.F.
Clough parcel at least 30 days but not more than 60 days prior to the June 4, 2007 hearing. Please note
that we have identified in our application all property owners within 200 feet of the 3,217.22 acre parcel and
will provide notice to all of these property owners.
3. Post the sign provided by the Gar1ield County Planning Department, at the proposed SemCrude L.P.
location clearly visible from County Road 246, at least 30 days but not more than 60 days prior to the June
4, 2007 hearing.
Fred, please let me know how many copies of the Special Use Permit application that you would like and by what
date these materials should be delivered to your office.
