Summa1y of Reque st: The Applicant is requesting approval to amend the Special Use Pennit
granted on June 10 , 2003, pursuant to Resolution No. 003-48 (see Exhibit G).
II. PROCESS
A. Applicability: Pursuant to Section 9.03.04 of the Zoning Resolution, an application for a
Special Use Permit shall be approved or denied by the Board of County Commissioners after
holding a public hearing thereon in conformance with all provisions of the Zoning Resolution.

There are no provisions in the Zoning Resolution for an amendment to a Special Use Permit.
Therefore, the Applicant was required to re-submit a complete SUP application. Included is a
copy of the previous application that was submitted with the additional infonnation for the three .
new strnctures : · .,
Since this is a request to cla rify and modify the previous approval, s taff will forgo a ddressing
each individual criteria outlined in Sections 5.03 [Conditional and Special Uses], 5.03.07
[Indus trial Operations], and 5.03.08 [Indus trial Perfo1mance Standards ] and refer the Board back
to the staff memorandum dated June 10, 2003, which addresses each criteria (see Exhibit M).
III. REVIE'W AGENCY AND OTHER COMMENTS:
The application was refen-ed to the following agencies for comments:
l. City of Rifle: Exhibit H
2 . Rifle Fire Protection District: Exhibit J
3. Garfield County Vegetation Management: No comment.
4. Garfield County Oil and Gas Auditor: Exhibit I.
IV. STAFF COMMENTS
The Applicant is willing to comply with the s pecific conditions outlined in Resolution No. 2003-
48, however the Applicant is seeking additional clarification or amendments to so me of the
conditions imposed by the Board of County Commissioners. Below in italics is the condition of
approval as seen in Resolution No. 2003-48. Staffs comments regarding the ite m s fo ll ows.
Condition No. 4: The Applicant shall provide a plan to minimize the spread of cheatg rass
through any activity. on -s ite . This may include, but is not limited to, 1) a
plan to wash items before they leave th e site, and 2) a plan that details
h ow cheatgrass seed production will be elim inated. The plan shall be
r ev iewed and approved by th e Garfield County Vegetation Manage r, prior
to the iss uance of th e Special Use Permit.
Response: The Appli cant met with Steve Anthony regarding these condition of approval. The
Applicant indicated that a Vegetation Plan for the storage yard was di scussed. The Applicant
proposed to spray the yard each year to control the cheatgrass in the yard. The Applicant noted
that it is not their intent to have any cheatgrass grow or s pread to any other part of the County
from the storage yard.

Condition No. 8 Prior to the issuance of th e Special Use Permit, the Applicant shall
provide a copy of the actual we ll permit. In addition, do c umentation shall
be provided regarding the physica l quantity of the well for th e proposed
uses. Sho uld the physical water supply of th e well not support the us es,
the Applicant shall obtain additional water allotmen ts or a water
augmentation p lan prio r to the iss uan ce of a Specia l Us e Permit.
Response: T he Applicant provided a co p y ofa W eJJ Pe1mit No. 24977 1. As seen on the well
perm it, Item No. 4 s ta tes that "the use of ground water from this well is lim ited to drinking and
san itary facilities as described in CRS 3 7-92-602(l)(c ), for a comm ercial business, being further
ide ntified as a commercial trucking business. Wat er/ram this well shall not be used for la wn or
landscap ~irrigation or for any other purpose o utside of the business building structure. "
The Applicant i s aware th at the well pennit is only fo r the office I maintenance sh op building a nd
tha t the water fro m the well , accordi ng to th e well permit , may not be u sed fo r the t ru ck wash
fac ility. The Applicant is h aving the well pumped to de termine th e vo lum e of water produced
from the well. Should th ere be adequate amount of water to suppl y the truck wash facility, the
Applica nt w ill ap pl y to the Division of Water Resource to a mend the well pennit t o include this
facility . Should there not be enough water produced fr o m the we ll , th e Applicant w ill amend
the ir ex isting contract with West Divide to a llo w for some of the water cmTently contracted I
purchased to be used for the truck wash facility.
Co ndition 8 shall be amended to allow the Applicant to a mend the existing we ll pe1mit to a ll ow
the use of water to include the truck was h fac ility, or a letter or a r ev ised contract from West
Divide shall be received by the County that a ll ows the Applicant to utili ze the contracted water
for th e truck wash fac ility .
Condition 12: Prior to the issuance of the Spec ial Use Permit, th e Applica nt shall
provide a copy of an approved Ci ty of R ifle Wat ers/z ed.P ermit.
Response: A copy of an appro ved City of Rifle W atersh ed Permit has not b een s ubmitted .
Co mments were received fr om Matt Sturgeon of the City o f Rifl e (Exhibit H). Mr. Sturgeon
not ed tha t this condit ion shall r emain in pl ace. However, s ince the Watershed Permit initia lly
subm itted does no t identify the proposed veh icle fueling st at ion, the C it y w ill r equire the
Applicant to submit a revised s ite plan and a drainage plan cl early showing how they will h a ndl e
the fueling station spill containment.

Prior to the issuance of the Special Use Permit, the Applicant shall
provide a screening I vegetation and landscaping plan to be reviewed and
approved by applicable County Staff.
Response: On the 11" X 17" site plan submitted with the application, the Applicant has
identified some trees or shrubs along CR 319. The type of species and s ize of these trees I shrubs
has not been identified. Staff is of the opinion that thi s site plan does not fit the s pirit of thi s
condition of approval and that thi s condition shall remain in place.
Condition 15: All parking (vacuum tanks) along the south end of the property shall be set
back and in line with the office I maintenance shop.
Response: This condition has not been met. According to the site plan submitted, the vacuum
truck parking has not been setback or in line with the office I maintenance shop as required.
Condition 16: The height of tlze tanks in the tank.farm shall not exceed 25' in height.
Response: The Applicant is requesting th at this condition be stricken to allow for a 35' tank as
initi a lly requested. As part of the previous SUP, the Applicant reque sted 2 tanks to be 35 feet in
hei g ht and 12 feet in diameter to hold KCI water 750 bbl capacity. The Applicant has purchased
these tanks and would like to in stall thi s tanks as initially proposed.
Upon further di scussion of section 5.06.01 of the Zoning Resolution, staff dete1mined that the
definition of..building height does not pertain to non-inhabitable structures, including tanks.
Section 5 .06.0 l of the Zoning Resolution reads:
Building Height Exceptions: Parapet walls may exceed building height limitations by
four (4) feet; stacks, vents, cooling towers, eleva tor cupolas, towers and similar non-
inhabitable building appurtenances s hall be exempt from height limitations of this
Resolution.
However, pursuant to section 5.03. l 0 of the Zoning Resolution, the b oard may impose additional
restrictions on the lot area, floor area, coverage, setback and height of proposed uses or required
additional off-street parking, screening fences and landscaping, or any other re strictions or
provision it deems necessary to protect the health, safety, and welfare of th e popula tion and uses
of the neighborhood or zone district as a condition of granting the special use.

Staff is of the opinion that these tanks should be allowed w ithin the proposed tank farm loca te d
on th e s ite pl an s ince pursua nt to section 5.06.01 of th e Zo ning R eso lution, non-inhabitable
s tru ctures are exempt ed from building height regulations.
Condition 19: The subject property sha ll no t become a regional parking and
maintenance facility. Only vacu um trucks and frac tanks used in th e
Hun ter Mesa area s hall be s tored on site.
Response: The Applicant is requesting th a t the County Co mmi ss ioner s defin e th e Hunter Mesa
are a. Staff ha s received comments from Doug Denni so n, Garfield Co unt y Oil and Gas Auditor
(see Exhibit I). Mr. Dennison recommended that thi s condition be revis ed to read as follo ws :

ADDITIONAL INFORMATION
T h e Applicant has al so reques te d a couple of mo difica t ions I a dditions to the previo us approval.
These includ e the following:
1. Increase in size of th e truck wash facility.
2. Addition of a fu el tank pad
3. Incr ease in size of th e LP tank (propane t a nk)
1. Truck Wa s h Facility :
T he Applicant is requesting app ro val to increase the s ize of the truck wash fac ility from a 30' X
50' was h bay to a 36' X 100' enclo sed s tru cture . The Applicant h as no t provided a n explanation
fo r an increase in s ize. The propo sed truck wash facility will be located immedi ate ly behind the
office I maintenance shop. The Applicant ha s provided a n e nlarged s it e plan of thi s a rea. T h e
hei ght o f the truck was h facility and the office I m aintena nce shop are approximate ly 18 feet to
th e eaves. According to th e building pl ans, the buildings appear to be mirror images of each
other. It does not appear th at the building will be any more visible th a t the office I maintenance
s hop fr om County Road 319. Plans for the truck wash fac ilit y have been included with the
application.

The Applicant is proposing to install a 24-' X 24' e l tank pad adj acent to the truck wa s h fac ility
for fueling of th e "V acuum tanks.
3. LP Tank:
The Applicant is requesting approval to increase the s ize of and relocate the LP Tank (propane
tank). T he siz e of th e tank initially approved was 1,000 gall ons a nd located on the northeast
corner of the office I m aintenance shop. The Applicant is proposi n g a 12 ,000 gall on LP tank to
be located east of the drainage and 50__fe et..from the property line. The Applicant has no t
provided an explanation as to the re ason for a l arger LP t ank.
Rifle Fire Protectio n Di strict:
Comments were recei ved from Mike Morgan of the Rifl e Fire Protection Dis trict (see Exhibit J).
Mr. Morgan noted that the primary concern of the proj ect is that it does not add re ss fire
protection water for any parts of th e project. The Uniform Fire Code, at a minimum, requires
1,500 gallons per minute for two hours (180,000 gallon s capacity) for commercial faci li ties. Mr.
Morgan noted that this particular project may require additional capacities based upo n final
design of the future structure. The installation of an automatic fire s uppre ssio n system may
reduce the total ava ilabl e capacity. Mr. Morgan indi ca ted that t hat this fire suppression system
would be required to b e ins talled with in the office I maintenance shop b uilding regardl ess.
Mr. Morgan noted that with respect to the fuel fann (tank fa1m on the site plan), the same
concern with re spect t o the lack of fire protection water applies. The fuel fann i ns tall a ti o n must
be in compliance wi th National E ire Protection Association standards and be approved by the
Colo rado Department of Labo r and Employment , Oil Inspection Secti on.
Finally, Mr. Morgan noted that with respect to the LP tank, mitigation of any concerns w ill b e
rather simple. However, M r . Morgan did not provide any mitigati o n measu res as thi s time.'
With respect to the o ffice I maintenance s hop. The initial SUP application wa s submit ted to the
Rifle Fire Protection District ("District") for comments, however, n o ne were recei ved. Upon
s ubmittal of a building pennit, copies of the building plans were submitted to the District for
rev ie w and comment. None were recei ved. A building p ennit fo r the initially approved
shuctures was reviewed and issued by the Garfield County Building Department. The Applicant
is in the process of constructing the structure.

With respect to the fuel faim, Condition No. 7 of Resolution No. 2003 -48 states that "The
Applicant shall comply with all Local, State, and Federal Fire Codes that p ertain to th e
op eration of this type of fa cility. " Staff is of the opinion th a th is condition extend s to any
standard s t o th e National Fire Protection Association, a nd shall b e approved by the Colorado
Department of Labor and Employment, Oil Inspection Secti on. Condition 7 has been modified
to refl ect this requi rement. g
Since th e Applicant has requested to enlarge the LP tank, Condition 7 has been modifi ed to
indicate that the Applicant shall work with the Rifle Fire Protec ti o n Distiict to mitigate a ny fire
protection concerns wi th r egards to the LP t ank.
VI. RECOMMENDED FINDINGS:
1. Proper posting and public notice was provided as required for the meeting b efore the
Board of Count y Commissioners.
2. The meeting before the Bo ard of County Commissione rs wa s e xtens ive an d complete,
that a ll pertinent fact s, matters and issues were s ubmitted and that all in terested
parties were heard at that meeting.
3. The above stated and other reasons , the proposed special u se permit has been
dete1mined [not] t o be in the best interest of the health, safety, morals, convenience,
order, prosperity and welfare of the citizens of Garfield County .
4. The application has [not] met the requ irements of Special Use (Sections 5:03 ,
5:03:07, 5:03.08 and 9:03) the Garfield County Zoning Re solution of 1978.
VII. RECOMMENDATION :
Staff recommends that the Board APP ROVE the Dalbo, Inc. Special U se Pennit, subject to the
following conditions:

2. All representations of the Applicant, either within the application or state d at the meeting
b efo re the Board of Count y Commi ss io ners, shall be considered conditi ons of ap proval,
unle ss specifica ll y al t e red by the B oard.
3 . The Applica nt shall comply with all applicable r equirements of the Garfi e ld Co unty
Zoning R eso luti on of 1978, as amended.
4. The Applica nt shall comply with all St ate and Federal r egu lat ions and st andards, such as
Noise Abatement, Water and Air Quality.
5. The Applica nt sha ll provide a plan to minimize the spread of cheatgrass th.rou gh any
activ ity o n-s ite. This may include, but is not limit ed to, 1) a p lan t o wash item s before
they leave the site, and 2) a pla n that detail s how ch eat grass seed production w ill be
e liminated. T he plan s h a ll b e reviewed an d approved b y the Garfield Count y Vegetation
Manager, prior to the issu ance of the Special Use Pe1mit.
6. The Applicant s hall comply w ith the fo ll owin g recommendatio ns from the Garfield
County Road and Bridge D epartment:
A. A 30-foot right-of-way shall b e d eed ed to the County from the centerline of County
Ro ad 3 19 , east onto th e property . No fences or st ructures shall be built w i th in this
deeded right-of-way.
B. The Road and Bridge D e p artme nt will issue a driveway pe1mit upon a p proval of the
Special Use Permit with provisions s p ecifi c to the p enn it.
C. A stop sign s hall be placed at the exit of the drivew ay . T he sto p sign sh all be of t h e
s ize and located as required by the Manua l on Uniform Traffic Co n tro l D evices.
D . Truck turning signs shall b e located on County Road 3 19 on ei ther side of the
dri veway access for traffic going both north a nd so u th. The signs shall be of the s i ze
and located as r eq uired by the M an ual on Uniform Traffic Cont ro l Dev ices.
E. A sign showing the name of the company shall be in a visible location for emergency
purpo ses.
7 . Vibration, emission of s moke and pa1ticul ate matter, and the emission of heat or radiatio n
shall comply with app licabl e Federal, State , and County laws, regulations and sta ndards .
8 . The Applicant sh all comply with all Local, State an d Federal Fire Codes that p e rtain t o
the operation of this type of fac ility, thi s shall include compliance with the National Fire
Protection A ssoc iati on and the Co lorado Department of Lab or and Employment, Oil
Inspecti on Section for the fu e l fa1m (tank farm on the site plan). The Applicant s h all a lso
work wi th the Rifle Fire Protection District to mitigate any fire protec tion concerns with
regards to the 12,000 gallon LP tank.

9. Prior to the issuance of the Special Use Permit, the Applieant shail prnvide a eepy efthe
aetual well permit. In additiefl, Documentation shall be provided regarding the physical
quantity of the well for the proposed uses. Should the physical water supply of the well
support the truck wash facilities, as well as the office I maintenance shop, the Applicant
shall submit a new well permit allowing all these uses. Should the physical water supply
of the well not support the truck wash facilities, as well as the office I maintenance shop,
the Applicant shall submit a letter or revised contract with West Divide that allows the
Applicant the ability to utilize the contracted water for the truck wash facility. ebtttffi

10. Any signage installed on-site shall comply with the County's sign regulations.
11. Any changes to the Special Use Permit for the storage of 30 vacuum tanks and 200 frac
trucks, a 50' X 100' office I maintenance shop, 36' X 100' truck wash bay enclosed
structure, 24' X 24' fuel tank pad, 12,000 gallon LP tank, and the storage of Potassium
Chloride in 4 tanks, will require a new Special Use Permit.
12. Partial rehabilitation of the property, should the use terminate, shall consist, at a
minimum, of the following:
A. All frac tanks shall be hauled away.
B. All vacuum trucks shall be driven away.
C. All KCI storage tanks shall be hauled away.
D. Building and structures may stay and be sold to other industrial uses.
E. Replacement of stockpiled topsoil.
F. Compliance with all prevailing COGCC and Garfield County regulations governing
final reclamation.
13. Prior to the issuance of the Special Use Permit, the Applicant shall provide a copy of an
approved City of Rifle Watershed Permit.
14. Groundwater resources shall be protected at all times. In the event of potential violations
with respect to water pollution, the Applicant shall provide proof of compliance with
applicable Federal, State and County laws, regulations and standards.
15. Prior to the issuance of the Special Use Permit, the Applicant shall provide a screening I
vegetation and landscaping plan to be reviewed and approved by applicable County Staff.

16. All parking (vacuum tanks) along the south end of the property shall be set back and in
line with the office I maintenance shop.
16. The height of the tanks in the tank farm shall not mrneed 25' in height.
17. In accordance to section 9.03.05 of the Zoning Resolution of 1978, as amended, this
Special Use Permit is subject to periodic reviews not less than every six (6) months. The
purpose of such review is to detennine compliance or noncompliance with any
performance requirements associated with granting the Special Use Permit. The petiodic
review is limited to the performance requirements and conditions, of this Resolution,
imposed at the time of the original issuance of the Special Use Permit.
18. All lighting on the property shall be inward and downward with limited glare off site.
19. The subject property shall not become a regional parking and maintenance facility. Only
vacuum trucks and frac tanks used in the Hunter Mesa area south oflnterstate 70 and
bounded on the west by Beaver Creek I County Road 317 and on the east by Garfield
Creek I County Road 312 and 326 shall be stored on site.

A RESOLUTION CONCERNED \\'ITH THE APPROVAL OF A SPECIAL USE
PERMIT APPLICATION FOR THE STORAGE OF VACUUM TRUCKS, FRAC
TAl~KS, POTASSIUM CHLORIDE, AN OFFICE, TRUCK MAINTENANCE SHOP,
AND TRUCK WASHING BAY FOR DALBO, INC.
\VHEREAS, the Board of County Commissioners of Garfield County, Colorado
("Board"), has received an application from Dalbo, Inc. for a special use permit ("SUP") to allow
for approval of the storage of 30 vacuum trucks, 200 frac tanks, an office, maintenance shop,
truck washing bay, and storage of Potassium Chloride in 4 tanks within the AIR/RD
(Agricultural I Residential I Rural Density) zone district; and
WHEREAS, the Board held a public hearing on the 16th day of June, 2003, upon the
question of whether the above described SUP should be granted or denied, at which hearing the
public an.cl interested persons were given the opportunity to express their opinions concerning the
approval of said special use permit; and
\VHEREAS; the Board on the basis of substantial competent evidence produced at the
aforement ioned hearing, has made the following determination of fact as listed below:

2. The meeting before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters and issues were submitted and that all interested
parties were heard at that meeting.
3. The above stated and other reasons, the proposed special use permit has been
determined to be in the best interest of the health, safety, morals, convenience, order,
prosperity and welfare of the citizens of Garfield County.
4. The application has met the requirements of Special Use (Sections 5:03, 5:03:07,
5:03.08 and 9:03) the Garfield County Zoning Resolution of 1978 .
. NO\V THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that Special Use Permit is hereby approved subject to compliance with all of
the following specific conditions:
i. All representations of the Applicant, either within the application or stated at the meeting
before the Board of County Commissioners, shall be considered conditions of approval,
unless specifically altered by the Board.
2. The Applicant shall comply with all applicable requirements of the Garfield County
Zoning Resolution of 1978, as amended.
3. The Applicant shall comply with all State and Federal regulations and standards, such as
Noise Abatement, Water and Air Quality.
4. The Applicant shall provide a plan to minimize the spread of cheatgrass through any
activity on-site. This may include, but is not limited to, !) a plan to wash items before
they leave the site, and 2) a plan that details how cheatgrass seed production will be
eliminated. The plan shall be reviewed and approved by the Garfield County Vegetation
Manager, prior to the issuance of the Special Use Permit.
5. The Applicant shall comply with the following recommendations from the Garfield
County Road and Bridge Department:
A A 30-foot right-of-way shall be deeded to the County from the centerline of County
Road 319, east onto the property. No fences or structures shall be built within this
deeded right-of-way.
B. The Road and Bridge Department will issue a driveway permit upon approval of the
Special Use Permit with provisions specific to the permit.
C. A stop sign shall be placed at the exit of the driveway. The stop sign shall be of the
size and located as required by the Manual on Uniform Traffic Control Devices.

D. Truck turning signs shall be located on County Road 319 on either side of the
driveway access for traffic going both north and south. The signs shall be of the size
and located as required by the Manual on Uniform Traffic Control Devices.
E. A sign showing the name of the company shall be in a visible location for emergency

shall comply with applicable Federal, State, and County laws, regulations and standards.
The Applicant shall comply with all Local, State and Federal Fire Codes that pertain to
the operation of this type of facility.
Prior to the issuance of the Special Use Permit, the Applicant shall provide a copy of the
actual well permit. In addition, documentation shall be provided regarding the physical
quantity of the well for the proposed uses. Should the physical water supply of the well
not support the uses, the Applicant shall obtain additional water allotments or a water
augmentation plan prior to the issuance of a Special Use Permit.
9. Any signage installed on-site shall comply with the County's sign regulations.
10. Any changes to the Special Use Permit for the storage of30 vacuum tanks and 200 frac
trucks, office I maintenance shop, truck wash bay and the storage of Potassium Chloride
in 4 tanks, will require a new Special Use Permit.
11. Partial rehabilitation of the property, should the use terminate, shall consist, at a
minimum, of the following:
A. All frac tanks shall be hauled away.
B. All vacuum trucks shall be driven away.
C. All KC! storage tanks shall be hauled away.
D. Building and structures may stay and be sold to other industrial uses.
E. Replacement of stockpiled topsoil.
F. Compliance with all prevailing COGCC and Garfield County regulations governing
final reclamation. ·
12. Prior to the issuance of the Special Use Permit, the Applicant shall provide a copy of an
approved City of Rifle Watershed Permit.
13. Groundwater resources shall be protected at all times. In the event of potential violations
with respect to water pollution, the Applicant shall provide proof of compliance with
applicable Federal, State and County laws, regulations and standards.

14. Prior to the issuance of the Special Use Permit, the Applicant shall provide a screening I
vegetation and landscaping plan to be reviewed and approved by applicable County Staff.
15. All parking (vacuum tanks) along the south end of the property shall be set back and in
line with the office I maintenance shop.
16. The height of the tanks in the tank farm shall not exceed 25' in height.
17. In accordance to section 9.03.05 of the Zoning Resolution of 1978, as amended, this
Special Use Permit is subject to periodic reviews not less than every six (6) months. The
purpose of such review is to determine compliance or noncompliance with any
performance requirements associated with granting the Special Use Permit. The periodic
review is limited to the performance requirements and conditions, of this Resolution,
imposed at the time of the original issuance of the Special Use Permit.
18. All lighting on the property shall be inviard and downward with limited glare off site.
19. The subject property shall not become a regional parking and maintenance facility. Only
vacuum trucks and frac tanks used in the Hunter Mesa area shall be stored on site.

Dalbo, Inc. at 12.SO County Road 319 in Rifle. Io review of this proposed project, some
concerns have arisen that will need ' mitigated, or at a minimwn need clarification in order

This is a request for approval of a Special Use Permit for the storage of vacuun1 trucks,
franc tanks, office and truck maintenance shop on a 35-acre site located off CR 319 in the
AIRJRD zoning. The applicant has been in the oil and gas service business since 1970
Dalbo, Inc. has been in the oil and gas se!vice business since 1970 in Utah, Wyoming,
Colorado and California. The primary function is to haul fresh water for drilling, renting
franc tanks, filling them with fresh water and hauling of produced water (salt water) to
disposal pits.
Tamara continued a review of the staff report. Two of the tanks are over 35 feet in
heights but it is her understanding that they will work within the 25 feet height limitation.
Staff recommends that the Board APPROVE the Dalbo, Inc. Special Use Permit for the
storage of vacuum trucks and frac tanks, office, and truck maintenance shop, subject to
the following conditions:

Nick stated that currently Dalbo is renting two facilities one in Mesa County and one in
DeBeque. Property has been purchased in Mesa for location of trucks and leasing
property west of Rifle on 1-70 where they have been renting for several years. They
would like to get out of the business of leasing property. Dalbo is currently operating in
Garfield County. About 30 trucks are in this area working. Most are driven into the area
by the drivers and the attempt is to elitninate some of the traffic going into the site. The
business park in Rifle seems to be congested. They tried to purchase other properties but
none are closer than this particular site they are requesting approval for today.
Commissioner Houpt, in trying to understand how the location of this particular property
· would cut down the vehicles trips asked ifthe trucks would be traveling down to pick up
water and then traveling back up. And in reference to other questions, Nick responded
stating they will be and are currently doing that now. There are two functions of the
trucks: one function is to go get fresh water each day and another would be going into the
field and actually transferring water from one location to location or transferred produced
water from a location to an evaporation pond. Those trucks would probably not be
corning back down. Some trucks would going for fresh water, but not all trucks would
perform that function. Nick said that have 10 wheelers or bobtails and those would be
working in the field. We have 15 or 16 transports that are a longer tubular truck trailer
and those are the ones that would be going for fresh water. Some of these trucks would be
leaving the property to go to some other location, like McClure Pass, yes on demand they
could and it depends upon where the wells are being drilled and how much water needs to
be 1noved at those sites. Currently, with the activity, they are involved in, Nick estimates
85-95o/o of the work; the tfucks are not leaving the area, but are working in that area.
There inight be 4 - 5 trucks working on McClure last week and a few trucks went over to
Parachute 10 days ago. The trucks go for fresh water for the most party anytime within a
24-hour period. Yes, the traffic that Commissioner Houpt referenced as a concern by the
residents in terms of the school bus traffic he could understand but the traffic from the
men going to work would be a savings in traffic. The water has to come from somewhere
and currently they are getting it near the river -all of the oil rigs are doing the same
thing. Nick clarified that the trucks Commissioner Houpt is concerned about are on the
road now anyway. By reducing the trucks leaving the area, they would be cars instead of
trucks coming and going morning and night. The lessened traffic would be on CR 319
down south but not up country.
Co1n1nissioner Houpt -this is an area that people are pretty sensitive about and felt he
was sure of the concerns of property owners up there and the feelings of their view scapes

being taken over and she appreciates the fact that Nick is sensitive to this as stated during
his presentation. She wondered what was done in the plans to create setbacks or berrning
so that it's not right on the road.
Nick stated there are no homes in sight of this property, no homes can view this property
in anyway that would offend them. What they are hoping to do is to build the storage
tanks that store water and the shop and then hide as much as they can behind that. If
Commissioner Houpt feels that berms are necessary or site obscuring fence, they'll do
that. Nick thinks for security reasons that they would prefer to have nothing hidden
behind the structures that they or anyone else can't see -activities they feel that would be
offensive are what usually get hidden behind something.
Com1nissioner Houpt -better excepted if the viewscape wasn't bothered.
Nick -they are willing to do whatever it takes.
Chainnan Martin -asked hOw they would address the water engineer on the Division of
Water Resources in reference to the well noting cisterns, gallons per minute, but truck
washing of 30 vehicles will take more than 250 gallons. Some other water would be
necessary and knows they are hauling water with the augmentation plan, doing the
storage, etc. and asked how they would-address the water on the wash bay.
Nick -two thoughts -Mr. Dennison brought this up and originally they applied for a
water well thought the Division of Water Resources for an inside use only/sanitary use
only and the water engineer suggested they drill a well and test it for it's ability to
produce more that what they wanted for that use. !fin fact, it will, then rather than haul
water they would like to use whatever water might be there. Discussion with West Divide
folks about augmenting water, purchasing water to do that, and we do have some
contracts with them now and we could purchase a contract for that specific reason and
then change the use of the water well to that of a commercial use. It's a wait and see how
the water does.
Chairman Martin noted the fear of everybody saying there's limited water and you're
going to be pumping it all out just to wash cares, etc.
Nick -second thought is -you use less water but a lot of pressure when you wash and
they would recycle the water that's there and it's the plan and if necessary they will haul
water on site.
Commissioner Houpt now addressed a fear of water being hauled for use at the site if the
other failed to transpire.
Chairman Martin inquired if the applicant would be willing, if there was a concern, to
setbacks for screening for those passer-bys who are sensitive to the views. This is just for
driving by, recognizing the neighbors are quite a distance from this site.
Nick agreed they would. Houpt -need to understand the road impact from this operation
because she sees an increase on the Mamm Creek Road.
Clarification was made by the applicant that the property, the old Gert Benzel land, was
not sold to the1n by John. Their property is south of this property.
Co1nmissioner Houpt asked staffs help for her to understand what the road iinpact would
be as a result of this because unless her math is wrong, she's sees an increase in traffic on
that Mamm Creek Road, not a decrease.
Chairman Martin noted we do have the designated haul route for the industry and no
number was set on the haul route.
Commissioner Houpt-one of the arguments for doing this was cutting down on traffic
and felt as though she was missing so1nething.
Doug Dennison, Oil and Gas Auditor, explained when he looked at the application, his
concerns about truck traffic was more of the traffic that's con1ing from West Rifle
through Rifle up to the Interstate, big trucks do that everyday. They drive from West
Rifle into the field in the morning and then back out at night. So she's right that it inay
not reduce the traffic on those County Roads south of the Interstate because it is there
now. Where it will reduce the big truck traffic is from the Airport Road interchange on I
-70 back through Rifle to West Rifle, although it's not County Roads it is traffic that
people are concerned about. The intersection at Railroad and Hwy 6 & 24 in Rifle, a lot
of the traffic is these big trucks. It won't reduce the traffic that's in the Mamm Creek gas
fields, but it will reduce the big truck traffic to and from the interstate to and from other
roads.
Commissioner Houpt 1naintained that is actually increases the traffic on CR 319. They
drive up to work, and then they drive the truck back down to get water, and then drive
back up.
Nick disagreed.

So1ne trucks will go get fresh water everyday.
Commissioner Houpt asked how the applicant would fee about limiting the time of day
that those fresh water trucks could go up and back so we miss the school traffic.
Nick said if the Commissioners want to do that to all the carriers in that area, he wouldn't
have a problem with it. To do it to just them is not fair.
Commissioners I-Ioupt -that's another discussion.
Chairman Martin -noted that down the road you would be interfering with agricultural
purposes on oversize and overweight trucks.
Con11nissioner Houpt -but she is hearing that this road is overused already and
understand that these trucks are using this road.
Nick -EnCana is trying to have some other roads built off Hunter Mesa back east to
Shaffer cut-off road. West Mann-they are in the process of trying to divert a lot of the
traffic off that road into the other direction to reduce according to what Jake Mall was
telling them it will reduce the traffic on CR 319 when they get the roads up country cut.
In looking at the map -Commissioner Houpt asked how Nick would feel about setting
the building back. He also pointed out where the trucks would be parked with only the
pick-up trucks in front of the buildings.
Com1nissioner Houpt said this is not the least controversial area for this establishing your
home base operation and understand the selection of this site, but doesn't want it to end
up being "an in your face type proposition for people either" as they are driving down the
County road and asked about set-backs. Nick explained how the buildings were already
set at 200-feet from the road. She would like to have them 300-feet and she would like to
have had a site review in advance of this hearing.
Trunara asked for clarification, if the Board makes this a condition of approval, in regards
to the screening, where it needs to be, how high and what form it needs to be in. The
other thing, lighting has been Indicated to be downward and inward so mat would need to
be a condition of approval. And also limiting the height of the tanks, if that's something
the Board wants.
Chairman Martin stated that would be the standard we have not to exceed 25-feet because
of the zone district. The applicant will figure that out.

uphill and you wouldn't be able to see it that way; downhill you can see right into the

Co1nmissioner Houpt -the berming I would want in that front portion so that there's not
an im1nediate view of the building and parking understanding that it's a huge flat area
and it won't all be hidden, and one more condition, and that's the trucks that are parked
up there, trucks that are being used up in that area, and that it doesn't turn into a regional
parking and storage for the whole region.
Chairman Martin-seconded the motion for discussion. I think you're extremely restrict
and very expensive to the applicant even though they may be able to do it financially, I
think it's unfair to them to have to go through as much as you did on the restrictions, I
that a 200-foot set back on that building, placement aftbat building, av.d a driveway
properly designed will suffice on hiding just bout everything that would he visihl~; other
than the wash bay and the commercial building, which is their office, which they need to
be seen anyway, and you're getting it off the road so far that the driveway improvements
and the e1nergency response is becoming an issue, I think getting it back 300-feet plus,
plus getting through all that, but some fencing can be used and used properly and lJhi!!k

too much sage brush is not very good and if you start re-transplanting that then we get
some other property problems. That's where I'm out, I think we can work it out.
Comtnissioner Houpt-where would you put fencing, and fencing is not very pretty.
Chainnan Martin-Lwould put back just so that you can have visibility of some sort so
that you can see a certain area for security pnrposeili and I know that the security force
will be going up there and also assist the Sheriff in vandalism if there is any theft, be a
deterrent, use some good comn1on practices for crime prevention which are crime
prevention through design which you would have to work with which I know that Nick
knows and we can work that out, but I think if we try to totally isolate and hide
everything to appease some folks, it just won't work. And I think we'll be challenged on
it, because I don't think our regulations would go ahead and support it, in my opinion.

if we fence and put some trees up along behind the fence to use as, granted it may take a
year or tow for the trees to grow. We're not going to buy the s1nallest trees we can find.
Buy some nice trees, put them along CR 319 back across to the north where it maybe
would site obscure that area that I could screen, I don't care. Hopefully our water well
will suffice to where we could water the trees whether they be a cotton less Cottonwood,
or Aspens or something that could be used as site obscuring. There is a berm on the
neighboring property and frankly it's offense to me and I think to a lot of people -it
doesn't work. The benn is not working. There's got to be some other way but the berm is
not working.
Chairman Martin -the only problem I see in reference to your suggestions is the water
because you're limited right at the present time with the information that you provided us
you can't do that with the well that you have. That would have ...
Nick -we do have water trucks.
Chairman Martin - I realize that but again you would have to go ahead and submit so1ne
kind of vegetation plan for review and if you can come up with a watering system not
using that well at present, or until you get your com1nercial well in place, we would
accept some kind of solution that way but water is the issues at the present time with the
infonnation, but if you're truly dedicated to going to do that and then come up with a
secondary watering system for that vegetation, that would be above and beyond what has
been asked prior.
Nick -this is just an idea to try to suffice on the site obscuring.
Chairman Martin-Ifyou're able to get that through the head office for that purpose, I
could accept it.
Commissioner Houpt -and I always willing to have other suggestions for obscuring
things, ifthe berm doesn't work.
Nick-I would really like it to look nice up there, we're not trying, I promise you we're
going to look at Jot nicer than the evaporative pit next door. We're going to look ever bit
as good as anything down in the Business Park -we will. You do not know us, that is
okay but if you go look in the Business Park that is east of the Wal-Mart area, the Rifle
Industrial Park, there is a lot of big trucks and bid equipment in that area. The people pass
by everyday.

B . Project Description : Dalbo, Inc. has been in the oil and gas service business si nce 1970.
Dalbo , Inc. has operations in Utah, Wyoming, Colorado, and California. The home o ffice is in
Vernal , Utah. Dalbo, Inc . owns and operates vacuum trucks and rent s frac tanks to o il and gas
companies for the extraction of oil and gas natural resources. The primary function of the
Applicant is the hauling of fresh water for drilling, renting frac tanks, filling frac tank s with fresh
water and KCI water, and haulin g of produced water (salt water) to di spo s al pits.
Currently, the Applicant is operating from a recently purchased property in Debeque, Colorado,
and a leased yard west ofl-70 in Rifle. They are also lea s ing space in Grand Junction. The
Applicant noted that the primary purpose of selecting the subject property, which recently has
been purchased (see Exhibit L), was its location. Approx imately 75% to 85% of the truck trips
associated with th e Applicant 's operation are a long County Road 319. In addition, the property
allows the Applicant to consolidate some of its operations throughout the county into one
location.
A frac tank is a mobile water s torage
container commonly used during the
completion stage in the oil and gas extraction
process. A frac ta nk is typicall y 45 ' long, 8'
wide, and 1 O' ta ll. The Applicant provided a
close up photograph of a frac tank with the
application. The photograph to the left,
taken in the Hunter Mesa, illustrates the frac
tanks in the field.
The following structures, as represented on
sit e plan provided with the application, will
be erected on the currently vacant property:
l. A 50' X 100' metal frame maintenance shop.
2. An attached 26' X 40 ' office.
3 . A 30' X 50' concrete wash bay for the vacuum tracks.

3. One (l) tank will be 24' tall , 22' in diameter and will hold fresh water (l,500 bbl.
capacity).
The maintenance shop will have two 16 ' tall bay doors for the vacuum trucks to access the
interior of the shop for light maintenance. Most of the major truck repairs will be done in
Vernal, Utah. The shop will be designed for minor truck repairs and periodic maintenance. The
attached office will be 26 ' X 40' and will have a main lobby, 3 offices for the secretaries,
salesman and manager. Two re strooms will also be in the office area.
To the south of the maintenance shop and office will be a tank battery. In the tank battery, there
will be four tanks enclosed by a concrete containment wall. Three tanks will have KCl water and
one will have fresh water, as described previously in this memorandum.
Behind the shop is the truck wash bay. This structure will consist of a 30 ' X 50' concrete wash
bay and a water and silt collection sump. The vacuum truck and frac tank storage will be south
and east of the shop as shown in the site plan submitted with the application.
Both photographs above were taken at the EnCana evaporation pit access looking north and east
on the subject property. The photograph to the left shows the area of the maintenance shop I
office, and truck wash. The photograph on the right s hows the area where the 4 upright metal
storage tanks, storage area of the vacuum trucks and the frac tanks will be located.
It is anticipated that there will be two full time office employees and two full time mechanics at
the facility five days a week, 8 hours a day. In addition, there will be a salesperson, a manager
and a truck dispatcher who will be in the office 2 to 3 hours each day. The Applicant noted that
the hours of operation would be 24 hours per day. However, generally the hours of operation
will be during the daylight hours. The truck drivers will mo st likely be in and out of the property
as often as once per day, 7 days a week . Weekends will be limited, however, this will be based
on the need of the oi l and gas companies.

It is also anticipated that deliveries could be as few as once a week to as many as once per day by
means of UPS or postal service. Most necessary parts will be picked up by the salesperson, the
manager, the dispatcher or the mechanics in the daily to and from travels to work . The Applicant
noted that customer visits to the facility would be rare.
The.Applicant noted that some fencing along County Road 319, drilling a water well, and
hauling of dirt will be necessary to complete the onsite improvements. Construction is
anticipated to begin upon County approval of the SUP request.
C. Site Description: As the Applicant noted, the property has two very distinct topographic
areas. The first area, a flatter or s lightly slope
area, contain s approximately 15 acres. This
area will be used for the storage yard and
maintenance shop. Intermittent small patches
of native grass exist on this area. Sagebrush
and other small native plants are sparse. Two
sides of this area ha ve existing fences.
According to th e Applicant, the fence was
constructed for the purpose of keeping cattle
on the adjacent property. There is also a very
distinct drainage that traverses the property.
The Applicant is purposing to culver thi s
drainage.
The second area of the property, along the northern boundary line, consists of the remainder 20
acres. This area is defined by a s mall hill. Sagebrush, cedar trees and intermittent s mall patches
of grass sparsely cover thi s area. No disturbance of thi s hill is proposed.
D. Zoning: The subject property is zoned NR/RD (Agricultural I Residential /Rural
Density). The type of use requested falls under the definition of"Storage" which is a Special
Use in the NRIRD zone district. "Storage" is a subcategory of "Industrial Operations
Classification", therefore it is subject to the standard outlined in Section 5.03.07 of the Garfield
County Zoning Resol ution. The office, maintenance, and truck wash sho uld be considered
accessory to the storage yard.

Pursuant to section 2.02.011 of the Zoning Resolution, the definition of "accessory use" is as
follows:
Accessory Uses: Incident only to a lawful use, any use, which complies, with all of the
following conditions may be operated as an accessory use:
(1) Is clearly incidental and customary to, and commonly associated with a lawful
use;
(2) Is operated and maintained under the same ownership and on the same lot as the
lawful use;
(3) Does not include structures or structural features inconsistent with a lawful use;
and
(4) Does not include residential occupancy except by domestic employees employed
on the premises and the immediate families of such employees.
E. Relationship to the Comprehensive Plan: The subject property is designated on the
"Proposed Land Use Districts, Study Area 2 & 3" map in the Garfield County Comprehensive
Plan of2000, as "Outlying Residential." Outlying Residential is consistent with the underlying
zoning, which in the case of A IR I RD is a minimum lot area of 2 acres. The subject property is
located within the 2-mile sphere of influence for the City of Rifle (see Exhibit J).
F. Adjacent Land Uses: The area surrounding the proposal is pre-dominantly rangeland
with similar, oil and gas, type land uses.
I. North: Existing and recent being drilled gas well.
2. South: Evaporation Pit
3. East: Vacant
4. West: Vacant
G. Road/Access: The access to the subject area will be by means of a driveway off of
County Road 319.
H. Applicability: Pursuant to Section 9.03.04 of the Zoning Resolution, an application for a
Special Use Permit shall be approved or denied by the Board of County Commissioners after
holding a public hearing thereon in conformance with all provisions of the Zoning Resolution.

III. REVIEW CRITERIA FOR SPECIAL USE PERMITS (SECTION 5:03)
Pursuant to Section 5.03, as listed under the Zone District Regulations, special uses shall
conform to all requirements listed thereunder and elsewhere in the Zoning Resolution, as well as
the following standards:
1. Utilities adequate to provide water and sanitation service based on accepted engineering
standards and approved by the Board of County Commissioners shall either be in place or shall
be constructed in conjunction with the proposed use.
Response: The Applicant noted that water for the office, shop and truck wash will be acquired
by drilling a water well. A septic system will be designed to accommodate the wastewater from
the two restrooms in the office I shop. The Applicant has provided a copy of the well application
and septic permit application. An actual well permit shall be submitted prior to the issuance of
the actual Special Use Permit. In addition, the application shall provide documentation
regarding the physical quantity of the water for the proposed uses.
The following is a summary of water usage of the project:
I. Office restrooms and hand washing in the shop. The water for the office and the shop
will be from the propose water well. Any wastewater would be put into the septic system
to be installed on the property. The Applicant anticipates that water usage will be
minimal, less than 250 gallons per day.
2. Truck washing facility. The water for the wash bay will also come from the water well.
The Applicant noted that water usage will be minimal, less than 500 gallons per day. The
wastewater will be recycled. Any silt from the wash bay would be collected and hauled
to the local landfill.
3. KCL Storage tanks. It is anticipated that this water would have to be hauled for a fresh
water source. If the water well can produce more water than used by the office and truck·
washing facility the excess water will be sue for the KCL storage tanks.

The Applicant asserted that the Department of Water Resources indicated that a well can be
drilled on 35 acres and there will be no need for a water allotment or a water augmentation plan.
However, the well allowed to be drilled is an exempt domestic well. The Applicant may need to
obtain an exempt commercial well permit from the State for the proposed uses.
2. Street improvements adequate to accommodate traffic volume generated by the proposed
use and to provide safe, convenient access to the use shall either be in place or shall be
constructed in conjunction with the proposed use.
Response: Access to the property will be off of County Road 319. The Applicant has had
discussions with Jake Mall of the Garfield County Road and Bridge Department with respect to
safe and convenient access to the site from CR 319.
Mr. Mall provided the following comments (see Exhibit G):
A. The Road and Bridge Department has no objections with the SUP, as it locates this
type of industry closer to the drilling fields and eliminates a considerable amount of
traffic on certain roads.
B. A 30-foot right-of-way shall be deeded to the County from the centerline of County
Road 319, east onto the property. No fences or structures shall be built within this
deeded right-of-way.
C. The Road and Bridge Department will issue a driveway permit upon approval of the
SUP with provision specific to the permit.
D. A stop sign shall be placed at the exit of the driveway. The stop sign shall be of the
size and located as required by the manual on Uniform Traffic Control Devices.
E. Truck turning signs shall be located on County Road 319 on either side of the
driveway access for traffic going both north and south. The signs shall be of the size
and located as required by the Manual on Uniform Traffic Control Devices.
F. A sign showing the name of the company shall be in a visible location for emergency
purposes.
3. Design of the proposed use is organized to minimize impact on and from adjacent uses of
land through installation of screen fences or landscape materials on the periphery of the lot and
by location of intensively utilized areas, access points, lighting and signs in such a manner as to
protect established neighborhood character.
Response: The area surrounding the property storage yard is vacant except for gas wells to the
north and one ofEnCana's evaporation pit and storage yards to the south. There are no homes,
subdivisions, irrigated lands, and retail or commercials operations in the area.

Currently along the south property line and the east property line there is a 5' field fence or
combination wire fence. The Applicant is proposing to retain this fencing. The Applicant is
proposing to install a 5' security fence along the north and west boundary line. However, due to
the hill along the north side of the property, the Applicant noted that fencing will follow the base
of this hill to prevent disturb of this hill area and keep it in its nature form .. A photograph
representing the type of fencing proposed has been included with the application.
The Applicant indicated that lighting will be installed to light up the area around the shop and the
office. This lighting will be on an electric eye to tum on at dark. The lighting used will be
directed to minimize any off-site glare. The Applicant is proposing to install a 4' X 8' non-
lighted sign will be erected to identify the facility. The sign shall comply with the county sign
standards.
No additional screening or landscaping of the site is proposed. The Applicant feels the fencing
proposed is adequate and that no additional screening is necessary. The Applicant feels that the
more visible the property is from the public right-of-way, the less likely there will be any
vandalism or problems.
Pursuant to Section 5. 03. I 0, uses listed as Special Uses shall be permitted only:
I. Based on compliance with all requirements listed herein, and;
2. Approval by the County Commissioner, which Board may impose additional
restrictions on the lot area, floor area, coverage, setback and height of proposed uses
or required additional off-street parking, screening fences and landscaping, or any
other restriction or provision it deems necessary to protect the health, safety and
welfare of the population and uses of the neighborhood or zone district as a condition
of granting the special use.
Response: Staff sees no reason for the Board to impose any special conditions.
Section 5.03.07 {Industrial Operations/:
Pursuant to Section 5.03.07 of the Zoning Resolution, a permit for Industrial Operations requires
the submittal of an impact statement on the proposed use describing its location, scope, design
and construction schedule, including an explanation ofits operational characteristics. The impact
statement is required to address the following:

(A) Existing lawful use of water through depletion or pollution of surface run-off, streamflow
or ground water.
The Applicant noted that water for the office, shop, and truck wash will be acquired by drilling a
water well. A septic system will be designed to accommodate the wastewater from the two
restrooms in the office I shop. The tank farm south of the shop will be surrounded by a concrete
containment wall with a concrete floor. A 4' diameter culvert will be placed in the wash to allow
surface run-off to continue through the property. The Applicant noted that the yard will be
graveled and the property will slope away from County Road 319, so that little or no water, dirt,
or mud will be carried onto the county road. The Applicant does not propose to change the
general topography of the property.
A concrete pad will be constructed to catch the wastewater from the truck wash and the water
will be reused similar to a car wash. The water and silt will flow to a concrete collection sump.
When it becomes necessary to remove the silt from the collection sump, a backhoe and dump
truck will be used to collect and haul the silt to the landfill. The truck wash is a concrete self-
contained unit.
The Applicant asserted that no truck wash water would impact the ground water or the surface
runoff. Frac tanks and vacuum trucks will be stored on site empty.
(B) Impacts on adjacent land from the generation of vapor, dust, smoke, noise, glare or
vibration, or other emanations.
Response: The Applicant noted that the maintenance shop will normally have its doors closed.
Any noise, smoke, dust, vibration, or other emanations from the shop should be minimal. No
painting, sandblasting, or manufacturing of new equipment will take place at the shop. Storage
of maintenance fluids (motor oil, antifreeze, transmission fluid, etc.) will be stored inside the
shop. The Applicant indicated that when a truck is started a minimal amount of smoke and noise
will be created. A minimal amount of welding, for minor repair only, will be done in the shop.
All manufacture of trucks and tanks is done off site. A used oil containment tank will be placed
outside of the shop to hold used oil. Use oil will be collected periodically.
In the event of potential violations with respect to vapor, dust, smoke, noise, glare or vibration,
the Applicant will be required to provide proof of compliance with applicable Federal, State, and
County laws, regulations and standards.

(C) Impacts on wildlife and domestic animals through the creation of hazardous attractions,
alteration of existing native vegetation, blockade of migration routes, use patterns or other
disruptions.
Response: The application did not contain an analysis of wildlife impacts on the property.
There is existing fencing that has been installed on the property by the previous property owner
which has probably disrupted the migration routes or use patterns by wildlife habitat if it existed.
The proposed use should not result in increased adverse impacts to wildlife or domestic animals
through creation of hazardous attractions, alteration of existing native vegetation, blockade of
migration routes, use patterns or other disruptions. The activities of the business will not result
in the generation of products or waste products that will attract wildlife or domestic animals.
This application was referred to the Colorado Division of Wildlife, however, no comments were
received.
(D) Affirmatively show the impacts of truck and automobile traffic to and from such uses and
their impacts to areas in the County.
Response: The Applicant has noted that County Road 319 is one of the main roads being used
by EnCana to access their gas extraction activities. The Applicant feels that there are some
distinct advantages to locating on the subject property. These include:
I. Currently, all of Dalbo's vacuum trucks are traveling into the Rifle area via 1-70 from
Grand Junction and Debeque. The vacuum traffic should decrease on the freeways and
secondary roads. The truck drivers will drive their personal vehicles to the yard each day,
pick up the trucks and go to work.
2. The tank storage yard is currently located in a leased yard on the west Rifle I-70 frontage
road. Winch trucks travel to the yard to retrieve our tanks and move them to various oil
field locations. If the tanks were located in the new yard, the winch truck traffic would
also decrease, because access to the oil field locations would be closer to the new storage
yard.
3. The KC! storage tanks are also located in the leased yard on the west Rifle 1-70 frontage
road. Vacuum trucks travel on this frontage road to load the KC! water and haul to
various oil field locations. The across town traffic on secondary roads should decrease.
(E) That sufficient distances shall separate such use from abutting property which might
otherwise be damaged by operations of the proposed use(s).
Response: Much of the adjacent land is vacant except for EnCana's evaporation pit to the south
and gas wells and tanks to the north. There are no homes or neighborhoods adjacent to the

property. The Applicant noted that the SUP request coincides with the current land uses on
adjoining properties.
(F) Mitigation measures proposed for all of the foregoing impacts identified and for the
standards identified in Section 5. 03. 08 of this Resolution
Response: Mitigation measures for all of the foregoing impacts identified have been addressed
throughout this memorandum. Mitigation measures for the standards identified in Section
5.03.08 [Industrial Performance Standards] of the Garfield County Zoning Resolution are
addressed in this memorandum.
Special Use Permits may be granted for those uses with provisions that provide adequate
mitigation for the following:
(A) A plan for site rehabilitation must be approved by the County Commissioners before a
permit for conditional or special use will be issued;
Response: The Applicant asserted that the following steps will be followed for "partial"
rehabilitation of the property:
A. All frac tanks will be hauled away.
B. All vacuum trucks will be driven away.
C. All KC! storage tanks will be hauled away.
D. Building and structures will stay and be sold to other industrial uses.
E. Restoration of grade to approximate original conditions.
F. Replacing stockpiled topsoil.
G. Complying with all prevailing COGCC and Garfield County regulations governing final
reclamation.
For "full" rehabilitation of the site, the Applicant indicated that the following steps will be taken:
I. All frac tanks will be hauled away.
2. All vacuum trucks will be driven away.
3. All KC! storage tanks will be hauled away.
4. Propane tanks, used oil tanks, and new fences will be removed.
5. Concrete containment wall and concrete wash bay will be demolished.
6. Maintenance shop and office will be demolished.
7. 4' culvert will be dug out and removed.
Staffis of the opinion that the proposed "partial" rehabilitation plan of the property is the
preferable plan.

Steve Anthony, Director of Vegetation Management, noted that the primary concern is that the
storage facility could act as a vector that will facilitate the spread of weed seeds throughout the
County as various items will be stored on site and than transported to other areas (Exhibit M).
Mr. Anthony noted that weeds on the Garfield County Noxious Weed list are not common on
this site, however, cheatgrass (bromus tectorum) is found in the area. Cheatgrass is not a county-
listed noxious weed, however, it is a State of Colorado listed noxious weed. Cheatgrass is an
invasive species that quickly spreads and it poses an immediate fire hazard once it has been
established. The seed of cheatgrass has a very long awn and will attach itself to vehicles and
other items. The obvious concern is the potential of cheatgrass to attach itself to any of these
items that are stored on site and to be carried to a previously cheatgrass free site.
Mr. Anthony indicated that the Applicant shall provide to the County a commitment to minimize
the spread of cheatgrass through any activities on site. This may include, but is not limited to, 1)
a plan to wash items before they leave the site, and 2) a plan that details how cheatgrass seed
production will be eliminated.
(B) The County Commissioners may require security before a permit for special or
conditional use is issued, if required. The applicant shall furnish evidence of a bank commitment
of credit, bond, certified check or other security deemed acceptable by the County
Commissioners in the amount calculated by the County Commissioners to secure the execution of
the site rehabilitation plan in workmanlike manner and in accordance with the specifications
and construction schedule established or approved by the County Commissioners. Such
commitments, bonds or check shall be payable to and held by the County Commissioners;
Response: The Applicant shall comply with this provisions if deemed necessary by the Board of
County Commissioners. The Applicant asserted that if any bonds, commitments, or other
security is deemed necessary, the Applicant will comply.
(C) Impacts set forth in the impact statement and compliance with the standards contained in
Section 5.03.08 of this Resolution. (A. 93-061)
Response: See responses in Section 5.03.08 below.
Section 5.03.08 [Industrial Performance Standards/:
Pursuant to section 5.03.08 of the Zoning Resolution, all Industrial Operations in the County
shall comply with applicable County, State, and Federal regulations regulating water, air and
noise pollution and shall not be conducted in a manner constituting a public nuisance or hazard.
Operations shall be conducted in such a manner as to minimize heat, dust, smoke, vibration,

glare and odor and all other undesirable environmental effects beyond the boundaries of the
property in which such uses are located, in accord with the following standards:
(1) Volume of sound generated shall comply with the standards set forth in the Colorado
Revised Statutes at the time any new application is made.
Response: Volume of sound generated by the proposal has been addressed previously in this
memorandum. The Applicant noted that the proposed operation shall comply with the maximum
standards established in the CRS 25-12-103. Upon a receipt of a legitimate allegation of a
violation with respect to noise, the Applicant will be required to provide proof of compliance
with State dB levels.
(2) Vibration generated: every use shall be so operated that the ground vibration inherently
and recurrently generated is not perceptible, without instruments, at any point of any boundary
line of the property on which the use is located.
Response: No vibration is anticipated with the proposed use. Upon a receipt of a legitimate
allegation of a violation with respect to vibration, the Applicant will be required to provide proof
of compliance with applicable Federal, State, and County laws, regulations and standards.
(3) Emissions of smoke and particulate matter: every use shall be operated so as to comply
with all Federal, State and County air quality laws, regulations and standards.
Response: No emissions of smoke and particulate matter are anticipated as part of this project.
Upon a receipt of a legitimate allegation of a violation with respect to smoke or particulate
matter, the Applicant will be required to provide proof of compliance with applicable Federal,
State, and County laws, regulations and standards.
(4) Emission of heat, glare, radiation and fumes: every use shall be so operated that it does
not emit heat, glare, radiation or fumes which substantially interfere with the existing use of
adjoining property or which constitutes a public nuisance or hazard. Flaring of gases, aircraft
warning signals, reflective painting of storage tanks, or other such operations which may be
required by law as safety or air pollution control measures shall be exempted from this
provision.
Response: No emission of heat or radiation is anticipated as part of this project, aside from the
emissions from the trucks. Upon a receipt of a legitimate allegation of a violation with respect to
the emission of heat and radiation by the proposed use, the Applicant will be required to provide
proof of compliance with applicable Federal, State, and County laws, regulations and standards.

Propane will be used to heat the office and shop. The 1,000 gallon propane tank will be located
between the shop and the truck wash.
(5) Storage area, salvage yard, sanitary landfill and mineral waste disposal areas:
(A) Storage of flammable or explosive solids or gases shall be in accordance with accepted
standards and laws and shall comply with the national, state and local fire codes and written
recommendations I comments from the appropriate local protection district regarding
compliance with the appropriate codes;
Response: The Applicant noted that any flammable soils or gases will be stored in accordance
with accepted laws and standards. The Applicant shall comply with all Local, State and Fire
Codes that pertain to the operation of this Facility. This application was referred to the Rifle Fire
Protection District, however, not comments were obtained.
(BJ At the discretion of the County Commissioners, all outdoor storage facilities may be
required to be enclosed by fence, landscaping or wall adequate to conceal such facilities from
adjacent property;
Response: The Applicant asserted that if required, fencing or landscaping of the facility from
adjacent properties will be accomplished.
(C) No materials or wastes shall be deposited upon a property in such form or manner that
they may be transferred off the property by any reasonably foreseeable natural causes or forces;
Response: No materials or waste are associated with the proposed use. All garbage generated
will be stored within standard garbage receptacles and will be removed accordingly.
(D) Storage of Heavy Equipment will only be allowed subject to (A) and (C) above and the
following standards:
1. The minimum lot size is five (5) acres and is not a platted subdivision.
2. The equipment storage area is not placed any closer than 300 fl. from any
existing residential dwelling.
3. All equipment storage will be enclosed in an area with screening at least eight (8)
feet in height and obscured from view at the same elevation or lower. Screening
may include berming, landscaping, sight obscuring fencing or a combination of
any of these methods.
4. Any repair and maintenance activity requiring the use of equipment that will
generate noise, odors or glare beyond the property boundaries will be conducted
within a building or outdoors during the hours of 8 a.m. to 6 p.m .. Mon.-Fri.

5. Loading and unloading of vehicles shall be conducted on private property and
may not be conducted on any public right-of-way.
Response: The subject property is 35 acres in size and is not part of a platted subdivision. There
are no residential dwellings within 300 ft. of the property. The Applicant noted that if deemed
necessary, the storage area will be screen. All repairs and maintenance will be conducted within
the shop. All loading and unloading of equipment will occur on the property.
(E) Any storage area for uses not associated with natural resources, shall not exceed ten (JO)
acres in size. (A97-l I 2)
Response: The Applicant noted that the storage areas are associated with natural resources
extraction.
(F) Any lighting of storage area shall be pointed downward and inward to the property
center and shaded to prevent direct reflection on adjacent property (A97-l 12)
Response: As previously noted in this memorandum, lighting will be installed to light up the
area around the shop I office and the tank farm. The locations of the proposed lights are
delineated on the site plan. This lighting will be on an electric eye to tum on at dark. The
lighting used will be directed to minimize any off premise lighting.
The Applicant noted that electrical service is in place and available from Public Service
Company (PSCo ). The Applicant provided in the application a copy of a application for new gas
and electric service. This application was referred to PSCo, however, no comments were
received.
(6) Water pollution: in a case in which potential hazards exist, it shall be necessary to install
safeguards designed to comply with the Regulations of the Environmental Protection Agency
before operation of the facilities may begin. All percolation tests or ground water resource tests
as may be required by local or State Health Officers must be met before operation of the
facilities may begin.
Response: The only chemical being stored on site will be a weak salt solution, that is non-toxic
and non-hazardous, known as potassium chloride (KC!). The maximum amount to be store on
site would be 2,500 bbls. The Applicant has provided a copy of the Material Safety Data Sheet

application was referred to the State Health Office for comments, however, none were received.
In the event of potential violations with respect to water pollution, the Applicant will be required
to provide proof of compliance with applicable Federal, State, and County laws, regulations and
standards.

Any Special Use Permits may be made subject to a periodic review not less than every six
(6) months if required by the County Commissioners. The purpose of such review shall
be to determine compliance or noncompliance with any performance requirements
associated with the granting of the Special Use Permit. The County Commissioners shall
indicate that such a review is required and shall establish the time periods at the time of
issuance of a Special Use Permit. Such review shall be conducted in such manner and by
such persons as the County Commissioners deem appropriate to make the review
effective and meaningful. Upon the completion of each review, the Commissioners may
determine that the permit operations are in compliance and continue the permit, or
determine the operations are not in compliance and either suspend the permit or require
the permittee to bring the operation into compliance by a certain specified date. Such
periodic review shall be limited to those performance requirements and conditions
imposed at the time of the original issuance of the Special Use Permit.
Response: At the discretion of the Board, this SUP may be subject to periodic review no less
than every six months. Shall the Board feel that periodic review is required, the Board shall
indicate that such a review is required and shall establish the time periods at the time of issuance
of this SUP.
III. ADDITIONAL COMMENTS
I. Doug Dennison, Garfield County Oil and Gas Auditor provided comments with respect to
the proposal (see Exhibit H). The Applicant responded to Mr. Dennison's comments (see
Exhibit I). The Applicant's responses were forwarded to Mr. Dennsion for review, however, no
additional comments were received from Mr. Dennison prior to the distribution of this
memorandum.
2. Matt Sturgeon, Planning Director of the City of Rifle, noted in his comments that the
subject property falls within the City of Rifle watershed boundary and that the proposed use is
subject to the City's Watershed Ordinance (see ExhibitJ). The Applicant has submitted the
required application form and provided a copy of watershed study (see Exhibit K).
IV. RECOMMENDED FINDINGS:
I. Proper posting and public notice was provided as required for the meeting before the
Board of County Commissioners.

2. The meeting before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters and issues were submitted and that all interested
parties were heard at that meeting.
3. The above stated and other reasons, the proposed special use permit has been
determined to be in the best interest of the health, safety, morals, convenience, order,
prosperity and welfare of the citizens of Garfield County.
4. The application has met the requirements of Special Use (Sections 5:03, 5:03:07,
5:03.08 and 9:03) the Garfield County Zoning Resolution of 1978.
V. STAFF'S RECOMMENDATION:
Staff recommends that the Board APPROVE the Dalbo, Inc. Special Use Permit for the storage
of vacuum trucks and frac tanks, office, and truck maintenance shop, subject to the following
conditions:
I. All representations of the Applicant, either within the application or stated at the meeting
before the Board of County Commissioners, shall be considered conditions of approval,
unless specifically altered by the Board.
2. The Applicant shall comply with all applicable requirements of the Garfield County
Zoning Resolution of 1978, as amended.
3. The Applicant shall comply with all State and Federal regulations and standards, such as
Noise Abatement, Water and Air Quality.
4. The Applicant shall provide a commitment to minimize the spread of cheatgrass through
any activity on-site. This may include, but is not limited to, I) a plan to wash items before
they leave the site, and 2) a plan that details how cheatgrass seed production will be
eliminated. These commitments shall be reviewed and approved by the Garfield County
Vegetation Manager, prior to the issuance of the Special Use Permit.
5. The Applicant shall comply with the following recommendations from the Garfield
County Road and Bridge Department:
A. A 30-foot right-of-way shall be deeded to the County from the centerline of County
Road 319, east onto the property. No fences or structures shall be built within this
deeded right-of-way.

B. The Road and Bridge Department will issue a driveway permit upon approval of the
Special Use Permit with provision specific to the permit.
C. A stop sign shall be placed at the exit of the driveway. The stop sign shall be of the
size and located as required by the manual on Uniform Traffic Control Devices.
D. Truck turning signs shall be located on County Road 319 on either side of the
driveway access for traffic going both north and south. The signs shall be of the size
and located as required by the Manual on Uniform Traffic Control Devices.
E. A sign showing the name of the company shall be in a visible location for emergency
purposes.
6. Vibration, emission of smoke and particulate matter, and the emission of heat or radiation
shall comply with applicable Federal, State, and County laws, regulations and standards.
7. The Applicant shall comply with all Local, State and Federal Fire Codes that pertain to
the operation of this type of facility.
8. Prior to the issuance of the Special Use Permit, the Applicant shall provide a copy of the
actual well permit. In addition, documentation shall be provided regarding the physical
quantity of the well for the propose uses. Should the physical water of the well not
support the uses, the Applicant shall obtain additional water allotments or a water
augmentation plan.
9. Any signage installed on-site shall comply with the County's sign regulations.
I 0. Any changes to the Special Use Permit for the storage of 30 vacuum tanks and 200 frac
trucks, office I maintenance shop, truck wash bay and Potassium Chloride storage, will
require a new Special Use Permit.
11. Rehabilitation of the property, shall the use terminate, shall consist of the following:
A. All frac tanks shall be hauled away.
B. All vacuum trucks shall be driven away.
C. All KC! storage tanks shall be hauled away.
D. Building and structures may stay and be sold to other industrial uses.
E. Replacement of stockpiled topsoil.
F. Compliance with all prevailing COGCC and Garfield County regulations governing
final reclamation.
11. Prior to the issuance of the Special Use Permit, the Applicant shall provide a copy of an
approved City of Rifle Watershed Permit.

I have reviewed the subject application for construction of an oil & gas service storage facility and have the
following comments -
1. Based on the current location of the bulk of the natural gas drilling in Garfield County, the
construction of this facility should help to reduce the amount of large truck traffic on City ofRifle
streets, State Highways, and Garfield County roads leading to the Mamm Creek area. However, it
would be helpful for Dalbo to address how this facility will be utilized if the volume of activity in the
Mamm Creek area decreases in the future, particularly if the activity were to shift to another
location within the County.
2. The special use permit application submitted by Dalbo states that the water well to be drilled at
this location could be used for the truck washing facility and, if there is sufficient water, for
producing the KCI solution. However, this proposed use doesn't appear to be consistent with the
restrictions stated on the well permit issued by the State Engineer which restr'1cts use of the water
to drinking and sanitary facilities.

When Dalbo decided to locate in Rifle, Colorado the search for an appropriate site began. In the
fall of 2002 I made a number of trips to the Garfield County. Again in the early spring of 2003 I
began the search for a site in Garfield County. We believe that the site on County Road 319 will
best serve the needs of all.
Response to I.
Most gas producing wells also produce a small amount of production water. This water
will need to be hauled away from the well site continually.
If the drilling activity were to decrease in the Mamm Creek area truck traffic would
decrease also. If drilling & producing activity in the area decreases, then truck activity would be
scaled down accordingly.
Drilling activity in other parts of the county are being serviced by use now. Dalbo has also
purchased property in the Debeque, Colorado. When needed trucks and storage tanks will be
transferred to that property to service the drilling and gas producing activity there.
In conclusion, if the gas wells continue to produce in the Marnm Creek area this trucking
facility will be utilized.
Response to 2.
Our original application for a water well included the use of water other than that of
drinking and sanitary use. After a discussion with Dwight Whitehead, Colorado Division of
Water Resources in Glenwood Springs, it was decided that we would first drill a well for the
drinking and sanitary use. If the well would produce more water than that required for our office.
We could purchase water to augment the amount we intended to use from West Divide Water
Conservancy District. We have been in contact with Janet Maddock in that office. Augmented
water can be purchased. Dwight Whitehead indicated that if we had a contract to augment the
water we used for the truck washing and the Kcl water we could change the intended use of the
well accordingly.

Introduction
Dalbo, Inc. has been in the water hauling business for over 30 years. They have hauled
water primarily for the oil & gas industry. Dalbo, Inc.' s function in the drilling and production of
oil & gas wells has been the hauling of fresh water to drilling rigs, hauling of produced water to
waste water pits, and renting water storage tanks. Dalbo, Inc. is currently working in the Rifle
area. They are renting a small truck maintenance shop in the Debeque, Colorado and a tank
storage yard on the I-70 frontage road west of Rifle, Colorado. Dalbo, Inc. is looking forward to
the purchase of property and the construction of a maintenance shop and office in Rifle,
Colorado.
Proposed Activitv
1. Our current and future plans for the subject property is a storage yard for our trucks.
Dalbo has about 30 trucks working in the Debeque and Rifle areas. Typically these trucks haul
fresh water to the drilling rigs. They also haul produced water from gas wells to the water
evaporation ponds. On occasion, they will haul a weak salt solution to the well locations, known
as Kcl water. Trucks will be empty while parked or stored at the subject property.
2. A 50' X 100' maintenance shop will be built with a 26' X 40' office attached to the
shop. This shop will be used for light duty repair and periodic maintenance of the trucks. All
fabrication, welding, and painting of trucks is done at the main shop in Vernal, Utah. Restroom
facilities will be available for the employees. A septic system would be installed to handle the
restrooms. Included is a copy of the engineers report for the septic system and a report on the
types of soils in the area. A water well would be drilled for water for the restrooms. Two full
time mechanics and two full time secretaries will work at the subject property. No permanent
living facilities are planned at the subject property. Drivers would drive their personal vehicles to
the yard and get into their assigned truck to go to work.
3. About 200 water storage tanks are currently being used by various oil & gas companies
in the Rifle and Debeque areas. These water tanks a stored and moved when they are empty. The
water trucks put water in them when they are placed on drilling locations.
4. A truck washing facility would be built to wash trucks. It would operate much like a
carwash except the wash water would be recycled. All silt and dirt washed from the trucks would
be collected and hauled to the county landfill.
5. Kcl storage tanks would be built to hold a weak salt solution known as Kcl water. A
copy of the MSDS sheet is included for KCL. It is a non-toxic and non-hazardous solution. It is
used to reduce the swelling of clay in the underground formations. Usually a 2% Or 3% solution
is used. The Kcl storage tanks will be place in a concrete containment pond. It is hoped that the
water well will produce enough water for Kcl water. If the well will not produce enough water
for our needs then fresh water will be hauled to mix the Kcl water.
Water Use
After a discussion with Dwight Whitehead, Colorado Division of Water Resources in
Glenwood Springs, it was decided that we would first drill a well for the drinking and sanitary
use. If the well would produce more water than that required for our office. We could purchase

About 450' east of County Road 319 on the subject property there is a dry gulch. We
propose to install a 4' culvert in this dry gulch to gain access to the back part of the property. It is
not our intent to impede the flow of surface water.
No trash, silt from the truck wash, or foreign matter will be deposited on site. All of these
items will be taken to county landfill.
Approximately 4 .5 acres will be gravel yard, used for the truck storage, shop and office,
truck wash, and the Kc! storage tanks. An additional 3-4 acres will be used to park the water
storage tanks. The remaining acreage will be left in native grasses. About 20 acres of hillside will
remain as is, with no change.
Best Management Practices
All servicing of trucks will be done in the maintenance shop, all truck washing will be done
at the truck wash facility, all silts and dirt from the truck wash will be taken to the county landfill,
all trash and foreign matter will be taken to the county landfill, all maintenance shop practices will
be in accordance to standard OSHA work practices, all Kcl water will be properly stored in the
concrete containment pond, all tanks used for Kcl water will be new or in good working
condition, and all access to the subject property will be through the access granted by the Garfield
County Road Permit.
It is our intent to be a good neighbor and an asset to the community.
Conclusion
This business should have less impact than the new Garfield County Shop near the subject
property. This business should have less impact than the electric generation plant nearby. This
business should have less impact than the oil & gas wells nearby.

1.0 Site History
The site consists of approximately 5 acres to be split from a 35 acre parcel of uncultivated native soil.
Drainage is approximately 1 % to the north. A percolation test/soils evaluation was conducted on the
property of reference on 05/13/03 by Torn A. Cronk, registered professional engineer (R.P.E.). The perc
excavation trench (excavation C) was located approximately 30' south of the north property line and
approximately 255' east of the west property line. Additional perc holes were located 85' west of the
trench (excavation B) and 155' west of the trench (excavation A).
The perc test was intended to provide subsurface design parameters for design of an individual sewage
disposal system (ISDS) for commercial use. As based on results from this subsurface investigation, the
following ISDS design has been prepared. Results from the 05/13/03 perc test/soils evaluation are
attached for reference as Appendix A.
2.0 Development of Design Parameters
A perc excavation trench (excavation C) was extended to a depth of 120" below ground surface (BGS).
There was no evidence of ground water or high seasonal water table in the open excavation to a depth of
120" BGS. The soils evaluation indicates three distinct soil horizons underlie the site. A lithological

A trench absorption field is proposed for discharge of septic effluent at the site. As shown in the
attached graphics, the absorption field will consist of three trenches 2' wide and 57' long. The trenches
will be excavated to a depth of 72". After excavation, 48" of gravel fill (l .0"-2.5" screened rock with
aggregate components of uniform size) will be used to construct a level seepage bed in each trench.
Adjacent trenches shall be separated by a minimum horizontal distance of 6' (10'-12' separation
recommended for ease of construction) of undisturbed soil.
Septic effluent distribution piping in the absorption field will consist of a 4" perforated discharge line
placed level (end-to-end) down the center of each trench. As shown in the attached graphic, the
perforated line will terminate 18" from the ends of each trench. The perforated line will be embedded in
the gravel seepage fill with a minimum of 42" of gravel under, and 2" of gravel over each pipe. Ends of
the perforated lines will be looped with solid piping to adjacent trenches. As shown in the attached
graphics, septic effluent will be delivered from the septic tank to each of the tlu·ee trenches through a
distribution box to assure equal distribution of septic effluent to each trench.
As shown in the attached graphics, floor drain effluent from the shop area will plumbed separately from
the solid waste building sewer. Floor drain effluent will be discharged to a 1,000 gallon oil/water
separator (a 1,000 gallon septic tank may be used for the oil/water separator). Effluent from the oil/water
separator will be combine with septic tank effluent for discharge to the absorption field.
Native soil will be used to fill the remaining 18" of trench excavation and construct a soil cap over the
absorption field. Before placing the soil cap, synthetic filter fabric ("myrafi", 140-200 mesh), hay, or
untreated building paper will be placed over the gravel bed to prevent intrusion of fine soils. The native
soil backfill will be mounded 5% over each trench to promote surface flow runoff in the vicinity of the
absorption system.
The installer should confirm the feasibility of gravity discharge of sewage effluent from the structure to
the absorption field by field verification of assumed design parameters. Assumed design parameters with
respect to gravity discharge include:
• distance from exit of sewage pipe at foundation line to absorption field -60' or less,
• elevation of ground surface at entry to absorption field must be no more than 14" above
the invert elevation of sewage pipe at exit from foundation line.
If field measurements do not confirm these design assumptions, gravity discharge of septic effluent from
the proposed structure can not be assured and a lift station may be required. Please contact the design
engineer to address any design modifications necessary if these design assumptions are not upheld.
The installer must also confirm the setbacks from property lines, building envelopes, and existing
easements shown in the attached graphics are maintained. Additionally, any unknown utility lines,
easements, or other adverse conditions disclosed during construction must maintain the required setbacks
listed on page 6 of this document.
Sewage loading for the ISDS will include lavatory and water closet service for 3 employees and
customers associated with a 1,000 sq. ft. office area and 5,000 sq. ft. shop. The ISDS will be sized for a

maximum of 20 employees taken as the occupancy load for the building as allowed by the IBC building

A l,000 gallon septic tank is required for retention of septic effluent for the proposed sewage loading. A
non-corrodible Orenco filter (model# FTW0444-36MA) shall be installed at the final outlet Tee of the
septic tank or in the effluent line between the septic tank and the absorption field to limit the size of
solids and sludge passing into the absorption fields. The filter must be accessible for cleaning and
replacement from the ground surface.
As discussed above, a trench absorption field is proposed to discharge septic effluent to the underlying
sub-soils. As shown in the attached graphics, the absorption field will consist of three trenches, each 2 ft
wide, 72 in. deep, and 57 ft long. The trenches will be filled with 48" of gravel to provide an effective
infiltration area of 855 square feet. Calculations and design parameters used to size the absorption field
follow.

4.0 Site Specific Installation/Operation Requirements
The owner and system contractor shall be aware and comply with the following installation and system
operation requirements.
4.1 Installation -Setbacks, Notifications. and Inspections
• All installation activities shall be conducted in accordance with current Colorado
Department of Health ISDS Regulations as well as any relevant Garfield County
regulations and requirements. If at any time during construction, subsurface site
conditions are encountered which differ from the design parameters developed in Section
2.0, construction activities will stop and the design engineer will be contacted to address
any necessary design modifications.

Installation procedures including grade, location, setbacks, septic tank size, and
absorption field size shall conform with the attached graphic details. Construction
activities and system components will not encroach upon existing easements or utility
corridors. A minimum of 6 ft of undisturbed soil shall be maintained between individual
absorption elements and the septic tank and/or adjacent absorption elements. Minimum
site specific setbacks for system components are:

To avoid surface flow infiltration and saturation of the new absorption system,
abandonment of irrigation in the vicinity of the disposal system is required. Diversion
ditches necessary to divert surface flows around the new absorption bed must maintain
the minimum setbacks listed above.
All sewer lines and effluent distribution piping shall be 4 inches in diameter, have glued
joints, and shall be looped at termination of discharge. Septic tank effluent lines shall be
placed level in the absorption field. All lines discharging sewage from the residence to
the septic tank shall maintain fall of between 118 in. and 1/4 in. per foot and shall employ
sweep 90's or 2-45's at all turns. Sewer lines from the dwelling to the septic tank and at
least 6 ft from the septic tank outlet must meet minimum standard ASTM-3034. Sewer
lines under driveways shall always meet minimum Schedule 40 PVC standards and shall
be encased with corrugated metal pipe when covered with less than 24" of soil.

The installer shall not place fill in the open excavation until inspected and approved by
the design engineer. Additionally, the final cover shall not be placed on sewer lines,
septic tank, or the absorption area until the system has been inspected and approved by
the design engineer. Provide 48 hour notice for all required inspections.
A non-corrodible Orenco filter (model# FTW0444-36MA) shall be installed at the final
outlet Tee of the septic tank or in the effluent line between the septic tank and the
absorption field to limit the size of solids and sludge passing into the absorption field.
The filter must be accessible for cleaning and replacement from the ground surface.
The distribution box shall be set level on undisturbed native soil or a structural pad (e.g.,
compacted fill or concrete) to prevent settling and promote uniform distribution of flow
to the absorption field. A 45 degree bend shall be turned down on the septic influent line
to damp surge flows from the septic tank and promote equal distribution.
The seepage trenches shall be constructed with a 48 in. layer of 1.0 in. to 2.5 in. screened
rock spread evenly over each trench. The effluent distribution lines will be placed level
in the seepage beds with 42" of gravel under, and 2" of gravel over each line. A covering
ofuntreated building paper, hay, straw, or synthetic filter fabric (e.g., "myrafi", 140-200
mesh) shall be placed on top of the gravel absorption trenches before placing the surface
cap. The surface cap shall be mounded 5% over the absorption trenches to promote
surface runoff.
The system contractor shall be aware of the potential for construction activities to reduce
soil permeabilities at the site through compaction, smearing, and shearing. The
following precautions and construction procedures should be employed during
installation to minimize disturbance to native soils:

Excavation should proceed only when the moisture content of the soil is below
the plastic limit. If a sample of soil forms a rope instead of crumbling when
rolled between the hands it is too wet and should be allowed to dry before
excavation continues.
Excavation and backfill equipment should work from the surface where at all
practical to avoid compaction of the soils at depth.
The bottom and sidewalls of the excavation should be left with a rough, open
surface. The appearance should be that of broken or ripped soil as opposed to a
sheared, smeared, or troweled surface. Any smoothed or smeared surfaces
should be removed with a toothed rake or shallow ripper taking care to remove
loose residues from the bottom of the trench by hand if necessary.
Care should be taken in placing fill materials in the excavation to avoid
damaging the exposed soil surfaces.

4.2 Operation -Maintenance and Inspections

The owner shall install a structural barrier if necessary and take precautions to prevent
vehicular traffic, excessive surface watering, accidental flooding, or other activities in
the vicinity of the absorption field which may compact, saturate, or otherwise alter the
subsurface soil parameters used in designing the septic system.
The owner will plant and maintain grass or other shallow rooted cover crop to prevent
erosion and promote evapotranspiration over the absorption field .
The owner will inspect and maintain the required mounding and drainage away from the
absorption field to prevent saturation from precipitation and surface flows.
To mitigate the generation of preferential flow channels which may compromise the
operation of the system, the owner will inspect and prevent intrusion of burrowing
animals and deep rooted plants into the absorption field.
The septic effluent filter shall be inspected and cleaned as necessary every six (6)
months.
The owner will conduct periodic maintenance of the septic system by removing
accumulated sludge from the septic tank every 3-4 years to prevent clogging of the
absorption field.

The site consists of approximately 5 acres to be split from a 35 acre parcel of uncultivated native soil.
Drainage is approximately I% to the north. A percolation test/soils evaluation was conducted on the
property of reference on 05/13/03 by Tom A. Cronk, registered professional engineer (R.P.E.). The perc
excavation trench (excavation C) was I ocated approximately 3 O's outh oft hen orth property I ine and
approximately 255' east of the west property line. Additional perc holes were located 85' we·;t of the trench
(excavation B) and 155' west of the trench (excavation A).
A perc excavation trench (excavation C) was extended to a depth of 120" below ground surface (BGS).
There was no evidence of ground water or high seasonal water table in the open excavation to a depth of
120" BGS. The soils evaluation indicates three distinct soil horizons underlie the site. A lithological

Pere holes were constructed in excavation A at the surface and at depths of approximately 38 in. and 70 in.
Additionalperc holes were constructed at the surface and at depths of 40 in. and 72 in. in excavation B, and
at the surface and at depths of 42 in. and 84 in. in excavation C. The holes appeared to be well saturated at
the time of the test. Results of the percolation test are shown in Table I.

2.0 Conclusions and Recommendation~
Soils at the site appear acceptable for implementation of an individual sewage disposal system (ISDS). The
following site-specific considerations should be observed during implementation of the ISDS:

The bottom of the ISDS absorption field should be located no deeper tlw1 72" BGS to
maintain 4' of usable infiltration soil above the extent of the soils observai1on excavation
located at 120" BGS. A designperc rate of 40 min/in. is recommended for overall system
s1zmg.
Care should be taken during construction to avoid compaction and smearing of the exposed
infiltrative surfaces and preserve the natural permeability of the native soils.

Re: Comments on the Dalbo Special Use Permit

My primary concern with this application is that this storage facility could act as a vector that will facilitate
the spread of weed seeds throughout the County as various items will be stored here and then transported to
other areas. Weeds on the Garfield County Noxious Weed list are not common on this site, however
cheatgrass (bromus tectorum) is found in the area. Cheatgrass is not a County-listed noxious weed,
however it is a State of Colorado listed noxious weed. Cheatgrass is an invasive species that quickly
spreads and it poses an immediate fire hazard once it has become established. The seed of cheatgrass has a
very long awn and will attach itself to vehicles and other items.
The obvious concern is the potential of cheatgrass to attach itself to any of these items that are stored here
and to be carried to a previously cheatgrass free site.
I am requesting that the applicant provide to the County a commitment to minimize the spread of
cheatgrass through any activities on this site.
This may include, but is not limited to:
I. A plan to wash items before they leave the site.
2. A plan that details how cheatgrass seed production will be eliminated.
