The purpose of this letter is to request a Special Use Permit to allow
DM Neuman Construction to complete the ADU for Mr. Ray
Ditta more.
History
The initial construction began in the Spring of 1999 and was
completed in March of 2000. The initial permit no. was 7146. The
plans were stamped by Art Hougland on April 7, 1999. A C.0. for the
primary residence was issued March 24, 2000. The ADU was part of
this design.
The ADU is located above the garage. It's structure was part of the
overall plan and initial construction. We completed the ADU through
framing and rough in plumbing in conjunction with the Main House.
Mr. Dittamore decided to delay the finish of the ADU during that
time frame. The balance to complete the ADU was to connect the
heat to the main house boiler system, insulate, drywall, finish
plumbing, finish electrical, finish carpentry, flooring and casework.
Early February of this year Mr. Dittamore directed us to fin ish this
portion. Because we had closed out the permit on the Main House
with the issuance of the CO we reapplied for a new building permit.

At that time it was discovered that an ADU would require a Special
Use Permit.
Description
The ADU is an existing structure located over the attached garage
and is part of the main house. The unit, as drawn and built, is
approximately 1400 sq. ft. structure. It is comprised of a living room,
small kitchen, laundry area and single bedroom with a bath.
Purpose of use
Mr. Dittamore will become a full time Garfield County resident
sometime in the Spring of 2001. The Main House will be his primary
residence. The attached ADU is to be used by his Children when they
visit. The amount of use of the ADU is somewhat conjecture, but it is
anticipated that it will be used 4 to 6 times a year, with visits
approximately one week per time. High Country Engineering's
summary addresses ADU trip charges as if it were a full time
residence.
Water and Sewer
High Country Engineering define these items in their letter. The
building and it's water and sewer systems were designed and
constructed with this ADU as part of the master plan. In addition, the
Main House has a large well water storage tank system,
approximately 2,000 gallons, designed to service both the Main
House and the ADU.
Requested Information
Through our application and attachments we are providing 1-6 as
requested on the application. Item #7 is not applicable. In addition,
regarding Conditional and Special Uses, 5.03, we provide the
following information:
(1) High Country Engineering's report defines the water and
sanitation service. The system was designed for this ADU.
(2) No street improvements are necessary. The existing road way
can safely handle the traffic volume and proposed use.
(3) The ADU was designed as part of the Main House. It is part of
the over-all structure and blends in nicely. It does not appear
to be separate quarters or a different architectural feature.
Additional Information
For your information and review we are also attaching a copy of the
Declaration of Covenants, Conditions, Restrictions and Easements for
Faranhyll Ranch as well as a copy of a Conservation Easement.
The basic point from the Covenants is that the use is for primary
residence and guests, it may not be used as a rental.
The Conservation Easement shows that this property is one of 12
parcels located on the Faranhyll Ranch. The parcel contains more
than 35 acres. There is only one building envelope per parcel. The
ADU is part of the Main House building envelope. According to the
Conservation Easement one single family and one guest house are
permitted.
Summary
We believe we have adequately addressed the Special Use
requirements to allow the completion of the ADU for Mr. Ray
Dittamore. We respectfully request your consideration and approval
of this Special Use Application.

the permit does not assure the applicant that no injury will occur to another vested water r ight or preclude
another owner of a vested water right from seeking relief in a civil court action.

in Sec ti o ns 9 and 16, T0\\.11Ship 7 South . Range 89 We s t in Garfie ld County, Colorado. Please se e the
attac hed Vici nity Map for site loca tio n . As prev iou sly propose d vvit h the resi dential bui ld ing permit
app lication. the propo se d 1330 s.f. ADU wi ll be located above the 3-car garage that is attached to the
existi ng 3-bedroo m res ide nce.
The Dittamore residence/ ADU is accessed from a shared private drive extending from County Road
117 (Four M il e Road). Based on the IT E Trip Generatio n Manual, 6th Edition , the ex istin g res idence
and proposed ADU are eac h expected to ge nerate l 0 ve h icle trips/day for a tota l of 20 ve hicle
trips/day. The driveway width and vertical grades we re previou sly improved prior to construction of
the existing re sidence. Hours of opera ti on shou ld be typ ica l of a sing le-family re side nce.
The ADU wi ll a lso be se rv ed by the existi ng water we ll , Ind ividual Sewage Disp osa l System
(ISDS) and p lumbi n g. T he in d ividua l water and sewer demands of the ADU will be typical of a
si n gle-fa mil y re sid ent ia l hom e. The ADU will increase water dem and by 240 ga ll ons /day and
generate an ad diti onal 150 gall o ns/day of sewage based on 2.0 pe rsons/ADU. The ex isting I SDS
was engi neered by Hig h Country Enginee ring, Inc .. (H CE # 98015.0 1) to accommodate the
proposed ADU a nd the ex isti ng we ll and water tr eatme nt faci liti es should be adequate to meet
