THULSON I am writing in regard to our telephone conversation yesterday concerning the Special Use Permit that the Board of County Commissioners issued to allow Holy Cross Energy to construct a utility line on property owned by Perry Sopris Ranch Partnership, Ltd. (Robert Perry). As we discussed, the application specifically requested that the Special Use Permit allow construction of the utility line to occur at any time within two (2) years of approval. At the public hearing we explained that a two year period to allow construction was necessary because of the long lead time to design the new line, the long lead time to order and obtain the material to construct the new line, and the heavy workload of Holy Cross. A copy of the draft minutes of the Board of County Commissioners from the date in question is attached. These minutes confirm the discussion about the two year duration of the Permit and also confirm that none of the Board members expressed any concern about that request. Nevertheless, neither the Special Use Permit itself (copy attached), nor Resolution No. 2004-85 (copy also attached), mention the two year duration of the Permit. It is my view that the Special Use Permit was granted upon all terms and conditions set forth in the application, so that the two year duration of the Penni! is implied. However, Holy Cross would like confirmation of this fact. I believe that a letter from your office or the Planning Department would be sufficient to confirm for Holy Cross that they have two years from September 13, 2004 to commence construction of the utility line. CONSIDER A REQUEST FOR A SPECIAL USE PERMIT FOR THE USE OF AN ELECTRIC UTILITY LINE (RELOCATION OF A PORTION OF AN EXISTING LINE). APPLICANT IS ROBERT M. PERRY -JIM HARDCASTLE Jim Hardcastle, Larry Green attorney for Robert Perry, Perry Sopris Ranch Partnership, Ltd., Crystal River Limited Partnership, and Holy Cross Energy with Bob Daniel, and Walt Durman representing Holy Cross were present. Carolyn reviewed the noticing requirements for the public hearing. Lan·y Green clarified the owners and how the public notice was referenced stating with the caveat that \Ve described the subject property as a 500 foot wide corridor where the line is being relocated, not the entire Perry Sopris Pa1tnership Ranch Property. Carolyn noted for the Board the one imperfection of the notice, there should have been noticing given from 200 feet of the entire Perry Ranch but Larry Green explained and the generally the notice should have been noticed within 200 feet of the Perry Ranch. Attorney Larry Green clarified. The Board finds the notice was adequate. Chairman Martin swore in the speakers. Jim submitted the following exhibits: Exhibit A -Mail receipts; Exhibit B -Proof of Publication; Exhibit C -Garfield County Zoning Regulations of 1978 as amended; Exhibit D -Garfield County Comprehensive Plan of 2000; Exhibit E -application; Exhibit F -Staff memorandum and Exhibit G -sound??? Chairman Martin entered Exhibits A - G into the record. Jim stated this is a special use permit request for the use of an Electric Utility line located south of the Town of Carbondale adjacent to River Valley Ranch on 42.145 acres. The applicant proposed to relocate and reconshuct an existing line through non-operating 69K v electric line on property O\vned by Perry Sopris Ranch Partnership, Limited Partnership. Staff recommendation: Staff recommends Approval with the following conditions: 1. All activities associated with the relocation of the proposed use shall be limited to Monday through Friday between 8:00 a.m. and 5:00 p.m. 2. All construction activities associated with the proposed use shall be done in accordance with the best and standard practices within the utility industry and shall have a minimum impact on the natural environment. 3. Upon completion of the installation of the relocated overhead electric line, operations shall comply with Colorado Revised Statutes. Carolyn noted that a bond for revegetation has been the custom to require for the utility lines. Larry Green pointed out to the Commissioners the plat and the location of the utility line. The request is to have this extended for a period of two years. It will be overhead line. The line is not energized at the present time. The easement is only 100 feet but they noticed 500 feet to make sure. Larry Green said they are requesting the Special Use Permit be valid for two years, ordinarily they have a shorter lifetime before the work can be accomplished, but here because of the lead time and the work load of Holy Cross with their rush for the Snowmass Village project. So it may be next year before this can be done. The new line will be overhead 69kv the same as the existing line although it will be on steel poles versus wood with a height of 70 feet. The existing line will be taken out immediately. The line is not in use energized at this time. Bob Perry said it was 1958 and not 1974 when the original easen1ent was signed. Our main purpose here is to ensure us that this 500 foot corridor width will not go down on the deed as a right of way. The 100 feet we will live with, the 500 feet is out. Larry stated the easement itself is only 100 feet; they took a 500 foot corridor for pmposes of notice to make sure we got everybody in. Bob Perry -it doesn't say that in the document. Commissioner McCown -Add a condition that the easement will only be 100 feet wide since he was confused on the 500 feet used for notification. Larry Green -regarding noise -Mr. Hardcastle recomn1ended hours forn1 8 a1n - 5 am; Larry gave the Carbondale noise standards as being M-F from 8 am to 6:00 pm so they are meeting the noise level standards of Carbondale, Monday through Friday. Carolyn-shall be limited to the 1-54-30 Bob Daniel -responded to the limited hours saying the crew comes from out of town and they would like to get as much done as quickly as possible. Mr. Dorman -M-F from Holy Cross and said that it will take one to take the line down and about a month to rebuild it. The design takes 6-months and they haven't started it. The tear down can occur as soon as this is approved and the agreements signed. A motion was 1nade by Con1Illissioner Houpt and seconded by Conllllissioner McCown to close the public hearing; motion carried. A motion was made by Commissioner Houpt and seconded by Conmtissioner McCown to approve a Special Use Pem1it for an electric utility line on the Perry Ranch with the recommendations of staff 1 -3 altering the hours in Condition number one to read Monday through Friday, between Sam - 6 pm and adding a 4" condition stating that the easement that will be granted will be a maximum of 100 feet wide and add the Carbondale noise levels limits which is 5 Db higher than the State levels; motion carried unanimously. My memory is that the BOCC said OK, but I have no memory if such was included in their Motion. If they approved it, this can be a scrivener's error and we can take it back to the BOCC with an additional paragraph. If the BOCC did not include it in their Motion as a condition of approval, then all Larry has is the Minutes. He wants a letter from Mark. I spoke briefly with Mark this am. We agreed an amended SUP, or it could be a repealed and replaced SUP, is better than an admin letter from Mark. EXISTING ACTIVITIES & DESCRIPTION OF THE PROPOSAL The proposal is to relocate and reconstruct an existing though non-operating 69K v electric line upon property owned by Perry Sopris Ranch Partnership, Ltd. The application has been submitted with the consent of the owner by the Crystal River Limited Partnership. Crystal River Limited Partnership ("CRLP"), on behalf of itself and on behalf of Holy Cross Energy, request a Special Use Permit to relocate an existing 69Kv overhead electric line. The existing line is owned by Holy Cross. The line as presently constructed crosses land owned by Perry Sopris Ranch Partnership, Ltd. ("Perry"). The existing line also crosses certain lots within River Valley Ranch, a subdivision developed by CRLP, within the municipal limits of the Town of Carbondale. As it crosses Perry and CRLP property, the power line is not located within its historic deeded easement. CRLP, Perry and Holy Cross have reached an agreement regarding the relocation of the power line. Pursuant to that agreement, CRLP will, at its expense, cause a portion of the existing power line to be tom down and removed. The portion of the existing line to be removed is labeled "OE" on the map submitted in response to paragraph 3 of the submittal requirements, and runs from the northerly end of the "OE" line to the intersection of the "OE" line and the line labeled "RF" on the map . The existing line will be removed immediately upon approval of this Special Use Permit. Thereafter, no later than two years after approval of this Special Use P ermit, CRLP will, at its expense, cause the line to be reconstructed along the route labeled "RF" on the map . A portion of the "RF" line will be within the historic deeded easement (recorded in the Garfield County records at Book 319, Page 290) and a portion will be along a new route, between the historic deeded easement and the existing line . The construction of the relocated line will terminate at the intersection of the "OE" line and "RF" line on the map. The line to be constructed will be an overhead 69K v line with cortan steel poles approximately 70 feet high. To the south of the newly constructed line, along the line labeled "Powerline Existing Location" the line will remain as presently constructed. Upon completion of construction of the new line, the parties will exchange quitclaim deeds to the end that Holy Cross will abandon the historic easement and it will, in tum, receive a surveyed easement for the line as it is actually constructed. Because of the long lead time necessary to design and construct that portion of the line to be relocated, the Applicants are requesting that the Special Use Permit be valid for a period of two years from its approval. II. SITE DESCRIPTION Located south of the Town of Carbomlale, the use is partially within the River Valley Ranch development and is traverses approximately 7 individual single family dwelling lots. IV. REFERRALS {No referrals were made on this existing proposal) v. REVIEW STANDARDS ZO'rJ.. Special Uses are subject to the standards in Section 5.03 of the Zoning Resolution. These review standards are presented below followed by a response by Staff. Sec. 5.03 Special Use Permit Review Standards X 1) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use. Staff Comment: This item is not an applicable review criteria item for the proposed use. This item has been met. 2 2) Street improvements adequate to accommodate traffic volume generated by the proposed use and to!rovide safe, convenient access to the use shall either be in place or shall be constructe in conjunction with the proposed use; Staff Comment: This item is not an applicable review criteria item for the proposed use. This item has been met. 3) Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character; Staff Comment: This item is not an applicable review criteria item for the proposed use as this use is proposed to be relocated further away from existing homes . S c. 5.03.0 ndustrial Performance Standards: All industrial operations in the County shall comply with applicable County, State, and Federal regulations regulating water, air and noise pollution and shall not be conducted in a manner constituting a public nuisance or hazard . Operations shall be conducted in such a manner as to minimize heat, dust, smoke, vibration, glare and odor and all other undesirable environmental effects beyond the boundaries of the property in which such uses are located, in accord with the following standards; Staff Comment: upon review of the above cited standards review it has been determined that the proposed use will not be observed as a nuisance or hazard and is in full compliance with this section of the Zoning Resolution of 1978 as Amended.. Applicant would request that the condition b e modified to simply adopt the Carbondale's Municipal Code Chapter 9.45.010 and impose the same restrictions and requirements as the Noise Ordinance. Section 9.45.010 allows construction activities between the hours of 7 am until 8 pm on weekdays, 8 am until 6 pm on Saturdays, a nd 9 am until 5 pm on Sundays and holidays. ' ----- NATURE AND CHARACTER OF SPECIAL USE REQUESTED By this Application, Crystal River Limited Partnership ("CRLP"), on behalf of itself and on behalf of Holy Cross Energy, request a Special Use Permit to relocate an existing 69Kv overhead electric line. The existing lille is owned by Holy Cross. The line as presently constructed crosses land owned by Perry Sopris Ranch Partnership, Ltd. ("Perry"). The existing line also crosses certain lots within River Valley Ranch, a subdivision developed by CRLP, within the municipal limits of the Town of Carbondale. As it crosses Perry and CRLP property, the power line is not located within its historic deeded easement. CRLP, Perry and Holy Cross have reached an agreement regarding the relocation of the power line. Pursuant to that agreement, CRLP will, at its expense, cause a portion of the existing power line to be torn down and removed. The portion of the existing line to be removed is labeled "OE" on the map submitted in response to paragraph 3 of the submittal requirements, and runs from the northerly end of the "OE" line to the intersection of the "OE" line and the line labeled "RF" on the map. The existing line will be removed immediately upon approval of this Special Use Penni!. Thereafter, no later than two years after approval of this Special Use Permit, CRLP will, at its expense, cause the line to be reconstructed along the route labeled "RF" on the map. A portion of the "RF" line will be within the historic deeded easement (recorded in the Garfield County records at Book 319, Page 290) and a portion will be along a new route, between the historic deeded easement and the existing line. The construction of the relocated line will terminate at the intersection of the "OE" line and "RF" line on the map. The line to be constructed will be an overhead 69Kv line with cortan steel poles approximately 70 feet high. To the south of the newly constructed line, along the line labeled "Powerline Existing Location" the line will remain as presently constructed. Upon completion of construction of the new line, the parties will exchange quitclaim deeds to the end that Holy Cross will abandon the historic easement and it will, in tum, receive a surveyed easement for the line as it is actually constructed. Because of the long lead time necessary to design and construct that portion of the line to be relocated, the Applicants are requesting that the Special Use Pe1mit be valid for a period of two years from its approval. Holy Cross Energy presently owns an overhead power line which crosses a portion of our property. Crystal River Limited Partnership, the developer of Ri ver Valley Ranch, approached us to find out w hether we would be will ing to allow a portion of the existing power line to be relocated on our property. In the course of further di scu ssio n s about this matter, we di scovered that a portion of the ex i sting power line i s not located within the historic easement deeded to Holy Cross's predecessor by instrument recorded in Book 319 at Page 290. Because of th at fact, and for other reasons, we have reached a conceptual agreement with CRLP and Holy Cross to a ll ow the re location of the ex isting power l ine. One of the conditions of our agreement requested by Holy Cross is that Garfield County grant its approval for any land use permit which might be necessary to re construct the power line. We, therefore, hereby authorize CRLP, on it s behalf, and on behalf of Holy Cross, to apply for and to purs ue a special use pennit application to relocate an existi ng 69Kv power line on our property, in part to the approx imate location of th e hi storic deed ed easement, and in part to a new easement which we will grant upon completion of the construction.
