Peny for a Special Use Permit. The special use permit would allow the applicant to have an Electric Utility Line on their property at the 42.145 acre site located South of the Town of Carbondale adjacent to River Valley Ranch at Sopris Mesa Drive and Perry Ridge, also at Section I 0 Township 8 S, Range 88 W., 6 the P.M. WHEREAS, the Special Use Permit request for an "Electric Utility Line" specifically will allow a portion of an existing electric utility line to be relocated. WHEREAS, the subject property is located in the Agricultural/Residential/Rural Density (AIR/RD) zone district which contemplates a "Electric Utility Line" as a Special Use within that district; and WHEREAS, the Board held a public hearing on the 9th day of August, 2004, upon the question of whether the above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Permit; and I Robert M. Special Use Permit r 111111111111111111111111111111111111111111111111111111 '59856 09/16/2004 10:19A B1623 P66 M ALSDORF ~ of 3 R 0.00 D 0.00 GARFIELD COUNTY CO WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete and that all interested parties were heard at that meeting; and all pertinent facts, matters and issues (other than sound levels of the proposed use) were submitted prior at the meeting. 3. That for the above stated and other reasons, the proposed permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in conformance with the Garfield County Zoning Resolution of 1978, as amended. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Permit be and hereby is approved to allow for an Electric Utility Line at the site identified in the application, upon the following specific conditions: 1. All activities associated with the relocation of the· proposed use shall be limited to Monday through Friday between 8:00 am and 6:00 pm. 2. All constructions activities associated with the proposed use shall be done in accordance with the best and standard practices within the utility industry and shall have a minimum impact on the natural enviromnent. 3. Upon completion of the installation of the relocated overhead electric line, operations shall comply with Colorado Revised Statutes. 4. The size of the easement for the proposed use shall be no greater, and a maximum of 100 feet. 2 Robert M.
