RE: Second Amendment - Pipeline Development Plan
Enterprise Gas Processing, LLC Natural Gas Gathering Pipeline for Marathon Well Fields
Dear Phil,
Upon review, we have found that the February 5, 2009 application for a Pipeline Development
Plan Amendment does not represent a substantial change from the original permit. Attached to this
letter is the approved and recorded Amended Administrative Permit. Exhibit A, attached to the
Amended Administrative Permit, contains the identical conditions that were attached to the original
December 11, 2008 permit for the pipeline.
Proiect Sumarv. The original Administrative Permit allowed the construction of a 3.7 mile long 20—
inch pipeline, a 5.5 mile long of 16 -inch pipeline, and the Jackrabbit Compressor Station. The
County previously summarized this project, along with conditions for approval, in a letter dated
November 24, 2008. In the first amendment to the permit, Enterprises Gas Processing LCC
obtained the County's permission to install two additional pipelines along side of the original
pipelines. Through this amendment, the County approves a change in the construction date
restrictions that were put in place to prevent disturbing the nesting of birds. In accordance to the
guidance provided by the Colorado Division of Wildlife, the seasonal constructions restrictions in
the vicinity of Cooper and Red Tailed Hawks have been revised to be April 15th to August 15. For
Greater Sage Grouse the seasonal construction restriction will be April 1st to May 31st. This
change was approved by the Colorado Department of Wildlife in an e-mail from JT Romatzke,
Area Wildlife Manager.
Upon review of the submitted documents against the required standards and criteria in Section
9.07,06, Staff has made a determination of Approval with Conditions for the Second Amended
Administrative Permit.
