I. DESCRIPTION OF THE PROPOSAL
The Applicant is requesting approval for a small contractor's yard on the property. The
contractor's yard will be used for oil and gas industry related equipment and machinery and
will be available to lease out to contractors. The property is currently improved with a
single family residence, agricultural operations, and an existing hay shed and storage in
the area proposed for the contractor's yard. The contractor's yard will be approximately 11/2
acres in size on an overall parcel of approximately 35 acres. Access to the site is existing
off of County Road 315 and has been improved with a concrete drain pan.
Storm water management improvements have been proposed with plans included in the
Application submittal. They include a sediment detention pond and drainage conveyance
ditch to capture and divert drainage flow to the sedimentation basin. The site is fenced
with agricultural fencing. The Facility is served with power but no lighting is proposed.
Screening is discussed in the original submittals with no specific plans/designs initially
presented. The Applicant has provided a supplement on screening and proposes use of
the existing hay barn including hay and farm implement storage within the barn as
screening along the County Road. The Applicant does not feel screening is needed along
the south property line adjacent to a neighboring driveway but proposes to use that area for
additional agricultural storage consistent with the character of the area. How effective the
proposed screening will be in terms of code compliance is discussed under the Staff
Analysis.
II. DESCRIPTION OF THE SITE
The site is located east of County Road 315 and is divided into two developable areas
based on topography and a steeper ridgeline. The existing residence is located on the
northerly portion of the lot and the proposed contractor's yard is located on the southerly
developable area. The two uses are effectively separated from each other and have
separate accesses onto the County Road. Outside of the areas of the site used for
existing residential purposes, parking, access, and the proposed contractor's yard area,
the site has native vegetation consistent with an arid climate.

The area proposed for the contractor's yards is generally level with moderate slopes
occurring as you move easterly away from the access point and the County Road (see
attached site photographs). The yard area has been graded and leveled with compacted
dirt and gravel for the driving and circulation areas. The yard area is fenced with an
agricultural wire fence. The area has been graded and disturbed for past agricultural
uses. The site plan shows a small area for future expansion of the contractor's yard along
the east edge of the currently improved area. The expansion area is within the existing
fenced area and will require only minor grading and limited removal of vegetation.

III. APPLICABLE REGULATIONS
A. This Application was submitted prior to the adoption of the new Land Use
Development Code on July 15, 2013 and is being reviewed under the ULUR in effect at the
time of submittal.

B. The Land Use Tables contained in Section 3-503 of the ULUR, designate a Small
Contractors Yard within the Rural Zone District as requiring Administrative Review. Section
4-103 of the ULUR sets forth the Administrative Review Procedures.
C. The Application submittal requests a number of waivers from submittal
requirements in Section 4-203. The waivers are requested based on the existing
conditions and agricultural/residential uses on the property along with the fact that the
area proposed for the contractor yard is disturbed and in use for agricultural purposes.
The waiver requests are summarized below and are addressed under the Staff Analysis.

Division 3. See below for a discussion in regard to the application meeting specific
standards as well as requests for waivers from specific standards.
IV. STAFF ANALYSIS
Article 7, Division 1: General Standards
1. Section 7-101: Compliance with Zone District Use Regulations
The Zone District Regulation for the Rural Zone District requires a 25 ft. setback from the
front lot line abutting County Road 315. The existing hay shed (steel frame building) does
not meet the required setback and is located 16.8 ft. from the front lot line. No other
conflicts with the underlying zone district standards have been noted.
The conversion of the non -conforming agricultural building into a storage building for a
contractor's yard would require approval of a variance to address the setback
encroachment.
The Applicant has subsequently submitted information indicating that they will keep the hay
shed as an agricultural building with no change in use and no use associated with the
contractor's yard. The agricultural use can be maintained in accordance with Article 10,
Nonconforming Uses and Structures.

2. Section 7-102: Compliance with Comprehensive Plan and IGAs
The site is located within the Residential Medium High (RMH) designation on the Garfield
County 2030 Comprehensive Plan Future Land Use Map (see map excerpt below).
Comprehensive Plan topics are summarized below:
a. The Application was referred to both the City of Rifle and Town of Silt. No
comments were received.

The County will encourage the development of a diversified industrial base
recognizing physical location—to-market capabilities of the community and
the social and environmental impacts of industrial uses.

The County will direct industrial development to the airport center and other
appropriately designated areas.

d. Section 4, Economy, Employment, Tourism, Strategies and Actions 4.
Ensure that commercial/industrial developments are compatible with
adjacent land uses and preserve the visual quality of the county.
3. Section 7-103: Compatibility
a. The Application and description of the proposed use reflects general compatibility
with an area of the county that includes agricultural uses and oil and gas energy
exploration and production. Compliance with conditions of approval will help to ensure
continued compatibility.
b. The County has received public comments from a neighboring property owner
expressing concerns regarding screening requirements (visual impacts) and any expansion
of the proposed yard area. This is further addressed in item #21 (Section 7-1001)
4. Section 7-104: Sufficient, Adequate, Legal and Physical Source of Water
The facility is proposed to be un -manned and as a result no provision of potable water for
the contractor yard is proposed at this time. Employees will only be on-site briefly for pick
and delivery purposes. The Applicant has requested a waiver from this requirement.
However, because the Contractors Yard will be unmanned the County can find that no
provision of water is adequate for the use.
5. Section 7-105: Adequate Central Water Distribution and Wastewater systems
As an unmanned facility the Application represents that no wastewater disposal provisions
are needed. The site visit noted that a portable toilet is currently located at the contractor
yard site. The County can make a determination that provision of a portable toilet is
acceptable for this particular unmanned type of use.
6. Section 7-106: Adequate Public Utilities
The Application represents that the contractor's yard site is already provided with electricity
through existing service lines. No other utilities are needed for the proposed use.
7. Section 7-107: Access and Roadways
The site has existing access from the County Road. Referral comments from the County
Road and Bridge Department indicate that the access has previously been permitted and
upgraded. No access concerns were noted.
8. Section 7-108: No Significant Risk from Natural Hazards
The Application has requested waivers from several sections of the Impact Analysis. As
part of those waiver requests the Application represents that there are no natural hazards

on the site that would impact the proposed contractor's yard. An excerpt from the County's
Geologic Hazard mapping has been included with the Staff Report (see item #15 below)

Article 7, Division 2: General Resource Protection Standards
9. Section 7-201 Agricultural Lands
The Application is compatible with agricultural lands provided proper fencing is maintained
and limits on the size of the yard are maintained.
10. Section 7-202 Wildlife Habitat Areas
The proposed contractor's yard will create minimal if any additional areas of disturbance.
The area is currently within the existing agricultural fencing. Waivers from the Impact
Report regarding wildlife and habitat studies were requested with the Application.
11. Section 7-203 Protection of Wetlands and Waterbodies
The proposed contractor's yard is located in an already disturbed area and distant from any
wetlands or water bodies. Storm water detention improvements are planned and should
include design features to protect water quality.

12. Section 7-204 Water Quality from Pollutants
a. No additional disturbance or impacts are anticipated by the Application. Proper spill
prevention containment areas will be required for any fuel storage. The Applicant should
confirm that no hazardous materials other than fuel are proposed to be stored on the site.
b. The Applicant's proposed sediment pond and related diversion ditches include straw
wattles and silt fences to protect water quality (see below). Re -vegetation of the swale and
detention area should also be required. The detention plan should include maintenance
provisions and address the minor area of future expansion.

13. Sections 7-205 Erosion and Sedimentation, 7-206 Drainage, 7-207 Storm water
Runoff, and Section 7-208 Air Quality
a. The Application proposes the creation of a storm -water sedimentation pond
adjacent to the access off of County Road 315. This installation along with best
management practices for the site is anticipated to address any drainage or storm -water
concerns. An updated drainage report should be required to address all improvements and
potential expansion.
b. In regard to air quality, the Application represents that dust mitigation measures will
be implemented during construction. Conditions of approval should require ongoing dust
mitigation during operation of the contractor's yard.

14. Section 7-209 Areas Subject to Wildfire Hazards
Referral comments from the Colorado River Fire Protection District address potential
concerns related to wildland fires.
15. Section 7-210 Areas Subject to Natural Hazards and Geologic Hazards
The Application request waivers from submittal requirements associated with evaluation of
geologic hazards. Garfield County GIS Geologic Hazard Mapping is attached and covers
the northerly portion of the site but does not extend to the contractors yard area. The GIS
mapping shows the northern portion of the site to be in a moderate hazard level
determination. Engineered foundations should be required for all fuel storage and
containment areas and should include an assessment of any special concerns or design
parameters needed to address any natural or geologic hazards. No structures are
proposed for the small contractor's yard and the existing hay shed will remain an
agricultural building.
16. Section 7-211 Areas with Archeological, Paleontological or Historical Importance
The Application includes a waiver request from this portion of the Impact Analysis based on
the lack of any new areas of disturbance.
17. Section 7-212 Reclamation
The Application indicates that based on the existing and proposed uses reclamation
provisions are not applicable to the use. A plan should be provided for the
decommissioning of the contractors yard and return of the site to agricultural uses if the
contractor's yard use is discontinued. The plan should include removal of contractor's
material, equipment, and vehicles.
Article 7, Division 3, Site Planning and Development Standards
Many Sections within this Division are not applicable to the proposed development based
on the rural character of the use. Those that apply are addressed as follows:
18. Sections 7-303 Landscaping Standards: The Applicant has requested a waiver from
submittal of a landscaping plan based on the proposed use and agricultural character of
the area.
19. Section 7-304 Off- Street Parking and Loading Standards: The Applicant's site plan
demonstrates more than adequate areas for off-street parking and loading for the proposed
use.
20. Section 7-308 Roadway Standards: Access is directly off of County Road 315. No
formal access roadways are required or proposed. Circulation within the contractor's yard
area is generally depicted on the site plan. Requirements for appropriate surfacing and

dust suppression should be included as conditions.
Article 7, Division 3, Section 7-1101: Industrial Use Standards
21. The Application submittal addresses key industrial use standards from the Unified
Land Use Resolution of 2008 as amended. These standards address the same or similar
issues as the current code. Key provisions are summarized below:
a. A 100 ft. setback from adjoining property (unless zoned industrial) is required. A
waiver from this standard will be necessary for the proposed use along the west and south
perimeter of the contractor's yard which abuts adjoining properties. The north and east
perimeter of the facility abuts the balance of the applicant's 35 acre parcel.
b. Screening:
• Under the ULUR of 2008 the industrial use standards include the requirement for
screening at least 8 ft. in height. Based on the timing of the submittal and the
Applicant's current screening proposal a waiver from the screening requirement
including the 8 ft. requirement will be necessary.
• In regard to the use of hay stacks/storage and agricultural equipment as a screening
buffer, Staff does not feel it meets the intent of the code requirement or the waiver
criteria found in Section 7-202.
• Under the current code screening is required as follows: "provisions, based on
location and topography, to conceal and screen the facility and/or operations from
adjacent property(s)".
• Refinement of the screening proposal to create a more effective and less temporary
screening for the site is recommended as a condition of approval.
c. Other code provisions are consistent with the applicant's submittals and ongoing
compliance with the Section 7-1101 standards shall be required including noise limits and
hours of operation. In regard to noise restrictions the residential standards shall apply
based on adjacent land uses.
V. PUBLIC AND REFERRAL COMMENTS
The Applicant has provided documentation that all required notice mailings have been
completed. Public comments and referral comments received on the Application are
attached as Exhibits and summarized below:
a. Garfield County Consulting Engineer, Chris Hale, Mountain Cross Engineering:
• Noted the need for additional drainage plans to address potential expansion of the
storage yard.
• Recommended that the Applicant provide an estimate of ADT (Average Daily
Traffic) on the adjacent County Road used for access to support the request for a
traffic plan waiver.

b. Garfield County Environmental Health Department:
• Ensure proper construction of storm water management improvements.
• Noted concern over fuel storage and containment to be included on the site plan.
c. Colorado River Fire Rescue:
• Noted the Applicant's representation that there will be no storage of hazardous
materials on site.
• Indicated the need for proper fuel storage and containment
• Wildfire Hazards and recommendation for compliance with Colorado State Forest
Service guidelines for defensible zones.
• Indicated that Fire Protection Water may be required for future additional buildings if
proposed.
d. Garfield County Road and Bridge: Indicated that they had no problems with the
Application and that the driveway was permitted and brought up to standards in 2007.
e. Colorado Parks and Wildlife:
• Indicated that review of their data system indicates that "... no significant habitats of
rare or sensitive ground based species of wildlife are known to exist within the
disturbance zone."
• Noted that they had no other wildlife concerns other than noxious weeds and
recommended compliance with the Garfield County Noxious Weed Plan.
f. Garfield County Vegetation Manager, Steve Anthony: Requested provision of a
noxious weed inventory and a weed management plan for any noxious weeds found on the
site.
g. Other agencies that did not provide comments included: City of Rife, Town of Silt,
and Holy Cross Electric.
h. Public Comments: Comments were received from an adjoining property owner
indicating concern over screening and expansion of the use.
VI. SUGGESTED FINDINGS AND WAIVER DETERMINATIONS
That the Application is in compliance with all applicable provisions of the ULUR, subject to
the conditions approval and the following determinations and waiver approvals.
a. Based on the unmanned operation of the facility the County has made the finding
that not providing a source of potable water and waste water treatment (portable toilets to
be provided) is adequate for the proposed use based on the Applicant's representations
and recommended conditions of approval.

b. Submittal waivers regarding components of the Impact Report including but not
limited to the Traffic Analysis, the Landscaping Plan requirements, Erosion and Sediment
Control Plans and Drainage have been approved based on the Applicant's submittals,
representations, and the recommended conditions of approval.
V. RECOMMENDED CONDITIONS OF APPROVAL
1. All representation of the Applicant contained in the application including the site plan
and overall dimensions of the contractor's yard shall be considered conditions of approval
unless specifically modified by the Director Decision. The proposed contractor's yard area
including the future storage area is approved as shown on the site plan. The contractor's
yard areas shall be entirely located within the existing fenced area.
2. That the operation of the contractor's yard shall be done in accordance with all
applicable Federal, State, and local regulations governing the operation of this type of
facility.
Conditions Prior to Issuance of the Land Use Change Permit
3. Prior to issuance of the Land Use Change Permit the Applicant shall provide the
following:
a. An updated drainage report to include the future storage area shown on the site
plan, clarification that re -vegetation of drainage ditches and the sedimentation basin will be
required, maintenance provisions and commitments for the drainage improvements, and
requirements for the sedimentation basin to be cleaned and existing sediment removed as
needed.
b. An updated Traffic Report waiver request to be supplemented with basic traffic
information (ADT, Average Daily Traffic) for the County Road and estimated traffic from the
contractor's yard. The report shall include a finding by a qualified professional of only
minimal traffic impacts with no additional traffic or access improvements required. The
finding shall include a maximum estimated traffic generation number consistent with the
Application representations and compliance with said estimate shall be a condition of
approval. Should the small contractor's yard use/activities change to the point that the
traffic generation exceeds the maximum estimate an amendment application to the Land
Use Change Permit shall be required for review by the County. ADT information from
standard County Road and Bridge reports is acceptable and supplemental review by the
County Consulting Engineer may be required.
c. The Applicant shall provide a dust suppression plan for the overall site including
circulation areas and storage areas. Circulation areas shall be improved with gravel and
storage areas may be compacted dirt.
d. The Applicant shall provide a reclamation plan for the decommissioning of the
contractors yard and potential return of the site to agricultural uses. The plan shall include

removal of contractor's material, equipment, and vehicles.
e. The Applicant shall provide a noxious weed inventory/evaluation for the site and a
Noxious Weed Management Plan acceptable to the County Vegetation Manager. Ongoing
compliance with the plan shall be required along with compliance with the Garfield County
Noxious Weed regulations.
Additional Conditions
4. The Applicant shall comply with Additional Standards for Industrial Uses contained
in Section 7-1101 of the ULUR, including but not limited to noise restrictions, hours of
operation limits, and the following conditions and waiver approvals. Noise limits shall be
based on the residential land use standards.
a. Prior to the issuance of a Land Use Change Permit the Applicant shall provide plans
for the installation of a screening fence or comparable improvements to adequately
obscure the contractor's yard activity from adjoining properties. The screening shall be
installed along the south and west perimeters of the contractor's yard adjacent to the
county road right-of-way and the adjoining driveway also known as Brandon Way. The
screening may include fencing attached to the agricultural shed building a minimum of 6 ft.
in height subject to structural engineering approvals, new fencing a minimum of 6 ft. in
height, or screening using other materials so long as they are continuously in place while
the contractor's yard is in operation, are a minimum of 6 ft. in height, are properly secured
and stabilized, and adequately screen the yard area. No screening shall be required along
the north and east perimeter of the contractor's yard based on the existing ridge and
topography which screens the facility from adjoining uses. This condition includes a waiver
from the ULUR 8 ft. screening height requirement.
b. Subject to compliance with the screening requirement noted above a waiver is
granted from the 100 ft. setback requirement for industrial contractor's yard operations to
allow contractor yard uses with a 25 ft. setback from the property lines adjacent to the
County Road and south property line.
c. The existing hay shed shall not be utilized in the contractor's yard operation and
shall remain an agricultural building. Conversion of the hay shed to commercial use shall
be subject to a Land Use Change Permit amendment request which may require approval
of a front yard setback variance and submittal of structural engineering analyses and
building permit review for the conversion of the use.
5. The Applicant shall provide bottled water and shall maintain a portable toilet on site
for employees that are temporarily working on site. The portable toilet shall be located in a
screened portion of the contractor's yard and shall routinely be maintained.
6. Fuel storage shall include proper containment as required by the State of Colorado.
Engineered foundations shall be required for all fuel storage and containment areas and
shall include an assessment of any special concerns or design parameters needed to

address natural or geologic hazards. No other hazardous materials may be stored on the
site. No structures are proposed or permitted associated with the contractor's yard.
7. The Applicant shall comply with the Colorado River Fire Rescue recommendation
that Colorado State Forest Service guidelines for defensible zones for wildfire protection be
followed. The contractor's yard operation shall maintain adequate separation from
agricultural storage including hay and shall not allow uses that generate ignition hazards.
8. The Applicant shall maintain the existing agricultural fencing on the perimeter of the
contractor's yard. All lighting will be the minimum necessary and shall comply with Section
7-306 of the ULUR, including but not limited to being down directed, fully shielded, and
directed inward toward the interior of the site.

This office has performed a review of the documents provided for the Administrative Review
Application of the Porter Small Contractor Yard. The submittal was found to be thorough and
well organized. The following comments were generated:
1. The Applicant requests a waiver from providing drainage information. The Applicant proposes
that if the contractor yard is expanded, drainage report and grading plan will be provided at
that time. It is the recommendation of this office that this information be provided now to
incorporate any proposed future expansion into this application.
2. The waiver of traffic is difficult to evaluate without an estimate of proposed ADT. The
Applicant should provide an estimate of daily trips to evaluate if a waiver is justified.

Hi Glenn,
Since the new area of disturbance for this application will be minimal, I have relatively few comments.
The applicant should be sure that the proposed stormwater drain system is constructed properly as outlined in
the application.
In the administrative review response, the applicant states that the site plan has been updated to include
potential fuel storage size and containment. I am not seeing in any of the 5 figures where this is outlined. Could
you clarify this for me? Are the drawings there and 1 am just not seeing them?

I have reviewed the Porter's Small Contractor Yard (GAPA-7613) Administrative Review that will be located at 2860
County Road 315, Silt, CO 81652. The following are the fire district's comments:
1. The submittal addresses that "there will not be any long term storage or disposal of fluids onsite." In addition, 7-
821 A states that "hazardous materials will be in accordance with local... codes." Figure 4, Site Plan for Small
Contractor Yard, indicates that there will be a "typical 500 gallon elevated diesel fuel tank... with 150% spill
containment." The fire district has no issues or will require further review if this is the only temporary storage of
hazardous materials on site. If this is not correct or changes, please contact he fire district for further review.
2. 7-209- Areas Subject to Wildfire Hazards recommends an evaluation and improvement to defensible spaces per
Colorado State Forest Service memorandum No.6.302 on Creating Widlfire-Defensible Zones. We can also

3. In letter from Colorado River Engineering dated May 24, 2013 it states that a decision has been made to include"
the existing hay barn ... for small machinery and equipment storage". The fire code does require fire protection
water for every structure or building occupied or built, but through administrative policy will only recommend
fire protection water when there is only one commercial building but we do require fire protection water when
two or more commercial buildings are built on a single piece of property. As such we only recommend to the
owner at this time that a source of fire protection water be supplied but we will require a source of water for
fire protection if and when another commercial building is built (reference 7-302).

RE: Opportunity for comment on the construction of a proposed small contractor's yard
at 2860 CR 315 Silt, Garfield County, CO
Thank you for the opportunity to comment on the small contractor's yard. The project utilizes an
existing road to access the location and will require a total ground footprint of approximately 5
acres. The yard will be located directly adjacent to an existing structure, a moderately used private
dirt road and heavily used CR 315.
Analysis of our Natural Diversity Information System data indicates that no significant habitats of
rare or sensitive ground-based species of wildlife are known to exist within the disturbance zone.
Due to the yards location and proximity to a residence and other structures I have no wildlife
concerns other than the control of noxious weeds. The CPW recommends that the applicant refer to
the Garfield County Noxious Weed Management Plan for the management and monitoring of weeds
on this project site.
We thank you for the opportunity to comment on proposed developments, and your willingness to
incorporate wildlife protections into the development process. Please don't hesitate to contact me if

Fred,
I received a notice that Kelly Porter is applying for a land use change for her property on the comer of Mamm
Creek Rd and Brandon Way. The property is adjacent to my driveway leading to both my home and the ranch
side of my property.
I oppose any extension of the current covered area on Mamm Creek Rd to be used outside of current land use.
If allowed to continue with the current area, a berm or some sort of fence, wall or sufficient blocking of the
view of the area should be
required.
On another issue, Bedrock Paving has yet to put vegetation on the berm separating our respective properties as
was required in their approval. Weeds have grown on the berm
Please remind them that they must grass the berm.
Please advise when the public meeting will be to discuss this application
