RE: Kelly Porter Conditions of Approval
Dear Glenn:
As requested in the Directors Determination and pursuant to our discussions, the
following additional information is being provided to satisfy the Conditions of Approval.
3.a. Updated drainage information confirming the drainage improvements are sized to
accommodate the contractor yard including future storage area. Per the provided sand
filter design information with the application, the tributary basin area used was 1.0
acres which exceeds the proposed small contractor yard of 0.967 acres. There are no
additional impervious areas, or increase in tributary area, proposed in either the shown
use or possible future yard expansion and it is anticipated the imperviousness of the
property will not change substantially in either condition. In addition, the required
design volume is 359 cf and the provided design is 500 cf, The intention of the response
for a future drainage study was related to any future building or alterations that cannot
be anticipated at this point (such as paving increasing the imperviousness). Future
grading will not change drainage patterns with regards to adjacent properties, wetlands,
water bodies, or discharge locations in accordance to the requirements of the Grading
Permit process.
3.b. Basic traffic information for the County Road and estimated traffic from the
contractors yard. Per Garfield County Road and Bridge, Mamm Creek is a major
dedicated haul route for the oil and gas industry and in 2002 had 1300 ADT per Road
and Bridge records. It was discussed in the pre -application conference that due to the
existing heavy loading of CR 315, it was reasonable to state that this small of a project
would have no relative impact and a waiver of the basic traffic analysis was appropriate.
The ITE doesn't have a standardized used that is clearly applicable to a storage yard as
proposed. The applicant has confirmed that site visits will be minimum, and possibly not
even daily. The average daily trip generation (on a day where an actual visit will occur)
will be 2 trips (1 in and 1 out) over the entire day; however peak days may encounter
more trips but some days may have no trips, the net impact will be substantially lower
that the traffic encountered on CR 315 and does not require traffic impact analysis or
roadway improvements.

3.c. A dust suppression statement for the overall site including circulation areas and
storage areas. Please see the attached site plan cover sheet for general note, in
addition, the Owner agrees that at all times of operation the property shall be
maintained and/or watered to prevent wind caused erosion. Operations shall be
suspended if fugitive dust significantly impacts adjacent properties.
3.d. A statement regarding the removal of the contractor's yard and reclaiming the site
to agricultural use should the contractor's yard use be discontinued. Please see the
attached site plan cover sheet for the added general note.
3.e. An evaluation of noxious weed issues in conjunction with a site visit with the County
Vegetation Manager. The property owner met with Steve Anthony on October 15th at
the site to discuss the property. Steve has forwarded recommendations to Garfield
County, which included monitoring a small patch of noxious weeds. The Owner has
agreed to this.
3.f. Plans for the installation of screening improvements to adequately oscure the
contractors yard activity from the adjoining properties along the southerly property line
adjacent to the adjoining driveway also known as Brandon Way. The property owner is
currently trying to locate fencing that is agreeable to the 6 -ft height and is consistent
with the surrounding agricultural uses, such as elk fencing from the Division of Wildlife
or snow drift fencing. Due to the time of year, fencing installation may not be practical
with weather conditions. The applicant is attempting to complete this item prior to
snow fall.
Comments 1-2 and 4-11 the property owner understands and is in agreement with.

Hi Catherine:
The pictures you provided were excellent. Please confirm how far along the easement frontage the fence extends. As
long as it is generally consistent with the Contractor Yard dimension you should be fine.
Per my voice mail our close out of the file includes final billing. I will be submitting a modest bill for approximately $82
based hours expended on the review. The billing typically goes directly to the applicant. Given the time this review has
taken to complete please let your client know about this wrap up item.
I will be out of the office for the next 2 weeks but have already drafted the actual Land Use Change Permit. I anticipate
submitting it for signature and recording when I'm back in the office pending your response on the above fence
information and the billing.

I have attached some pictures of the fence that i took with my phone so hopefully you can open them. Please let me

The fence is made of 6 ft tall 1" by 6" boards and runs along the south edge of my property from the county road to the
east along the distance of the exempted area.
Please let me know if you need anything else. I appreciate your help in getting this finalized.
