SUBJECT: Proposed Amendment to Approved Pipeline Development Plan (PDP 12908
Marathon Oil Company Fresh & Produced Water Pipelines
Dear Fred:
As a follow up to our discussion yesterday, this letter provides details of a proposed amendment
to the subject Pipeline Development Plan (PDP). Marathon Oil Company (MOC) is proposing to
revise approximately 1,000 feet of the right-of-way (ROVV) previously approved by Garfield
County as indicated on the plan and profile included as Attachment A to this letter. This
revision is necessary to relocate this portion of the ROW to an area that is less challenging
topographically and allows for additional separation between the disturbed area and Little
Creek. Potential impacts from this relocation are discussed below.
Surface Owner Approval
As indicated in the original application for this PDP, the surface in this location is jointly owned
by MOC and Berry Petroleum Company. Attachment B to this letter provides approval from
Berry Petroleum Company for amending the approved PDP and relocating this portion of the
ROW.
Stream Crossings
MOC has submitted permit applications to the U.S. Army Corps of Engineers (USACOE) under
nationwide permits 12 and 33 for the two crossings of Little Creek and will construct those
crossings in accordance with the USACOE's permit requirements.
Wildlife and Sensitive Plants
The wildlife and sensitive plant surveys conducted by WestWater Engineering that are
documented in the application for the subject PDP were performed in an area extending 0.25
mile from the center line of the originally -proposed ROW. The proposed relocation is well within
this survey area, so the conclusions of the WestWater report are applicable to the relocated
ROW. No sensitive plants or habitat for such plants were identified in the area of the proposed
relocation. This portion of MOC's pipeline project is in the vicinity of the Bear Run sage grouse

lek, however, as detailed in MOC's original submittal, the construction schedule for this project
was specifically designed so that construction near the lek will be completed this winter to avoid
any impact to spring grouse lekking.
Cultural Sites
The cultural survey conducted by Grand River Institute (GRI) that is documented in the
application for the subject PDP stated that no cultural sites are identified within 1 mile of the
proposed pipeline ROW. Therefore, the results of the GRI survey are applicable to the
proposed relocation and no effect is expected from the proposed relocation.

Re: Pipeline Development Plan Permit for Garfield County, Colorado
Gentlemen:
By letters dated September 18, 2008 and November 10, 2008, Marathon Oil Company
("Marathon") received permission from Berry Petroleum Company ("Berry") to obtain a Garfield
County Pipeline Development Plan Permit for pipelines, and to construct said pipelines, which
may be comprised of fresh water, produced water and/or gas lines and appurtenant facilities that
are located on surface acreage that is jointly owned by Berry and Marathon in Garfield County,
Colorado. Garfield County has subsequently approved Marathon's Pipeline Development Plan.
Due to terrain issues, Marathon has found it necessary to re-route approximately 1000 feet of the
pipeline in the S/2S/2 of Section 29, Township 5 South, Range 96 West as reflected on
Attachment 2, attached hereto and made a part hereof.
This letter shall amend the Attachment 1 to the previous permission letters, but only as to this
portion of the pipeline route. Marathon respectfully requests permission from Berry for approval
of this re-route as identified on the attached Attachment 2 and to amend the approved Pipeline
Development Plan permit from Garfield County. Please indicate this approval by signing in the
space provided below.
