Request for permission to make the above installation at the location specified is hereby granted, subject to the following terms,
conditions and special provisions:
I. It is understood that the Applicant will cause the inslallation to be made at no expense whatsoever to Garfield County and
that the Applicant will own and maln1ain the installation upon completion of work
2. The Applicant shall maintain the installatioo at all times and agrees to hold harmless the County of Garfield and its
representatives, agents or employees ftom any and all liability, loss and damage which may arise Olli of or be connected with
the installation, maintenance, alteration, removal or presence of the installation above described or any work or fiu:llity
conneeted therewith, within the area covered by this permit
3. The entire installation repairs and clean up shall be completed prior to: 11/1/2006.
4. The trawling public shall be protected durins the installation with proper waming signs or signals both day and night, and
warning signs and signals shall be installed by and at the expense of the Appliamt and in llCCOl'dance with directions given by
the Board of County Commissioners or their representative. No open trench shall be permitted in the traveled roadway after
dark, unless otherwise specified in the Special Provisions below.

6. In the event any changes are made to this county road in the future that would necessitate removal fur nolocation of lhis
installation, Applicant will do so promptly at its own expense upon writtm request ftom the Board of County
Commissioners. The County will not be responsible fur any damage that may result in the maintenance of the county road to
installation placed inside Public Right-of-Ways Limits.
7. Applicant will be requinod to shut off lines and remove all combustJ"ble materials from the right-of-way when requested to do
so by The Board of County Commissioners because of-.ssary road construction or maintenance opendions.
8. Where the insta1lation crosses the roadway, it shall be encased in pipe of larger diameter and the crossing shall be as nearly
perpendicular to the roadway IS physically possible. This instaUation shall be installed by the method of boring or jacking
through beneath the road surfilce: however, open cut shall be allowed up to the edge of the surfilced portion of the county
road. No water shall be used in the boring, and no tunneling shall be permitted. If boring is not successlill then ammgements
should be established with the County for possible excavation methods.
9. Where the installation crosses any ditches, canals or water carrying structures, wherever possible it shall be pushed through
and beneath a pipe of larger diameter thereby eliminating the necessity of trenching with a minimum bury of 4 foot. Jn no
case shall the flow of water ever be impaired or inmnlpted, without arrangements having been made with the enected water
company or ditch association.
I 0. The installation must be accomplished in accordance with accepted good pnctices and confunn to the nocommendat:ions of
the National Electric Safety Code and to such Colorado statues as are applicable. The above-described Road Bore sball be
installed benealh the surface of the right-of-way at a minimum depth of 5 ft min and the disturbed portion of the right-of-way
will be restored to its original condition. Any backfilling in the roadway shall be made in six-inch lifts and mechanically
tamped and packed and the last twelve inches of backfill shall be of stable granular material such as crushed rock or gravel.
11. Applicant shall be respoosible fur any repairs to roadway or right-of-way necessitated by the inslallation.
12. Applicant's installation shall be made at a location mutually agreed upon by Applicant and the Board of Commissioners or
their representative, and in accordance with details and specifications shown on the construction plans, a copy of which shall
be furnished to Garfield County.
13. Applicant shall inform the Board of County Commissioners of construction methods, equipment and operational procedures
that will be utiiiud and shall obtain the occurrence of the Board of County Commissioners.
14. Applicant shall advise the Board of County Commissioners or their representatives at least 48 hours in advance of the time at
which work on the installation will commence.
15. Any materials from excavation as the result of the installation will be removed from the road way surface each day.
16. Under no condition is an asphalt surface to be cut unless otherwise specified in the attached Special Provisions
17. Where reference is made herein to the representative of the Board of County Commissioners, such representative shall be the
District Road Supervisor, unless otherwise specified in writing by the Board of County Commissioners.
18. This pennit shall be valid during the l'Stim•ted construction scbedu1e set forth above. Neither the Owner, nor the Applicant
shall conduct any work pursuant to this pennit at anytime other than that set furtb in the estimated construction schedule.

Special Provisions for Excavation of Road Surface and Installation

J. Any oversiz.ed material (larger than I 0 inches in diameter) that is not utilized in backfill will be removed from site by
Applicant Further, Applicant will remove any frozen material from site.
2. When a paved or chipped surface is cut, it is to be replaced with a minimum of three (3) inch hot mix asphslt patch. A
temporary patch with cold mix asphalt would be allowed, which would be replaced with hot mix asphalt when the weather or
availability of materials allows the work to be completed. An asphalt or chipped surface cut would require the road to be
sttaigbt cut and squared by means of a pavement cutter or saw. A chipped surface cut will require a seal coat of the patch that
will be full width or half width of roadway when trenches nm with the road. For trenches across the road, the edges of the
seal coat will overlap the existing edge. All Seal coats will overlap edges by a two-foot minimum to insure adequate seal over
the undisturbed portion of the roadway in the vicinity of the excavation. Asphalt hot mix or cold patches will he completed in
a maximum of five working days, weather permitting.
3. When possible, all installations should avoid the top edge of a fill slope.

5. 1nstallations at culvert crossings will be buried beneath the culvert with a minimum separation of 18 inches between
installation and the bottom of the culvert.
6. Open trenches adjacent to the traveled roadway shall be backfilled daily to within 100 feet of the working area of the trench,
and shall he barricaded with warning devices after dark. A 3 foot high orange plastic fence will be Installed dally to keep
livestock out of the open trench after hours.
7. In areas being disturbed where ~on is established, reseed;ng with a mixture either by brolldcasting. drilling, and
mulching with seed mixtures suitable to tbe climatic conditions or existing vegetation will be performed. Use only certified
weed-free seed. Noxious weed control will be ongoing along with re-vegetation.
8. The Applicant should check the right-of-way of surrounding landowners to see if other permits me required, I.E., BLM,

General Comments: Garfield County Road & Bridge Department has no objections to
this gathering line request with the following conditions.
I have met with Phil Vaughan and discussed the bore under Cr. 215 and we have agreed
on the conditions of the utility permit that will be issued upon final approval by the
BOCC. The utility permit will have provisions specific to the location of the bore.
Any new or additional entrances from Cr. 215 for work associated with the project will
require approval of Garfield County Road & Bridge Department prior to start of work.
All vehicles used in the hauling of equipment and construction materials for the pipeline
construction will comply with Garfield County Road & Bridge Departments
oversize/overweight regulations.
Garfield County Road & Bridge Department requests 24 hour notification prior to the
start of work within the County ROW.

I know that we have been trying to speak with each other this week and have not been able to as of yet, so I
decided to send an email regarding the status of our application.
Sandy Hotard and I attended the Town of Parachute Board of Trustees meeting last night.
The council unanimously voted to issue a Watershed District Permit for the 30" gathering line. I will receive a
hard copy of this permit and will digitize and email this to you when I receive it next week.
The Town staff was complementary of the application materials and felt that all issues had been clarified.
Trustee Loshke requested that during the pipeline pre-construction meeting that we emphasize the following
issues with the pipeline workforce:
A. Obey speed limits.
B. Dispose of trash in proper locations versus along side roads.
C. Even though you may not be from the area, please respect and care about our community.
I indicated to the Town Council that these items would be passed on at the pipeline pre-construction meeting on
Thursday, June 15, 2006 at 9 a.m. at the Mancamp building.
I wanted to verify the status of our application and comments from Garfield County.
We submitted the application to Garfield County on 4126106.
The 28 day review period for Garfield County ended on 5126/06.
The 14 day call-up deadline expires today, June 9, at midnight.
I will work with Garfield County and Bargath, Inc. to get the revegetation bond in place as soon as possible and I
will relay any additional issues from Garfield County to Bargath, Inc.

Thanks for the opportunity to comment on this project. My comments are as follows:
Reclamation
• It is recommended that the applicant make some changes to the seed mix. The applicant's
proposed mix is listed below. It is recommended that sideoats grarna be deleted from the mix as
it does better on the east side of the state then it does here. Also the amount of seed to be used per
acre is low. It is recommended to add Indian ricegrass (Achantheum hymenoides) at 4 lbs. per acre
and also Galleta (Pleuraphis jamessii) at 2lbs per acre. If these two species are added and the
sideoats grama is deleted it would total 13 lbs. per acre PLS.

• A revegetation security in the amount of$2500 per acre is recommended. The applicant has
quantified the area of disturbance as 98 acres. A bond of$245,000 is recommended. The
applicant shall provide the Vegetation Management Department with the original tags from each
seed bag. The seed mix in the final approved plan shall match the seed mix used in the field.
Do not use a seed mix containing yellow sweet clover (Meli/otus ojfcinalis) or annual yellow
sweetclover (M indicus). The amount of seed specified to be planted in the Plan shall match the
quantity of seed used in the field.
• The security shall be held by Garfield County until vegetation has been successfully reestablished
according to the Reclamation Standards in the Garfield County Weed Management Plan. It is the
responsibility of the applicant to contact the County, upon successful revegetation establishment,
to request an inspection for security release consideration.
Sensitive Area Survey
In the application under Tab I 1, Sensitive Area Survey, the applicant cites the Garfield County Zoning
Resolution, 9.07.04 (IO) on page I. On page 3 the applicant states that the studies are "typically not
welcome and are many times not allowed on private property", the applicant further states that they
respectfully decline to provide the County with a copy of the study. These regulations were updated
October 11 2005. It is my interpretation that the regulations are in place and that the applicant should
comply with 9.07.04 (10).
