SUPPLEMENTARY INFORMATION
1. Disposal Site Description
The area requested for permanent withdrawal at Estes Gulch is the W1/2 of
the NE1/4, the W1/2 of the SE1/4, and the NW1/4 and the SW1/4, all of
Section 14, Township 5 South, Range 93 West, 6th PM, Garfield County,
Colorado.
2. Upgrade of Highway 13 and Traffic Control
A letter dated December 14, 1990, from the DOE to the Colorado Department
of Health (CDH) concerning road maintenance during the UMTRA Project in the
State of Colorado is included as Exhibit S-1. Discussions between the DOE
and CDH on road maintenance are continuing. Regarding improvements on the
intersection of the Highway 13 Bypass and County Road 266, please provide
further information. This county road does not seem to intersect our
proposed haul route.
3. Shift Periods
The DOE seeks to perform the UMTRA Project in the most economic and
efficient manner possible under current funding limits. To achieve this,
it requests approval of a multiple -shift, 24-hour, 7 -day per week operation
during the 17 -month haul schedule.
4. Defined Haul Schedule
To operate as efficiently and economically as possible, the haul schedule
cannot be determined before selection of the subcontractor.
5. Tailings Cover
During haul operations tailings will be covered with a tarpaulin or sealed
with a surfactant to prevent spillage along the haul route. Any
contaminated materials deposited on access or haul roads will be cleaned
up immediately in accordance with subcontract conditions and the project
Construction Safety and Health Management Program.
6. Noise Levels
MK -Ferguson will perform noise modeling at the processing and disposal
sites to determine the approximate impact on nearby residences. In
addition, baseline surveys will be carried out to determine ambient

background levels. At this time, Colorado Noise Abatement Standards
CRS -25-12-103(5) are no longer in effect and there were no statutory limits
for the "receiving" zones. However, project activities will not produce
noise levels in excess of the former limits established for industrial
zones.
7. Air Emission Permits
Copies of Air Emission Permits 88GA190 and 88GA191 are included as Exhibit
S-2. Both permits have been extended to January 1992. Confirming
correspondence from CDH is also enclosed.
8. Reseeding
The Estes Gulch Disposal Site will be reseeded per the project
specifications, which is included as Exhibit S-3.

We have reviewed the Colorado Department of Health's preli WORM'
recommendation concerning Directive 7 in the Statement of Principles and
• Directives for Implementation of the Uranium Mill Tailings Remedial Action
Project. This directive calls for the U.S. Department of Energy (DOE) and
Colorado Department of Health (CDH), with assistance from the Colorado
Department of Highways (CDOH), to develop a plan for appropriate upkeep
and maintenance of roadways for each of the affected remaining mill sites
in Colorado.
Enclosed for your review is a copy of the Uranium Mill Tailings Remedial
Action Project Road Maintenance Plan for the State of Colorado. As stated
in this draft, details on implementation of the plan and on the commitment
and transfer of funds will be included in a modification to the
Cooperative Agreement. We would be pleased to meet with the CDH and CDOH
to discuss this plan which we believe meets the intent of Directive 7 in
the Romer/Twining Agreement.

ROAD MAINTENANCE PLAN
FOR THE STATE OF COLORADO
I. Background
The "Statement of Principles and Directives for implementation of the
Uranium Mill Tailings Remedial Action Project in the State of Colorado,"
directs the U.S. Department of Energy (DDE) and_the Colorado Department of
Health (CDH), with assistance from the Colorado Department of Highways
(ODOR), to "develop a plan to ensure appropriate upkeep and nnintenance of
roadways" used by the Uranium Mill Tailings Remedial Action (UMTRA)
Project for hauling of residual radioactive material (RRM) to UMTRA
Project disposal sites. The plan's goal is "to maintain the integrity of
the road and provide for safe operating conditions."
II. Objective
The hauling of the RRM from the mill sites to an offsite disposal site may
result, over a relatively short period of time, in a significant amount of
UMTRA Project truck traffic utilizing state roads. There is a potential
for adverse impacts to these state roads from this truck traffic.
Accordingly, the UMTRA Project has an objective of mitigation of these
potential adverse thpacts.
III. Responsibilities
In order to achieve the objective of this plan, a pavement evaluation of
each affected state road will be performed by the DOE prior to the hauling
of the RRM. This pavement evaluation will include estimates of UMTRA
Project truck traffic informations including volume of RRM, total number
of round trips, daily round trips, haul period, and truck weight limits.
The design life to carry the UMTRA Project truck traffic used in the
pavement evaluation will correspond to the anticipated haul period.
A cost estimate will be prepared by the DOE based on DOE's review of the
pavement evaluation. The cost estimate will be reviewed by CDH and CDOH
and comments, if any, provided to the DOE. This cost estimate will not
include costs to repair non-UMTRA Project (normal) surface roadway wear,
nor will it include costs for normal road maintenance functions, which is
the responsibility of the croup as specified below.
During the annual non -haul periods (as defined by the UMTRA Project) the
CDOH will continue to perform its normal road maintenance functions, at no
cost to the UMTRA Project, on the affected state roads. Such normal road
maintenance functions shall include, but not be limited to, surface
roadway maintenance, shoulder work, roadside repairs, drainage repairs,
snow removal, and traffic services. During the annual haul periods, the
CDOH will not perform surface roadway maintenance, which is the
responsibility of DOE's contractors. However, except for this surface
roadway maintenance, the CDOH will continue to perform its normal
functions mentioned above. The CDOH will expend, for both periods, in
accordance with the average annual expenditures for these normal
maintenance functions over the last three years prior to the start of
UMTRA-related road use. At the end of the UMTRA site remediation, the
CDOH will contract to perform the work, if necessary, as indicated from
the pavement evaluation and within the associated cost estivate.
IV. Funding
The surface roadway maintenance performed by the DOE contractors during
the haul periods and at the end of UMTRA site remediation will be
cost -shared at 75%/25% by the DOE and the State, respectively. An
estimate of the cost of this surface roadway maintenance will be provided
yearly by the DOE. The State will obligate 25% of the estimate under the
Cooperative Agreement. The DOE will bill the State for surface roadway
maintenance in accordance with the terms and conditions of this
Cooperative Agreement. The DOE, through its'UN RA Project contractors,
will pay State fuel taxes and vehicle registration fees as a normal part
of performing..its remedial action responsibilities in the State of
Colorado. The State will credit the DOE, against the DOE portion of the
cost estimate for the surface roadway, for 30% of these taxes and fees
paid. Additionally, the State will credit the DOE, against the DOE
portion of the cost estimate, for the surface roadway maintenance costs
incurred by the DOE contractors, which would have been incurred by CDO&i
had such maintenance been performed by them during the haul periods.
V. Transfer of Funds
To the extent the plan requires compensation to or reimbursement of the
CDOH, the DOE share of such funds shall be transferred from the DOE to the
CDH. The specifics of this plan and transfer of funds will be included in
a modification to the Cooperative Agreement No. DE-FC09-81AL16257 between
the DOE and the State of Colorado.

cy rip rap as cover material for tailings embankment. Material is
received from an offsite borrow area.
e. Remove and transport up to 326,800 total cy of non -contaminated
topsoil and general fill material from tailings embankment construction
approximately 1.5 miles to Old Rifle site for restoration and cover.
f. Site grading activities requiring up to 39300 total cy of material
to be moved around 70 acre disposal site.
3. Construction of this source must commence within 18 months of initial
approval permit issuance or within 18 months of the start -up -date
stated in the application. If commencement does not occur within the
stated time the permit will expire on July 18, 1940
(See General Condition No. 6., Item 1 on the reverse side of the first
page of this permit).

FLUITIVE PARTICULATE EMISSION CONTROL PLAN
The following Fugitive Particulate Emission Control Measures shall be used
far enforcement purposes on the sources covered by this permit, as required
by the Air Quality Control Commission.
1. Fugitive emissions from actively disturbed, non -contaminated areas
shall be controlled by watering, including weekends. Chemical
surfactants maybe applied to inactive areas subject to wind errosion
periodically to assure dust free conditions and as required by the On
Site Coordinator.
2. Contaminated mill tailings shall be watered to maintain a surface
moisture content of 5X or greater during excavation and placement.
3. Material and surface areas left undisturbed for 6 months and longer
shall be reseeded and mulched and watered to promote and maintain
vegetation growth. If not reseeded, the area will be watered to
maintain a surface moisture content of 5X or greater.
4. Vehicle speed on unpaved surfaces shall be limited to 20 mph. Speed.
limit signs shall be posted at appropriate locations Haul vehicle
loads shall be covered by tarp in transit off site and load size
restricted to legal limit of road. Tailgates will be sealed to prevent
spillage.
5. Unpaved haul roads chn11 be watered to maintain a surface moisture
content of 5X or greater to minimize fugitive dust. Chemical treatment
may be used on infrequently graded areas and roads.
6. Vehicles contaminated by radioactive materials shall be washed at
decontamination pads before leaving the disposal site.
7. Earthmoving activities on site shall be halted when wind speeds• exceed
40 mph continuously.
8. Mud and dirt carryout onto paved surface shall be controlled by gravel
entry nays, covering load and limiting load size.

on July 18, 1990. In accordance with Regulation 3.IV.G.4.b. the Division may
extend an expiration date for a period of up to 18 months, upon showing of
good cause by the permittee. In considering what constitutes good cause and
the length of time a permit may be extended the Division shall consider the
degree of construction completed, the amount invested or legally committed to
the project, whether an extension would prevent (e.g., through reservation of
a PSD increment) economic development in the affected area, general economic
conditions, the health of the community as it affects the ability of the
permittee to proceed and other relevant factors.
Based upon the above criteria and the information submitted for the extension
request we make the following conclusions:

from the Estes Gulch disposal site for backfill at the Old Rifle site.
3. Construction of this source must commence within 18 months of initial
approval permit issuance or within 18 months of the start -up -date

4. Applicant shall maintain a continuous ambient air total suspended
particulate monitoring program. This particulate monitoring program
shall be conducted to determine compliance with ambient air quality
standards for particulate. Tu (2) TSP samplers wi11 be operated daily
for 24 hours. Sample filters will be collected every 3 days and
analyzed for TSP concentration. Metals sampling for lead and vanadium
shall be required. =samples wit/ be preserved and stored and made
available for Division analysis on request. Any exceedance of 135
ug/m3 averaged over a 24 hour period measured at the property line and
beyond will result in the need for the applicant to review the cause of
the high measurement and to propose and implement additional emission
controls or operational changes to prevent future rxceedances of 150
ug/m3. The proposed changes shall be submitted to the Division and
implemented within 10 days after the occurrence.
Applicant shall furnish an ambient air monitoring program protocol to
the Division at least 60 days prior to removal of any contaminated
tailings material for Division review and approval. Monitoring
protocol shall be in accordance with Ambient Air Monitoring
Requirements prepared by the Air Pollution Control Division of the
Colorado Department of Health.

4. Vehicle speed on unpaved surfaces shall be limited to 20 mph. Speed
Limit signs shall be posted at appropriate locations Haul vehicle
loads chaff be covered by tarp in transit off site and load size
restricted to legal limit of road. Tailgates will be sealed to prevent
spillage.
5. Unpaved haul roads shall be watered to maintain a surface moisture
content of 5X or greater to minimize fugitive dust. Chemical treatment

6. Vehicles contaminated by radioactive materials shall be hashed at
decontamination pads before leaving the pickup and drop-off sites.
7. Earthmoving activities on site shall be halted when wind speeds exceed
40 mph continuously.
8. Mud and dirt carryout onto paved surface shall be controlled by gravel
entryways, covering load and limiting load size.

on July 18, 1990. In accordance with Regulation 3.IV.G.4.b. the Division may
extend an expiration date for a period of up to 18 months, upon showing of
good cause by the permittee. In considering what constitutes good; cause and
the length of time a permit may be extended the Division shallconsider the
degree of construction completed, the amount invested or legally committed to
the project, whether an extension would prevent (e.g., through reservation of
a PSD increment) economic development in the affected area, general 'economic

PART 1 - GENERAL
1.1 SCOPE
A. This Specification Section covers seeding for the restora-
tion of the following areas:
1. Old Rifle Processing Site and Access Road Turnout
2. New Rifle Processing Site including Wet Meadow/Shrub
Wetlands
3. Estes Gulch Disposal Site: Retention Basin, Access
Control and Staging Area, and Access Road Turnout at
Highway 13
4. Disturbed areas and earth materials stockpiles left
inactive for 6 months or longer shall be seeded but
not mulched.
1.2 WORK NOT INCLUDED
Seeding related to the restoration of off-site construc-
tion facilities including borrow areas is not included in
the Scope of Work of this Section.
1.3 RELATED WORK

1.4 MATERIAL STORAGE
A. Seeds shall be stored in sealed waterproof containers in a
cool, dry location and shall be kept out of direct sun-
light until ready for use.
B. Fertilizer, if required, shall be delivered and stored in

sis and name of manufacturer.

2.2 ACCEPTANCE OF SEED
Final acceptance of seed will be made by the Contractor

the following information provided by the seed vendor on
each seed container label: (1) seed name: (2) lot number:
(3) net weight: (4) percentages of purity and of germina-
tion: (5) seed coverage, in acres, on a pure live seed
basis: and (6) percentage of maximum weed seed content
clearly marked for each kind of seed. Seeds shall be
packaged by the vendor in even acre coverage containers.
The Subcontractor shall furnish the Contractor duplicate
copies of a statement by the vendor, certifying that each
lot of seed has been tested by a recognized laboratory for
seed testing within 6 months of date of delivery. This
statement shall include: (1) name and address of labora-
tory, (2) date of test, (3) lot number for each kind of
seed, and (4) results of tests as to name, percentages of
purity and of germination, and percentage of weed content,
for each kind of seed furnished, and, in case of a mix-
ture, the proportions of each kind of seed.
2.3 FERTILIZER
Fertilizer, if required, shall be a standard commercial
grade and provide the nutrients as determined by the soils
fertility analysis specified in Article 3.1.C. Fertilizer
shall be furnished in new, clean, and sealed containers
with the name, weight, and guaranteed analysis of contents
clearly marked. A liquid form of fertilizer providing the
nutrients as determined by the soils fertility analysis
specified in Article 3.1.0 may be used. If the fertilizer
is delivered in bulk, the Subcontractor shall submit to
the Contractor, for each load, a certificate from .the
manufacturer or supplier indicating the above-mentioned
information.
2.4 MULCH
Mulch shall consist of grass hay. Mulch shall be free
from all viable seed, mold, or other objectionable
material. Final acceptance of mulch will be by the
Contractor.
2.5 WATER
Water used in the planting or care of vegetation shall be
free of oils, acids, alkalies, salts, or any substance
injurious to plant life.

2.6 TOPSOIL
Topsoil for seeding of disturbed areas within the State of
Colorado Highway Department rights-of-way shall conform to
Section 207 of the Colorado Standard Specifications.
PART 3 - EXECUTION
3.1 PREPARATION
A. Timing of Seeding: All final grades not covered by gravel
or riprap shall be seeded as soon as practical (after
September 15 and until consistent ground freezing) after
their completion or as directed by the Contractor.
Seeding materials shall not be applied during windy
weather, when the ground is excessively wet except in Wet
Meadow/Shrub Wetlands, or frozen, or when snow is
present. If the ground is wet in the Wet Meadow/Shrub
Wetlands, broadcast method of application shall be used.
B. Grading and Seedbed Preparation: Before applying seed in
a given area; any stockpiled topsoil and select fill shall
be put in place and the area shall be graded as shown on
the Subcontract Drawings. Processing and Disposal site
surfaces, except Wet Meadow/Shrub Wetlands, shall be
graded to slope gradually towards drainage courses, with
no enclosed low spots where water can accumulate. The Wet
Meadow/Shrub Wetlands shall be graded to provide undulat-
ing surfaces for water accumulation. Areas to be seeded
that have been damaged by erosion or other causes shall be
restored prior to seeding and then cultivated to provide a
reasonably firm but friable seedbed. •A minimum of 6
inches of surface soil shall be in a loose condition at
the time of fertilizer and seed application.
C. Enrichment: Micronutrient fertilizer requirements, if
any, shall be determined by laboratory soils fertility
analysis of representative soil samples from each of the
following project areas: Old Rifle processing site, New
Rifle processing site and Estes Gulch disposal site. The
Subcontractor shall collect representative soil samples
and have them analyzed by a certified soil laboratory. A
copy of the laboratory report shall be submitted to the
Contractor for approval prior to application of fertilizer
or seed.

3.2 APPLICATION
A. Seed shall be applied by a rangeland drill to a depth of
0.50 to 0.75 inch and at a spacing of not more than
7 inches. To the greatest extent possible, seeding shall
be oriented along (parallel to) land contours. For slopes
too steep or soils too moist to use a drill, a mechanical
broadcaster may be used and the seed raked in.
B. Immediately following seeding, mulch shall be applied at a
rate of 1 ton per acre to all areas seeded, and the mulch
shall be crimped with a mulch crimper.
3.3 CARE DURING CONSTRUCTION
The Subcontractor shall be responsible for protecting and
caring for areas seeded before final acceptance of the
work. The Subcontractor shall repair any damage to seeded
areas caused by erosion or construction operations without
additional compensation.
PART 4 - MEASUREMENT AND PAYMENT
