They have not finalized their testing, but it appears that the levels should fall back into the acceptable range . We will have the final results next week. Even in worst-case scenario, the original test results which were in excess of acceptable drinking water standards, would be removed to perfectly acceptable levels via reverse osmosis purification. The Well es residence has a central reverse osmosis system which delivers drinking water to locations within the home where they draw their drinking/ cooking/ ic e water. We look forward to finding acceptable results in our final testing, but we wanted you to know that regardless of this, their drinking water will be of exce ll ent quality . This isotope has a very long halflife, and emits a beta particle and a gamma ray when it decays. High amounts of potassium always result in high gross beta results, and a small amount of that beta activity can appear as alpha activity, a phenomenon known as crosstalk. I believe this accounts for all of the radioactivity in the sample you submitted. Let me know if you have any other questions . There were not any glaring problems. The -1.63 result for the Langlier index is a corrosivity measurement. Typically it is best to be in the range from -1 to + 1. The -1.63 result shows water which is slightly more corrosive as opposed to scale-forming. Partially, this may be the result from the softening process, and the elimination of hardness/ calcium---and the addition of sodium. This result was reviewed with two water test lab director, both of whom had no problem with this result. Typically, this index is more utilized for water towers , boilers , and mechanical systems rather than residential applications. It a lso changes with temperature of the water. Typically if water is too aggressive there will be a copper residual to indicate possible erosion of the piping. In this case, there was almost negligible copper at .1 mg/1----c ompared to the 1.3 mcl for copper. The su lfate level was measured at 250mg/I, which is exactly the national standard. Levels above this can contribute to a laxative effect with certain people---depending on sensitivity---and if this is a primary drinking supply . In this case, all drinking water is treated via reverse osmosis which removes virtually all sulfate---as well as virtually all other impurities. The other parameter of consideration is the total dissolved solids---at 820 mg/I. This is basically a measurement of the components dissolved in this water supply. The national standard is considered 500 mg/I. which tells us that as a primary source for drinking water, this would be in excess of the desired level. Once again, the primary drinking water supply here is further purified via reverse osmosis, and the dissolved solids are closer to 5-30 ppm ---well under designated levels. Your county guy asked for further radio-nucleotide results , and the lab is following up with those tests, and they should be available within a week. Since the Comm issioners have waived the roadway standard, the on ly issue that remains is demonstrating legal access. The deed from Rim ledge Uranium and Mining clear ly grants an easement for access and egress "from the county road to the NE corner of the sel/4nel/4 of Section 25 . County Resolution 79-8 in the third "Whereas" paragraph indicates that "the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners ... that there is adequate ingress and egress to said tracts" This resolution was granting the division of the 40 Acre tracts into three tracts in 1979. This was clearly done after the construction of Rim ledge Road as required by the deed in 1976 indicating the "access road " would be constructed before August 1, 1976. Perhaps the County has this file handy to reference documents contained therein, however, it would seem that based upon the previous resolution granted by the county that you could rely upon the determination and conc lu sio n made back in 1979. From the research that the Tit le company ha s done so far, Rim ledge Uranium and Mining clearly reserved a 60 ' right of way for access and utilities along the length of Rimledge Road to the County Road. You suggested that we provide a waiver request from the road standard. However, I believe that we should be in compliance with the road standard using the existing road. You noted that the Average Daily Trips (ADT) for a residence is 9.57, according to the institute of Traffic Engineers' Trip Generation Manual. With the three residences in the subdivision that would make a total of over 28 ADT's, roughly one vehicle trip every 34 minutes during the day. This estimate must certainly be for an urban or suburban setting. Here, we are dealing with a rural residence. It is highly unlikely for a rural resident to make more than 4 ADT's, (2 trips out and back) from these homes. Typically, rural residents combine errands and leave the house no more than twice in a day. To do more would be inefficient, costly and time-consuming. In fact, this is exactly how the owner of this property, Pete Welles, described his daily trips to me, a maximum of two round trips per day, which would equal 4 ADT's. If we factor in the ADU at Yz of the ADT's of the homes, then we would have a total of 14 ADT's from the users of this road. The closest store is Catherine Store, 3 1/2 miles away. Downtown Carbondale is 6 1/2 miles away. Sure, on a terribly busy or difficult day, one might make an additional trip. But in the case of our client and many others in the valley, the extra trip is likely on a bicycle! In addition, the internet has created the ability to do much of our business on line, which these rural residents do quite a lot. It allows them to forgo that extra trip or two during the day. When guests are staying at the residence, there may be additional vehicle trips, but the average between the three residences and new ADU would be less than 20, fitting easily into the Primitive Residential category with a design capacity of 11 to 20. There is a 20 foot easement for the road across the neighboring properties. In fact, the road is almost perfectly flat, wider than necessary, improved with gravel, and it is perfectly straight coming across the neighbors' properties. The flat, improved, and straight characteristics make this an easy road to negotiate, and allow it to work well at its current width without creating any safety concerns. There are no drop-offs, ditches, or blind corners restricting vision. Additionally, since 1977, the easement and access configuration has performed safely and well without any accidents, complaints, or concerns to the best of our knowledge. The easement for the road within the subdivision is 60 feet wide, more like a Minor Collector. The shoulder width of 2 feet on each side is that of a Semi-Private Road, with a capacity of 21-100 ADT's. The minimum radius is 100 feet, like a Secondary Access Road; and the surface is gravel, like a Rural Access Road or Semi-Primitive Road. The existing width of 13 to 15 feet is greater than the 12 foot single lane allowed for in the Primitive Residential category, one foot wider in its narrowest spot. Additionally, the Ranch Driveway veers to the right shortly after crossing the property lines, the Horn's driveway branches to the left immediately thereafter, and the Adobe driveway is separate for the entire length after the split from the Horn's property. The only item missing from the increased standard is the designated ROW width set at either 30' or 40' in the code. As previously indicated, the ROW is an easement created in 1977 that is set at 20' and has served well because of its design and location/topography not in spite of its lower ROW width. Again, it seems that the traffic engineer's 9.57 ADT's is very high, more than double what we are calculating. If after considering all of the above, it is determined by the County Building and Planning Director that the 9.57 ADT's must be applied, then I would like to respectfully request a waiver from the County Road Standard based on the above information, from the standpoint that the road standard is not applicable to this property. Said parcels are adjacent to that roadway known as the Rirnledge easement. WHEREAS, the parties hereto have each been granted a right of way along the road appurtenant to their homesites for purpos es of ingress and egres s to County Road 100 in the Carbondale , Colorado area. NOW, 11iEREFORE, in consideration of the mutual promises and terms contained herein , the parties h ereto agree as fo ll ows : 1. The access road servi ng the homesites of t he :-arties hereto sha ll be maintained by all the lan down ers serve d by such road and eac h owner shall pay his/h er pro rata share of suc h maintenance and upkeep. 2. The provisions of t hi s agreeme nt sha ll run \O.ith the land of each of t he a bove described parties and sha ll be binding upon and in ure to the ben efi t of the success or s and assigns of the parties here to . 3. A bo ard of directors comprised of homeowners shall be elected by November 1st each year . Said bo ard shall handle the administration of said maintenance and upkeep . Page 1 of2 ' I \ -- 4 . A copy of this document may be executed by each party, separately, and when each party has executed a copy thereof, such copies taken together shall be deemed to be a full and complete contract b etween the parties.
