1.0 PROJECT OVERVIEW
The following sectio ns provide a narrative of the nature and character of the special use permit
requested.
1.1 PROJECT DESCRIPTION
Canyon Gas Resources, LLC (CGR) has applied to the Bureau of Land Management (BLM) for
a right-of-way grant under Section 28 of the Mineral Leasing Act of 1920, as amended, to
authorize the construction, operation, and maintenance of a 12-inch diameter natural gas pipeline
and related facilities in Garfield County, Colorado. The proposed pipeline project wou ld loop an
existing CGR 6-inch diameter natural gas pipeline and would connect CGR's Bentley and
Porcupine Gathering Systems. The pipe line would transport existing and future natural gas
produced by Tom Brown, Inc . (TBI) in the R ifl e, Co lorado area for processing at the Rifle
C lough Comp ressor Station. TBI plans to drill more than 40 new we ll s in 200 4, a ll of which are
d edicated to CGR's gathering sys tems. Production from thes e we ll s i s expected to increase by 35
mmscf/d, in creasing total throughput from 15 mmscf/d to 50 mmscf/d . System throughput will
inc rease to 100 mmscf/d in th e n ex t four years. Th e proposed pip e lin e will d e-b ottlen eck the
ex istin g gathering systems and wi ll ensure su ffici ent capaci ty to carry CGR's current projection
of futur e gas vo lum es .
1.2 PROJECT LOCATION
The project is approximat ely 4 .3 mi les in length , of which 0.8 mil es are located on fee-lands and
3.5 miles are lo cated on BLM lands administered by the G lenwood Springs Fie ld Office. The
approximate area of temporary disturbance for construction within the right -of-way is 26 acres
and total temporary disturbance (including temporary use and existing disturbed areas) is 29
acres.
The project is located south and west of Rifle, Colorado in Sections 1, 9, 10, 11, and 12 of
Township 7 South, Range 94 West in the Rulison and North Mamm Peak USGS Quadrangles .
Project area maps are included in Appendix A.
1.3 PROJECT DESIGN
CGR will design and build the pipeline in accordance with the National Electrical Code,
Depaiiment of Transportation, Title 40 CFR Part 192 , and ASME B31.8 standards . Facilities will
be designed, constructed, and operated in compliance with the Occupational Hea lth and Safety
Act (OSHA) regulations pertaining to pipeline construction and operation.
The right-of-way co n stru ction width will be 50 feet. A launch er and rece iv er will be located at
loc ated at opposite end s of the pipeline, with risers , blow -downs, and va lve sets where appropriate
along the ri ght -of-way. Cath od ic prot ec tion will be install ed as n ecessary. No electricit y is n ee ded
and the existing rectifi er will be us ed if po ss ibl e. No buildin gs will be constructed .

1.4 PROJECT SCHEDULE
Constrnction activiti es are expected to be compl ete d in 4 to 6 weeks and are sc hedul ed for
summ er or fa ll 2004. Constrnction crews will typically work six days per week from daylight to
dusk.
1.5 CONSTRUCTION DESCRIPTION
The standard open cut construction method will be used to install the pipeline. This method
includes c learing, grad ing, trenching, pipe stringing, pipe bending, weldin g, joint coating,
padding where req ui red, lowering in, backfilling, p n eumatic testing, cleanup, and revegetation.
Clearing, topsoiling and grading w ill be limited to the minimum area required for safe and
efficient constrnction. C learing wi ll be performed only to the ex tent necessary to allow fo r
constrnction activities. The ground surface will not be grubbed or cleared of vegetation less than
four inches in h eight when possible . Every effort will b e made to salvage root systems. Large
vegetation, such as tre es and shrubs, will be cl eared from the right-of-way and stockpiled or
windrowed at th e edge of the approved workspace for later us e in reclamation.
Topsoil will be removed and stockpi led. Where topsoil is available , th e top 4 to 6 inches of soil
will be removed over the trenchline and in areas requiring grading . Topsoil and cleared
vegetation will be stockpiled together on BLM l ands . Topsoil will be stockpi led separate from
cleared v egetation on fee -l ands. The right-of-way will b e graded only to the extent necessary to
c reat e safe and e ffici ent pipeline installation conditions . Topsoil w ill not b e salvaged over th e
existing CGR pipelines.
Trenching operation s wi ll begin after th e right-of-way has been prepared. The trench wi ll be
excavated in accordance with OSHA and DOT req ui rements. Subsoil material will be stockpiled
separately from topsoil stockpi les .
After preparing the right-of-way and trench, pipeline construction and install ation will include
stringing, bending, welding, x -raying, and coating . Segments of pipe Uoints) will be transported
to the right-of-way, bent to conform to the contours of the trench, and welded together. The
welds will be visually inspected and non-destrnctively tested utilizing radiographic or other
approved teclmiques in accordance with API standards. At a minimum, radiographic inspection
wi ll be conducted in accordance with DOT requirements. The welded joints will be coated and
any coating anomali es will be repaired accordingly.
Completed sec tions wi ll be lowered into the trench, padded as necessary to prevent rocks or
other obj ec ts from coming in contac t with and damaging pipe coati n g, and bac kfill ed with
stockpi le d sub so il.
To t es t the integiity of the pip e lin e, pipeline segments will be pneumatically tested wi th nitrogen
and held und er pressure for a specified p eriod of time.
Cleanup and restoration activities will b eg in promptly after backfilling. The right -of-way will be

graded to the original contours and natural runoff and drainage patterns will be restored. Topsoil
will be redistributed over th e tren ch and oth er portions of th e right-of-way from w hi ch th e
topsoil was salvaged. Disturbed areas wi ll be seeded with seed mixes approved by th e BLM and
fee-landowner.
Equipment that will be used during construction will include, but is not limit ed to, 10-3/4 ton
pickup trucks, 3 welding rigs, 2 dozers, 2 track hoes, 2 side-boom tractors, 1 bending machine, 1
ditching machine, and 1 water truck.
Specific construction requirements are listed in the Plan of Development (POD). The POD is
included in Appendix B.
1.6 PROJECT MAPS
The following maps have been developed and are presented in Appendix A:
• A site plan/map (alignm ent sheets) drawn to scale that portrays th e right-of-way boundaries
and temporary us e and disturbed areas that will be utili zed during construction. This map
a lso shows co unty roads in the project v icinity.
• A vicinity map showing slope/topography.
• A copy of the Garfie ld C ounty Assessor's Map showing all mineral and surface owners a long
the c orridor. This map a lso shows adjacent landowners .
1.7 LANDOWNER DOCUMENTATION
The following items are presented in Appendix C:
• A copy of the deed and l egal description of the fee-lands property.
• An acknowledgment from the fee-landowner that CGR may act on her behalf.
• A copy of the engineering plat for the fee -lands property.
1.8 REQUIRED PERMITS
The Glenwood Springs Field Office of the Bureau of Land Management will issue the Right-of-
Way Grant with stipulations and the Notice to Proceed. In addition, the following permits will be
obtained and adhered to:

• Colorado Dewatering Industrial Wastewater Permit

2.0 ZONING REGULATIONS 5.03
2.1 WATER AND SANITATION
The project will utili ze adequate uti lit ies to prov id e water and sanit at ion service. Portab l e toi let s
wi ll be availabl e on-site and potable water wi ll be transported from off-site and provided to the
crews.
2.2 STREET IMPROVEMENTS
Access to the proposed pipeline route would be via County Road (CR) 317 (Beaver Creek Road),
CR 325 (Porcupine Creek Road), and CR 329 (Spruce Creek Road). New roads would not be
constructed and improvements to existing roads wou ld occur within the previous ly disturbed
area. Roads used for the project would be maintained and/or repaired as necessary to conditi ons
eq ua l to or better than those which existed prior to project-related u se.
2.3 NEIGHBORHOOD CHARACTER
Installation of screen fences or landscape m aterial s will not be install ed on th e periphery of th e
project. The project wi ll not result in a lo ss of neighborhood character. The project is loc ated
within an existing gath ering system that includes pipelines, well pads, and re lated above -ground
appurtenances.
3.0 INDUSTRIAL OPERATIONS-REGULATIONS 5.03.07
The BLM has prepared an Environmental Assessment (EA) analyzing th e impacts of the project
and has determined that the proposed Porcupine Loop project will not cause any significant or
long-term impacts. The BLM EA is attached as Appendix D.
Specific Garfie ld County regulations are addressed below.
3.1 WATER IMPACTS
No water depletion will occur as a result of the project. Construction dewatering may be
required when groundwater and/or stormwater enters the trench . Dewatering shall be
accomplished by pumping water from the trench at a controlled rate that prevents erosion and
sed im entation. Water will be discharged in a we ll -vegetated, up land area and will not be pumped
directly into flowing wat erbodies. Dewatering will occur in accordance with the Colorado
Dewatering Industrial Wastewater Permit.
The risk of stormwater, eros ion, and sed im en t pollution will be minimized by following CGR's
Stormwater Po llution Prevention P lan, which id entifies erosion, sediment, and stormwater
pollution control practices used during construction to avoid or reduce the impact of so il erosion,
sed im entation , and stormwater pollution on or adjacent to the proposed project right -of-way. The

3.2 AIR, NOISE AND VISUAL IMPACTS
Construction of the proj ect will not result in the production of vapor, glare or vibration. Noise
levels will increase due to operation of heavy equipment during daylight hours and will decrease
to pre-construction levels after construction is complete. Fugitive dust will increase during
construction of the project and will be minimized by following CGR's Fugitive Dust Control
(Dust) Plan and any conditions attached to the Colorado Air Emission Permit. No burning or
open fires will be allowed during construction of the project. CGR's Fire Prevention and
Suppression (Fire) Plan will be implemented to minimize the risk of fire danger and, in case of
fire, provide for immediate suppression . The Dust Plan and Fire P lan are included in the POD,
which is attached as Appendix B.
3.3 WILDLIFE AND LIVESTOCK IMPACTS

Construction of the project wi ll not result in the creation of hazardous attractions, blockade of
migration routes or use patterns.
3.4 TRAFFIC IMPACTS
Construction of the project will not result in substantial impacts from traffic to and from the site .
Usage of county roads CR 317 , CR 325 and CR 329 will increase during construction of the
project. Roads will be maintained as discussed in Section 2 .2 and fugitive dust will be controlled
as discussed in Section 3 .2 .
3.5 PROPERTY IMPACTS
Abutting property will not be damaged by operations of the pipeline project. As discussed in
Section 2.1, the project is located within an existing gathering field and pipelines, well pads, and
aboveground appurtenances are already located within and adjacent to the project area.
3.6 SITE REHABILITATION

Cleanup
All co n s truc tion-re lated debris wi ll be removed and disposed of at an approved disposa l area.
The righ t-of-way and temporary use areas will be graded as near as possib le to th e pre-
construction contours and natural runoff and drainage patterns wil l be restored. Stockpiled
topsoil will be redistributed over the trench and other portions of the right-of-way from which
the topso il was salvaged. Topsoil will be left in a roughened condition.
Permanent waterbars will installed according to the guidelines in the Stormwater Pollution
Prevention Plan, which is included in the POD in Appendix B.
Vegetative mulch and excess rock will be used to reduce erosion potential on BLM-administered
lands by providing additional surface relief structure. Vegetative debris salvaged during clearing
and grading operations will be distributed across the right-of-way. Layering of rock may be used
on the surface of erodible soils in some critical areas to reduce erosion and restore appearance of
native surface. Suitable sites include naturally rocky s lopes and areas that have a natural gravel,
cob bl e, or b o ul der veneer on th e s urface. S ui tab le sit es wi ll b e de t ermined by the CGR
Re present ativ e in conjun ct ion w ith th e BLM on BLM-adm ini s tered land s.

maint a ined and repaired by th e Co nt rac tor to at leas t pre-construct ion co n dition and to the
satisfaction of the landowner or BLM fie ld representative to m inimize distu rbance to th e pub li c.
OHV barriers may be required by the BLM. Suitable sites will be determined by the CGR
Representative in conjunction with the BLM on BLM-administered lands.
Revegetation
Every attempt will be made to seed disturbed areas within 24 hours of completing topsoil
replacement and installation of permanent soil erosion and sediment control measures. If an area
is not seeded within 24 hours of topsoil replacement, the seed will need to be incorporated into
the soil.
All disturbed areas will be reseeded with the appropriate seed mix and rates by vegetation type as
determined by the BLM. Seed mixes will be purchased from commercial seed vendors and must
be state-certified weed-free mixtures . Seed bag tags will be collected and submitted to the BLM
to confirm that the seed was purch ased from a commercial seed vendor and was tested and
certified. Seeding rate will be listed as pounds per acre of pure live seed (PLS). T h e BLM-
approved seed mixes for thi s proj ect ar e li sted in th e sti p ul atio ns att ac h ed to th e Right-of-Way
Grant.

• seed drill with a seed re lease and agitation mechanism suffic ient to a llow seeds of various sizes
an d densities to be planted at the proper seeding depth . Broadcast seeding wi ll b e employed only
in areas where drill seeding is un sa fe or physically impossible . Broadcast application rates will
be twice that of drill rates. Immediately after broadcasting, the seed will be uniformly raked,
chain ed, or dragged to incorporate seed to a suffici ent seeding depth. If the area is seed ed prior to
a soil crust forming (within 24 hours of topsoi l replacement), harrowing or raking may not be
necessary. Fall seeding would be comp leted after Sept ember 1 and prior to prolonged ground
frost. If necessary, sp1ing seeding will be completed when the ground thaws and prior to May 15.
3.7 FINANCIAL SECURITY
CGR will comply with any financial requirements set by the Garfield County Commissioners.
3.8 MITIGATION MEASURES
Mitigation measures to minimize impacts of constructing and operating t h e proposed pipeline
project have been id entifi ed in this document, the POD, and the EA. T h e POD and EA are
attach ed in Appendix Band Appendix D.
4.0 INDUSTRIAL PERFORMANCE STANDARDS-

nois e po llution, and wi ll not conduct operations in a m anner constituting a public nuisan ce or
h azard.
4.1 AIR, NOISE, AND VISUAL STANDARDS
Construction of the project will not result in the production of vapor, heat, glare, radiation or
vibration. Noise levels will increase due to operation of heavy equipment during daylight hours
and will decrease to pre-construction levels after construction is complete. Volume of sound will
comply with the standards set forth in the Colorado Revised Statutes at all times. Fugitive dust
will increase during construction of the project and will be minimized by following CGR's
Fugitive Dust Control (Dust) Plan and any conditions attached to the Colorado Air Emission
Permit. No burning or open fires will be allowed during construction of the project. CGR's Fire
Prevention and Suppression (Fire) Plan will be implemented to minimize the risk of fire danger
and, in case of fire, provide for immediate suppression. The Dust Plan and Fire P lan are included
in the POD, which is attached as Appendix B.
4.2 STORAGE AND WASTE DISPOSAL AREAS
Hazardous Materials
Con struction, operation , and maintenance of th e proj ec t will require th e u se of certain potentially
hazardous materia ls such as gaso lin e, di ese l fu e l, lubricating oil s, h ydrau li c fluid s, paints, and

solvents. Hazardous materials will be stored in the construction sto rage yard and not on the right-
of-way. CGR has prepared a Spi ll Prevention, Containment and Countermeasure (Spill) P lan to
address hazardous material transportation, storage, inventory and disposal. The Spi ll Plan a lso
addresses spill prevention and spill response and cleanup measures associated with the
construction, operation, and maintenance of the project. The Spill Plan is included in the POD,
which is attached as Appendix B.
Solid Wastes
The construction right-of-way and temporary use areas will be maintained in a sanitary condition
at all times and waste materials on the project will be disposed of promptly at an appropriate
waste disposal facility. Waste includes, but is not limited to, human waste, trash, garbage, ashes,
welding rods, etc. Portable toilets will be available on-site. Liquid and solid waste generated
during construction of the project will be disposed of in an approved manner at an appropriate
facility so as not to impact air, water, soil, vegetation, or wildlife.
Equipment Storage
Equipment wi ll not b e transported to the site until construction activities begin. Equipment may
b e temporarily placed in a temporary use area until needed for construction activities, but wi ll
not be stored lon g-term. There are four temporary use areas associated with th e proj ect; two are
located on BLM-administered lands and two are existing well pads lo cated on fee -lands. T h e
temporary u se areas range from 0 .23 to 1.37 acres, are not located within 300 feet of any
residential dwelling and are not platted subdivisions. Screening wi ll not be installed because
these areas are temporary use areas and not long-t erm equipment storage yards.
Equipment will be maintained during daylight hours and will not require lighting. Equipment
will be on-loaded and off-loaded inside the temporary use area and will not occur on public road
right-of-ways.
4.3 WATER QUALITY STANDARDS
Construction of this project will not result in degradation to surface or groundwater quality, and
activities will be conducted in accordance with the Colorado General Construction Stormwater
Permit, the Colorado Dewatering Industrial Wastewater Discharge Permit, and the ACOE NWP
12 . Impacts to water are discussed in Section 3 .1.
4.4 MITIGATION MEASURES
Mitigation measures to minimize impacts of constructing and operating the proposed pipeline
project have been identified in this document, the POD, and the EA. The POD and EA are
attached in Appendix B and Appendix D .

Porcupine Gas Gathering System pipeline across our property in Sec. 10 , T. 7 S. R. 94
W., 6th P.M .
No fina l agreement has been formalized on the exact placement of the new p ipeline or the
compensation we will require .
