Noble Energy lnc. 2447-013-00-027 The Site will be approximately 2.11 acres on an overall tract of approximately 40 acres. The property is located approximately 5.25 miles southeast of the Town of Parachute, in the Section 1, T8S, R94W. The facility is accessed by County Road 306 and a section of roadway maintained by Noble Energy lnc. The property is zoned Rural GENERAL PROJECT DESCRIPTION The Applicant is requesting a Limited lmpact Review for a 2.11 acre Storage area (laydown yard) within an overal! 40 acre parcel. The site is previously disturbed and graded. Staff understands that Noble had initially intended to permit the site as a well pad with the COGCC, however, although the site was graded and developed as a well pad, this permit was never submitted. As a result the permit was never issued. Noble has represented that they have no intentions to permit this site with the COGCC in the future. To this end, Noble would like to use this currently graded site as a laydown yard and as a result, no additional grading or site disturbance will occur. The facility will be located about 5.25 miles southeast of the Town of Parachute and is surrounded by oil and gas development, some residential uses as well as limited agriculture. The site is proposed to be fenced and hazardous materials will not be stored at this location. As employees will only be onsite to pick up and drop off equipment, no water or wastewater facilities are proposed. The traffic study as submitted states that the site will generate 2 vehicle trips per day (one round trip) as well as one heavy truck trip every week. This correlates to a maximum of a 1% increase in traffic on CR 300 and a 12o/o increase on CR 306. SITE DESCRIPTION The site was previously constructed for a well pad and has been graded for that use. Of the 40 acre overall property, 2.11 acres that are currently graded and unused are proposed for the storage area. The surrounding area is primarily agriculture, residential and oil and gas development. There are several residences in the vicinity with one being 'l,OO0 ft. to the south and another 1,000 ft. to the east (property owner). Another residence is located approximately 1,500 ft. to the west. The surrounding zoning is Ruralwith some public land nearby. III. PUBLIC COMMENTS AND REFFERAL AGENGY COMMENTS Public Notice was provided for the Board's public hearing in accordance with the Garfield County Land Use and Development Code as amended. No public comments have been received at this time. Comments from referral agencies and County Departments are summarized below and attached as Exhibits. 1.Garfield County Consulting Engineer, Chris Hale, Mountain Cross Engineering: (See Exhibits 12). Comments from Mr. Hale indicate that he has no comments on the proposed development. / t Garfield County Road and Bridge Department: (See Exhibit 11) . Comments stated that Road and Bridge has no objection to the development. Garfield County Vegetation Manager: (See Exhibit 13) . Comments indicate that the submitted information is satisfactory and that no revegetation security is required. Grand Valley Fire Protection District: (See Exhibit 14) . The access drive has an incline over 10% (noted at 10.3%) which is in excess of IFC standards. The District is going to be purchasing a remote area response engine in the near future that will be able to handle steeper grades. The District wants the Applicant to understand that longer response times will result from this steep grade. . The Response Plan needs to be updated to include an accurate contact numbers for both the Grand Valley Fire Protection District and the Parachute Fire Department. These phone numbers need to be corrected in the Emergency Response Plan. Colorado Parks and Wildlife: (See Exhibit 10) . Noted that because this is a previously disturbed site, minimal impact is expected on wiHlife. 6. Other agencies that did not submit comments include: (a) the Colorado Department of Public Health and Environment (Water Quality Control Division and Air Pollution Control Division) and (b) Garfield County Environmental Health. IV. STAFF COMMENTS AND ANALYSIS ln accordance with the Land Use and Development Code, the Applicant has provided detailed responses to the Submittal Requirements and applicable sections of Article 7, Divisions 1,2, and 3, including Section 7-1001 lndustrial Use Standards. The Application materials include an lmpact Analysis and related consultant reports, technical studies, and plans. 2. 3. 4. 5. 8 7-'101 - 103: Zone District Requlations, Comprehensive Plan & Compatibilitv The proposed use demonstrates general conformance with applicable Zone District provisions contained in the Land Use and Development Code and in particular Article 3 standards for tfie Rural zone district. ' The Comprehensive Plan 2030 designates the site as RMH (Residential Medium/High Density). Excerpts from the Land Use Description Section Chapter 2 and Section 8, Natural Resources and Section 9, Mineral Extraction are provided below. Chapter 2 - Land Use Designations Residentiat Medium High (RMH): Small farms, esfafes, and clustered residential subdivisions; density determined by degree of clustering and land preserved in open condition: 0%o open land = 1 du per -6 acres 50% open land = 1 du per 4 acres 70% open land = 1 du per 2 acres Secfion I - Natural Resources /ssues *The county maintains high air quality standards, however there may be a propensity for air pollutants to exist in the western part of the county Goals 1. Ensure that natural, scenic, ecological, and critical wildlife habitat resources are protected and /or impacts mitigated. 4. Ensure the appropriate reclamation of land after extraction processes. Policies1. The County will encourage and cooperate with the protection of critical habitat including state and federally protected, th reatened, or endangered species. Section 9 - Mineral Extraction Goals 2. Ensure that mineral extraction activities mitigate their effecfs on the natural environment, including air quality, water quality, wildlife habitat or important visual resources. 3. ln working with mineral extraction projects, the county wilt protect the public health, safety and welfare of its citizens. Policies 1. Garfield County recognizes that surface and mineral owners have certain tegal rights and privileges, including the right to extract and develop,these interests. Private property owners also have certain legat rights and priviteges, including the right to have the mineral estate developed in a reasonable manner and to have adverse impacts mitigated. The property rights of minerallessees must be balanced with the rights of private property owners and the general public. 2. Minerat resource extraction activities will protect critical wildlife habitat as identified by state and federal agencies. Development within fhese designations that cannot be designed, constructed and conducfed so as fo have a minimum adverse impact upon such habitat or these wildlife species shall be discouraged. 3. Natural drainage patterns will be preserued or mitigated so the cumulative impact of mineral extraction activities will not cause storm drainage/ftoodwater patterns to exceed the capacity of natural or constructed drainage ways, or to subiect other areas to increased flooding, erosion or sedimentation or result in pollution of streams, rivers or other natural bodies of water. 4. Facitities that are appurtenances to oil/ gas development activities (compressors, etc.) are considered appropriate in all land uses so long as they meet the respective mitigation requirements of the LUDC to maintain compatibility with surrounding land uses. The location and design of the proposed facility is in general conformance with the Comprehensive Plan Policies subject to proper mitigation of impacts. The Application has also provided information indicating the character of the area and adjacent land uses. The request demonstrates general compatibility with adjoining usbs that are primarily oil and gas exploration/production, limited residential and agricultural. 7-104 & 105: Source of Water & Waste Water Svstems The Application represents that the facilities will be operated with minimal staff activities. The proposal demonstrates that the uses will be adequately served by provision of waier in individual staff vehicles and provision of portable toilets at numerous sites in the surrounding Noble Energy fields. 7-106: Public Utilities No public utilities are required for operation of the facility. 10 7-107: Access & Roadways The Applicants access their property from County Road 306 via a 0.5 mile long access road maintained by Noble Energy. The submittals include general descriptions of the roadway as currently in, use and a signed engineered study that identifies deviations in , the road design from those identified in Section 7-107, specifically the requirements for ditch width and cross slope. Despite these deviations, the study, conducted by Olsson and Associates and signed by two Professional Engineers, states that "The road functions adequatety as built and is typical of existing roads providing access to natural gas production in Garfield County." Section 4-118 allows for waivers from the Standards in the LUDC provided the waivers achieve the intent of the Code and impose no greater impact on adjacent property owners. In addition, Section 7-107 of the LUDC does allow for deviations from ditch width if they are determined to be adequate by an engineer. The Olsson and Associates study, as noted previously, does indicate that the road is adequate and as a result, Staff believes these standards are met. Although such discretion is not anticipated in the LUDC for cross slope, the Applicant has requested a waiver from this standard. As the cross slope is the only dimensional requirement that would be impacted by the waiver and an engineering review has found the road to be adequate, Staff recommends granting the waiver. The Applicant submitted a Basic Traffic Analysis that indicates that the site will have a traffic demand of one round-trip (2 ADT) of a light vehicle (pickup truck) per day. ln addition, one heavy truck is expected to access the site every week. This amounts to a maximum of 1o/o of traffic on County Road 300 and 12o/o on CR 306. 7-108: Natural Hazards The Application provides significant information on natural hazards including information on soils, geology, and slopes associated with the site which were developed by a qualified geologist. The information supports a determination that the proposed use is not subject to significant natural hazard risks. However, the study does state that in relation to slope, "engineering controls will need to be taken into consideration with the proposed development." Because no structures are proposed on site, Staff is of the opinion that this risk is manageable and will pose a limited public safety risk. 7-109: Fire Protection The Application includes the Emergency Response Plan for the site. The Application was referred to the Grand Valley Fire Protection District who provided valuable feedback on response times and contact information updates for Nobles Emergency Response PIan. Staff understands that the Applicant has updated the contact information in the Emergency Response Plan accordingly. No structures are proposed for the storage areas. 11 7-201 : Asricultural Lands With little to no new disturbed areas and fencing for the storage area, minimal if any impact on agricultural land is anticipated. There are no irrigation ditches located within the perimeter of the site. 7-202: Wildlife Habitat Areas The Applicant has provided a wiHlife habitat study completed by Olsson and Associates (dated December 2013). The study concluded that because the site was previously disturbed, there is little additional impact expected to wildlife. In addition, the Applicant is proposing a fence surrounding the storage area. No other threatened, endangered, proposed, candidate or other sensitive species were noted to occur in the project area. However, several noxious weeds were found on the site. A recommendation from the study suggests that a follow-up site visit be conducted during the growing season in order to verifl7 the noxious weed species. Staff suggests a Condition of Approval that requires a follow-up site visit to positively identify the noxious weeds on the site. The follow-up visit results should then be reviewed and accepted by the Garfield County Vegetation Manager prior to issuance of the Land Use Change Permit. Colorado Parks and Wildlife submitted comments (Exhibit 10). lt is noted that because the area is previously disturbed, negligible impacts to flora and fauna are expected. 7-203: Protection of Water Bodies The site location is not in close proximity of an active water body. The nearest water feature is Spring Creek which is located approximately 1,400 feet from the subject area. Due to this distance, impacts to water bodies are not anticipated. 7-204: Drainaqe and Erosion (Stormwater) The Applicant has provided a copy of the Storm Water Management Plan (SWMP). The Applicant has also provided a Grading and Drainage Plan. The Garfield County contract engineer has reviewed these documents and has no additional comments. Staff feels that the Drainage and Erosion control plans as submitted meet the standards of the LUDC. 7-205 Environmental Quality The storage facilities wil! not have hazardous materials onsite and as a result, the stored materials should not impact water quality. !n addition, the facility will no generate 72 air emissions except for those typical of motor vehicles accessing the site. To this end, the facility is not expected to impact air quality and does not require a permit from the CDPHE. 7-206: Wildfire Hazards No structures are proposed. The Grand Valley Fire Protection District commented that because the access road is over a 10% grade, the operator should expect longer response times. The facility is not located within a "very high" wildland fire susceptibility designation according to the Community Wildfire Protection Plan. ln addition, no fuels or other combustible material will be stored onsite and no buildings will be constructed onsite with shake roofs. 7-207 Natural and Geoloqic Hazards See Section 7-108, above. 7-208: Reclamation The Applicant has included a reclamation plan that addresses re-vegetation and reclamation. The facility has an expected life of 30 years. At this time, the site will be reclaimed in accordance with the submitted plan. As no additional grading or site disturbance is expected, no security will be necessary. 7-301 & 302: Compatible Desiqn. Parkinq. and Loadinq The proposed use is consistent with and compatible with typical oil and gas exploration and production activities. Large areas of the site plan are available for parking, circulation, and loading activities. 7-303: Landscapinq As an industrial use, landscaping submittals and standards are not applicable to the proposal. 7-304: Liohtinq Lighting shall be limited to down directed, shielded and internally oriented fixtures in accordance with the County's lighting standards. 7-305 Snow Storaqe Adequate portions of the site plan including areas adjacent to the proposed storage area are available for snow storage. 13 7-306 Trails Trails standards are generally not applicable based on the industrial nature of the proposal and surrounding uses. 7-1001 INDUSTRIAL USE STANDARDS The Applicant represents that the facility will comply with all the lndustrial Use Standards contained in Section 1001 with exception to Section 7-1001(B), Setbacks. The Applicant has requested a waiver from SectionT-1001(B) as is further discussed below. The following summary addresses the applicable provisions. A. Residential Subdivisions The facility is located on a large tract of property in a remote area of Garfield County and is not within a platted subdivision. B. Setbacks The proposed facility is 30 feet from the property lines and will not be able to meet the 100 foot setback as prescribed in the LUDC. To this end, the applicant has requested a waiver from this standard. ln accordance with the LUDC, the Applicant has responded to the applicable waiver criteria. The Applicant has represented the following: D'. Stoing 3. Shall be a minimum of 100 feet from an adjacent property line. A waiver of standards request shall be considered based on the following criteria: 3. Achieves the intent of the subject standard to the same and better degree than the subject standard: Response: The intent of the setback standard is to provide separation between dissimilar uses. The proposed storage area would be approximately 30 feet from an adjacent property line located directly west of the laydown yard. This adjacent property located to the west is approximately 59 acres in area and contains agricultural buildings, irrigated hay fields and oil and gas production facilities. lmmediately west of the laydown yard area is an access road to an oil and gas production facility. lmmediately west of this access road is a well pad with production equipment. A residence is located approximately 1500 feet west of the storage area on another parcel. The proposed setback does not significantly reduce the separation between the residential use located to the west and the laydown yard. The established oil and gas production facilities in the area are located closer to this residence than the proposed laydown yard. 4. lmposes no greater impacts on adjacent properties than would occur through compliance with the specific requirements of this Code. Response: Full compliance with the code would increase the distance between the laydown yard and the residence to the west by less than an additional 5 percent. The proposed setback would not impose an additional impact on the residential use than it would under the full standard. Following a visit to the atea, Staff concurs with the Application that the requirements to grant this setback waiver are satisfied. To this end, Staff recommends granting a waiver from Section 7-1001(B) and Section 7-1001 (DX3). C. Concealino and Screeninq The site is visible from CR 306 and by a couple residences in the area. However, the site is setback nearly 0.5 miles from the public roadway and is between 1000 and 1500 feet from any neighboring residence. !n addition, due to other natural gas activities in the immediate vicinity, the proposed laydown yard is generally within character of the area. D. Storins The materials to be stored on the site will be industrial equipment that will not be transferred off the property by any foreseeable natural causes. No hazardous materials will be stored on the site, however, all industrial products and wastes will be stored in accordance with all applicable state and federal regulations. See the above discussion in Section B regarding setbacks. E. lndustrialWastes No hazardous wastes will be stored in the facility. F. Noise This facility is not anticipated to generate any noise. Topography, geographical features and distance provide for any Ioading and unloading noise mitigation. G. Ground Vibration No ground vibrations are expected from the site. H. Hours of Operation The facility will operate during daylight hours and in compliance with the LUDC. L lnterference. Nuisance. or Hazard No other nuisance or ground vibration hazards are anticipated based on type of use, existing operation, COGCC compliance, and the remote location. 15 V. SUPPLEMENTAL AND ADDITIONAL STAFF ANALYSIS No supplemental materials were submitted after the application was determined Technically Complete. VI. SUGGESTED FINDINGS 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. The hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons the proposed Land Use Change Permit for Noble - Ramos Storage Facility is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That with the adoption of conditions, the application is in general conformance with the 2030 Comprehensive Plan, as amended. 5. That with a waiver from the roadway standards, Primitive/Driveway Cross Slope, the application has adequately met the requirements of the Garfield County Land Use and Development Code, Section 7-107. 6. That with a waiver from the lndustrial Use and Storage Setback Standards, the application has adequately met the requirements of the Garfield County Land Use and Development Code, Section 7-1001. 7. That with the adoption of the Conditions of Approval the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. VII. RECOMMENDATION The following recommended conditions of approval are provided for the Board of County Commissioners consideration. 1. That all representations made by the Applicant in the application shall be conditions of approval, unless specifically altered by the Board of County Commissioners. 2. That the operation of the Noble, Ramos Storage Facility shall be done in accordance with all applicable Federal, State, and local regulations governing the operation of this type of facility. 16 3. Gonditions Prior to lssuance The Applicant shall conduct a follow-up evaluation during the growing season of the noxious weeds on the site. This follow-up report and updated control plan shall be submitted and accepted by the Garfield County Vegetation Manager prior to issuance of the Land Use Change Permit. Other Conditions The facility shall maintain compliance with Storm Water Management Plan, Drainage and Grading Plans and Reclamation for the site. The Applicant shall control fugitive dust during the operation of the site. The facility shall maintain compliance with Section 7-306 Lighting, with all lighting to be directed inward and doward toward the interior of the site. Facilities and storage tanks shal! be painted a non-glare neutral color to lessen any visual impacts. I found two things to address. The 10.3 percent grade is over the allowed IFC code requirement, however the Fire District is in the process of purchasing a remote area response Engine. This apparatus is designed to handle the steeper inclines of our remote areas. Will the grade being over the l0 percent incline Noble Energy should now that this could delay our response time if there is an emergency on site. The other issue that hasn't been resolved in the past is the contact Name and number for the Fire District. It states in Noble Energies Emergency Response Plan under the Piceance Asset Phone List as Parachute Fire Department with a 970-285-7711, these are both incorrect. They should state Grand Valley Fire Protection District and phone numbers should be 911 for an emergency and970-285-9119 or 970- 625-8095 for non-emergency calls. I have a letter from December 16, 2010 (attached to email) stating these errors need to be fixed that went to both Noble Energy and Olsson Associates, Mike Markus. I will copy this letter to Lorne Prescott with Olsson Associates since he is listed as the contact for this project. Even with the Fire Districts review of the plans it is the responsibility of the owner to make sure the building complies with the International Fire Code 2009 Edition. Such housing shall be of a temporary nature, and at the expiration or other termination of the Minor Permit, all structures, foundations and associated infrastructure shall be completely removed.
