I. GENERAL PROJECT DESCRIPTION
The Applicant is requesting a Limited lmpact Review for a 2.5 acre Storage area
(laydown yard) within a 5.74 acre site that is already permitted for a compressor
station. The site was previously permitted for a compressor station under Resolution
2011-68. The layout for the compressor station left the 2.50 acres vacant that is now
proposed to be used for Storage. The Applicant has represented that there will be no
conflicts between the proposed Storage area and the existing compressor station. ln
addition, all storage will occur on already graded and disturbed land. As a result, no
additional grading or site disturbance will occur.
The facility will be located about 3.5 miles southeast of Rulison and surrounded by
primarily oil and gas development as well as limited agriculture. The site is proposed to
be fenced and hazardous materials will not be stored at this location. As employees will
only be onsite to pick up and drop off equipment, no water or wastewater facilities are
proposed.
The traffic study as submitted states that the site will generate 2 vehicle trips per day
(one round trip) as well as one heavy truck trip every two weeks. This correlates to a
maximum of a 2o/o increase in traffic on County Roads.

II. LOCATION - SITE DESCRIPTION
The site was previously constructed for a compressor station and has been developed
for that use. Of the 5.74 acre compressor station site, 2.5 acres that are currently
unused are proposed for the storage area. The surrounding area is primarily native
vegetation and developed for oil and gas. There is limited residential or agricultural
development in the surrounding area. The surrounding zoning is Rural with some
public land nearby.
III. PUBLIC COMMENTS AND REFFERAL AGENCY COMMENTS
Public Notice was provided for the Board's public hearing in accordance with the
Garfield County Land Use and Development Code as amended. No public comments
have been received at this time. Comments from referral agencies and County
Departments are summarized below and attached as Exhibits.

. Noted atypical calculations in the drainage calculations and requested that this
be expliined. This is particularly important in relations to the detention
calculations.. Noted that the vegetation assessment recommends evaluation in the spring.
. Requested that the traffic analysis break out the impact based on the use of the
site (delivery of materials, compressor use and laydown use).
Garfield county Road and Bridge Department: (see Exhibit 11)
. Comments stated that Road and Bridge would like to have the brush cleared
away from the south side of the driveway for better visibility.
Garfield county Vegetation Manager: No Comments Received.
Garfield County Environmental Health: (See Exhibit 13)
. Requests that the applicant follow dust mitigation procedures.
Colorado Parks and Wildlife: (See Exhibit 10)
. Noted that because is this is a previously disturbed site, minimal if any impact is
expected on wildlife.
Other agencies that did not submit comments include: (a) the Colorado
Department of Public Health and Environment (Water Quality Control Division and
Air Pollution Control Division) and (b) Colorado River Fire Rescue.
IV. STAFF COMMENTS AND ANALYSIS
ln accordance with the Land Use and Development Code, the Applicant has provided
detailed responses to the Submittal Requirements and applicable sections of Article 7,
Divisions 1, 2, and 3, including Section 7-1001 lndustrial Use Standards. The
Application materials include an lmpact Analysis and related consultant reports,
technical studies, and plans.
The proposed use demonstrates general conformance with applicable Zone District
provisions contained in the Land Use and Development Code and in particular Article
lll standards for the Rural zone district.
The Comprehensive Plan 2030 designates the site as RMH (Residential Medium/High
Density). Excerpts from the Land Use Description Section Chapter 2 and Section B,
Natural Resources and Section 9, Mineral Extraction are provided below.

4. Ensure the appropriate reclamation of land after extraction
processes.
Policies1. The county will encourage and cooperate with the
protection of critical habitat inctuding state and federally protected,
threate ned, or end angered sPecies.
Section 9 - Mineral Extraction
Goals 2. Ensure that mineral extraction activities mitigate their effects on
the natural environment, including air quatity, water quality, wildlife habitat
or important visu al resources'
3. ln working with mineral extraction projects, the county will protect
the public health, safety and welfare of its citizens'
Policies
1. Garfield County recognizes that surface and mineral owners
have certain legat rights and privileges, including the right to
extract and develop these rnferests. Private property owners also
have certain legal rights and privileges, including the right to have
the mineral esfafe devetoped in a reasonable manner and to have
adverse impacts mitigated. The property rights of mineral /essees
must be balanced with the rights of private property owners and
the general public.
2. Minerat iesource extraction activities will protect critical wildlife
habitat as identified by state and federal agencies. Development
within fhese designations that cannot be designed, constructed
and conducted so as to have a minimum adverse impact upon
such habitat or fhese witdtife species shalt be discouraged.
3. Natural drainage patterns wilt be preserved ar mitigated so the
cumulative impact of mineral extraction activities will not cause
starm drainage/ftoodwater patterns to exceed the capacity of
natural or coistructecl drainage ways, or to subiect other areas to
increased flooding, erosion ar sedimentation or result in pollution
of sfreams , rivers or other natural bodies of water'
4. Facitities that are appurtenances to oil/ gas development
activities (compressors, etc.) are considered appropriate in all land
uses so long as they meet the respective mitigation requirements
of the LUDC to maintain compatibility with surraunding tand uses'
The location and design of the proposed facility is in general conformance with the
Comprehensive Plan Policies subject to proper mitigation of impacts.
The Application has also provided information indicating the character of the area and
adjacent land uses. The request demonstrates general compatibility with adjoining
us-es that are primarily oil and gas explorationiproduction and agricultural associated
with cattle grazing.
7-104 & 105: Source of Water & Waste Water Svstems
The Application represents that the facilities will be operated with minimal staff
activities. The proposal demonstrates that the uses will be adequately served by
provision of waier'in individual staff vehicles and provision of portable toilets at
numerous sites in the surrounding Noble Energy fields.
7-106: Public Utilities
No public utilities are required for operation of the facility.
7-107: Access & Roadwavs
The Applicant's access their property from County Road 350 via a756 foot long access
road maintained by Noble Energy. The submittals include general descriptions of the
roadway a, "rrr"nily
in use ano i signed engineered study that identifies deviations in
the road design from those identified in Section 7-107, specifically the requirements for
Right-of-Wry (nOW), ditch width and cross slope. Despite these deviations, the study,
co-nducted Uy btsson and Associates and signed by two Professional Engineers, states
that "This access road is typical of roadways providing access to natural gas
production facilities in Garfield County. The roadway is adequate for the intended use.'
Section 4-118 allows for waivers from the Standards in the LUDC provided the waivers
achieves the intent of the Code and impose no greater impact on adjacent property
owners. ln addition, Section 7-107 of the LUDC does allow for deviations from ROW
width and ditch width if they are determined to be adequate by an engineer. The
Olsson and Associates study, as noted previously, does indicate that the road is
adequate and as a result, Staff believes these standards are met. Although such
discretion is not anticipated in the LUDC for cross slope, the Applicant has requested a
waiver from this standard. As the cross slope is the only dimensional requirement that
would be impacted by the waiver and an engineering review has found the road to be
adequate, Staff recommends granting the waiver.
The Applicant submitted a Basic Traffic Analysis that indicates that the site will have a
traffic demand of one roundtrip (2 ADT) of a light vehicle (pickup truck) per day. ln
addition, one heavy truck is expected to access the site every couple weeks' This
amounts to a maximum of 2o/o of traffic on County Road 350 and 329' Chris Hale,
Garfield County contract engineer, did note that the Applicant should breakout the
traffic impact by use that will impact the access point to County Road 350 (compressor
station tiips, liydown yard trips and material delivery trips). While this information
would be usefui, the Application was reviewed by Garfield County Road and Bridge
who did not share the concern. To this end, Staff feels that although the additional
information would have been good to have in the original submittal, it is not necessary
to demonstrate compliance with the LUDC.
7-108: Natural Hazards
The Application provides significant information on natural hazards including
information on soils, geology, and slopes associated with the site which were
developed by a qualified geologist. The information supports a determination that the
proposed ,r" is not subject to significant natural hazard risks. However, the study does
staie that in relation io slope, "engineering controls will need to be taken into
consideration with the proposed development." The Garfield County contract engineer,
Chris Hale, has identified some discrepancies with the drainage calculations that will
need to be reevaluated and explained in order to ensure adequate drainage and slope
stability.
7-109: Fire Protection
The Application includes the Emergency Response Plan for the site. The Application
was referred to Colorado River Fire Rescue with no comment received. No structures
are proposed for the storage areas.
7-201: Aqricultural Lands
With little to no new disturbed areas and fencing for the storage area, minimal if any
impact on agricultural land is anticipated. There are no irrigation ditches located within
the perimeter of the site.

7-202: Wildlife Habitat Areas
The Applicant has provided a wildlife habitat study completed by Olsson and
Associates (dated December 2013). The study concluded that because the site was
previously disturbed, there is little additional impact expected to wildlife. ln addition, the
Applicant is proposing a fence surrounding the storage area'
No other threatened, endangered, proposed, candidate or other sensitive species were
noted to occur in the projeciarea. However, several noxious weeds were found on the
site. A recommendation irom the study suggests that a follow-up site visit be conducted
during the growing season in order to verify the noxious weed species. Staff suggests
a Condition of A[proval that requires a follow-up site visit to positively identify the
noxious weeds on the site. An eradication plan will then need to be developed and
submitted to the Garfield Count Vegetation Manager for review and acceptance. The
weeds will need to be eradicated in accordance with this plan prior to issuance of the
Land Use Change Permit.
Colorado parks and Wildlife submitted comments (Exhibit 10). lt is noted that because
the area is previously disturbed, negligible impacts to flora and fauna are expected.
7-203: Protection of Water Bodies
The site location is not in close proximity of an active water body. The nearest water
feature is Spruce and Cache Creeks which are located approximately 1,000 feet from
the subject area. Due to this distance, impacts to water bodies are not anticipated.
7-204: Drainaoe and Erosion (Stormwater)
The Applicant has provided a copy of the Storm Water Management Plan (SWMP).
The Applicant has also provided a Grading and Drainage Plan. The Garfield County
contraci engineer has reviewed these documents and has found discrepancies in the
calculations. Staf recommends that as a Condition of Approval, the Applicant provide
an explanation of the calculations or revised calculations, as necessary, to be reviewed
by the contract engineer. This issue will need to be resolved to the satisfaction of the
contract engineer prior to issuance of the Permit.
7-205 Environmental Qualitv
The storage facilities will not have hazardous materials onsite and as a result, the
stored materials should not impact water quality. ln addition, the facility will no generate
air emissions except for those typical of motor vehicles accessing the site. To this end,
the facility is not expected to impact air quality and does not require a permit from the
CDPHE.

7-206: Wildfire Hazards
No structures are proposed and no comments were received from the Fire Protection
District. The faciliiy is not located within a "very high" wildland fire susceptibility
designation according to the Community Wildfire Protection Plan. ln addition, no fuels
or other combustible material will be stored onsite and no buildings will be constructed
onsite with shake roofs.
7-207 Natural and Geologic Hazards
See Section 7-108, above.
7-208: Reclamation
The Applicant has included a reclamation plan that addresses re-vegetation and
reclamation. The facility has an expected life of 30 years. At this time, the site will be
reclaimed in accordance with the submitted plan. As no additional grading or site
disturbance is expected, no security will be necessary.
7-301 & 302: Compatible Desiqn, Parkinq, and Loadinq
The proposed use is consistent with and compatible with typical oil and gas exploration
and'production activities. Large areas of the site plan are available for parking,
circulation, and loading activities.
As there will not be any gas or electric powered permanent equipment on the site, it is
anticipated that compliante with COGCC regulations will be achieved and maintained.
7-303: Landscapinq
As an industrial, use landscaping submittals and standards are not applicable to the
proposal.
7-304: Liohtinq
Lighting shall be limited to down directed, shielded and internally oriented fixtures in
accordance with the County's lighting standards.
7-305 Snow Storaoe
Adequate portions of the site plan including areas adjacent to the proposed storage
area ate available for snow storage.

7-306 Trails
Trails standards are generally not applicable based on the industrial nature of the
proposal and surrounding uses.
7-1001 INDUSTRIAL USE STANDARDS
The Applicant represents that the facility will comply with all the lndustrial Use
Standards contained in Section 1001 . The following summary addresses the applicable
provisions.
A. Residential Subdivisions
The facility is located on a large tract of property in a remote area of Garfield County
and is not within a platted subdivision.
B. Setbacks
The proposed facility is over 100 feet from the property lines and will meet the
applicable setbacks.
C. Concealing and Screeninq
The site is effectively screened by topography and geographical features.
D. Storinq
The materials to be stored on the site will be large industrial equipment that will not be
transferred off the property by any foreseeable natural causes. No hazardous materials
will be stored on the site, however, all industrial products and wastes will be stored in
accordance with all applicable state and federal regulations.
See the above discussion in Section B regarding setbacks.
E. lndustrialWastes
No hazardous wastes will be stored in the facility.
F. Noise
The Applicant represents that COGCC noise limits will be adhered to. This facility is
not anticipated to generate any noise. Topography, geographical features and distance
provide for any loading and unloading noise mitigation. The previously permitted
compressor station has been in operation and has not experienced noise compliance
issues.
G. Ground Vibration
No ground vibrations are expected from the site.

H. Hours of Operation
The facility will operate during daylight hours and in compliance with the LUDC.
l. lnterference, Nuisance. or Hazard
No other nuisance or ground vibration hazards are anticipated based on type of use,
existing operation, COGCC compliance, and the remote location.
V. SUPPLEMENTAL AND ADDITIONAL STAFF ANALYSIS
No supplemental materials were submitted after the application was determined
Technically Complete.
VI. SUGGESTED F!ND!NGS
1. That proper public notice was provided as required for the hearing before the
Board of County Commissioners.
2. The hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that meeting.
3. That for the above stated and other reasons the proposed Land Use Change
Permit for Noble - Rulison Storage Facility is in the best interest of the health, safety,
convenience, order, prosperity and welfare of the citizens of Garfield County.
4. That with the adoption of conditions, the application is in general conformance
with the 2030 Comprehensive Plan, as amended.
5. That with the adoption of waiver from the roadway standards, Primitive/Driveway
Cross Slope, the application has adequately met the requirements of the Garfield
County Land Use and Development Code, Section 7-1O7.
6. That with the adoption of the Conditions of Approval the application has
adequately met the requirements of the Garfield County Land Use and Development
Code, as amended.
VII. RECOMMENDATION
The following recommended conditions of approval are provided for the Board of
County Commissioners consideration.
1. That all representations made by the Applicant in the application shall be
conditions of approval, unless specifically altered by the Board of County
Commissioners.

2. That the operation of the Noble, Rulison Storage Facility shall be done in
accordance with all applicable Federal, State, and local regulations governing the
operation of this type of facility.
Gonditions Prior to lssuance
3. The Applicant shall provide a greater explanation of the post development
coefficients contained in the Grading and Drainage Report. ln addition, the
detention volumes need to be verified based on these coefficients. This
information shall be submitted to the Garfield County contract engineer for review
and acceptance prior to issuance of the Land Use Change Permit.
4. The Applicant shall conduct a follow-up evaluation during the growing season of
the noxious weeds on the site. This follow-up shall include a plan to eradicate any
State or County listed noxious weeds. ln addition, all noxious weeds shall be
eradicated following the plan as outlined in the report. This follow-up report,
eradication plan and evidence that the identified noxious weeds have been
eradicated shall be submitted and accepted by the Garfield County Vegetation
Manager prior to issuance of the Land Use Change Permit.
5. Prior to issuance of the Land Use Change Permit, the Applicant shall demonstrate
to Road and Bridge that the brush has been cleared on the south side of the
access driveway.
Other Conditions
6. The facility shall maintain compliance with Storm Water Management Plan,
Drainage and Grading Plans and Reclamation for the site.
7. The Applicant shall control fugitive dust during the operation of the site.
8. The facility shall maintain compliance with Section 7-306 Lighting, with all lighting
to be directed inward and doward toward the interior of the site. Facilities and
storage tanks shall be painted a non-glare neutral color to lessen any visual
impacts.
g. The Applicant shall comply with their Noxious Weed Management Plan including
the best management practices.

southeast of the town of Rulison, CO. After a review of the planning documents, it has been determined
that the proposed land use change will not have an overly adverse impact to local wildlife. As stated in
the application, this location has previously been approved for a compressor station and the addition of
the 2.5 acre storage facility within the approved area will not result in additional land disturbance or a
substantial increase in activity or vehicular traffic.

This office has performed a review of the documents provided for the Limited Impact Review
Application of the Rulison Laydown Yard. The submittal was found to be thorough and well
organized. The following comments were generated:
1. Concerning the drainage report, the post development coefficients are less than existing and
causing the post d"r"iop*"nt flows to be less ihan existing. This would be atypical' The
applicint should explain these coefficients in gteater detail.
Z. Detention volumes may need to be verified based on the coefficients determined above'
3. The vegetation assessment recommended evaluation in the spring, after plants are growing'
The A[plicant should verify if this was performed and if there are any additional
recommendations.
4. The Applicant should break out the traffic for the project based on each use for the site:
delivery of materials, compressor use, and laydown use. The traffic study should show what
was previously approved and then also the impacts associated with the proposed application'

Recitals
A. The Board of County Commissioners of Garfietd County, Colorado, received an
application for a Land Use Change Permit for a Limited Impact Review for a Compressor
Station and related support infrastructure, also known as the Noble Energy Rulison Compressor
Station, on property owned by Joan L. Savage. The Application was submitted in conjunction
with Nobte Energy Inc.
B. The compressor station is located on 5.14 acres of an approximately 663 acre
parcel owned by Joan L. Savage. It is accessed by private roads offof County Road 329. The
site is approximately 3.5 miles southeast of Rulison, Colorado.
C. The Compressor Station site is located u'ithin the parcel of land described in the

Recorder. The compressor site is located within the Ell2, Section 8, Township 7 South, Range
94 West of the 6*'p.-., Garheld County, Colorado and further described in the Site Plan
attached as Exhibit "A" and the Site Legal Description attached as Exhibit "B".
D. The subject property is contained within the Rural Zone District and a Land Use
Change Permit for a Compressor Station requires approval through a Limited Impact Review
Process by Garfield County.
E. The Board of County Commissioners is authorized to approve, deny or approve
with conditions a Land Use Change Permit for a Compressor Station, pursuant to Sections 1-301
and 4-105 of the Garfield County Unified Land Use Resolution of 2008, as amended.
F. The Board of County Commissioners opened the public hearing on the 3'd day of
October, 2011 upon the question of whether the Land Use Change Perrnit applicatioq LIPA
6835, should be granted or denied, during which hearing the public and interested penons were
given the opportunity to express their opinions regarding the applicafion.
G. The Board of County Commissioners closed the public hearing on the 3'd day of
October, 20ll to make a final decision.
H. The Board of County Commissioners on the basis of substantial competent
evidence produced at the aforementioned hearing has made the fotlowing determinations of fact:
l. That proper public notice was provided as required for the hearing before the
Board of County Commissioners.
2. That the hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted or could be
submitted and that all interested parties were heard at that meeting.
3. That for the above stated and other reasons, the Land Use Change Permit for a
Compressor Station is in the best interest of the health, t"f"ty, morals,
convenience, order, prosperity and welfare of the citizens of Garfield County.
4. That the application, if all conditions are met, is in confonnance with the
applicable Sections of the Garfield County Unified Land Use Resolution of 2008,
as arnended and in general conformance with the Garfield County Comprehensive
Ptan 2030.
