Recitals
A. The Board of County Commissionsrs of Garfield County, Colorado, "Board" received
a request for a Land Use Change Pennit to allow for Storage (laydown yard), as further
described in Exhibit A, Site Plan.
B. The Noble Rulison Storage area is known as the Noble Rulison Laydown Yard is
located on approximately 2.50 acres of a prwiously permitted 5,74 acre compressor site within
an overall 369.39 acre parcel of land owned by Joan L. Savage.
C. The subject property is located within unincorporated Garfield County in the Rural
zone disfrict, approximately 3.5 miles southeast of Rulisorq Colorado accessed by private roads
offof County Roads 329 and 350.

D. Storage may be permitted in the Rural zone district with a Limited Impact Review.
E. The Board is authorized to approve, deny or approve with conditions a Limited Impact
application resulting in issuance of a Land Use Change Permit pursuant to the Garfield County
Land Use and Development Code, as amended.
F. The Board of County Commissioners opened a public hearing on the 21$ day of Ju1y,
2074 for consideration of whether the proposed Land Use Change Permit should be granted or
denied, during which hearing the public and interested persons were given the opportunity to
express their opinions regarding the request.
G. The Board of County Commissioners closed the public hearing on the 27"t day of July,
2014 to make a final decision.
H. The Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determinations of fact:
1. That proper public notice was provided as required for the hearing before the Board
of County Commissioners.
2. The hearing before the Board of County Commissioneni was extensive and complete,
that all pertinent facts, matters and issues were submitted and that all interested
parties were heard at that meeting.
3. That for the above stated and other reasons the proposed Land Use Change Permit for
Noble - Rulison Storage Facility is in the best interest of the health, safety,
convenience, order, prosperity and welfare of the citizens of Garfield County.
4. That with the adoption of conditions, the application is in general conformance with
the 2030 Comprehensive Plan, as amended.
5. That with the adoption of waiver from the roadway standards, PrimitivdDriveway
Cross Slope, the application has adequately met the requirements of the Garfield
County Land Use and Development Code, Section 7-107.
6. That with the adoption of the Conditions of Approval the application has adequately
met the requirements ofthe Garfield County Land Use and Development Code, as
amended.

NOW THEREF'ORE, BE IT RESOL\rED by the Board of County Commissioners of Garfield
County, Coiorado, that:

The forgoing Recitals are incorporated by this reference as part of the resolution.
The Land Use Change Permit for Storage (laydown yard), also known as the Noble
Rulison Facility is hereby approved subject to compliance with the following conditions:
1.That all representations made by the Applicant in the application shall be
conditions of approval, unless specifically altered by the Board of
County Commissioners.
That the operation of the Noble, Rulison Storage Facility shall be done
in arcordance with all applicable Federal, State, and local regulations
governing the operation of this tlpe of facility.
Conditions Prior to Issuance
3. The Applicant shall provide a greater explanation of the post
development coefficients contained in the Grading and Drainage Report.
In addition, the detention volumes need to be verified based on these
coeffrcients. This information shall be submitted to the Garfield County
contract engineer for review and acceptance prior to issuance of the
Land Use Change Permit.
4, The Applicant shall conduct a follow-up evaluation during the growing
season of the noxious weeds on the site- This follow-up shall include a
management plan for all identified State or County listed noxious weeds.
This follow-up report, management plan and evidence that the identified
noxious weeds have at least been initially treated shall be submitted and
accepted by the Garfield County Vegetation Manager prior to issuance
of the Land Use Change Permit.
Other Conditions
The facility shall maintain compliance with Storm Water Management
Plar5 Drainage and Grading Plans and Reclamation for the site.
The Applicant shall control fugitive dust during the operation of the site.
The facility shall maintain compliance with Section 7-306 Liglrting, with
all lighting to be directed inward and downward toward the interior of
the site. Facilities and storage tanks shall be painted a non-glare neutral
color to lessen any visual impacts.
The Applicant shall comply with their Noxious Weed Managernent Plan
