HomeMy WebLinkAbout1.0 ApplicationCounty Roads 331 and 336 Road Vacation/Dedication and Location & Extent May 2014 R E Q U E S T PROJECT NARRATIVE Garfield County Road & Bridge (R&B), on behalf of Gary & Karen Hill, request review of applications for a Location & Extent and Vacation of a County Road. These reviews are requested pursuant to the 2013 Land Use and Development Code, as amended (LUDC) sections 4-108 and 4-111. The current configuration of Jenkins Cutoff and Dry Hollow (CR 336 and 331, respectively) is in the shape of a Y rather than a T intersection. R&B seeks to improve the intersection to a T, or 90 degree, in order to enhance public safety. The proposed improvements will require the County acquire a right-of-way easement for that area necessary to construct the T intersection. Concurrently the owners request that the right-of-way that is no longer necessary for road purposes be vacated. A Road Vacation application requires a Location & Extent review so that the Planning Commission has the opportunity to determine if the proposed improvements and vacation are consistent with the 2030 Comprehensive Plan. Attached is the required submittal documentation for the Road Vacation request and Location & Extent. This documentation is provided to meet the code requirements, specifically: A. The proposed improvements, and related vacation and dedication of right-of-way, is in general conformance to the 2030 Comprehensive Plan, as amended. B. Review criteria for the road vacation include: 1. County Roads 336 and 331 do not provide access to any public lands and access to all properties from CR 336, Jenkins Cutoff, and CR 331, Dry Hollow, will be unaffected by the vacation of the County Roads. 2. The subject county roads do not abut or connect to any property owned by the Federal government, State of Colorado, municipality, County, or special district, where such property or easement constitutes a public park, recreational area, or trail. 3. Use of the subject county roads will be enhanced by the proposed improvements. GENERAL PROJECT DESCRIPTION Road & Bridge seeks to realign the intersection of two roads to create a T at CR 336 and CR 331. This re -alignment necessitates the acquisition of right-of-way on land owned by the Hill family and had resulted in the subject vacate the existing right-of-way that will no longer be necessary for road purposes. County regulations require two processes to accomplish the actions requested — a 'Road Vacation' and a 'Location and Extent'. Separate applications and submittal requirements are required for each process. Location and Extent, Section 4-111 — this is a, process required by State Statute as a companion to requests for road vacations. The Planning Commission is the decision-making body upon holding a public hearing regarding the request. Public notice of the hearing is required to be published, posted and notice sent to adjacent properties. Review criteria include a finding of general conformance of the proposal with the Comprehensive Plan. Road Vacation — this process is defined in section 4-108 of the LUDC including a requirement for Planning Commission recommendation and BOCC decision. Specific approval criteria are included. It is necessary to determine if a ROW deed was ever accepted by the County or if the use of the ROW is prescriptive. It is also necessary to determine if there are existing utilities within the ROW that is requested to be vacated. If so, utility easements will need to be created prior to the vacation of the ROW. If ROW is proposed to be dedicated to the County, the Board of County Commissioners must formally accept that ROW prior to vacating the ROW currently being utilized. II. This intersection is one of the county's intersections that have a lot of Oil and Gas truck traffic on it daily and could be determined by some people as a dangerous intersection. The former intersection was one that the view of oncoming traffic was somewhat blocked by a large pile of dirt looking to the north on CR 331. Your Department worked with the land owner to re -design this intersection and improve it from a "Y" intersection to a "T" intersection which also improved the sight distance both to the north and to the south on 331. Although we have not had any calls in my memory to this intersection, the potential existed for an accident. The safety improvements made at this intersection is appreciated by me, who lives in that area, and by Colorado River Fire Rescue who provides emergency response to that area.
