ORTIZ GRAVEL PIT
GARFIELD COUNTY
August 28, 1981
Corn Construction Co. is requesting a Special Use Permit for a
gravel extraction and processing site. The proposed site is located
5 miles east of Parachute in Lot 3, Section 35, Township 6 South,
Range 95 West, 6th P.M.
The total area to be included in this Permit is 9.9 acres, which
will include the processing site and the gravel pit area.
The present land use of the area is agricultural (grazing.) The
adjoining land use is agricultural (grazing) to the south and east,
gravel pit (Dere Pit) on the west, and the Denver and Rio Grande
Western Railroad to the north.
The existing vegetation on the site consists largely of weeds.
The site has been cultivated at some time in the past.
An area in the southwest corner of the site is covered with salt
grass.
Mining will start on the west side of the property and proceed
to the east. Extracted pit run gravel will be transported to the
processing area to be crushed into road base material. The
processing area will be mined last, with the material being
removed from the site as unprocessed gravel.
AN EQUAL OPPORTUNITY EMPLOYER
Reclamation of the area will consist of placing topsoil on the
slopes and seeding with a seed mixture recommended by the Soil
Conservation Service. The area will be left as a pond with a
shoreline sloping 3 horizontal to 1 vertical from the existing
ground to the water surface.
Traffic is not expected to increase as a result of this operation.
Corn Construction Co. is presently operating at the Dere Pit.
After all material has been removed from the Dere Pit, material
will then be removed from the Ortiz property, so the average number
of vehicle trips per day (45), should remain about the same.
The average number of employees working the gravel pit and the
processing site will be seven. The work hours will be from 7:00
a.m. to 5:00 p.m., 5 days per week.
Pollution control for the gravel pit, processing site and crushing
equipment will be in accordance with the Emission Permit requirement
of the Colorado Department of Health.

RE: Corn Construction Company 404 Permit Application
Corn Construction Company is proposing to construct a haul road between
the Ortiz Pit and Mahaffey Pit as a result of the present access being
closed by the D & RG railroad. It appears that the proposed haul road
could be classified as an "access route." The property is located in the
A/R/RD zone district, which does not allow access routes in any form. An
access route is a special use in the A/I and R/L gentle slopes and lower
valley floor zone districts. It is a conditional use in the other R/L
sub -zone districts.
The Mahaffey pit was permitted by Special Use Permit No. 126 on April 14,
1975. It appears that this permit was extended on December 8, 1980 by
Resolution #80-296. The Ortiz pit was permitted on October 20, 1981 in
Resolution #81-328. The purpose of the application is to connect the
Mahaffey Pit to the Ortiz pit railroad access point. In a sense, this is
an internal haul road, since both pits are operated and permitted by Corn
Construction Company. The problem in interpretation arises from the fact
that the proposed haul road crosses property owned by the D & RG railroad,
that separates the two pits.
Since comments are due to the Corps of Engineers by February 22, 1984, I
would appreciate your comments as soon as possible.
