ACTION BY THE COLORADO WATER POLLUTION CONTROL COMMISSION: WP -33(10-72-2) GARFIELD COUNTY ENVIRONMENTAL HEALTH GLENWOOD SPRINGS, COLORADO B1601 2014 BLAKE AVENUE PHONE 946-7255 May 1, 1974 Gentlemen: Please find attached a repair permit for individual home sewage treatment for Mr. Lee Moss, Box 183, Elk Creek Mobile Home Park, New Castle, Colorado. Mr. Moss originally constructed a 750 gallon septic tank and dry well system approximately five years ago. The dry well has recently failed to receive and absorb the effluent from the septic tank. It is the firm belief of this office after a site inspec- tion on April 29, 1974 that due to an increase in family size, the existing system is inadequate to handle the present loading. To repair the dry well and leave the 750 gallon tank installed would not solve the problem, but only temporarily alleviate it before the same difficulty surfaced again. Therefore, if Mr. Moss is to construct an entirely new individual home sewage treatment system, he would have to comply with Section 4.04.05 of the Garfield County Zoning Resolution since his 14 acre property is less than the two acres minimum. However, in view of the permission granted in Section 5.04 of the Garfield County Zoning Resolution which reads as follows: CHANGE IN USE A non -conforming use shall not be replaced by the use con- sidered to exhibit a greater degree of non -conformity than the existing use; a non -conforming use may be replaced by a use considered to exhibit an equal or lesser degree of non -conformity than the existing use; the degree of con- formity to be determined by the building inspector based on the intent and purpose of this resolution; it is deemed appropriate to allow construction of a complete septic system to conform with existing Garfield County and 1 May 1, 1974 page 2 Colorado State individual home sewage treatment codes. Your review and approval would allow the Moss family to avoid financial hardship and yet have adequate sewage facilities.
