BACKGROUND The Building and Planning Department is in receipt of a Special Use Permit (SUP) application for "Storage, Processing, and Material Handling ofNatural Resource" for a Cuttings Storage Facility on a 27,000-acre property owned by Encana Oil & Gas USA, [nc. The Subject property is located atthe end of County Road 215, northwest of Parachute. This area is formerly known as the UNOCAL property where oil shale processing occurred- More specifically, the location of the proposed storage facility is approximately 2.25 miles northeast of the guard gate. As required in $9.03.04 of the Zoning Regulations, this request was heard by the Board of County Commissioners for a possible referral to the Planning Commission. On July 5, 2005 the Board voted not to refer this item to the Planning Commission. This decision was based on the historic industrial use of the property, the relatively remote location, and the size and impact of the request. 2. PROPOSAL The drilling of natural gas wells generates drill cuttings as formation materials are brought to the surface while the drill casing advances. The cuttings arc typically stored in a reserve pit. The application for this storage facility will store this type of cuttings. Cuttings placed on the site will be stabilized/solidified prior to hansportation to the facility. Stabilized cuttings will not generate water nor present an entrapment hazard to wildlife. At a maximum, 10 cuttings transport truck tips per day in and out of the facility are proposed. Periodically, a small dozrr will spread the cuttings in a 12 inch lift. Cuttings will be compacted by track walking the entire surface with the placement dozer The proposed I acre cuttings storage facility is on top of a spent shale/retortpile which already contains solid waste materials generated by Unocal from oil shale mining and processing operatiors. The expected life of the storage facillty will be I to 3 years. 2. StafrComments: North Parachute Ranch is at the end of a County Road that is gated and manned with a guard shack, which is in operation 24 hours alJmry. The facility is2.25 miles northeast ofthe gate, and is not visible to the public. The cuttings storage facility is in an area isolated from adjoining uses that could be impacted. StaffComments: Due to the size and location of the site, staff does not see the need for security. It shall be at the discretion of the Board to determine whether sectrity is needed. The applicant shall be aware of all sound volume standards and meet all State requirements. (2) Wbration generated: every use shall be so operated that the ground vibration inherently and recurrently generated is not perceptible, without instrumcnE, at any point of any boundary line of the property on which the use is located;. Staff Comments: Due to the size of the property, the proposed use, and the pre-treatrnent of the cuttings, the use will not produce vibration that will affect any adjoining properties. (3) Emissions of smoke and particulate matter: every use shall be operated so as to comply with all Federal, State and County air quality laws, regulations and standards. Staff Comments: If the facility creates smoke or particulate matter, the applicant shall be aware of and meet all air quality standards. StaffComments: No lighting is proposed on the site. (6) Water pollution: in a cose in which potential hazards exist, it shall be necessary to install safeguards designed to comply with the Regulations of the Environmental Protection Agenq before operation of thefacilities may begin. Any other practices will be met for federal or state compliance prior to operation of the facility. 4. SUGGESTED FINDINGS l. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed Special Use Permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in conformance with the Garfield County ZontngResolution of 1978, as amended. 5. STAIT' RECOMEI\IDATION: Staffis recommending the board approve the Special Use Permit to allow a Cuttings Storage Facility with the following conditions. 1. That all representations of the Applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval unless explicitly altered by the Board. 2. That the operation of the facility be done in accordance with all applicable federal, state, and local regulations governing the operation of this type of facility. 3. The County reserves the right to retain outside expertise, at the expense of the applicant / operator of the facility, in order to conduct tests or analyses of the physical nature, water chemistry or groundwater properties on or away from the site. 4. That this facility is for the sole use of the applicant. If any other entities are to be added as users, then they would be subject to an additional SUP as well as rules and regulations as administered by the COGCC. 5. The applicant shall submit a weed inventory and control plan of the subject properfy 6. TO FROM DATE RE MEMORANDUM Board of County Commissioners Building and Planning Department, Richard Wheeler July 5, 2005 Referral of a Special Use Permit for "Storage, Processing, and Material Handling of Natural Resource" cuttings storage facility I. BACKGROLIND The Building and Planning Department received a Special Use Permit (SUP) application for "Storage, Processing, and Material Handling of Natural Resource" for a Cuttings Storage Facility on a 27,000-acre property owned by Encana Oil & Gas USA, Inc located at the end of County Road 215 north of Parachute and is also formerly known as the old I-INICAL property where oil shale processing occurred. The actual location of the proposed storage facility is approximately 2.25 miles northeast of the guard gate. Wagon Wheel Consulting, representing Encana Oil & Gas USA has submitted an impact statement which describes the proposed use, general design of the storage facility, and hours of operation, trips generated, noise, vibration, odor impacts, and impacts to wildlife, soils, and life of structure. The mentioned impact statement is enclosed with this memo for further review. The proposed I acre cuttings storage facility is will be on top of a spent shaleiretort pile which already contains solid waste materials generated by Unocal from oil shale mining and processing operations. II. REOUEST Section 9.03.04 of the Zoning Resolution of 1978, as amended requires that Special Use Permit applications be initially brought to the Board so that the Board may determine if a recommendation from the Planning Commission is necessary. III. STAFF RECOMMENDATION Due to the limited nature of potential impacts to surrounding properties, the remote location of the property such that it is situated at the end of a dead-end county road which is used primarily for industrial traffic serving the existing industrial uses in the area with very limited general population traffic, the fact that the site itself will be situated in an industrial area already characterized by intense industrial activity from the oil shale exploration / processing activities. Of note is the number of trips generated per day will be minimal, having little impact on the general public located on the privately owned 27,000-acre property, Staff recommends the Board direct Staff to schedule a public hearing for the Board and not refer the matter to the Planning Commission. Part II ImPact Statement The location for the cuttings storage facility was selected for a number of beneficial reasons: 1. The proposed location is on top of the spent shale/retort pile which already "ootaior-solid waste materials generated by Unocal from oil shale mining and processing operations. 2. The proposed location is "high and dry" and is located well some distance from and ii higher in elevation than the East Fork of Parachute creek. 3. The proposed location is central to operations on the NPR. This will shorten truck trips and lessen the need for truck travel off the NPR to other facilities located closer to Parachute or Rifle. The cuttings storage facitity does not differ significantty from the past oil shale waste disposal and cunJnt natural gas exploration and production related land uses. The location is relatively remote. -The nearest residence is located approximately 3 miles south of the site. A cuttings storage facility presents relatively benign effects in terms of noise, odor, dus! and visual impact and sufficient distance exists to provide protection to surrounding properties from the minimal impacts of this facility. The facility will be in continuous use and operation 24-hours per day, year-round. However, tire majority of activity at the facility will occur during normal business hours. At maximum usage the facility is expected to require an average of approximately 10 cuttings transport truck trips per day into and out of the new facility. The majority of these -trips wi1 be on existing private roads that already service natural gas operations within the NPR. Cuttings trauf tructs will operate primarily during daylight hours and will be traveling to and from well locations in the area. Heavy trucks already travel the roads in the Nortfr Parachute area, therefore the new facitity is not expected to require specific improvements to the existing roads. It is anticipated that at maximum facility use, 2 d"-p truck trips and one pickup truck trip will occur each business day. These vehicles are for cuttings t uo*port and for one equipment operator. It is expected that these vehicles will come from contactor yards in the Rifle or Parachute area each morning and will return to their yards at the end of each work day. This facility is designed to protect gtoundwater and surface water resources. The storage facitity wili be surriunded by a soil b"*, and will be lined with non-woven geotextile fabric and a single 40-mil high-density polyethylene (FIDPE) or 45-mil Hlpalon liner. The perimeter birm will serve to contain both drill cuttings and run-off water from the 100 year, 24bow storm event and will divert run-on from surrounding areas away from the facility. There will be no sewage or solid waste generated on the site. A security gate and guard shack are located at the end of County Road 215 near the property Uo*a-y. A guard is posted at the gate during peak operating hours (currently ^Z+ iro*r per dayj and after hours the gate is locked. The security gate precludes public access to the site. The adjacent property characteristics and surrounding land uses are such that a visible banier fence should not be necessary. Signage includes the company name and address as well as a 24-hour toll-free emergency phone number' The NPR cuttings storage facility will occupy about 1 acres of an approximately 27,000- acre parcel. Stabilized cuttings will not generate water nor present an entapment hazard to animals' No equipment will be installed at the facility and exposed liner materials will be on the interior of 15" perimeter bemr. Visual impact to the area will be negligible due to the minimal amount of surface equipment at thi site. No public utilities will be needed at the facility. The expected life of the NPR cuttings storage facility is I to 3 years. Reclamation of the facility is outlined in Part VII of this document. ATTACHMENT A SITE DESCRIPTTON NORTH PARACHUTE RANCII CUTTINGS STORAGE tr'ACILITY The site area is located in a remote area along the Parachute Creek drainage north of Parachute in Garfield County. The proposed cuttings storage facility will be located on the top surface of the Unocal retorilspent shale pite. The topography is relatively flat and slopes to the east at an approximate 3;/o grade- The location of the proposed North Parachute Ranch (NPR) facility is underlain by 3 to 5 feet of cover soil and up to 100 feet of,spent shale. The cover soil on the retort pile is a gravelly, sandy silt. Ephemeral East Fork of Parachute Creek runs east to west approximately % mile south of the facility location. 'Ihis drainage will not affect operation of the storage facility. Infonnation from the site-specilic soils investigations indicates ttrat the depth to alluvial ground water near the cuttings facitity is approximately 120 feet below the elevation of the proposed facility bottom. The depth to ground water along with water chemistry, and characteristics of the underiying soil indicate that the site is within a non-sensifive atea. The cuttings facility is designed io protect surface and ground water resources. The pond will be lined with a base 3 to 5 feet of cover soil, overlain by an 8 ounce per square yard non-woven geotextile, 40 mil HDPF, liner, overlain by a second layer of non-woven geotextile (see Attachment D Facility Diagram). lf groundwater is encountered during constuction, monitoring wells will be installed and sampled regularly. ATTACHMENT B DESCRIPTION OF ADJACENT LAND USES I{PR CUTTINGS STORAGE FACILITY 'fhe North Parachute Ranch (NPR) cuttings storage facility location is central to EnCana operations in the area. This will shorten truck trips and reduce the number of tnrcks traveling on darfield County Road 215. The operation of the cuttings storage facility does not differ significanfly from the surrounding land uses, which in the past included disposal of solid waste generated irom oil shale processing and are currently related to oil and gas exploration and production. The location is relatively remote. The closest residence is approximately 3 miles south of the site, with other area residences lying approximately l0 miles south of the site in Parachute. A cuttings storage facility presents relatively benign effects in terms of noise, odor, dust, and visual impart, thereiore sufficient distance exists to provide protection to surrounding properties from the minimal impacts of this facility. ATTACHMENT F STORED MATERIAL PROFILE NPR CUTTTNGS STORAGE FACILITY The material within the NPR cuttings storage facility will consist entirely of cuttings generated from the drilling of natural gas wells on EnCana's North Parachute Ranch property. Cuttings have been characterized by the analysis of 4 samples collected from 4 different well pads on the NPR. Two samples {ue of raw drill cuttings and two samples of stabiliz.ed drill cuttings.
