1' Submit this completed application form (pages 1-4), base fee, and all submittal requirements tothe Garfield county Planning Department.lt witt be received and given to a staff planner whowill review the apprication for technicar compreteness.
2' Once the application is deemed technically complete, the Staff planner will send you a letterindicating the application is complete. ln iddition, the letter will indicate the dates and timesscheduled for your request to be heard before the Planning Commission during a publicmeeting (no notice required) and the Board of County Commis-sioners during a public hearing(notice required)..The Planning Commission will forward a recommendation to the Board ofcounty commissioners to be tons.idered_during a properly noticed public hearing. staff willsend you the appropriate "Public Notice Form(sl)" indicating the time and date of your publichearing and will provide you with a Staff Memorandum regarding your request. (lf Staffdetermines your application to be deficient, a letter will be sent to you indicating that additionalinformation is needed to deem your apprication comprete.)
3' It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the publichearing before the Board of county Commissioners.'lf proper iotice has not occurred, thepublic hearinq will not occur. Notice requirements are as follows:
a. Notice by publication, including the name of the applicant, description of the
subject lot, a description of the proposed amendment and nature of the hearing,
and the date, time and place for the hearing shall be given once in a newspape, ofgeneral circulation in that portion of the County in which the subject property is
located at least thirty (30) but not more than sixty (60) days prioi to the date of
such hearing, and proof of publication shall be presented at hearing by the
applicant.
4. The Applicant is required to appear before the Planning Commission and the Board of County
Commissioners at the time and date of the public meeting / hearing at which time they wiil
consider the request. ln addition, the Applicant shall provide proof it tne hearing before the
Board of County Commissioners that proper notice (publication)was provided.
5. Once the Board of County Commissioners makes a decision regarding the request, Staff willprovide the Applicant with a signed resolution memorializing the action taken by the Board.
Following the Boards' approval, this office will make the approved changes to tne Zoning
Resolution.

Colorado Rocky Mountain School; Application for a Zone Text Amendment
Please consider this letter and its attachments an Application for Zone Text Amendment
to the Garfield County Zoning Resolution of 1978.
As we have discussed, Colorado Rocky Mountain School ("CRMS") desires to have
constructed upon its property a ground mounted solar electric power generating system that will
generate approximately 150kW of electricity. In our discussions about this matter, I inquired
about the sort of land use approval that would be necessary to authorize construction of such a
facility. It is my understanding that you discussed my inquiry with other members of the County
planning and legal staff. You thereafter told me that it was the consensus of the County staff that
because the proposed use is not currently recognized within the Garfield County Land Use Code
CRMS should seek to add the use as a special use within the applicable zone district, and
simultaneously apply for a special use permit. Thus, we are submitting the within Application,
simultaneously with a separate application for a special use permit.
By this Application, CRMS is requesting the following:
1. That a new Section2.02.494 be added to the Garfield County Zoning Resolution
which would read as follows:

generate more than 50kW of energy consisting of some, but not
necessarily all, of the following components: Photovoltaic
modules; array support structures, including footers; power
converstion/inverter system; balance-of-system components;
ancillary metering and monitoring equipment; acceptable service
panel for consumer use of photovoltaic power; AC grid
connection; and securitY fencing.
2. That Section 3.02.03 of the Zoning Code be amended to add "Solar Electric
Power Generating System" as a special use within the agricultural/residential/rural density zone
district.
We are submitting duplicate copies of this Application, consisting of the following
materials:
1. The completed Application form for a Text Amendment to Zone District/Zoning
Resolution which I have signed as the attorney and authorized representative of CRMS.
2.

A copy of the Deed by which CRMS took title to the subject property.
A letter from CRMS authorizing me and this firm to submit and prosecute this
Application on the School's behalf.
5. An executed Agreement to Pay Form together with our check in the amount of
$300.00 which we understand to be the base fee for this Application.

Dear Madam or Sir:
Colorado Rocky Mountain School ("CRMS") has directed that its attorney, [,awrence R.
Green of the hrm o[Balcomb & Green, P.C., prepare an application for a text amendment to the
Garfield County Zoning Resolution by adding a section to the eode which defines a "solar
electric power generating system" and providing that a solar elecbie power generating system is
a special use within the agriculturaVresidential/rural density ("A/R/RD ) zone distict.
Futhermore, CRMS has requested that Mr. Grcen simultaneously prepare and submit a special
use permit application by which CRMS requests permission to construct upon its prope(y a
l47kW solar electric power generating systern.
CRMS hereby authorizes Lawrence R. Green, and ihe firm of Balcomb & Green, P.C., to
act in allrespects as the authorized representatives of CRMS to submit and prosecute the above-
described applications for zone text amendment and special use permit.

AGREEMENT FOR PAYMENT FORM
(Shall be submitted with application)
GARFIELD COLINTY (hereinafter COI-INTY) and Colorado Rocky Mountain School
(hereinafter APPLICANT) agree as follows:
l. APPLICANT has subn"ritted to COUNTY an application for
Text Amendment to Zone District/Zoning Resolution (hereinafter, THE PROJECT).
2. APPLICANT understands and agrees that Garfield County Resolution No. 98-09, as amended,
establishes a fee schedule for each type of subdivision or land use review applications, and the guidelines for
the administration of the fee structure.
3. APPLICANT and COTINTY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved in processing the
application. APPLICANT agrees to make payment of the Base Fee, established for the PROJECT, and to
thereafter permit additional costs to be billed to APPLICANT. APPLICANT agrees to make additional
payments upon notification by the COTINTY when they are necessary as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Cornmissioners for the consideration of an
application or additional COI-INTY staff time or expense not covered by the Base Fee. If actual recorded costs
exceed the initial Base Fee, APPLICANT sliall pay additional billings to COUNTY to reimburse the COUNTY
for the processing of the PROJECT mentioned above. APPLICANT acknowledges that all billing shall be paid
