I. APPLICATION SUBMITTAL REQUIREMENTS
This Apprication appries to owners of rear property in Garfierd county who desire to 1)
amend, add, or delete specific text in the County's Unified Land Use Resolution of 2008'
or 2) amend, add, or delete text of an approv"d Pl"nn"d Unit Development (PUD)' As a
minimum, specificaily iespond to ail the'folrowing items berow and attach any additional
information to be submitted with this application:
1. Submit a cover letter containing a detailed narrative describing the proposed
amendment to the specific text of the county Unified Land Use Resolution or to the text
of an approved Planned Unit Developrenf lnUp) This narrative should describe the
overall purpose of the amendment and the specific sections to be amended'
2. Submit a copy of the deed, legal description, an-d copy of the counly. Assessor's Map

County Comprenensive plan and any intergovernmental agreements affecting
land use or development or an approveA amenOment to the Comprehensive Plan
prior to the decision on the text change'
b) Compliance with Statutory Provisions' The proposed text does not conflict with'
State statutory provisions regulating land use'
c)lncreasedHazards'Theproposedusedoesnotresultinhazardsoralterthe
natural environment to an extent greater than the other uses permitted in the zone
district to which it would be added'
d) lncreased Nuisance. The proposed. use does not create more offensive noise'
vibration, dust, heat, smoke, odor, glare or other objectionable influences or more
traffic hazards than that normally relufting from the other uses permitted the zone
district to which it would be added'
e) compatibility. The proposed use is compatible with the uses permitted the zone
district to which it would be added'

II. PROCEDURAL REQUTREMENTS
The following outlines the process for amending the text of the Unified Land UseResolution or an existing pUD pursuant to section 4-2o2of Article lv.
1' Submit Application- The application materials required for text amendment are set forthin Section 4-SO1(D) and inctuded above.
2' Determination of completeness. The Director shall review the application fordetermination of completeness in accordance with the provisiorc oi-Section 4-103(C),Determination of Completeness.
3' schedule Public.Hearing. upon a determination of completeness, the Director shaltschedule the application for consideration by the planning Commission.
a' Public hearing by the Planning Commission shall be held at the next regularlyscheduled meeting of the Commission for which proper notice of hearing can beaccomplished.
b' Public notice. g{ thg hearing shall be published by the Director in a newspaper ofgeneral circulation in the County at least thirty (3ri) catenoai J"y. prio, to the dateof the public hearing.
4' Evaluation by Director/Staff Review. Upon determination of completeness, the Directorshall review the proposed text amendment and prepare a staff report. A staff reportshall be prepared pursuant to Section 4_103 E.
5' Review and Recommendation by. th_e. Planning commission. A proposed textamendment shall be considered by th^e Planning C6mmission at a public hearing, afterproper notice, conducted pursuant to Section +-tos G, Conduct of puoiic Hearing.
a' Recommendation by Planning Commission. The planning Commission shallrecommend approval, modification or denial of the proposed amendment.

Unified Land Use code to include an lnclement weather Vehicle safety Area use within the
Resource Land Zone District's Plateau and Lower Valley Floor subzones' As requested by the
Building and Planning Department chevron has indentified the proposed use as an
Administrative Process for areas not exceeding four (4) acres in size and a Limited lmpact
Review for areas greater than four (4) acres. The proposed use will be utilized to adequately
and safely prepare vehicles for use during inclement weather and hazardous road conditions'
Proposed Definitions:
lnclementweather vehicle safety Area < 4 acres in size:
An area outside of the pubtic right-of-way /ess than four (4) acres in size utilized for vehicle
preparation in the event of inclement weather. The area may be used for the application of
snow-chains/mud-chains, equipment inspections and other vehicte safety related activities' No
long term parking, toading/untoading of equipment or material, storage or staging shall be
allowed within the lnclement weather vehicle safety Area.
lnclementWeather Vehicle Safety Area > 4 acres in size:
An area outside of the public right-of-way greater than four (4) acres in size utilized for vehicle
preparation in the event of inclement weather. The area may be used for the application of

Application Approval Criteria :
o) Complionce with Comprehensive Plon ond lntergovernmental Agreements. The proposed text
omendment is consistent with opplicable provisions of the Gorfield County Comprehensive Plan
and ony intergovernmentol ogreements offecting the lond use or development or an opproved
omendment to the Comprehensive Plon prior to the decision on the text chonge.
Applicant response: The proposed text amendment is limited to the Resource Land Zone
District's (RL) Plateau and Lower Valley Floor subzones. RL zoning is found in study areas 3 and 5
of the Comprehensive Plan of 2000 (the Plan) and designated Outlying Residential' Although
not residential in nature the safety intent of the proposed text amendment generally conforms
to the Policy, Goals and objectives found in the comprehensive plan.
b) Compliance with Stotutory Provisions. The proposed text does not conflict with Stote stotutory
provision regulating land use.
Applicant response: The proposed text amendment does not conflict with State statutory
provisions that regulate land use in the State of Colorado.
c) lncreosed Hozard. The proposed use does not result in hozords or alter the noturol environment
to an extent greoter thon the other uses permitted in the zone district to which it would be
odded.
Applicant response: The proposed text amendment is consistent with uses currently allowed
within the RL zone district. The approval of the proposed text amendment will not result in
hazards or extreme alteration of the natural environment. lf approved Garfield County will
review and regulate construction of an lnclement Weather Vehicle Safety Area through the
Administrative Review/Limited lmpact Review processes.
d) lncreosed Nuisance. The proposed use does not creqte more offensive noise, vibrotion, dust,
heot, smoke, odor, glare or other objectionable influences or more traffic hozords thon that
normolly resulting from the other uses permitted in the zone district to which it would be odded.
Applicant response: The proposed text amendment is consistent with uses currently allowed
within the RL zone district and impacts will not be greater than uses currently permitted within
the RL zone district.
e) Compotibility. The proposed use is compotible with the uses permitted in the zone district to
which it would be odded.
Applicant response: The proposed text amendment is compatible with the uses currently
contemplated within the RL zone district. The use is intended to increase the safety of oil and
gas drilling operations identified as a use-by-right.

GARFIELD COUNTY (hereinafter COUNTY) and chevron u ' s 'A' rnc '
Propertyowner(hereinafteroWNER)agreeasfollows:
1.OWNER has submitted to COUNTY an application for Text Amendment
(hereinafter, THE PROJECT).
2. OWNER understands and agrees that Garfield County Resolution No. 98-09, as
amended, establishes a fee scheduli for each type of subdivision or land use review
applications, and the guidelines for the administration of the fee structure.
3. owNER and coUNTY agree that because of the size, nature or scope of the
proposed project, it is not possiblJat this time to ascertain the full extent of the costs
involved in processing the application. owNER agrees to make payment of the Base Fee,
established for tne ino.lECT, and to thereaftei permit additional costs to be billed to
OWNER. OWNER agrees to make additional payments upon notification by the COUNTY
when they are necessary as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication -or
cost of consulting service determined necessary by the Board of County Commissioners for
the consideration of an application or additionaicouurY staff time or expense not covered
by the Base Fee. lf actual recorded costs exceed the initial Base Fee, OWNER shall pay
additional billings to coUNTy to reimburse the coUNTY for the processing of the
PROJECT mentioned above. OWNER acknowledges that all billing shall be paid prior to
the final consideration by the coUNTY of any land use permit, zoning amendment, or
subdivision Plan.
