Dear Garfield County: I own Dick Casey Concrete Co., a concrete company located in Garfield County. Our main office is located near Rifle, adjacent to the property owned by Rocky Mountain Hotshots, Inc. in the Commercial-General district. We support Rocky Mountain Hotshots, Inc.'s request to amend the Garfield County unified Land Use Resolution to allow an eight foot fence within our front yard setback. In fact, our company is contemplating this same type of fence. This level of fence is necessary to ensure secure commercial operations within the zone district. Due to our proximity to 6 & 24, olr front yard setback prevent us from building a secure fence within the first 50 feet of our property, which in turn prevents the most effective utilization of this portion of our property for comrnercial purposes. It also seems unfair that land owners in the Rural district area able to build 8 foot fences, especially when it appears that much more of the county is zoned Rural than is zoned Commercial-General. The properties across 6 & 24 from me are zoned Rural. Business owners in the Commercial-General District need to be given the flexibility to build secure fences on their boundaries to protect their inventory and to ensure commercial operations. Though inat is the case, this text amendment would apply to all commercial general zoned properties within unincorporated Garfield county. see EXHlBlrs K and L for maps highlighting the commercial properties in the County. COMPLIANCE WITH COMPREHENSIVE PLAN The Comprehensive Plan discusses basic policy direction for land use in Garfield County but does not provide specific direction regarding dimensional standards or setback requirements. Applicable Goals, Objectives, and Policies for commercial & industrial uses include: lll 4.0 Commercial & lndustrial Uses lssues. Commercial development has been characterized by strip development which results in frontal parking, little regard for pedestrian access, and a wide variety of non- complementary uses; o Vehicular access has been characterized by arterials or highways. These patterns hinder competing vehicular/pedestrian movement; o Commerciat development, in some instances, has adjacent land uses and along major arterials; ...created visual impacts on Goals/Obiectives/Policieso Ensure that commercial development is conducive to safe and efficient traffic flow, reduces vehicular movements and encourages alternate transportation modes and the use of mass transit. o Landscaping and screening will be required to address specific visual impacts of industrial and commercial development. o Zoning regulations and a review process will be developed and enforced that recogiize the differences in size, scope, and type of commercial and industrial development. REQUEST The Applicant is requesting that the text of the Unified Land Use Resolution of 2008, as amended be changed as follows: 53-301 General Use Restrictions l. Accessory Structure in Required Yards: (Except as provided in the following Section (K 0, "Accessory Structures - Agricultural and Commercial General Property", which applies to the Rural, RL (Gentle Slopes i Valley Floor), and DWC zone districts), CG a fence, hedge or wall may be located in any required yard provided that no such installation shall exceed eight (8) feet in height in a required side yard or rear yard, nor shall any such structure exceed three (3) feet in height in any required front yard. BACKGROUND The Applicant has requested an amendment to the Unified Land Use Resolution of 2008, as amended, which currently limits the maximum height of fences within tne troni yard setback in the Commercial General zone District to three feet (3')' The request is to G*it fences of up to eight t:."1 (8.) in height in the front yard setback within the Commercial General Zine District of unincorporated Garfield County. This application is the result of a process that began in 2008 when investigation of a violation commenced. Chris Chappelle, Garfield County Code E-nforcement Officer, issued notice to the ptop".iy' owner on- November 3, 2008 regarding construction of a fence within the requiied 50' foot front setback from Highway 6' A Notice of Anticipated Enforcement was issued by Mr. Chappelle o,n June 18' 2009 and a Notice of violation was issued on June 29,2009. ln an effort to seek correction of the violation the Applicant scheduled a pre-application conference with planning staff. That conference was held on July 16, 2009 and focused on the submittal requirements and processing of an application for a variance to the 50' required front setback. An application was submitted on Augusl24, z}Og.for a variance from the three foot (3') maximum height provision foi a fence within the front yard setback' The App I icant subseq uently withd rew that app lication' A Pre-Application e,onference was held on November 6, 2009 for a request to amend the Unified Land Use Resolution of 2008, as amended. That conference resulted in the application currently under consideration.
