Application Requirements: These_items must bejgbmi, ed with the application
11 Plans and specifications for the proposed use including the hours of operation, the amount of vehicles
accessing the site on a daily, weekly and/or monthly basis, and the size of any existing or proposed
structures that will be utilized in conjunction with the proposed use. Please submit this information
in narrative form and be specific.
2] If you will be using water or will be treating wastewater in conjunction with the proposed use, please
detail the amount of water that would be used and the type of wastewater treatment. If you will be
utilizing well water, please attach a copy of the appropriate well permit and any other legal water
supply information, including a water allotment contract or an approved water augmentation plan.
3] A map drawn to scale portraying your property, all structures on the property, and the County or State
roadways within one (1) mile of your property. If you are proposing a new or expanded access onto
a County or State roadway, submit a driveway or highway access permit.
4] A vicinity map, showing slope of your property, for which a U.S.G.S. 1:24,000 scale quadrangle map
will suffice.
5] A copy of the appropriate portion of a Garfield County Assessor's Map showing all public and private
landowners adjacent to your property. Include a list of all property owners and their addresses.
6] Attach a copy of the deed and a legal description of the property. If you are acting as an agent for the
property owner, you must attach an acknowledgment from the property owner that you may act in
his/her behalf.
7] For all applications pertaining to airports, the oil and gas industry, power generation and/or
transmission industry, or any other classified industrial operation, you must submit an impact
statement consistent with the requirements of Sections 5.03, paragraphs 1 thru 3; 5.03.07, inclusive;
and 5.03.08, inclusive.
The consideration of this proposed Special Use will require at heist one (1) public hearing, for which public
notice must be provided. The Planning Department will mail you information concerning this hearing(s),
approximately 30 days prior to the scheduled hearing. You will then be required to notify, by certified return
receipt mail, all adjacent landowners and publish the notice provided by the Planning Department, in a
newspaper of general circulation. Both these notices must be mailed/published at least 15 days prior to the
public hearing. The applicant shall bear the cost of mailing and publication and proof of mailing and
publication must be submitted at the time of the public hearing,

NTCH Colorado Inc., (CLEARTALK) is a new, local wireless telecommunications
company who has made a large investment to acquire the FCC license and the equipment
necessary to build and operate a wireless system in the local area. CLEARTALK will be using
state of the art CDMA (code division multiple access) PCS (personal communication services)
technology. This brand of service is 100 percent digital and offers dramatically improved call
quality and reliability over today's cellular service. Calls will be crisper, cleaner and more
secure. CLEARTALK has located its corporate headquarters in the City of Grand Junction,
Colorado.
In order to provide continuous, quality coverage to Garfield County, construction of
multiple telecommunication towers is necessary. Tower placement and arrangement are key to
making this service run at its optimum performance. Cellular networks operate in the 800 MHz
frequency band. PCS networks operate in the 1900 MHz band. Since radio waves propagate
better at lower frequencies, PCS sites need to be spaced closer together for improved network
coverage and over-all attainment of the signal. Co -locatable towers keep tower placement to a
minimum, while still meeting the engineering needs when additional wireless providers are
present in the community.
The site referred to in this application is for one (1) 125' self-support lattice tower with a
non -glaring metallic finish. The 125' tower will enable this location to be co -locatable for four
carriers. The site will contain a lattice tower, microwave dish, a three -sector antenna array at the
top of the tower with future placement of up to three additional canTiers. The base level of the
tower will contain the Base Transmitting Station (BTS), the radio transceiver and equipment
shelter buildings on a concrete pad.
The "Clough" site is an integral link in a chain to provide service throughout Garfield
County. The network is designed to handle a large capacity of channels and calls. We will be
using a 100 by 100 foot parcel of land on an undeveloped lot in an ARRD zoned area. Access to
the site is via Exit 87. Land disturbance will be minimal. Site preparations include, placing weed
barrier prior to the graveling of the area.

Wireless made simple.
The "Clough" site is "key" in that it will connect to our Doghead site to the West and our
Grass Mesa site to the East. This will be an unmanned facility running 7 days a week, 24 hours a
day and will be routinely maintained by CLEARTALK technicians (approximately once a
month). It requires only telephone and power to operate correctly and will have no unusual
demands on these or any public utilities. Safety is also a key issue with us and accompanying a
six-foot, gated chain-link fence, the proper signs for the safety of the general public will be
prominently displayed.
We originally proposed a site south of I-70. After working with the Garfield Planning
Staff, we decided to move this site north of I-70. This site will still provide the required
coverage area while being far less intrusive. By using a lattice type tower, we believe this tower
will be less noticeable than a monopole. The lattice construction allows the background to show
through and blend the tower into the hillside.
Wireless technology has vastly improved in the last few years, and with the introduction
of digital service and wireless Internet we are excited to be able to bring these services to you.
With the increasing use of wireless telephones, CLEARTALK's goal is to provide the highest
quality PCS network to its customers and to be a good "fit" within the community. Not only will
CLEARTALK be providing digital telephony, we are providing jobs for the local workforce.
This spring Mesa State College graduated its first class in the Telecommunication Engineering
program. Of the eight graduates four are employed by CLEARTALK, and as we grow and
additional carriers are added to our towers even more jobs will become available to the future
graduates and the areas workforce.
Hopefully this summary will allow you to have a better overall picture of our need for
site development on the "Clough" site in Garfield County and our goal of bringing PCS service

MEMORANDUM OF LEASE
THIS MEMORANDUM OF LEASE ("Memorandum") is executed this Ott da) of November, 1999 by
and between William F. Clough AKA W.F. Clough, an INDIVIDUAL. ("Landlord"), whose mailing address
is P.O. Box 686 Rifle, CO. 51650 and American Tower, L.P., a Delaware limited partnership ("Tenant"),
whose mailing address is 3411 Richmond Ave, Suite 400, Houston, TX 77046.
WHEREAS, Landlord and Tenant executed and entered into an Option and Lease Agreement (the
"Lease") dated 4th November 1999, for the purpose of installing, operating and maintaining radio
communication facilities and other improvements on the Property (as hereinafter defined).
WHEREAS, the parties wish to provide a memorandum of the lease, to supplement the description of
the Property (as hereinafter defined), to acknowledge Tenant's exercise of its option under rhe Lease and to
provide for commencements date under the Lease.
NOW, THEREFORE, in consideration of the Lease and other good and valuable consideration, the
receipt and sufficiency of which are hereby acknowledged, Landlord and Tenant hereb3 agree as follows:
1. Lease Term. The terms of rhe Lease shall be Five (5) years commencing on the date the
Option is exercised by Tenant, which date is to be no later than June 30, 2000 (the "Commencement Dare"), and
terminating at midnight on the 5th anniversary of the Commencement Date (the "Inti-ol Term"). Tenant has the
option under the terns of the Lease to extend the Lease for Nine (9) additional Five (5) year terms (the
"Renewal Terms").
2. P�onerty. Subject to the terms of the Lease, as may be amended from time to time, Landlord
has leased to Tenant the real property described on Exhibit "_A" attached hereto (the "Property") and Landlord
has granted unto Tenant, for the Initial Teras and any Renewal Term, easements for ingress, egress and utilities
over that real property also described in Exhibit "A" attached hereto (the "Easement").
3. Notices. All notices, requests, demands, and other communications to Landlord or Tenant
shall be made at the addresses for each as set forth above, unless otherwise notified in writing.
