I. APPLICAT]ON SUBMITTAL REQUIREMENTS
This Application applies to owners of real property in Garfield County who desire to 1) amend, add, or delete
specific text in the County Zoning Resolution, and 2) amend, add, or delete text of an approved zone district
in the Zoning Resolution or an approved Planned Unit Development (PUD),
As a minimum, specifically respond to all the following items below and attach any additional information to
be submitted with this application:
1. Submit a cover letter containing a detailed narrative describing the proposed amendment to an
approved zone district including an approved Planned Unit Development (PUD) or text of the
Zoning Resolution of 1978, as amended. This narrative should describe the overall purpose of
the amendment and the specific sections of the resolution are to be amended.
\hJ(2. Submit a copy of the deed, legal description, and copy of the County Assessor's Map of the
' real property, owned by the Applicant in Garfield County, which will be affected by such change.

ptq Submit payment of the $30o.oo Base Fee: Applicant shall sign the "Agreement for Payment"
form and provide the fee with the application.
5. Submit 2 copies of this completed application form and all the required submittal materials to
the Building and Planning Department. Staff will request additional copies once the application
has been deemed technically complete.
II. PROCEDURAL REQUIREMENTS
(An amendment to an approved zone district or text of the Zoning Resolution is considered a two
step process because it is first reviewed by the Planning Commission which makes a
recommendation to the Board of County Commissions. The following steps outline how the Text
Amendment application review process works in Garfield County.)
1. Submit this completed application form (pages 1-4), base fee, and all submittal requirements to
the Garlield County Planning Department. lt will be received and given to a Staff Planner who
will review the application for technical completeness.
2. Once the application is deemed technically complete, the Staff Planner will send you a letter
indicating the application is complete. ln addition, the letter will indicate the dates and times
scheduled for your request to be heard before the Planning Commission during a public
meeting (no notice required) and the Board of County Commissioners during a public hearing
(notice required). The Planning Commission will forward a recommendation to the Board of
County Commissioners to be considered during a properly noticed public hearing. Staff will
send you the appropriate "Public Notice Form(s)" indicating the time and date of your public
hearing and will provide you with a Staff Memorandum regarding your request. (lf Staff
determines your application to be deficient, a letter will be sent to you indicating that additional
information is needed to deem your application complete.)
3. lt is solely the Applicant's responsibility to ensure proper noticing occurs regarding the public
hearing before the Board of County Commissioners. lf proper notice has not occurred, the
public hearinq will not occur. Notice requirements are as follows:
, a. Notice by publication, including the name of the applicant, description of the
subject lot, a description of the proposed amendment and nature of ihe hearing,
and the date, time and place for the hearing shall be given once in a newspaper 5tgeneral circulation in that portion of the County in which the subject property is
located at least thirly (30) but not more than sixty (60) days prioi to ine'date ofsuch hearing, and proof of publication shall be presented at hearing by the
applicant.
4. The Applicant is required to appear before the Planning Commission and the Board of Countycommissioners at the time and date of the public meeting / hearing at which time they wiilconsider the request. ln addition, the Applicant shall provide proof at tne hearing before theBoard of County Commissioners that proper notice (publicationj was provided.
5' Once the Board of County Commissioners makes a decision regarding the request, Statf willprovide the Applicant.with a signed resolution memorializing the actidn taken by the Board.Following the Boards' approval, this office will make the ipproved changes to the Zoning
Resolution.

FEE SCHEDULE
Garfield County, pursuant to Board of County Commissioners ("Board") ResolutionNo. 98-09, has established a
fee structure ("Base Fee") for the processing of each type of subdivision and land use applications.
The Base Fee is an estimate of the average number of hours of stafftime devoted to an application, multiplied by
an hourly rate for the personnel involved. The Board recognized that the suMivision and land use application
processing time will vary and that an applicant should pay for the total cost of the review which may require
additional billing. Hourly rates based on the hourly salary, and fringe benefits costs of the respective positions
combined with an hourly overhead cost for the office will be used to establish the actual cost of County stafftime
devoted to the review of a particular project.
Actual staff time spent will be charged against the Base Fee. After the Base Fee has been expended, the
applicant will be billed based on actual staff hours accrued. Any billing shall be paid in full prior to final
consideration of any land use pennit, zaning amendment or suMivision plan- If an applicant has previously failed
to pay application fees as required, no new or additional applications will be accepted for processing until the
outstanding fees are paid.
Checks, including the appropriate Base Fee set forth below, must be zubnnitted with each land use application,
and made payable to the Garfield Cbuntv Treasurer. Applications will not be accepted without the required
application fee. Base Fees are non-refundable in full" unless a written request for withdraw from the applicant is
submitted prior the initial review of the application materials.
Applications must include an Agreement for Payment Form ("Agreerrent") set forth below- The Agreement
establishes the applicant as being responsible for payment of all costs associated with processing the application
The Agreement must be signed by the party responsible for palm'rent and submiued with the application in order
for it to be accepted.

The following Base Fees shall be received by the County at the time of submittal of any procedural application to
which such fees relate. Such Base Fees shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board for the consideration of any application or additional
County stafftime or expense not covered by the Base Fee, which have not otherwise been paid by the applicant
to the County prior to final action upon the application tendered to the County.

The following guidelines shall be used for the administration of the fee structure set forth above:
1. AII applications shall be submitted with a signed Agreement for Payment form set forth below.
2- County staffshall keep accurate record of actual time required for the processing of each land use
application, zoning amendment, or subdivision application Any additional bi[ing will occur commensurate
with the additional costs incurred by the County as a result of having to take more time that that covered by
the base fee.
Any billings shall be paid prior to final consideration of any land use permit, zoning amendment, or
suMivision plan. AIl additional costs shall be paid to the execution of the written resolution confirrning
action on the application
Final Plats, Amended or Corrected Plats, Exemption Plats or Permits will not be recorded or issued until all
fees have been paid.
5. In the event that the Board determines that special expertise is needed to assist them in the review of a land
use permit, zonsng amendment, or subdivision application, such costs will be borne by the applicant and paid
prior to the final consideration of the application. All additional costs shall be paid prior to ihe execution of
the written resolution confirming action on the application.
If an application involves multiple reviews, the Applicant shall be charged the highest Base Fee listed above.
Types of '?rocedures" not listed in the above chart will be charged at an hourly rate based on the pertinent
planning staffrate listed above.
The Planning Director shall establish appropriate guidelines for the collection of Additional Biliings as
required.
This fee structure shall be revised annually as part of the County budget hearing process.

Re: Rescind'(Oxy Amendment'
Per the Garfield County Board of County Commissioner's direction of November 13,
20}6,the Garfield County Planning Departrnent has submitted per Section 10 of the
Garfield County ZornngResolution of 1978 to amend the text of Sections 3.10.01,
3.10.03 and 3.10.04.
The request is to remove the changes made by the "Oxy Amendment" which allows
"Camper Parks for the purpose of providing temporary quarters to employees and
contractors of the energy extraction industries" as a lJses, Special to Sections 3. I 0.01 ,
3.10.03 and 3.10.04 of the Garfield County ZonrngResolution of 1978, as amended.
This amendment is at the direction of the Board of County Commissioners to prevent
duplication within the Garfield County ZoningResolution of 1978 in regards to the use of
campers for temporary employee housing. On November 13,2006, the Board of County
Commissioners approved an amendment to Section 5.02.21, Temporary Employee
Housing which now allows campers and manufactured homes. Rescinding what has
become known as the "Oxy Amendment" will eliminate duplication within the code and
will reduce confusion as to which regulations are applicable for the use of campers as
temporary employee housing.
