December 27,2007 Fred Jarman Director Garfield County Building and Planning Department 108 8tn Street, Suite 401 Glenwood Springs, CO 81601 Re: Special Use Permit for Processing and Material Handling of Natural Resources for the North Parachute Ranch Shale Pit, Resolution 2005-86 Fred: On Monday, August 3, 2005, the Board of County Commissioners (BOCC) approved the request for a Special Use Permit for Processing and Material Handling of Natural Resources for the North Parachute Ranch Shale Pit (also known as the West Fork Pit) based on compliance with certain conditions. EnCana Oil & Gas (USA) lnc. (EnCana) is providing this letter and attached documentation as proof of compliance. For your reference, the BOCC conditions appear in italicized font and the EnCana response occurs in normal font. ,/,That alt representations of the Applicant, either within the application or stated at the hearing before the Board of County Commissioners, shalt be considered conditions of approval unless explicitly altered by the Board. The shale pit is for the sole use of the EnCana. lf any other entities are to be added as users, EnCana will submit a new SUP. Shoutd the Department of Witdlife find Sage Grouse in the area affected, the Applicant shall comply with all stipulations and conditions. The Colorado Division of Wildlife (CDOW) visited the site in May 2005. The CDOW noted that the site fell within greater sage grouse brood habitat but did not note the presence of any sage grouse. The CDOW retommended that EnCana limit noise and operations around June and July; conduct erosion monitoring; and complete sufficient reclamation when the site is complete. EnCana will commit to the mitigation measures recommended by the CDOW. The Appticant shall submit an approved Storm Water Management Plan permit from the State. The North Parachute Ranch Shale Pit is authorized under EnCana's stormwater permit COR- 037689. Refer to Attachment 2 for a copy of the site-specific stormwater management plan and a copy of the Colorado Department of Public Health and Environment Stormwater permit COR-37689. The Appticant shall submit a Noxious Weed inventory and maintenance plan. Refer to Attachment 3 for a copy of the lntegrated Vegetation and Noxious Weed Management Plan prepared for the shale pit in August 2005. The Appticant shatl submit an approved Division of Minerats and Geology permit from the State for the proposed mining operation. Refer to Attachment 4 for a copy of the Division of Minerals and Geology permit from the State for the proposed mining operation. The Appticant shatt submit an approved Air Pollutanf Emlssions permit from the State. Refer to Attachment 5 for a copy of the Construction Permit issued by the State of Colorado. ./n / 11- ZO The S:JP for the Middte Fork Pond shatt beissued prior to approvat of this SIJP. The SUP for the Middle Fork Water Storage Facility was approved by the BOCC on May 16, 2005 and was issued by the BOCC on February 5,2007. Refer to Attachment 6 for a copy of the SUP. The applicant shatt compty with all standards as set forth in 5.03.08 "lndustrial Performance Standards" of Garfietd County Zoning Resolution of 1978 as amended and included here as follows: Volume of sound generated shall compty with the standards set forth in the Colorado Revlsed Sfafufes. EnCana will conduct operations at the shale pit in such a manner as to comply with the standards set forth in the Colorado Revised Statutes. a. b. Every use sha// be so operated that the ground vibration inherently and recurrently generated is not perceptible, without instruments, at any point of any boundary line of the property on which the use is located. EnCana will conduct operations at the shale pit in such a manner as to not create vibrations that would be perceptible at the property line. The nearest property line is 0.5-miles northwest of the shale pit and vibration at the property line is not expected to occur. c. Emissions of smoke and particulate matter: every use shall be operated so as fo comply with all Federal, State and County air quality laws, regulations and standards. No smoke emissions will occur at the staging area. Particulate matter may occur in the form of fugitive dust emissions and EnCana will comply with all Federal, State and County air quality laws, regulations, and standards. EnCana will adhere to stipulations in the Construction Permit, which include watering topsoil and overburden piles within one year, controlling vehicles speeds; and watering haul roads, as necessary. d. Every use shalt be so operated that it does not emit heat, glare, radiation or fumes which substantially interfere with the existing use of adjoining propefty or which constitutes a public nuisance or hazard. Ftaring of gases, aircraft warning srEtna/s, reflective painting of storage tanks, or other such operations which may be required by law as safety or air pollution control measures shall be exempted from this provision. Heat, glare, radiation or fumes are not expected to occur during operation of the shale pit. e. Storage of flammabte or explosive solds or gases shall be in accordance with accepted standards and laws and shatt comply with the national, sfafe and local fire codes and wriften recommendations/comments from the appropriate local protection district regarding compliance with the appropriafe codes. No flammable or explosive solids or gases will be stored at the shale pit. f. No materials or wasfes shall be sfored at the shale pit in such a form or manner that they may be transferred off the property by any reasonably foreseeable naturalcauses or forces. No materials or wastes will be stored at the shale pit in such a form or manner that would allow off- site transport by any reasonable foreseeable natural causes or forces. EnCana will adhere to the SWMP to prevent stormwater run-off. lf you are satisfied that EnCana has met the conditions of approval, please issue the Special Use Permit for this facility. lf you need additional information or have any questions, please contact me. The Colorado Dlvision of Witdlife concludes: The site does fallwithin the greater sage grouse brosd rearing habitat denoted by the Division of Wildlife's {DOW} WRI$ mapping. This critical area for rearing of young sage grouse is af concern to th* UOW for furthering the population of this species. Concems iray arise that the *teep slopes from the gravel pit may move sediment into this habitat. The naise and activity levels may hinder further use of portions of the habitat as well. The DOW would recommend to limtt noise and operations around June and July while birds ar* utilizing these areas. To address the DOW's csncerns, the Applicant will: 1. lnrplement a stonrwatsr management plan to contain sediment within the gravel pit and; Z. to limit noise. the Applicant will stockpile rnaterial before June and July of each year. The noise generated by the shale pit during June and July will only be ioading and hauling stockpiled material. There is no processing (crushing, screening, etc.i of material. 1. 2. 3. 4. l-r I 6.4.5 EXHIBIT E - Reclamptipn, PI4lr The pit excavation will leave few sloper if the pit is mined to daylight on the south, east and wesl edges on the rig top. These slopes will be no steeper than 3h:1v on advance. h4ining of construction materials has occurred at this pit in the past. Approximately 3 acres has been disturbed. The Applicant will reclaim the existing disturbanee concurrently with the new disturbance. Acreage numbers outlined below include the existing disturbance. The rnining operations willexpase a max[mum advancing face approxirnately 350 feet wide and a pit floor area of 10 acres. Topsoilwill be stripped from the advancing face and placed atrong the west side of the pit. Final reclamation will involve the re-handling of the topsoil which was stockpiled along the west side of the pit and placing that topsoil on approximately 12.0 acres. The pennit boundary includes 18.4 acree , more or less. Of the total acres included within the perrnit boundary, only 12.0 acres will be disturbed. The proposed postmining land use for the reclaimed area is rangeland and wildlife habitat, This land use conforms to the sunounding rugged terrain. Prior to mining, avaifable topsoil, 3 to 12 inches, will be stripped from the area to be disturbed and stockpiled along the west edge of the pit. $oi[ horizons, if any, will not be segregated. As a etabilization measure, any topsoil which is to be stockpiled longer than about one grawing sea$on will be broadcast seeded with a perennial sod-forming grass cover such as Westem Wheatgrass at a typical rate of 20 pounds of pure live seed per acre. Topsoilsalvaged during operatirns will be used for replacement on disturbed areas. Final slopes along the north, east and west pit boundaries will range from 10h:1v to 3h:1v. The pit floorwillgently slope to the south. Prior to re*seeding, eny compacted areas will first be scarified. This permit also rncludes stofin'n'ater discharges from dedicated asphalt batch plants and dedicated concrete batch plants. CONTENTS OF THE STORMWATER MANAGEMENT PLAN The SWMp shail be prepared in accordance wrlh good enginecnng, hydrologic and pollution control practices' (The SWMP need 'ot be preparedbya registered engineer.) The rnain oblective of the plan shall be to identify Best Management Practices (BMps) which when implemlented will meet the terms and conditions of this permit (see I'art I.C., below). Site plans should ensure that exisring vegetation is pre,served where possible and that disturbed areas are stabilized. Non-structural practices may include- but are not limited to: temporary seeding, permanenl seedr.ng, rnulching, eeotextiles, sod stabilization, vegetative buffer strips, pnrlection of trees, and presewation of matur'e vegetation. Insrrection and Mainteuance The plan shail include a description of procedures to inspect ancl maintain in good and effective operating condition the vegetation, erosion and sediment control measures and otler protective measures identified in the SWMP' TERMS AND CONDTTIONS L Generai Lirnitations The lbllowing limitations shall apply to all discharges covered by this permit: a) Stormra,ater discharges from construction activities shall not cause or threaten to cause pollution, contamination or degradation of State waters b) Concrete wash water shall not be discharged to state waters or to stom sewer systems. c) Bulk storage structure.s for petroleum products and other chemicals shall have adequate protection so as to contain all spiils and prevent any spilled material from entering state rvaters. d) No chemicals are to be added to the discharge uuless permis.sion-for the use of a specific chemical is granted by the Division. Point .source: any discemible, confined and discrete conveyance from which pollutants are or may be discharged. Point . source discharges of stormwater result from structures lr.hich increase the imperviousness of the ground which acts to coliect runoff, with runoff be ing conveyed along the resulting drainage or grading pattern. 10. In the fall plants draw nutrients into the roots for winter storage. Herbicides will be drawn down to the roots more efficiently at this time. If the weed patch has been there a long time, another season of seed production is not as important as getting the herbicide into the root system. Monitoring. Monitoring for targeted weeds should be performed on a weekly basis beginning at spring green up and confinuing through the growing season. Disturbed areas have been inspected and no weeds were detected in the Special Use Permit area on August 25,2005. Monitoring by qualified personnel will be conducted using Table 5 as a general guide to best control periods. Mechanical. Observed weeds will be controlled first by mechanical means, primarily hand grubbing or pulling. Control of listed species in nearby disturbed areas is recommended to reduce the risk and rate of infestation. Chemical. Spot treating is recommended in areas immediately adjacent to the Shale Material Pit site for the purpose of reducing risk of infestation. If necessary, spot treatment will be conducted in the Shale Material Pit site as well as the surrounding areas. Chemicals typically used include synthetic auxin growth regulators (e.g., 2,4D; tordon, banvel, and garlon), EPSP synthase inhibitors (e.g., glyphosate) or a mix of these. For whitetop, an ALS inhibitor such as metsulfuron methyl has been found to be most effective. In all cases, the certified applicator shall deem which chemical(s) and at what concentration(s) shall be used at the time of application.
