At a regular meeting of the Board of County Commissioners for Garfield County,
Colorado, held in the Commissioners'Meeting Chambers, Garfield County Plaza Building, in
Glenwood Springs on, Monday, the 14* day of July 2003, there were present:

PERMIT APPLICATION FOR THE ADDITION OF A MOTOR CONTROL CENTER
BUILDING, A TREATED WATER POND BRIDGE AND ASSOCIATED SUCTIOI{
CONTROL TOWER AT'TIIE HUI{TER MESA EVAPORATION / RECYCLING
FACILITY FOR ENCANA OIL AND GAS (USA), INC.
WHEREAS, the Board of County Commissioners of Garfield County, Colorado
("Board"), has received an application from EnCana Oil & Gas (USA), Inc., for a special use
permit ("SUP") to al1ow the addition of a Motor Control Center building, a treated water pond
bridge and associated Suction Control Tower at the Hunter Mesa Evaporation / Recycling
Facility; and
WHEREAS, the subject property is located in the Hunter Mesa area, approximately 1
mile south of County Road 322 and 1 mile east of County Road 3 19 (W. Mamm Creek Road);
and
WHEREAS, the subject property is zoned A/RRD (Agricultural/ResidentiaVRural
Density); and
WHEREAS, the Board held a public hearing on the 14* day of July, 2003, upon the
question of whether the above described SUP should be granted or denied, at which hearing the
public and interested persons were given the opportunity to express their opinions concerning the
approval of said special use permit; and

WHEREAS, it was established that the Special Use Permit runs with the land and is
issued to the property owner, Benzel Livestock Company.
WHEREAS, it has been established that the EnCana Oil & Gas (USA), Inc. has been
given authority by the property owner, to submit an application for an SUP to install, operate and
maintain an evaporation pit and related facilities on the subject properfy.
WHEREAS, the Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determination of fact as listed below:
1. Proper posting and public notice was provided as required for the meeting before the
Board of County Commissioners.
2. The meeting before the Board of County Commissioners was extensive and complete,
that ali pertinent facts, matters and issues were submitted and that all interested
parties were heard at that meeting.
3. The above stated and other reasons, the proposed special use permit has been
determined to be in the best interest of the health, safety, morals, convenience, order,
prosperity and welfare of the citizens of Garfield County.
4. The application has met the requirements of Special Use (Sections 5:03, 5:03:07,
5:03.08 and 9:03) the Garfield County ZoningResolution of 1978.
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that Special Use Permit to Benzel Livestock Company for the processing and
material handiing of natural resources is hereby approved, subject to compliance with all of the
following specifi c conditions:
1. All representations of the Applicant, either within the application or stated at the meeting
before the Board of County Commissioners, shall be considered conditions of approval,
unless specifically altered by the Board.
2. The conditions of approval outlined in Resolution No. 2OO3-02, shall be adhered to and
complied with prior to the issuances of this actual Special Use Permit. The Planning
Department shall be notified upon completion of the conditions outlined in Resolution
No. 2003-02 in order to determine if the actual Special Use Permit can be issued.

Subject: EnCana Water Pipeline
I just talked to Doug Jones, EnCana, and he acknowledged that they are indeed installing the plastic water line
in the Dry HollowiDivide Creek area. He said that they understand that the county may take issue with them
moving ahead, but that they felt that they had no choice because of several reasons, including: '1. Their
financial risk for not developing the coal bed methane (CBM) wells in this area is huge and probably far
outweighs any risk of potential litigation with the county; and 2. Technically and financially it didrlt make sense
to not place the water line in the trench that has already been cut for the gas pipelines. He also reiterated that
they still do not feel that the county has any jurisdiction over these lines and that the COGCC rules govern their
construction. I told Doug that I would be relaying this information on to all of you and that I didrlt know what
decision would be made by the county in response.
One of the questions that came up the other day when this issue first arose was whether they have crossed
any county roads with the water line. I believe they have bored thls line, along with a gas line, beneath the Dry
Hollow Road (Rd 331 ) and will confirm that when I head that direction in a little while. Ill update you as soon as
I return to the office.
